HomeMy WebLinkAboutResolution 2026-020RESOLUTION NO. 2026-020 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING A REQUEST FOR A CONDITIONAL USE PERMIT, MINOR DESIGN REVIEW, MINOR EXCEPTION, AND VARIANCE TO ALLOW THE OPERATION OF A PROPOSED 4,910 SQUARE FOOT EXPRESS CAR WASH TO BE CONSTRUCTED ON A VACANT 1.05 ACRE PARCEL OF LAND WITHIN THE CORRIDOR I (CO1) ZONE, LOCATED AT 8172 VINEYARD AVENUE, GENERALLY TO THE SOUTHWEST OF THE INTERSECTION OF VINEYARD AVENUE AND FOOTHILL BOULEVARD. (APN: 0207- 211-48). A. Recitals. 1. The applicant, A&S Engineering, Inc., filed an application requesting the approval of Conditional Use Permit DRC2025-00113, Minor Design Review DRC2025-00118, Minor Exception DRC2026-00098, Variance DRC2026-00074 as described in the title of this resolution. Hereinafter in this Resolution, the subject entitlements request is referred to as "the application." 2. On the 24th of June, 2026, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on said application and concluded said hearing on that date. 3. All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined, and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon the substantial evidence presented to this Commission during the above -referenced public hearing on June 24th, 2026, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows: a. The project site consists of approximately 1.05 acres, generally located to the southwest of the intersection of Vineyard Avenue and Foothill Boulevard; and b. The application proposes the construction of a 4,910 square foot Car Wash facility on the aforementioned project site. Nonresidential development of this scale requires the approval of a Minor Design Review; and PLANNING COMMISSION RESOLUTION NO. 2026-020 DRC2025-00113, DRC2025-00118, DRC2026-00098, DRC2026-00074 June 241h, 2026 Page 2 c. The existing Land Use, General Plan and Zoning designations for the project site and adjacent properties are as follows: Land Use General Plan Zoning Site Vacant City Corridor Corridor 1 (CO1 } Moderate North Multi -Tenant City Corridor Corridor 1 (CO1 } Commercial Moderate South Multi -Family Suburban Medium Residential (M) Residential Neighborhood Low East Multi -Family City Corridor Corridor 1 (CO1) Residential Moderate West Vacant City Corridor Corridor 1 (CO1 } Moderate d. The proposed use falls within the scope of the Car Washing and Detailing use type as described in Development Code Section 17.32.020G.7. The Development Code requires the approval of a Conditional Use Permit to allow the operation of Car Washing and Detailing uses within the Corridor 1 zone; and e. In addition to the Design Review and Conditional Use Permit applications, the project also includes a request for a minor exception to permit deviation from the maximum wall height requirement on the south property line of the project site, to allow for the construction of an 8 -foot screen wall. This deviation is necessary to maximize noise attenuation for the adjoining residential use; and f. In addition to the Design Review, Conditional Use Permit, and Minor Exception applications, the project also includes a request for a Variance to permit deviations from the minimum residential use and frontage requirements in the underlying zone. These requests are necessary to accommodate unique site limitations. 3. Based upon the substantial evidence presented to this Commission during the above referenced public hearing and upon the specific findings of facts set forth in Paragraphs 1 and 2 above, this Commission hereby makes the following findings for Conditional Use Permit DRC2025-00113 pursuant to Development Code Section 17.20.060: a. The proposed use is consistent with the general plan. The project site falls within the City Corridor Moderate General Plan Land Use Designation, intended for mixed -use development which transitions auto -oriented corridors to walkable neighborhoods. Small-scale auto -oriented uses such as drive throughs and car washes are allowed. The proposed Car Washing and Detailing use is limited in scope and intensity, consistent with the intention for auto - oriented uses located within the City Corridor Moderate General Plan Land Use Designation; and b. The proposed use is consistent with the purposes of the Development Code and the purposes of the applicable zone as well as any applicable specific plans or city regulations/standards. Pursuant to Development Code Section 17.136.020, Car Washing and Detailing uses are permitted in the Corridor 1 zone with the approval of a conditional use permit. The proposed use shall conform to all general operational standards as detailed in the Development Code. Further, the proposed use shall adhere to the operational standards specific to Car Washing and Detailing as detailed in Development Code Section 17.90.030; and PLANNING COMMISSION RESOLUTION NO. 2026-020 DRC2025-00113, DRC2025-00118, DRC2026-00098, DRC2026-00074 June 24th 2026 Page 3 c. The site is physically suitable for the type, density, and intensity of the use being proposed, including access, utilities, and the absence of physical constraints that would make conduct of the use undesirable. The project site is a vacant lot directly adjoining Vineyard Avenue, which the general plan identifies as an auto -oriented street and thus ideal for auto -dependent uses such as Car Washing and Detailing The project shall share access from the public right of way with an existing Multi -Tenant Commercial Center. Thus, Staff finds that the project site is physically suitable for the proposed Car Washing and Detailing use; and d. The design, location, size and operating characteristics of the proposed use would be compatible with the existing and other permitted uses in the vicinity including transportation and service facilities. The proposed use is similar in scale to the neighboring multi - tenant commercial development to the north. Appropriate screening and noise attenuation will be applied to the south of the project site to minimize the negative impacts of the Car Washing and Detailing use for adjacent residential uses; and e. Granting the permit would not constitute a nuisance or be injurious to detrimental to the public interest, health, safety, convenience, or welfare, or materially injurious to persons, property, or improvements in the vicinity and zone in which the property is located. The proposed project shall adhere to all operational standards as required by the development code and shall include screening and noise attenuation measures to mitigate the impact of car washing activities on surrounding properties. Conditions of approval have also been applied which shall mitigate negative impacts of the proposed use so as not to create a nuisance; and f. The proposed use will not pose an undue burden on city services, including police, fire, streets, and other public utilities, such that the city is unable to maintain its current level of service due to the use. The proposed use has been reviewed by the engineering and traffic departments, and conditions of approval have been applied to mitigate potential traffic conflicts related to the proposed Car Washing and Detailing use. This includes the requirement that a queueing study be conducted and approved by the Engineering department prior to issuance of building permits. 4. This Commission also hereby makes the following findings in support of Minor Design Review DRC2025-00118 pursuant to Development Code Section 17.16.130 a. The proposed project is consistent with the general plan. The project site falls within the City Corridor Moderate General Plan Land Use Designation, intended for mixed -use development which transitions auto -oriented corridors to walkable neighborhoods. Small-scale auto -oriented uses such as drive throughs and car washes are allowed. The proposed car wash facility is limited in scope and intensity, consistent with the intention for auto -oriented uses located within the City Corridor Moderate General Plan Land Use Designation; and b. The proposed project is in accord with the objective of the Development Code and the purposes of the zone in which the site is located. The project site is located within the Corridor 1 (CO1) zone. This zone promotes medium -intensity mixed -use development which transitions auto -oriented corridors to more walkable areas. Intended uses include a broad range of commercial and retail uses, as well as auto -oriented uses which are small in scale. The proposed car wash facility is limited in scope and intensity, consistent with the intention for auto - oriented uses located within the Corridor 1 (CO1) zone; and PLANNING COMMISSION RESOLUTION NO. 2026-020 DRC2025-00113, DRC2025-00118, DRC2026-00098, DRC2026-00074 June 24th, 2026 Page 4 c. The proposed project is in compliance with each of the applicable provisions of the Development Code. With the approval of the minor exception and variance referenced herein, the proposed project adheres to all development standards for the zone in which it is located. This includes the use -specific development standards which apply to Car Washing and Detailing uses as detailed in Development Code Section 17.90.020; and d. The proposed project, together with the conditions applicable thereto, will not be detrimental to public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. The proposed project shall adhere to all operational standards as required by the development code and shall include screening and noise attenuation measures to mitigate the impact of car washing activities on surrounding properties. Conditions of approval have also been applied which shall mitigate negative impacts of the proposed use so as not to create a nuisance. 5. The Commission also hereby makes the following findings in support of Minor Exception DRC2026-00098 pursuant to Development Code Section 17.16.110. a. The minor exception is consistent with the general plan or any applicable specific plan or development agreement. The proposed wall height increase is intended to improve noise attenuation to protect residential uses adjacent to the project site. This supports General Plan LC1.11 — Compatible Development by ensuring compatibility of new development with adjacent contexts. b. The proposed minor exception is compatible with existing and proposed land uses in the surrounding area. The proposed wall height increase is comparable with similar noise attenuation provisions elsewhere in the City and is intended to protect neighboring uses from noise created by the proposed Car Washing and Detailing use; and c. The proposed exception to the specific development standard(s) is necessary to allow creative design solutions compatible with the desires of the community and/or accommodate unique site conditions. The subject wall height increase was proposed at the suggestion of the Design Review Committee, as a solution to potential noise nuisance issues that could be created by the proposed Car Washing and Detailing use. Thus, the proposed minor exception is compatible with the desires of the community; and d. The granting of the minor exception will not constitute a grant of special privilege inconsistent with the limitations on other properties classified in the same zone, and will not be detrimental to public health, safety or welfare, or materially injurious to properties or improvements in the vicinity. Noise attenuation is a standard requirement of commercial and industrial uses adjacent to residential development. The proposed minor exception is intended to improve noise attenuation and mitigate nuisance noise for neighboring residential uses. 6. The Commission also hereby makes the following findings in support of Variance DRC2026-00074 pursuant to development code 17.20.030 a. Strict or literal interpretation and enforcement of the specified regulation would result in practical difficulty or unnecessary physical hardship inconsistent with the objectives of this code. The granting of the variance is necessary to accommodate the circulation needs of the proposed use. The size of the lot and its nature as infill development limits the ability to provide the necessary circulation while meeting the frontage requirements. Further, as the project can be considered to already be an element of existing and proposed horizontal mixed use development, PLANNING COMMISSION RESOLUTION NO. 2026-020 DRC2025-00113, DRC2025-00118, DRC2026-00098, DRC2026-00074 June 24th, 2026 Page 5 requiring additional residential development would result in an undue burden on the applicant; and b. There are exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to other properties in the same zone. The property is located adjacent to an entitled mixed -use development and is further adjacent to existing residential and commercial uses. As such, the proposed use can be considered a component of existing and proposed horizontal mixed -use development. Further, the proposed Car Washing and Detailing use has unique circulation requirements as an auto -oriented use which cannot be met should a strict interpretation of the code be applied; and c. Strict or literal interpretation and enforcement of the specified regulation would deprive the applicant of privileges enjoyed by the owners of other properties in the same zone. Car Washing and Detailing is a conditionally permitted use in the Corridor 1 zone. The commercial property located to the north of the project site does not incorporate residential development, and in addition another Car Washing and Detailing use, also in the Corridor 1 zone, is located in the vicinity of the project site. Thus, strict enforcement of the specified regulations would prevent the applicant from enjoying the same privileges enjoyed by other users in the vicinity; and d. The granting of the variance will not constitute a grant of special privilege inconsistent with the limitations on other properties classified in the same zone. Another Car Washing and Detailing use is located within the vicinity of the proposed use. Further, the adjoining multi -tenant commercial use to the north of the project site does not incorporate residential development, and is also considered by Staff to be a component of the existing and proposed horizontal mixed use development. As such, granting of the variance shall not constitute a granting of special privilege not enjoyed by owners of other properties in the vicinity; and e. The granting of the variance will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. The proposed variance shall not result in an intensification of the proposed use beyond what is typical of similar uses in the vicinity. The proposed project shall adhere to all operational standards as required by the development code and shall include screening and noise attenuation measures to mitigate the impact of car washing activities on surrounding properties. Conditions of approval have also been applied which shall mitigate negative impacts of the proposed use so as not to create a nuisance. 7. Planning department staff have determined that the project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) and the City's CEQA guidelines. The project qualifies as a Class 32 categorical exemption under State CEQA Guidelines Section 15332 - Infill Development Projects. The project scope is the development of a commercial Car Washing and Detailing use on a vacant lot which is adjacent on three sides to already developed property. The proposed project is consistent with the general plan and the standards of the development code. A technical memorandum has been prepared for the proposed project and confirms that the project meets all criteria to qualify for a Class 32 Categorical Exemption, and that there is no substantial evidence that the project may have a significant impact on the environment. Based upon the substantial evidence presented to this commission during the above -referenced meeting and upon the specific findings of facts set forth in paragraphs 1, 2, 3, 4, 5, 6 and 7 above, this Commission hereby approves the application subject to each and every condition set forth in the Conditions of Approval, attached hereto and incorporated herein by this reference. 9. This project is subject to public art requirement outlined in Chapter 17.124 of the Development Code. Prior to the issuance of building permits (for grading or construction), the applicant shall inform the Planning Department of their choice to install public art, donate art or select the in -lieu option as outlined in 17.124.020.D. If the project developer chooses to pay the in -lieu fee, the in -lieu art fee will be invoiced on the building permit by the City and shall be paid by the applicant prior to building permit issuance. If the project developer chooses to install art, they shall submit, during the plan check process, an application for the art work that will be installed on the project site that contains information applicable to the art work in addition to any other information as may be required by the City to adequately evaluate the proposed the art work in accordance with the requirements of Chapter 17.124. If the project developer chooses to donate art, applications for art work donated to the City shall be subject to review by the Public Art Committee which shall make a recommendation whether the proposed donation is consistent with Chapter 17.124 and final acceptance by the City Council. No final approval, such as a final inspection or the a issuance of a Certificate of Occupancy, for any development project (or if a multi -phased project, the final phase of a development project) that is subject to this requirement shall occur unless the public art requirement has been fulfilled to the satisfaction of the Planning Department. 10. Approval of this request shall not waive compliance with all sections of the Development Code, all other applicable City Ordinances, and applicable Community, Specific Plans and/or Master Plans in effect at the time of Building Permit issuance. 11. The site shall be developed and maintained in accordance with the approved plans which include Site Plans, architectural elevations, exterior materials and colors, landscaping, sign program, and grading on file in the Planning Department, the conditions contained herein, and the Development Code regulations.
