RESOLUTION NO. 80 -78 12 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, DECLARING • ITS INTENTION TO ORDER THE ANNEXATION TO LANDSCAPE MAINTENANCE DISTRICT NO. 1, AN ASSESS - MENT DISTRICT: DESIGNATING SAID ANNEXATION AS ANNEXATION R1 TO LANDSCAPE MAINTENANCE DIS- TRICT NO. 1: PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972: AND OFFERING A TIME AND PLACE FOR HEARING OBJECTIONS THERETO. g. Vacation of Chestnut Street. It is recommended that 20 November 5, 1980 be set for public hearing for the vacation of Chestnut Street from Hermosa to 1,000 feet west. V -011 ON FILE IN THE OFFICE OF THE CITY CLERK. i. Street Improvement Waiver Request. Approval is requested under Ordinance No. 28 -A to postpone the requirement for immediate construction of street improvements for the split of a parcel currently occupied by two houses. j. Street Improvement Waiver Request. Approval is requested for postponement of street improvements on Summit Avenue under Ordinance No. 28 -A. The street improvements were required as a condition of Parcel Map 5441. k. Award of Striping Contract. Robinson Assistant City Manager RE: Request For Interdivisional Fund Transfer To Accommodate Overtime and Additional Intern Assistance for Completion of General Plan and Related Planning Projects. Attached is a request from Community Development to make an inter - divisional fund transfer from the Engineering Intern account to the Planning Division Intern and overtime account. The purpose of this fund transfer is to provide additional funds for the Planning over- time and intern account to insure the timely completion of the General Plan, Industrial Specific Plan, the Fiscal Impact Model and Victoria Plan. RECOMMENDATION: That the City Council of the City of Rancho Cucamonga authorize a transfer of funds in the amount of $500.00 from the Engineering Intern Account to the Planning Intern Account and $500.00 from the Engineering Intern account to the Planning overtime account. J 1977 FROM: Jack Lam, Director of Community Development SUBJECT: Request for Overtime and Fund Transfer I have assessed the current work program and find that because of events beyond our control, many major projects, the most important of'which is the General Plan, are coming together rapidly as we must meet our accepted deadlines. The good news is that these major projects are coming together. The bad news is that they come all at once which results in the problem of workload compression, one that can be helped immensely if we have au- thorization for overtime work for some of the staff. The management personnel are already working evenings and weekends, but we must now involve the non - management staff, which will require paid over- time. We do have salary savings as a result of the lag time between au- thorization of positions and the hiring of positions, thus there are funds available within the total approved budget if internally shifted. Speci - fically, we are requesting overtime for Dan Coleman, Assistant Planner, and for additional hours for Ed Villanueva, our part -time student intern. Furthermore, as the need could arise, we are requesting the use of an inter - divisional fund transfer for potential hiring of a part -time intern for approximately two months, The funds would come out of the Engineering Division Intern Account to the Planning Division Intern Account, The problem of the timeframe compression is that during this period of time when the General Plan, the Industrial Specific Plan, the Fiscal Impact Model and the Victoria Plan are coming together all at once, staff must cope wit the proces ing of residential projects totaling 4093 units. Mr. Cherbak has obtained conditional approval from the County Board of Supervisors for the north half of Chestnut. The south half of the street is in the City limits (see sketch). Therefore, the County conditioned their approval, requiring Mr. Cherbak to obtain abandonment approval of the south half from the City. The County has agreed to hold recording of their approvals, so that the City's action may be filed for record simultaneously with theirs. The street presently traverses the side of three mountain ridges and two valleys, thus making it nearly impossible to construct. It presently is identified by offers of dedications of several Parcel Maps. The future prospect of construction to street stan- dards or within present alignment is remote. Hubbs, City Engineer SUBJECT: Street Improvement Waiver Request The Hoovers are the owners of a "land locked" parcel located east of East Ave. and south of Highland Ave., near the Route 15 freeway. Access to the parcel from Highland Ave. is via a private easement across properties to the north. The parcel is now occupied by two houses and the Hoovers wish to split the parcel so the houses will each be on a separate lot. The split will not produce any buildable lots. A parcel map will be required to achieve the lot split. Normally, a parcel map carries with it the requirement for street dedication and improvement. In this case, the land is far from an improved street and the subdivision will not result in any future new construction. Recently adopted Ordinance 28 -A allows the City Council the discretion of postponing street improvements required by parcel maps, provided that an agreement is entered into by the land owners to construct the improvements at such future time as required by the City Council. Hubbs, City Engineer SUBJECT: Street Improvement Waiver Request Parcel Map 5441 is for the purpose of dividing property at the southeast corner of East Ave. and Summit Ave. into 4 parcels. The property is ultimately to be residential and one of the proposed parcels will contain an existing house. Ordinarily a parcel map of this kind requires the construction of street improvements for the currently built -upon parcels) and construc- tion of improvements for other parcels at the time of their development. The applicant wishes to build a house on Parcel 2 immediately. In this case, the immediate construction of improvements for • Parcel 2 (new house) and Parcel 3'(existing house) is impractical for the following reasons: 1. Natural drainage along Summit Ave. is such that curb and gutter, if built, would increase the danger of flooding of the property. 2. A storm drain would be an unreasonable requirement for the size of development proposed. 3. East Ave., the west boundary of the property, will require realignment, but this cannot be done until the property on the west side of East Ave. is developed (please note the proposed realignment on the parcel map). It appears that development of the west side of East Ave. is imminent and such a development will necessitate the realignment of East Ave. to achieve proper geometries for the East - Summit intersection. At that time, the drainage situation along Summit Ave. will also be cleared up and the improvements required for Parcel. Map 5441 will be feasible, regardless of the timing of this development. TRAFFIC GRAIJT OFFICER TRAINING - FY 1980/81 In the fiscal year 1980/81 training courses are required of officers participating in the traffic management grants for the contract cities. These courses were not appropriated in the fiscal year 1980/81 budget. The contract cities have agreed to pay for the advanced registration and expenses that will be in- curred by the officers. This is with the understanding that they would be reimbursed by the County when P.O.S.T. reimburse- ment is received by the Sheriff's Office. In order to not reduce county training appropriations of the Sheriff's Office for contract cities grant expenditures, guidance was requested from Henry W. Harvey, Chief Deputy Controller. A procedure was initiated that would not reduce Sheriff's county • training appropriation for expenses incurred by a contract city grant, Mr. Haney recommended that the City's amount be placed in the Sheriff's Training Account as receipts. The County then pays for all expenses through the training account as expenditures. When the county receives the state's P.O.S.T. reimbursement, that is to be placed in the training account as receipts and a warrant he issued from the training account to reimburse the city for its initial outlay of funds. Mr. Harvey stated that this procedure could only be used in those specific cases, and only for the fiscal year 1980/81. The City Council of the City of Rancho Cucamonga does ordain as follows: SECTION 1: PURPOSES: A. The Citv Council finds and determines that the conversions of apartments to community apartments, stock cooperatives and condominiums affect the public health, safety, and welfare; and that such projects, which are subject to the subdivision regulations of the State of California, should be regulated by local ordinance. The City Council determines a need to regulate the conversions of existing buildings to community apartments, stock cooperatives and condominiums so as to: 1. Encourage a balanced supply of rental and ownership housing in the community and a variety of choices of tenure, type, price, and location of housing. . 2. Maintain and encourage the supply of affordable housing, both ownership and rental, for low- and - moderate income persons and families; and 3. Promote the residential stability and quality of the community by developing neighborhood identity, discouraging displacement of residents, and facilitating affordable home ownership opportunities and rental ownership opportunities for the community. The City Council, therefore, states its express intent to set such standards and regulations necessary to insure that apartments and like structures being converted will. be in the best interest of the community. SECTION 2: DEFINITIONS: The words and terms used in this Chapter shall have the following meaning unless the context clearly indicates otherwise: A. Community Apartment: Community Apartment as defined in Section 11004 of the Business and Professions Code, containing two or more rights of exclusive occupancy. B. Condominiums: Condominiums as defined in Section 1350 of the Civil Code: "An estate of real property consisting of an undivided interest in common areas, together with a separate right of ownership in space." Ordinance No. 119 Page 2 C. Conversion: The process or act of subdivision, in accordance • with the Subdivision Map Act, of existing rental dwelling units into condominiums, community apartments or stock cooperative. D. Pest Report: An inspection and written report conforming to the requirements of Section 8516 of the Business and Professions Code of the State of California including documentation of conditions ordinarily subject to attach by wood destroying pests and organisms. E. Project: Project means a condominium, community apartment, and stock cooperative. F. Stock Cooperative: Stock cooperative as defined in Section 11003.2 of the Business and Professions Code: property consisting of dwelling units owned by a corporation whereby shareholders receive a right of exclusive occupancy in a portion of the real property owned by the corporation. SECTION 3: APPLICATION INFORMATION REQUIRED: No Tentative Map for the purpose of conversion will be accepted for filing unless it is accompanied by an application which in addition to the information required by the Subdivision Map Act and the Subdivision Ordinance, contains all of the following information and documentation: A. Sr ecif is Requirements: • 1. Terms of proposed assistance, discount, or other financing program to be offered, if any, to present residents for the purpose of subsequent unit purchase; 2. Proposed program of relocation assistance to be offered by the applicant, if any; 3. Proposed Homeowner's Association fee; 4. Names and addresses of all tenants. When the subdivider can demonstrate that such information is not available, this requirement may be modified by the Community Development Department. 5. The subdivider shall submit evidence that a certified letter of notification of intent to convert was sent to each tenant for whom a signed copy of said notice is not submitted. 6. A report of field test by a qualified independent testing agency as specified in the Uniform Building Code showing that the wall separation and the floor and ceiling separation between units shall provide the same airborne sound insulation as required by the most current Uniform Building • )i2 Ordinance No. 119 Page 3 . Code requirements adopted by the City. If the report shows that these standards are not met then the applicant shall indicate that he will complete improvements necessary to meet these requirements prior to any sale of said converted apartments. In cases where units are occupied by tenants, who have initiated a contract for the purchase of the units, the improvements for such soundproofing shall be complete prior to the sale of the unoccupied units. A copy of the proposed declaration of covenants, conditions and restrictions which will apply and which shall include an agreement for common area maintenance, including facilities and landscaping, together with an estimate of the initial assessment fees anticipated for such maintenance; a description of a provision for maintenance of vehicular access areas within a project; and an indication of appropriate responsibilities for maintenance of all utility lines and services for each unit. 13 8. A physical elements reports which shall include but not be limited to: (a) A report detailing the condition and estimating the remaining useful life of each element of the project proposed for conversion: Roofs, foundations, exterior paint, paved surfaces, mechanical systems, electrical systems, plumbing systems, including sewage systems, swimming pools, sprinkler systems for landscaping, utility delivery systems, central or community heating and air-conditioning systems, fire protection systems including automatic sprinkler systems, alarm systems, or standpipe systems, and structural elements. Such report shall be prepared by an appropriately licensed contractor or architect or by a registered civil or structural engineer other than the owner. For any element whose useful life is less than five (5) years, a replacement cost estimate shall be provided. (b) A structural pest control report. Such report shall be prepared by a licensed structural pest control operator pursuant to Section 8516 of the Business and professions Code. (c) A Building history report including the following; (1) The date of construction of all elements of the project; (7) A statement of the major uses of said project since construction; 13 Ordinance No. 119 Page 4 (3) The date and description of each major repair or renovation of any structure or structural element since the date of construction. For the purposes of this subsection a "major repair" shall mean any repair for which an expenditure of more than $1,000 was made; (4) Statement regarding current ownership of all improvements and underlying land; (5) Failure to provide information required by subsections (1) through (4), inclusive, shall be accompanied by an affidavit, given under penalty of perjury, setting forth reasonable efforts undertaken to discover such information and reasons why said information cannot be obtained. 9. Other information which, in the opinion of the Planning Commission, will assist in determining whether the proposed project is consistent with this chapter. SECTION 4; PROPERTY DEVELOPMENT STANDARDS: A. General Requirements: No Final Map for the purposes of condominium conversion will be accepted for filing unless the following requirements, which shall be conditions of approval of the tentative map are approved: 1. Each dwelling unit shall conform to current noise and energy insulation standards required by the latest adopted Uniform Building Code or other applicable law or regulation. 2. Each unit shall have installed smoke detectors as required by the latest adopted edition of the Uniform Building Code. 3. For each unit there shall be. provided a minimum of two covered, on -site parking spaces per unit in a garage or carport, plus an additional 202 of the total spaces provided for guest parking non- covered. 4. Each dwelling unit shall be separately metered for gas and electricity unless the City approves a plan for equitable sharing of communal metering. 5, Each unit shall be provided with separate water shut -off valves and electrical main shut off. h. Each area for trash placement and pickup shall be adequately designated and all refuse shall be removed on a regularly scheduled hasis from the premises. • �q Ordinance No. 119 Page 5 • 7. Permanent mechanical equipment which the Building Official determines is a potential source of vibration or noise shall be shock mounted or isolated, or otherwise mounted in a manner approved by the Building Official to lessen the transmission of vibration and noise. 8. Illuminated addresses, and if found necessary by the Planning Commission, directory maps, for all units shall be prominently displayed from appropriate public or private access within or adjacent to the project. 9. At least 125 cubic feet of enclosed, weatherproof, lockable storage space is to be provided for each unit. This storage space shall be in addition to that ordinarily contained within each unit. It may be either within or exterior to, but shall bear a reasonable lacational relationship to each unit. 10. A laundry area shall be provided in each unit; or if common laundry areas are provided, such facilities shall consist of not less than one automatic washer and dryer for each five units or fraction thereof. 11. The applicant shall provide written certification to the buyer of each unit on the initial sale after conversion that any dishwashers, garbage disposals, stoves, refrigerators, • hot water tanks, and air - conditioners that are provided are in working condition as of the close of escrow. At such time as the Homeowner's Association takes over management of the development, the applicant shall provide written certification to the Association that anv pool and pool equipment and any appliances and mechanical equipment to be owned in common by the Association is in working condition. B. Application Requirements: The applicant shall provide the City with a tentative subdivision map in conformance with the State Subdivision Map Act and local ordinance and a development plan of the project including, but not limited to: 1. Dimensions and location of each building or unit, and the location of all fences or walls. 2. Building elevations indicating the type of construction material existing and proposed; i. Typical floor plans of existing units with .square footages of each unit indicated and the number of units per plan; 4. l.ocntion of common area and amenities existing or proposed; I 1 U 15 Ordinance No. 119 Page 6 5. Location and dimensions of parking garage, carport, • parking area, access -ways, and any other on -site area reserved for vehicular use; 6. Location of areas for exterior storage space for individual occupants; 7. Landscape plan per City standards which specifies proposed trees, shrubs, plants, and ground cover, and indicates existing landscape massing. Species, quantity, and sizes shall be indicated for proposed landscaping only. 8. Evidence that a notice of intent to convert shall be delivered to each existing tenant's dwelling unit. The form of the notice shall be as approved by the Community Development Department and shall. contain not less than the following: (a) Name and address of current owner; (b) Name and address of the proposed subdivider; (c) Approximate date on which the tentative map is proposed to be filed; (d) Tenant's right to purchase; (e) Tenant's right of notification to vacate; • (f) Tenant's right of termination of lease; (g) Provision for special cases; and (h) Provision of moving expenses. (i) Tenant's Right to Purchase. As provided in Government Code Section 66427.1(b) any present tenant or tenants of any unit shall be given a nontransferable right of first refusal to purchase the unit occupied at a price no greater than the price offered to the general public. The right of first refusal shall extend for at least sixty (60) days from the date of issuance of the Subdivision Public Report or commencement of sales, whichever date is later. (j) Vncation of Units. Each non - purchasing tenant, not in default under the obligations of the rental agreement or lease under which he occuples his unit, shall have not less than one hundred- twenty (120) days from the date of receipt of notification from the owner of his intent to convert, or from the filing date of the Final Subdivision Map, whichever . date is later, to find substitute housing and to relocate. 14t • L, Ordinance No. 119 Page 7 (k) Other information as may be deemed necessary by the Community Development Department. 9. Any other information that the Director of Community Development deems necessary to determine whether the proposed project is consistent with this chapter. SECTION 5: EXEMPTIONS: In the event that any of the Property Development Standards required for the Conversion causes practical difficulties and are determined to be unnecessary or would result in excessive costs, the Planning ,Commission may waive, reduce or modify the requirement. Waivers shall only be made for parking, laundry facilities, storage provisions for individual units, and noise and energy requirements. SECTION 6: CONVERSION LIMIT PROCEDURE: A. Annual Limit. The City shall approve the conversion of no more than one -half (',) the number of multi - family rental dwellings added to the City's housing stock (i.e. dwelling units completed and ready for occupancy) during the preceding year, in any one calendar year. The number of multi- family rental units added in one year shall be determined as follows: From January 1 through December 31, the total number of multi- family rental units given a final building inspection and occupancy permit minus the number of such units demolished, removed from the City, or converted to non - residential use. If approval for a project expires prior to recordation of the Final Tract Map for that project, the number of dwelling units provided in the expired project shall be added to the allocation in the calendar year of expiration. For a one -time only basis, this ordinance shall establish 264 dwelling units available for conversion in 1980. E. 'Came Limit. Any multi - family rental unit constructed after, the effective date of this ordinance snall be allowed to convert to condominiums subject to the provisions of this ordinance, five years from the date of the final occupancy of the project. This property is located adjacent to a ravine which at that time a county owned casement. In late 1974, the tract of homes to the north and directly behind us was built. The contractor was allowed by the county to divert all water run -off (approximately 33 acres) of said tract into the ravine by means of a long concrete V- channel. The amount and Speed of the water caused extensive erosion to the ravine, moving inside our property line; loss of a portion of our chain link fence; cracking of block walls, loss of land; etc. This erosion has caused the entire hill /slope to pull and shift away toward the ravine (approximately 220' in length). Our house is located where the hill is pulling away and heavy erosion has occurred under the foundation. We have taken our problem to the San Bernardino County Flood Control District many times in the last five years, to the County • Supervisor, to the Building and Safety Department, and to the City of Rancho Cucamonga via the City Engineer's office. Due to this problem, the County Assessor has reassessed our property to approximately one third of the original assessment, and presently our property is not marketable to the general public. We have had a reputable engineering firm evaluate our situation. (Available for your review upon request.) The end result being - we will not he able to survive another rainy season, as the hill slips further into the ravine so will one room of our home. This offer and construction project have always been a "given" in the Heritage Park program. The particulars of the transaction are: Acres to be sold: 6.804 Total purchase price: $120,533.00 • The offer presented averages $17,715 per acre. The City paid an average of $9,812 per acre. (We will make our last payment of $83,000 in January, 1981 from the proceeds of this sale. The balance of $37,533 remaining after final payment can be used in a "matching" grant situation for Heritage Park planning and development). The City Attorney, City Engineer and myself have reviewed the paperwork and their mechanics, and while it is somewhat complicated by the unusual circumstance surrounding the incremental purchase of the park by the City, it does appear that the offer is proper and in order. Council Options: 1. Accept offer and authorize Mayor to execute necessary documents for sale. 2. Reject offer and conduct our own appraisal. Attached to this report is information received from Goldman, Sachs 8 Co. Bond Underwriters regarding the proposed Mortgage Revenue Bond by the County of San Bernardino. The City Council has been asked to consider participation in this program. The County has provided responses to several questions proposed by the City in regards to the proposed Mortgage Bond Program. City Staff has been in touch with County Staff Representatives and the Bond Underwriter. They have indicated that additional material on the Bond Program would be delivered to City Staff and Council members prior to the Council meeting. In addition, members of the County Staff have indicated that they will be present at the Council meeting to answer any questions. County Staff Representatives have indicated that the City would likely be able to participate in the Bond Program without an adopted Housing Element provided the City is preparing a Housing Element and has addressed housing in other City policy. Housing policy adopted by the City includes the Growth Management Plan which provides an incentive for affordable housing. The County Staff has scheduled a presentation to the Board of Supervisors on the Mortgage Revenue Bond on Monday September 29, 1980. Being considered at that time is the possibility of sharing with the City any arbitrage rendered from the Bond Program, In addition, in response to the concerns by the building industry, County Staff Representatives are considering increasing a maximum number of units per project, eligible for the Bond financing - from twenty -five (25) to one - hundred (100) dwelling units. The county will be accepting requests from developers for reservations of finds to finance eligible units. Should you have any questions, require any additional information, or wish to have umbers of the County's staff attend a meeting of your city council, please contact Ann Siracusa, Director of the San Bernardino County Office of Camunity Development, at (714) 383 -2945. • • 7-3 • Response to Certain Questions Raised at the Meeting between the County of San Bernardino and the Incorporated Cities within the County held on September 8, 1980 Question #l: According to AB 1355, in order for an incorporated city to participate in the County's mortgage revenue bond program, the city must pass a resolution and adopt an agreement which states, in part, that the city agrees not to participate in any competing hor.�e mortgage finance program under the Act until at least 90% of the hoe mortgages to be financed by the County under the program with the proceeds of the County's series of bonds have been made or acquired. Howe is "competing" defined, and would this include an SB 99 • bond issue which has been, or will be, issued? • Response: A competing issue would be that for a "home mortgage finance program under the Act" (that is, AB 1355). Therefore, this would only be another program financed by a bond issue under AB 1355, and, by definition, would not mean an SB 99 bond issue. SB 99 issues, whether proposed or in the mortgage acquisition phase, would not be considered "competing' issues. 74 0 Question #2: AB 1355 requires that a city issuing bonds under the Act on its own mist not implement a program unless the program coWlies with the housing element and land use element which is required to be included in the general plan of the city. Must a city have such a housing and land use element in order to participate in the County's program? Response: The County as issuer complies with this requirement of AB 1355. The statute does require a partici- pating city to have adopted a general plan including a housing element and land use element, but the plan is not required to be approved by the State Housing and Conv pity Development Department. If a city has no such general plan it may still be possible to participate, and the city should contact the County so that its participation can be investi- • gated. • �5 • A i C -. Question 113: Will the participating Cities be able to share in some of the "arbitrage" profits that the County receives from the program? Response: The primary source of arbitrage in programs of this type has been earnings on the investment of bond proceeds. Under current market conditions there will not be substantial earnings, and there may even be losses since the average rate at which the funds can be invested is at or below the rate the County will pay on its bonds. Arbitrage can also be earned on the mortgages by increasing the imrtgage rate above what is required, but this approach increases the cost to borrowers, The County's program is not designed to provide for surplus. Any excess revenues will be used to reduce debt by paying off bonds in order to get the highest bond rating possible. Surplus from the program would be available only after all bonds are retired, in approximately 12 years. At • that time the Board of Supervisors would determine its disposition. It is contemplated that partici- pating Cities would receive the benefit of any use of such surplus by the County. n U RESOLUTION NO. 80-92 • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, ADOPTING A HOME MORTGAGE FINANCE PROGRAM IN COOPERATION WITH THE COUNTY OF SAN BERNARDINO. WHEREAS, there is a shortage in the County of San Bernardino (the "County ") and in the City of Rancho Cucamonga (the "City') of decent, safe and sanitary housing, particularly of housing affordable by persons in the lower end of the purchasing spectrum, and a consequent need to encourage the construction and rehabilitation of homes affordable by such persons and otherwise to increase the housing supply in the City and in the County for such persons; and WHEREAS, the Board of Supervisors of the County of San Bernardino has determined to engage in a home mortgage finance program (the "Program ") pursuant to Part 5 of Division 31 of the health and Safety Code of the State of California (the "Act ") for persons and families within the income limits established by the Act, and has determined to issue revenue bonds persuant to the Act to provide funds for the Program; and WHEREAS, the County proposes to adopt the Program by ordinance for the purpose of increasing the housing supply in the County; and WHEREAS, the Council of the City finds and determines that it • is in the best interest of the City to adopt the Program and to consent to the operation of the Program by the County of San Bernardino within the geographic boundaries of the City pursuant to the Act; n U NOW, THEREFORE BE IT RESOLVED, by the Council of the City of Rancho Cucamonga, Calif., as follows; 1. Council had the following questions and corrections to the Consent Calendar: Item "n" -- Councilman Palumbo wanted to know the amount this amendment to the Industrial Specific Plan would be. Mr. Lam stated that it was the amount agreed upon namely, $7,000. Item "d" and "e" -- Mayor Schlosser said that "and interested Council members" should be added to these two requests of authorization. Motion: Moved by Palombo, seconded by Frost to approve the amended Consent Calendar. Motion carried 5 -0. a. Approval of Warrants - Register No. 80 -10 -1 for $279,522.76. b. Alcoholic Beverage License: transfer of license to Xazem Xhoyloo, 9626 Base Line Road (Milanos) for on -sale beer and wine. c. Request for interdivisional fund transfer to accommodate overtime and additional intern assistance for completion of General Plan and related Planning projects. d. Authorization for City Manager and staff members and interested Council members to attend the League of California Cities Conference, October 19 -22. e. Authorization for City Manager and interested Council members to attend the 1980 Congress of Cities in Atlanta, Georgia, November 29 through December 3, 1980. f. Tract 9637: Annexation O1 to Landscape Maintenance District O1. Recommend approval by Resolution No. 80 -78 declaring the City's intention to annex Tract 9637 to Landscape Maintenance District No. 1 and setting a public hearing for November 5, 1980. RESOLUTION NO. 80 -78 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE ANNEXATION TO LANDSCAPE MAINTENANCE DISTRICT NO. 1, AN ASSESSMENT DISTRICT; DESIGNATING SAID ANNEXATION AS ANNEXATION 01; PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972; AND OFFERING A TIME AND PLACE FOR HEARING OBJECTIONS THERETO. g. Acceptance of Base Line Reconstruction Project. The Base Line Reconstruction Project has been completed to the satisfaction of Caltrans and the City Engineer. It is recommended that the Council approve acceptance of the project and authorize the City Engineer to file a Notice of Completion with the County Re- corder and release performance bonds. Vacation of Chestnut Street. It is recommended that November 5, 1980 be set for public hearing for the vacation of Chestnut Street from Hermosa to 1,350 ± feet west. RESOLUTION NO. 80 -91 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, DECLARING ITS IN- TENTION TO VACATE CHESTNUT STREET FROM HERMOSA TO 1,350 + FEET WEST AS SHOWN ON MAP NO. V -011 ON FILE IN THE OFFICE OF THE CITY CLERK. i. Street Improvement Waiver Request. Approval is requested under Ordinance No. 28 -A to postpone the requirement for immediate construction of street improvements for the split of a parcel currently occupied by two houses. The street im- provements were required as a condition of Parcel Map 5441. k. Award of Striping Contract: It is recommended that the City Council anvrove the award of the annual contract for street striping and pavement marking to Safety Striping Service of Anaheim, California, for $25,215.00. 1. SUBDIVISION ORDINANCE. Staff report by Jack Lam. Councilman Palombo requested that Council meet with the City Attorney regarding this item Councilman Mikels said that lie felt this was an important ordinance and should have several discussion meetings before its adoption. He also requested copies of all revisions to the State Subdivision Map Act. Councilman Bridge concurred with Councilman Mikels. Motion: Moved by Frost, seconded by Palombo to set Thursday, October 16 at 6:00 p.m. for a work session to discuss the Subdivision Map Act with staff. The City Attorney stated it would be necessary to adjourn the October 15 meeting to this special work session. Motion carried 5 -0. 5. CITY MANAGER'S STAFF REPORTS. 5A. REQUEST BY DONALD HOLLOWAY TO ADDRESS COUNCIL RELATING TO PROBLEMS WITH FLOODING AND EROSION OF HIS PROPERTY. Mrs. Holloway presented the problem they have encountered with their property at 8916 Camellia Court in Alta Loma. Their problem relates to a ravine which is adjacent to their property. It was a county -owned easement at the time they pur- chased their home. However, the County now claims this is within the City of Rancho Cucamonga. Water from a tract of homes built to the north has been diverted into this ravine. The excessive amount of water now in the ravine during stormy seasons has caused severe erosion to the Holloway property. The City Attorney recommended that the City first determine whether this easement is city property before proceeding. Motion: Moved by Bridge, seconded by Mikels to refer item to the City Engineer and City Attorney for investigation to determine the status of this easement and to report back to the Council in a public session. Motion carried 5 -0. Mayor Schlosser called a recess at 8:40 p.m. The meeting reconvened at 8:55 p.m. with all members of the staff and council present. 5B. REPORT ON THE STATUS OF THE MAINTENANCE MANAGEMENT PROGRAM. Mr. Tim Todd from Roy Jorgensen and Associates made an oral presentation of the management system that had been developed. After some discussion, Council thanked him for his report. 5C. AUTHORIZE SALE OF A PORTION OF HERITAGE PARR FOR CONSTRUCTION OF DEMENS CHANNEL. Motion: Moved by Bridge, seconded by Mikels to defer this item to the next meeting. Bridge said he did not like the way this was proposed and wanted to investigate this further. Motion carried 5 -0. 5D. CITY PARTICIPATION IN SAN BERNARDINO COUNTY MORTGAGE REVENUE BOND PROGRAM. Jack Lam turned the meeting over to Ann Siracusa, Director, Office of Community Development, San Bernardino County, who answered questions presented by the Council. After her presentation, Mayor Schlosser opened the meeting for public comments. There were none. Motion: Moved by Frost, seconded by Schlosser to approve Resolution No. 80 -92. The motion failed by the following vote: AYES: Frost, Schlosser. NOES: Mikels, Palumbo, Bridge. ABSENT: None. ATTORNEY'S REPORTS. There were none. 6 7. NEW BUSINESS. Mr. George Lyman, Cucamonga Service Club, presented the problem of drainage at Hellman and San Bernardino Road. Council directed staff to look into the problem and to report back to Council. Mt. Lyman brought up the refuse problem. Council said that they would discuss this at the October 15 meeting. B. ADJOURNMENT.
