A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO CUCAMONGAi COUN~ OF SAN BERNARDINO,
STATE OF CALIFORNIA, FINDING THAT CERTAI!N REAL
PROPERTY, MORE P~TICM~RLY DESCRIBED HEREIN, TO
BE SURPLUS AND A B!URDEN O!N THE CITY OF RANCHO
CUC~ONGA AND AUTHORIZING THE DIRECTING THiE MAYOR
AND CITY CLERK TO EX!ECUT!E THAT CERTAIN DEED, A COPY
OF WHICH IS ATTACHED HERETO AS EXHIBIT "D" AND TO
CAUSE THE SAME TO. BE DELIV!ERED TO THE PERSON NAMED
THEREIN
A. RECITALS.
(i) The City of Rancho Cucamonga has a fee interest in that certain
portion of a City-owned alley generally the Northtown area, located on
the south side of Feron Bou!lievard, west of Hermosa Avenue in the City
of Rancho Cucamonga, County of San Bernardino, California, and
hereinafter referred to in thins Resolution as "said property." A full, true
and complete description of said property is set forth in that copy of
deed attached hereto as Exhibit "D" and by this reference set forth
herein.
(ii) California Government Code Section 37350 provides as follows:
'% City may purchase, lease, receive, hold and enjoy real
and personal property, and control and dispose of it for the
common benefit?'
(iii) California Government Code Section 37351 provides in pertinent
parts, as follows:
"'Tile legislative body (City Council may...dispose of, and
convey such property for the benefit of the City..."
(iv) The Planning Commission of the City of Rancho Cucamonga
heretofore made the findings on January 27, 1999, that disposing of said
portion of' City-owned property, as herein contemplated, would be in
conformity with the General Plan of the City of Rancho Cucamonga.
(V) Said portion o[ City-owned property was granted to the City of
Rancho Cucamo~n,ga thorough a Grant Deed for alley purposes for which
it was granted,
(vi) Said property constitutes a burden on the City of Rancho
Cucamonga and is no longer necessary or convenient for the purposes
for which it was granted

(vii) Conveyance of said property will further the use of said property
and benefit the Ci~' of Rancho Cu~monga by deletion of a necessity to
mainbin sai:d propeR.
(viii) All legal prerequisites to the adoption of this Resolution has
occurred.
B. RESOLUTION.
NOW, THEREFORE, the City Council of the City of Rancho Cucamonga does
hereby find, determine, and resolve as follows:
1. All facts stated in the Recitals, Part A, of this Resolution hereby are found to be
true and correct.
2. This Council hereby finds that the quit claiming of said property to the persons
described in said deed will benefit the City of Rancho Cucamonga.
3. The Mayor and City Clerk hereby are authorized and directed to execute the
deed, a full, true and correct copy of which is attached hereto as Exhibit "D" and
cause the same to be recorded f0rthwiith upon adoption of this Resolution.
4. The City Clerk shall certify to the adoption of this Resolution.

That portion of the 20-foot wide unnamed right-of-way bounded on the west by the southerly
p~ojection of the westerly line of Lot 10 and on the east by the southerly projection of the
westerly line of the easterly 5 feet of Lot 7 all of said Block 5.
As shown on Exhibit "E"' attached hereto and by this reference made a part hereof.
