HomeMy WebLinkAbout447 - Ordinances ORDINANCE NO. 447 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANfFK) CUCAMONGA, CALIFORNIA, APPROVING INDUSTRIAL SPECIFIC PIAN ~ 91-02, ESTABLISHING REGUIATIONS FOR RECYCLING OOTI,FCTION AND ~ING, AND MAKING FINDINGS IN SUPPOR~ THEREOF A. Recitals. (i) On April 10, 1991, the Plaruing Cnmmission of the City of Rancho Cucamonga conducted a duly noticed public hearing with respect to the above- referenced Lrrk~trial Specific Plan ~t. Follc~ing the conclusion of said public hearing, the Planning Commission adopted Resolution No. 91-36, thereby reczmmeraing that the City Council adopt Industrial Specific Plan Amerament No. 91-02. (ii) On May 15, 1991, the City Council of the City of Rancho Cucamonga conducted a duly noticed public hearing and concluded said hearing prior to its adoption of this Ordinance. (iii) All legal prerequisites prior to the adoption of this Resolution have occurred. Ordinance. The City Council of the City of Rancho Cucamonga ordains as follows: SECTION 1: This Council hereby specifies and finds that all of the facts set forth in the Recitals, Part A, of the Ordinance are true and SECTION 2: This Council hereby finds and certifies that the project ba-~ been reviewed and considered in c~mpliance with the California Environmental Quality Act of 1970, and further, this Council hereby issues a Negative Declaration. SECTION 3: Part III, Table III-1 is hereby amended to read, in words and figures, as shown on the attached Exhibit "A." Section 4: Part III, Table III-2, Section H is hereby added to read, in words and figures, as follows: H. MATERIALS EVERY FACILITIES (MRFs) Collection Facility: AEtivities typically include the acceptance by donation, redemption, or purchase of recyclable materials from the public for sorting and storage. Such a facility may involve aggregat- ing, weighing, and storing large amounts of material on-site, including bailing, compacting, or similar packaging operations for shipment. Outdoor storage may be permitted when approved by a Conditional Use Permit. Ordinance No. 447 Page 2 Processinq Facility: Activities typically include, but are not limited to: weighing, heating, melting, crushing, grinding, briquetting, mechanical sorting, shredding, stripping, cleaning, and remanufacturing. The finished materials are semi-finished or raw materials to be shipped for further manufacture or assembly. Such a facility may involve outdoor storage of laDge amounts of recyclable or processed materials. Scrap Operation: Activities typically include, but are not limited to: the storage and sale from the premises and/or dismantling of used, recyclable, or waste materials, except when such activities are part of a manufacturing operation. SECTION 5: Part III, Table III-2, Subsection D, land use type definition for "Scrap Operation" is hereby deleted in its entirety. SECTION 6: Part III, Section IV, Development Standards, Subsection J is hereby added to read, in words and figures, as shown in the attached Exhibit "B." SECTION 7: Appendix F is hereby added to read, in words and figures, as shown in the attached Exhibit "C." SECTION 8: Part IV is hereby amended to add "Collection Facilities" as a permitted use within Subareas 1-5, 8-11, and 13-15. SECT/ON 9: Part IV is hereby amended to add "Processing Facilities" as a conditionally permitted use within Subarea 5, 8-11, and 13-15. SECTION 10: The City Council declares that, should any provision, section, paragraph, sentence, or word of this Ord/nance be rendered or declared invalid by any final court action in a court of competent jurisdic- tion, or by reason of any preemptive legislation, the remaining provisions, sections, paragraphs, sentences, and words of this Ordinance shall remain in full force and effect. SECTION 11: The Mayor shall sign this ~ and the City Clerk shall cause the same to be published within fifteen (15) days after its passage at least once in the Inland Valley Daily Bulletin, a newspaper of general circulation published in the City of Ontario, California, and circulated in the City of Rancho Cucamonga, California. MATERIALS RECOVERY FACILITIES STANDARDS The purpose of Materials Recovery Facilities Standards is to establish minimum standards for screening, parking, noise, and litter control which meet the intent of the plan. Unless specifically modified through the Conditional Use Permit, all other development standards of the City of Rancho Cucamonga shall apply, including but not limited to, grading, drainage, and street improvements. J.1. All business operations shall be conducted within an enclosed building unless specifically permitted within the General Industrial and Heavy Industrial categories and adequately screened from public view pursuant to the Section A, General Provisions, for the Industrial Area; in particular, screening from the Ontario 1-15 Freeway shall be required. J.2. All facilities shall be maintained free of litter and vermin and any other undesirable material and shall be cleaned of loose debris on a daily basis. J.3. The facility shall meet the parking requirements for warehouse uses. In addition, stacking space shall be provided for six vehicles or the anticipated peak customer load, whichever ~s higher. If no drive-up facilities are available, than a minimum of six additional spaces for customer drop-off shall be provided. J.8. Power-driven equipment, including aluminum foil and can compacting or bailing, necessary for efficient temporary storage and shipment of material shalX be permitte~. Ordinance No. 447 Page 6 0 H "c ', APPENDIX F RECYCLING DEFINITIONS The following definitions are offered to provide clarification to technical terms relative to recyclable materials and recycling operations: Construction Waste - Construction and demolition debris, dredgings, grubbing from land clearing, rubble resulting from construction, remolding, repair, and demolition operations on housing, commercial buildings and other structures and pavements. D~mestics - A class for discards that occurs both in the home and in the work place; i.e., beverage containers and newspapers. Heavy Industrial Wastes - Waste derived from industrial or manufacturing operations such as ship building, construction, and demolition operations. Light Industrial Waste - Waste derived from research and development facilities and light manufacturing operations such as sem/conductors and computer manufacturers. Materials ]~ex7 Facilities (MRFs) - The point of extraction of valuable raw materials, which are then sold on the com~dity and scrap markets or are used as part of a manufacturing operation. Materials targeted are paper, plastic, glass, metals, textiles, and other goods deemed similar by the City Planner. RecTclables - Recyclables are discards or waste materials, that are collated, separated, or processed, and used as raw materials or products. Typically recyclables would include: domestics such as beverage containers and newspaper, cardboard, high grade paper, plastics, textiles, light industrial waste, or other similar materials. Rec~clables are not intended to include: chemicals, toxic water, heav~ industrial waste, ~etroleum, construction waste, unsorted garbage, heav~ metals, or other similar materials as determined b~ the Citx Planner. ~]/ng - The series of activities by which materials that would otherwise be disposed of, are collected, separated, or processed and used in the form of raw materials.
