Some of the spaces allocated for Bwlding 2 are located on Parcel 1 Therefore, as similarly provided in shopping centers, reaprocal parking and maintenance agreements for both parcels ensuring joint use and maintenance of all drives and parking areas will need to be provided by CC&Rs or deeds which will be recorded with the final parcel map B Design Review Committee The site, building elevations, materials, and conceptual landscaping were reviewed on April 2, 2002 The Committee (McNiel, Stewart, Fong) recommended approval subject to staffs recommendation to have planters provided in the rear of the site for tree plantings The Committee recogrnzed that the planter number and location might have to be ad/usted if tree-planting prohibitions were placed on the site by a utility easement that runs along the east property line ~~~ ~ PLANNING COMMISSION STAFF REPORT DRC2001-00719 & SUBTPM15790 -HILL PINCKERT ARCHITECTS, INC May 8, 2002 Page 3 The utility company does restnct tree heights to 15 feet within the easement Trees limited to that height will not provide the desired skyline/windrow effect Therefore, planters that extend beyond the easement have been provided that would allow for tall tree speaes to be planted C. Technical Rewew Committee. The Grading and Technical Review Committees reviewed the project and recommended approval subject to the standard conditions outlined in the Resolution of Approval. D Environmental Assessment Part I of the Initial Study was completed by the applicant The City's environmental consultant completed Part II and the Environmental Checklist The site is in an area identified as potential Delhi Sands Flower-loving Fly (DSF) habitat Based on focused DSF studies, the site did not exhibit features charactenstic of a viable habitat nor were any DSF observed in the immediate area. Therefore, the consultant and staff determined that the site would presumably remain unsuitable for DSF The consultant determined, and staff concurred, that the probed could have a significant adverse environmental impact on short-term air quality dunng site preparation, such as grading and egwpment exhaust. The proposed bwldings will be used for storage and distnbution, which is consistent with permitted uses in the General Industnal District, Subarea 14. APN: 229-331-01. Related file• SUBTPM15790. ENVIRONMENTAL ASSESSMENT AND TENTATIVE PARCEL MAP SUBTPM15790 -HILL PINCKERT ARCHITECTS, INC. - A proposed tentative parcel map consisting of two lots of 1.292 and 1.000 acres on a 2.3 acre site, within Subarea 14 of the Industnal Distnct on the east side of the southem terminus of Hyssop Dnve, east of the I-15 Freeway The proposed subdivision will designate the center dnveway as an easement, granting access to truck docks for both properties. APN: 229-331-01. Related file: DRC2001-00719. Design Parameters: The site is close to the east side of the I-15 Freeway and therefore visible from the moderately elevated road surface. The line of sight studies show that the roof top equipment should not be visible from the freeway. The truck loading docks are at the rear of each building and therefore not visible from the street or freeway. This presents a favorable view of the development. The property to the south is developed with a similar size industnal building and a vacant site borders the IoYs north property line. To the east is the recently approved public storage facility. Accompanying the design review, an application to subdivide the site into two parcels, each with a building has been submitted. The dividing properly line is to be between the buildings with a shared common easement dnveway to the rear. Staff Comments: The following comments are intended to provide an outline for Committee discussion Major Issues: The following broad design issues will be the focus of Committee discussion regarding this project: The architecture embellishments are in keeping with similar styles of recent industnal building approvals. In addition to the glazed office poRion, the plans call a standard smooth concrete finish with major portions of the office frontage having heavy sandblasted finish. Staff believes the use of these proposed matenals, along with the proposed colors, is generally compliant with the policy of requinng at least two pnmary building materials. Secondary issues: Once all of the major issues have been addressed, and time permitting, the Committee will discuss the following secondary design issues: The Landscape Plan proposes four tnangular planters (with vines) along the rear property line. Staff believes that the number should be increased to one planter per 3 parking spaces (for a total of ten) between the side property line planters and be planted with trees instead of vines. This would provide adequate shade for parking lot and a sign'rficant line of trees nsing above the buildings along the rear of the site. Staff also suggests that Eucalyptus citndora would be a good tree in this area, with a fast growth rate, to provide a picturesque tree line above the buildings. 2. No on-site pesticide fabrication or storage areas were identified. Additionally, during an on-site inspection, no hazardous materials storage or usage was noted. The applicant has requested a condition modification to specify aseven-year term of approval for the approved conditional use permit This would provide the applicant with an additional two years to implement the conditional use permit ANALYSIS Development Code Section 17 02 100 states, "approval for development review, conditional use permits, variances, and minor exceptions shall lapse and become void five years from the approval date, unless a ddferent exp~rat~on date ~s speafically established as a condd~on of approval [emphasis added]." The Planning Commission then issued a new Mitigated Negative Declaration in May 1999 with the three-year time extension Conditions in the vicinity have not changed appreciably since 1999 to justify further environmental review. Action on the requested condition modification would be undertaken based upon these past environmental clearances. RECOMMENDATION. Staff recommends that the Planning Commission approve the requested condition modification to allow aseven-year time frame for approval of Conditional Use Permit 95-25, through adoption of the attached Resolution of Approval. On May 14, 1997, this Commission adopted its Resolution No 97-27, thereby approving, subtect to specfic conditions and time limits, Conditional Use Permit 95-25 3. On May 26, 1999, this Commission adopted its Resolution No 99-47, thereby approving a three-year time extension for Conditional Use Permit 95-25 for an ultimate expiration date of May 14, 2002 4. On May 8, 2002, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing that date 5 All legal prerequisites prior to the adoption of this Resolution have occurred B. Resolution NOW, THEREFORE, it is hereby found, determined, and resolved by the Planning Commission of the City of Rancho Cucamonga as follows 1 This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon the substantial evidence presented to this Commission during the above- referenced public hearing on May 8, 2002, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows a The previously approved Conditional Use Permit is insubstantial compliance with the City's current General Plan, specific plans, ordinances, plans, codes, and policies, and b The condition modification granting a time extension of the Conditional Use Permit approval will not cause significant inconsistencies wrath the cun•ent General Plan, specfic plans, ordinances, plans, codes, and polices, and c The condition modification granting a time extension of the Conditional Use Pemtd approval is not likely to cause public health and safety problems; and C~\ PLANNING COMMISSION RESOLUTION NO 02-49 CUP95-25 MODIFICATION - GIL RODRIGUEZ, JR May 8, 2002 Page 2 d The protect was granted an initial approval penod of two years Subsequently, the City CounGl adopted its Ordinance No 596, which established an approval penod of five years vnth no further time extensions allowed but a provision for the Planning Commission to set speGfic expiration, via Conditions of Approval e The applicant has diligently pursued the protect since approval in 1997 includmg~ being in vanous stages of building pennit and grading permit plan check, since, diligent work with staff and the Planning Commission to develop a Uniform Sign Program and Design Guidelines for the center both have been approved, from 1999 through 2001, the applicant was processing a mator modification to the site plan concept, and the applicant is currently processing a Chevron service station at the northwest comer of the site 3 A Mitigated Negative Declaration was issued by the Planning Commission forCond~Lonal Use Permit 95-25 on May 14, 1997, and an updated Mitigated Negative Decaration was issued on May 26, 1999 Conditions in the viGnity have not changed appreciably since 1999, hence, no further environmental clearance is necessary The approval herein granted relies upon the Mitigated Negative Declarations previously issued for the protect and contained in the protect file 4 Based upon the findings and contusions set forth in paragraphs 1, 2, and 3 above, this Commission hereby approves the application subtect to each and every condition set forth below. 1) The approval penod forthis Conditional Use Permit is hereby extended to May 14, 2004 No further time extensions v~nll be pemvtted 2) All applicable conditions in Planning Commission Resolutions 97-27, 97-27A, and 99-47 shall apply.
