HomeMy WebLinkAbout98-172 - Resolutions RESOLUTION NO. 98-172 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, FINDING THAT CERTAIN REAL PROPERTY, MORE PARTICULARLY DESCRIBED HEREIN, TO BE SURPLUS AND A BURDEN ON THE CITY OF RANCHO CUCAMONGA AND AUTHORIZING THE CITY ENGINEER TO SIGN THE QUITCLAIM DEED AND TO PRESENT SAME TO THE COUNTY RECORDER TO BE FILED FOR RECORD A. RECITALS. (i) The City of Rancho Cucamonga has a fee interest in those certain parcels of real property generally located north of Fourth Street and east of Cucamonga Creek, in the City of Rancho Cucamonga, County of San Bernardino, California, and hereinafter referred to in this Resolution as "said properties." A full, true and complete description of said properties are set forth in that copy of deed attached hereto as Exhibit "A" and by this reference set forth herein. (ii) California Government Code Section 37350 provides as follows: "A City may purchase, lease, receive, hold, and enjoy real and personal property, and control and dispose of it for the common benefit." (iii) California Government Code Section 37351 provides in pertinent part, as follows: "The legislative body (City Council) may...dispose of, and convey such property for the benefit of the City .... " (iv) The Planning Commission of the City of Rancho Cucamonga heretofore made the findings on August 31, 1998, that disposing of said property, as herein contemplated, would be in conformity with the General Plan of the City of Rancho Cucamonga. (v) Said property was acquired by the City of Rancho Cucamonga in fee, for landscaping pedestrian access, storm drain, and public utility purposes the need for which has been superseded by the development of Amended Tract No. 15727 as a private gated community. (vi) Said property constitutes a burden on the City of Rancho Cucamonga and is no longer necessary or convenient for the purposes for which it was acquired. (vii) Conveyance of said property will further the use of said property and benefit the City of Rancho Cucamonga by deletion of a necessity to maintain said property. Resolution No. 98-172 Page 2 (viii) All legal prerequisites to the adoption of this Resolution has occurred. B. RESOLUTION. NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does hereby find, determine, and resolve as follows: 1. All facts stated in the Recitals, Part A, of this Resolution hereby are found to be true and correct. 2. This Council hereby finds that the quit claiming of said property to the persons described in said deed will benefit the City of Rancho Cucamonga. 3. The City Engineer and City Clerk hereby are authorized and directed to execute the deed, a full, true and correct copy of which is attached hereto as Exhibit "A," and cause the same to be recorded forthwith upon adoption of this Resolution. 4. The City Clerk shall certify to the adoption of this Resolution. PASSED, APPROVED, AND ADOPTED this 16th day of September, 1998.
