The meeting was called to order at 7:02 p.m. by Mayor Phillip D. Schlosser who led in the pledge of allegiance. Present: Councilmen James C. Frost, Jon D. Mikels, Michael A. Palombo, Arthur H. Bridge, and Mayor Phillip D. Schlosser. Also present were: City Manager, Lauren M. Wasserman; Deputy City Attorney, Robert Dougherty; Assistant City Manager, Jim Robinson; Community Development Director, Jack Lam; City Engineer, Lloyd Hubbs; Finance Director, Harry Pmpey; Community Services Director, Bill Holley. Approval of Minutes of June 17, 1981. Motion: Moved by Mikels, seconded by Palombo to approve the minutes of June 17, 1981. Motion carried unanimously 5 -0. 2._ ANNOUNCEMENTS. a. Mayor Schlosser announced that the meeting would be ad]ourning to a legal session regarding pending litigation. 3. CONSENT CALENDAR. a. ORDINANCE NO. 148 (second reading) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, ADDING CHAPTER 8.10 TO TITLE 8 OF THE RANCHO CUCAMONGA MUNICIPAL CODE TO PROVIDE FOR A MOBILE HOME PARK RENT MEDIATION PROCESS. Motion: Moved by Mikels, seconded by Bridge to waive further reading. Motion carried unanimously 5-0. Mayor Schlosser opened the meeting for public hearing. Addressing Council were: Stephen White, attorney representing the park tenants. Mr. White had a list of comments and questions by the tenants which he presented. 1. Section 8.10.030, item J. He asked what the extent or limit was of that inquiry? Would this include the owners records and documents to see if the increase was really justified? Council concurred with a suggestion by Councilman Mikels that the owner provide the petitioners with information identified in "A" through "F ". Such changes were made in the Ordinance by the City Attorney. �y that if there were a language change, then this would require a new reading of the ordinance. Mr. Dougherty drafted the following language change: "The proposed rent increase when added to all rent increases which were effective during the 12 months immediately proceeding the effective date of the proposed rent increase computes to be a sum greater than seventy -five (75X) of the percentage by which the Los Angeles -Long Beach- Anaheim Area Consumer Price Index for Urban Wage Earners and Clerical Workers, as reported by the United States Bureau of Labor Statistics, has increased in the twelve (12) months immediately preceding the date of the most recently published CPI information." 3. Section 8.10.060. He asked if it had been discussed to have a moderator present? He felt that it might be advisable to have a facilitator present. The City Attorney explained that it was not the intent to require this at this stage, but that this does not preclude a moderator being present. The City Attorney said that some parks are owned by a corporation, and obviously they would appoint someone to represent the corporation. There was nothing to preclude the tenants committee from having an advisor present. He said the spirit of this was for an owner and tenant to meet person to person. Councilman Frost suggested that section 8.10.020 could be changed to reflect "a committee representing the tenants." The City Attorney concurred with the suggestion by Councilman Frost that section 8.10.020 should read "a co®ittee, representing the tenants." 4. Section 8.10.110, section A. Mr. White asked if this petition would be dismissed with prejudice? The City Attorney stated that if a meeting is not attended without a cause, then the petition would be dismissed. The intent was to be with prejudice. Also addressing Council were: Jack Emerson, resident of Chapparrel Heights. He had questions regarding the number of increases an owner could impose. Councilman Mikels explained there could be several as long as they did not exceed 75% of the CPI. Harry Pate, Alta Laguna resident. There being no further comments, Mayor. Schlosser closed the public hearing. The City Attorney reviewed the changes which the Council had made. City Clerk Wasserman read the title of Ordinance No. 148 again for first reading to include the changes, Motion: Moved by Palombo, seconded by Frost to waive further reading. Motion carried unanimously 5 -0. Mayor Schlosser set August 5 for second reading to include the Resolution and Agreement at the August 5 meeting. Mayor Schlosser called a recess at 8:20 p.m. The meeting reconvened at 8:35 p.m. with all members of Council and staff present. act am. City Clerk Wasserman read the title of Ordinance No. 151. ORDINANCE NO. 151 (second reading) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, REZONING ASSESSOR'S PARCEL NUMBER 202 - 181 -12, 21 (PORTION) GENERALLY LOCATED ON THE NORTHEAST CORNER OF ARCHIBALD AND BASE LINE, FROM R -3 (MULTI - FAMILY) TO R- 3 -P.D. (MULTI - FAMILY /PLANNED DEVELOPMENT). Motian: Moved by Palombo, seconded by Bridge to waive further reading of Ordinance No. 151. Motion carried unanimously 5 -0. Mayor Schlosser opened the meeting for public hearing. Addressing Council was: Jack Tarr, representing Diversified, requested Council to concur with the staff recommendations and approve the rezoning. There being no further public response, Mayor Schlosser closed the public hearing. Motion: Moved by Palombo, seconded by Bridge to approve the rezoning request and Ordinance No. 151. Addressing Council were: Max Hackett who lived on the corner of Ramona and Stafford. He said he had he had attended the Planning Commission meetings when they addressed the same issues of density and traffic flow. He also stated that neither he nor man;: of his neighbors had received a notice of tonight's meeting. As far as they were concerned, the issue had not been resolved by the Planning Commission to their satisfaction. John Klempner said they would be willing to give up the park which the developer was providing land for just to see that this development of 10 to an acre woul? not be built. Paul Byrnes said this area was designated medium density 5 -15 per acre. As far as the traffic issue, he felt the Planning Commission had adequately discussed this. Mr. Hackett said they had asked if this would not require a traffic signal, but they had never received an answer. Peggy Dablia said she was very concerned about the traffic Betty Core expressed concern over the traffic and density. There being no further response from the public, Mayor Schlosser closed the public hearing. Mayor Schlosser recommended that the residents talk with the developer before the second reading. Councilman Mikels suggested that enough time be set before the second reading so that adequate input could be received from all the neighbors and friends. Motion: Moved by Palombo, seconded by Bridge to set second reading for August 19. Motion carried unanimously 5 -0. 5. CITY MANAGER'S STAFF REPORTS. Mr. Wasserman requested that this item be set for August 5 meeting since it would be appropriate for a representative from Edison Company to be present to give this report. Council concurred. 5B. CONSIDERATION OF CITY COUNCIL APPOINTMENTS TO ADVISORY COMMITTEE FOR THE ETIWA.NDA SPECIFIC PLAN. Staff report by Lauren Wasserman. ADDED ITEM: RECOMMENDATION OF REDEVELOPMEIT SURVEY AREA. (Item had appeared on the Redevelopment Agency Agenda, but it was necessary that the Council make the survey area designation.) Manny DiDios, Consultant, presented the report and answered Council's questions. Motion: Moved by Mikels, seconded by Palumbo to approve the survey area as designated, approve Resolution No. 81 -112, and to waive the entire reading. Motion carried unanimously 5 -0. City Clerk Wasserman read the title of Resolution No. 81 -112. RESOLUTION NO. 81 -112 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, DESIGNATING A REDEVELOPMENT SURVEY AREA FOR STUDY PURPOSES. 6. CITY ATTORNEY'S REPORTS. Mr. Dougherty said there was a need to adjourn to a legal session following the meeting. 7. ADJOURNMENT. Motion: Moved by Palumbo, seconded by Frost to adjourn to a legal session not to reconvene this evening following the Redevelopment Agency business. Motion carried unanimously. The project will consist of 413 townhouse units, to be located between Archibald and Ramona, south of Church. In general, the project meets development and design standards; however, Staff is recommending several modifications which will effect pedestrian circulation, landscaping, fire access, and recreational facili- ties. Should the Commission concur with these modifications, conditional approval as recommended, would be appropriate. BACKGROUND: The applicant is requesting review and approval of a tentative tract map and a total development package consisting of 413 townhouse until to be located on about 40 acres of land located between Archibald and Ramona Avenues, south of Church Street CExhibit "A "). The project site is ;-acant, and is not in use at this time. However, there are a number of mature Eucalyptus trees and a Cedar tree located on the premises. The project site is zoned R -2, multiple family residential, and is designated for medium density residential (4 -14 du's /ac) on the City's General Plan. The proposed project density of about 10.8 dwellings per acre is therefore consistent with the General Plan. ANALYSIS: As noted above, the project will consist of 413 townhouse units Exhibit "B "). Each dwelling will have a two -car attached garage, and a private fenced patio. According to plans, all dwellings will be clustered in rows of 3 -6 dwelling units each, as follows: Tri -plex 7 (21 units) Four -plex 28 (112 units) Five -plex 2 (10 units) Six- lex 45 (270 units Total: 82 (,41J units. The main vehicular access point is located on Archibald Avenue, with 2 additional points of access on Ramona Avenue. In addition to the 2 -car garages, approximately 327 additional parking spaces will be provided in open areas and along the project streets and drives, resulting in parking ratiosof about 2.85 spaces per unit, which exceeds the minimum requirement. The pedestrian circulation within the project is comprised by a series of private sidewalks and walkways located throughout the project. However, the Design Review Committee is recommending that texturized pedestrian crosswalks be incorporated into the design of the project to connect dwellings with open space and recreational facilities, and that additional walkways be constructed to provide a continuous system. Conditions of ap- proval to that effect have been included in the Resolution for your consi- deration. The main recreational facilities are centrally located and include a swimming pool, spa, 2 tennis courts, and a recreation center. In addition, 2 smaller recreational areas consisting of a pool and a spa are proposed in the northerly and southerly portions of the project. In the southeast corner of the site -Z)I I J Staff Report TT 11663 -3- June 10, 1981 0 the applicant is proposing to construct a temporary retention basin to accomodate potential overflows, and to avoid possible flooding of Ramona Avenue. The retention basin will be fenced, (.Staff is requesting that wrought -iron fencing be provided rather than chainlink as originally proposed) and its perimeter will be heavily landscaped. The interior of the basin will be seeded with grass and will be used as a children's play area. If, at some point in the future, a master planned storm drain is constructed in the vicinity of the project and the need for the retention basin is eliminated, 8 additional dwellings (units no. 406 through 413) could be constructed and sold by the Homeowners Association. The use of the retention basin as a children's play area will provide a reasonable use at this open area when not used for retention purposes. However, such facilities are temporary. Therefore, Staff is recommending that additional children play areas be provided elsewhere in this project. According to the submitted plans, the applicant will be providing a sub- stantial amount of landscaping along Archibald Avenue, which has been designated as a Special Boulevard (Exhibit "C "). Structural setbacks along Archibald will be kept to a 35' minimum, with the average setback exceeding 40'. The setback area will be heavily landscaped and the existing mature Cedar tree will be preserved. Along Ramona Avenue, • standard structural setbacks of 25' will be provided. However, the appli- cant is proposing to construct private patios, bounded by walls not to exceed 42" in height, within the 25' setback area along portions of Ramona Avenue frontage. Along the westerly boundaries where the proposed development abuts the existing apartment complex and school, the landscape plan indicates a minimum of 15 feet of landscaping, including a substantial number of trees. However, the Fire District is requesting that 15 foot wide fire lanes be provided along these boundaries, eliminating all trees and shrubs in the process (Exhibit "B "). Staff has reviewed this alternative withthe Design Review Committee, and concluded that the total elimination of landscaping in these two critical areas is not acceptable. It is recommended that the site plan provide a minimum of 10 feet of landscaping, including shrubs and trees, at these locations, and that other alternatives of fire access and protection be explored with the Foothill Fire District. The Design Review Committee also reviewed the building elevations and architectural design of the project and was very satisfied with the style of the buildings and the amount of detailing incorporated into the design of the patio walls (Exhibit "D "). Color renderings and elevations of these buildings will be available for review and comment at the Planning Commission meeting. Attached is Part I of the Initial Study as completed by the applicant. Staff has completed Part II of the Initial Study, the Environmental Check- • list, and found no significant adverse impacts on the environment that could occur as a result of this project. Lewis received an A.A. from Los Angeles City College in 1939, a B.S. in Accounting from UCLA in 1941, and took graduate work in Business Administration at USC (1944- 1949). lie holds the distinction of passing the California bar examination (1952) without attending law school, having composed his own law course. Mr. Lewis is licensed in California as an attorney, a certified public accountant, a general building contractor, and a real estate broker. Prior to 1955, Mr. Lewis was engaged in the private practice of publi^ accounting and law in Los Angeles. He became recognized as one of the leading authorities on accounting and tax planning for the home building industry. He became a builder in 1955 in partnership with Robert A. Olin, and in 1957 he formed his own building company in partnership with his wife, Goldy. They and their four sons -- Richard, Robert, Roger, and Randall - -have since built more than 18,000 homes and apartment units. Today, Mr. Lewis oversees the operations of the Lewis companies, which develop real estate and build homes, apartments, offices, and commercial buildings in California and Nevada. He chairs the Boards of Directors of Republic Sales Co., Inc., Lewis Building Co., Inc., and Lewis Construction • Co., Inc. Mr. Lewis served a two -year term as a member of the nine -man California Commission on Housing and Community Development, having been appointed by Governor Brown in 1965. He chaired the Commission's Statistics and Research Committee and its Development Committee. As a Commissioner, Mr. Lewis made studies of housing problems in California, such as financing, building codes, subdivision controls, and housing for low- and moderate - income families, minorities, the elderly, and farm Workers. The Commission made field studies, held hearings, directed staff research studies, and proposed solutions to the Governor, the State Legislature, Federal agencies, and the Congress. Mr. Lewis was subsequently appointed to Governor Ronald Reagan's Task Force on the Home Building and Construction Industry. On a national level, Mr. Lewis is presently a National Director of the National Association of Home Builders (NAHB). He is a member of NAHB's Committee for Housing Low Income Families, of which he was Chairman in 1975, and has served on a number of NA1BS committees in the past. Most recently, in December 1978, he chaired an NAI18 committee which met with the staff of the Federal Office of Management and Budget to propose ways to simplify the paperwork and processing functions of government agencies such as FHA and VA. Ralph Lewis has .actively participated in education throughout his career. He has taught courses in accounting, taxation, and housing finance at USC, UCLA, and Los Angeles City College. The foremost of these is the need for citizens to participate in local government so that community input is spread throughout as large and as representative a base as possible. I believe that this is the most effective way to let governmental action reflect citizen desires. Second, I am concerned that Etiwanda is a volatile situation for planning due to high resident emotion concerning development. I think this was shown during meetings there on the General and Victoria Plan. Such a situation is, in my opinion, too adversarial to allow the sound and reasoned planning essential to accomodating all representative interests. Finally, I do not have a particular axe to grind except as a member of Myohoji Temple. Rev. Sakata, Chief Priest of the temple, has consistently advocated a reasoned and balanced approach to all questions impacting the temple. I believe that this approach could well serve for all planning in the Etiwanda area, and I would intend to represent such a view if allowed to serve as a member of the commission. If a conflict in the provisions of Exhibit "A" and Exhibit "8" result, the provisions of Exhibit a shall control, ARTICLE 11. CONSULTANT'S COMPENSATION ADD s'ETHOO OF PAYMENT Consultant shall receive compensation at the rates for services rendered pursuant to the Scope of Services of and in the amounts set forth in the aforementioned Exhibit "A" (M.S.[. Proposal) and Exhibit "B" (Hevisod Tinge Schedule) on a product /payment basis. The total compensation to be . paid consultant for such service shall not exceed $40,000 unless otherwise agreed to in writing by Agency and Consultant. Consultant will submit monthly invoices and a one page summary of progess to date, schedule timing, products completed, problems encountered and solutions achieved. Consultant's invoice shall be payable within twenty (20) days of submission, upon veri- fication of work progress and work product to date. ARTICLE 111. PERSONNEL Consultant represents that it has all personnel required to perform all services under this Agreement. Consultant's personnel shall not be employed by, nor have any direct contractual relationship, with the Agency. All ser- vices hereunder shall be performed by Consultant, its employees, or personnel under direct contract with Consultant. The personnel responsible for this contract and scope of services shall be: Project Manager - Manuel OeDios Team Coordinator - Abraham DeGios Engineering - Dwight French Environmental Planning - Joann Grudgen Citizen Participation /Relocation - Don Watson The project manager shall be responsible for not only the day -to -day work but shall attend all necessary meetings with the City and shall make all presentations required at public meetings. Responsible personnel listed in Article III shall be replaced only by consent of the City. ARTICLE IV, STANDARDS OF PERFORMANCE •^ "'- "' ^° Consultant shall comply with all applicable laws, ordinances and codes of the federal, state, and local governments Al le performing services pursuant to this Agreement. Consultant shall perform all services to be performed by it as described herein in a skillful and professional manner. Consultant shall comply with the directions of Lauren Wasserman, Executive Director Redevelopment Agency and Jack Lam, Deputy Director Redevelopment Agency. ARTICLE V. OWNERSHIP OF OOCIIME'1TS • All reports, files, and other material prel'ared under this agreement shall be and remain the Property of the Agoncy, and shall be delivered to the Agency upon Consultant's receipt of final payment of all services rendered and costs ue incurred and reimbursable as herein provided if not so delivered prior thereto. ARTICLE VI. OBLIGATIONS Consultant shall be an independent Consultant and shall not incur or have the power to incur any debt, obligation or liability whatever for or against the Agency. ARTICLE VII. TERM OF CONTRACT This contract shall remain in effect until September 30, 1982, unless other- wise extended by mutual agreement of the parties executing this Agreement or terminated earlier as provided for in Article VIII. ARTICLE Vlll. PENALTY If the services described in Exhibit "B" are not completed in a timely manner, as set forth therein, owing to the fault of the consultant and not a result _ of delays due to Acts of God, County, City, or Agency delays; and, if as a result the Ordinance adopting the Redevelopment Plan and certifying the EIR has not received second reading as of December 31, 1981; then the compensa- tion payable to the Consultant shall be reduced by the sum of $8 ,GDO, ih which sum, Goth parties agree, is reasonable as and for liquidated damages in such event. ARTICLE IA. TERMINATION The Agency may terminate this Agreement upon thirty (30) days' written notice sent certified mail, at the close of each work phase as described in Exhibit A. In the event of such termination by the Agency, Consultant shall be compensated for all services performed and expenses that have been mutually agreed upon to have been incurred to the date of notice of temi- nation, less any amounts previously paid by Agency. "Date of Tenminatiom shall be the date which is thirty (30) days following receipt of notice of termination, ARTICLE X. CONFLICT OF INTEREST Consultant represents and agrees that Consultant has not employed any person ® to solicit or procure this Agrnement other than employees of Consultant, and has not made, and will not make, any pdyrent or any agreement for the pay- - rent of any commission, percentage, brokerage, contingent fees, or other compensation in connection with the procurement of this Agreement. • ARTICLE XI. ENTIRE AGREEMENT This Agreement shall constitute the entire Agreement between the parties.
