A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO CUCAMONGA ADOPTING THE MODIFIED
ENGINEER'S REPORT, CONFIRMING THE ASSESSMENTS, AND
ORDERING THE WORK
CITY OF RANCHO CUCAMONGA
ASSESSMENT DISTRICT NO. 82-1
(6TM STREET INDUSTRIAL AREA)
WHEREAS, on May 19, 1982, this Council adopted Resolution No. 82-92, A
Resolution of Intention to Order the Construction of Certain Improvements known as Assessment
District No. 82-1 (6th Street Industrial Area) hereinafter referred to as the "District" and in it directed
the Superintendent of Streets to make and file a report in writing in accordance with and pursuant
to the Municipal Improvement Act of 1913; and
WHEREAS, on February 17, 1999, this Council adopted Resolution No. 99-
029 , A Resolution Ordering Changes and Modifications to the original Engineer's Report; and
WHEREAS, the modified report was made and filed, and considered by this Council
and found to be sufficient in every particular, whereupon it was determined that the report should
stand as the Engineer's Report for all subsequent proceedings under and pursuant to the
Resolution of Intention; and
WHEREAS, this Council hereby acquired jurisdiction to order the improvement
modifications.
NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does
hereby resolve, determine and order as follows:
1. The public interest, convenience, and necessity require that the improvements
be made.
2. The district benefitted by' the improvements.
3. The modified Engineer's Report as a whole and each part thereof, are hereby
approved and confirmed to wit:
(a) the plans and specifications for the proposed improvements;
(b) the engineer's estimate of the itemized and total costs and expenses
of the improvement, and of the incidental expenses in connection
therewith;
(c) the diagram showing the assessment district and boundaries and
dimensions of the respective subdivisions of land within the district;

(d) the apportionment of the total amount of the costs and expenses of
the proposed improvements upon the several subdivisions of land in
the district in proportion to the estimated special benefits to be
received by the subdivisions, respectively, from the improvements,
and of the incidental expenses thereto; and
5. Final adoption and approval of the modified Engineer's Report as a whole, and
of the plans and specifications, estimate of the costs and expenses, the diagram and
the apportionment of costs, as contained in the modified Engineer's Report, as
hereinabove determined and ordered, is intended to and shall refer and apply to the
Engineer's Report, or any portion thereof, as amended, modified, revised, or
corrected by, or pursuant to and in accordance with this resolution heretofore duly
adopted or made by this Council.
6. Based on the oral and documentary evidence, including the Engineer's Report,
offered and received, this Council expressly finds and determines (a) that each of
the several subdivisions of land will be specially benefitted by the additional
improvements.
