A regular meeting of the Rancho Cucamonga City Council was held on Wednesday, August 4, 1999, in the
Council Chambers of the Civic Center, located at 10500 Civic Center Drive, Rancho Cucamonga, California.
The meeting was called to order at 7:0.9 p.m. by Mayor William J. Alexander.
Present were Councilmembers: Paul Diane, James Curatalo, Bob Dutton, Diiane Williams, and Mayor William
J. Alexander.

people in the community. He felt things are progressing forward.

Rick Gomez, Community Development Director, stated they are putting together a public information packet
to inform them about the entire Central Park process.

Enrique Espinosa, 8786 Center, reported he has a court date for August 20 and wanted to clari:fy
the only question is the units in the back, not the units in the front. He commented on a letter his
father received regarding his court date and the consequences if he was not present for that date.
Bill Makshanoff, Building Official, stated the reason the letter was sent is per the instruction of Judge Cote.
Norm MacKenzie, Chamber' of Commerce, invited the Council to attend the Chamber's yearly retreat for Y2K
planning.

F1,2, 3, 4. ,Jack Lam, City Manager, stated it is recommended that this be continued for two weeks.
Mayor' Alexander opened the meeting for public hearing. Addressing the City Council were:
Garth Br'andaw of Curry Brandaw stated they have had a neighborhood meeting where people could
come in and make comments about their project. He stated they have also had a meeting at the
Castle Gate project: to get input from the neighbors. Fie stated he feels they have received very
positive support from those attending the meetings.. He felt they have addressed the issues that
were brought up the last time this issue was before the Council.
Rick Gomez, Community Development Director, stated they would like to see the item continued to allow
for any additional input of those that were not able to attend the first set of meetings. He stated they would
like to continue this matter for two weeks to allow this additional input.
Mary Jo Gurley stated the people on the petition that: was previously submitted were not notified of
the meetings. She said she would like to talk to Mr. Brandaw. She talked about the traffic: that
would occur during the construction time and also talked about the number of employees who would
have to work at this facility once it was built.. She stated she did not feel this was the proper location
to build this type of facility, and felt other traffic improvements needed to be made.

A. CALL TO ORDER
An adjourned meeting of the Rancho Cucamonga City Council and the Rancho Cucamonga Community
Foundation was held on Tuesday, August 10, 1999, in the Tri C:ommunities Room of the Civic Center located
at 10500 Civic Center Drive, Rancho Cucamonga, California. The meeting was called to order at 4:35 p.m.
by Mayor William J. Alexander.
Present were Councilmembers: Paul Biane (arrived at 4:40 p.m), James Curatalo, Robert Dutton, Diane
Williams, and Mayor William J. Alexander.
Present were Foundation Members: Chuck Buquet, Patti Geye, Dawn Rae Granger, Sue McNiel, Sandra
Metel,. and Ann Punter.
Also present were: Jack Lam, City Manager; Diane O'Neal, Assistant to the City Manager; Kevin McArdle,
Community Services Director; Paula Pachon, Management Analyst II; Melissa Morales, Administrative
Secretary and Debra J. Adams, City Clerk

Mayor Alexander' administered the Oath of Office to Foundation Member Punter.
B2. DISCUSSION REGARDING GOALS AND OBJECTIVES FOR THE RANCHO CUCAMONGA
COMMUNITY FOUNDATION
Staff report presented by Kevin McArdle, Community Services Director.
Foundation Chair Buquet stated he has been named the Chair of the Community Foundation. He stated the
list of priorities is not a rubber stamp but added each member has put a lot of thought into this. He hoped that
the Foundation could really help the City. He stated the list is a first cut.
Foundation Member Geye stated they want to be unified with the City Council and the community. She felt
having staff's assistance would help them to achieve their goals
Mayor Alexander stated he: felt Performing Arts is very important. He felt they should focus on a small thing
first instead of going after something that is very big

Foundation Chair Buquet continued to go through the attached list of possible goals and explained them to
the Council.
Foundation Member Geye stated right now no one really knows about them and that they need to make
themselves known throug~ an event to raise funds.
Councilmember Biane inquired how much money' they have in their bank account.
Foundation Member Geye stated they have $18,,579 in their account.
Councilmember Biane asked if the tax exempt status issue had been worked out so that is now legal to use
staff time to he~p them.
Councilmember Dutton stated it was resolved when he was part of the Foundation which is when this was
first a question. He continued to comment about the previous funds that the Board had set up and explained
what they were.
Councilmember Biane asked if these different funds that were, set up are included in the $18,579 amount.
Foundation Member Geye, Foundation Treasurer, stated yes and commented how the money was broke out
into the various funds~
Councilmember Dutton stated he likes the work that he sees so far and complimented them for taking on the
challenge.
Mayor Alexander asked if resources have been identified where they can get funds.
Foundation Chair Buquet stated not formally, but felt: they will get more into this at their September meeting.
Foundation Member Granger stated she has been doing some research or~ grants available and will bring that
information back to the Foundation Board at its next meeting.
Councilmember Biane asked what the City can do towards the grant writing program.
Kevin McArdle, Community Services Director, stated he and Dave Moore, Recreation Superintendent, would
be able to provide staff time to help in this area He talked about his other staff that would also provide
support to the Foundation, which would not affect its nonprofit status.
Foundation Chair Buquet stated he felt the Foundation would work in concert with some of the Library
Foundation"s goals as well.
Councilmember Biane stated he wants to make sure the Foundation knows they can use City staff resources
to get things done.
Foundation Chair Buquet stated they do realize this.
Mayor Alexander suggested they provide an update to the City Council every 90 days on their
accomplishments and progress.
Foundation Member McNiel felt this would be a good way to measure their progress.

Mayor Alexander stated he is glad that previous nonprofit issues are resolved and that staff can now assist
the Foundation Board.
Foundation Member Punter stated she wanted to make sure that the wheel isn't reinvented and did not want
to waste staff's time. She felt Performing Arts is a good goal for them to work on.
Councilmember Williams felt the Foundation can be used as a conduit for raising funds through various
projects or events.
Foundation Member Granger added she and Foundation Member Metel could do some of the grant writing
because of their previous experience.
Jack Lam, City manager, stated staff is available to help the Foundation, but if the Foundation has experience
they can go ahead and do a project with staffs help if needed.
Councilmember Dutton explained that Mike Mitchell worked with Jim Markman on clearing the nonprofit issue
up and that it: is not a problem any longer so the Foundation will not lose their tax exempt status by using
staffs help.
Foundation Chair Buquet ,.stated they want to make a contribution and make a difference. He stated this is
a partnership between the Council and the Foundation.
Foundation Member Geye stated they like being aligned with the Community Services Department and felt
that gives them strength.
Councilmember Curatalo stated he doesn't know if it is a good idea just to focus on Performing Arts.
Councilmember Dutton stated the previous Foundation had talked about having a Founder's Day Ball in
conjunction with all of the other Founder's Day activities. He asked that they take a look at implementing this.
Councilmember Williams stated a Founder's Day Ball 2000 is a reachable goal.
Mayor Alexander suggested the Council and Foundation meet on an annual basis to see how they are
progressing:.
Foundation Member Geye stated they could come to a City Council meetling and give a report how they are
doing which would give them more exposure to the community.
Foundation Chair Buquet stated they could on a quarterly basis 9ive an update to the Council at their regular
meetings.

RECOMMENI)ATION:
It is recommended that the City Council approve the plans and specifications for the construction of
Landscaping and Irrigation lbr the Metrolink Corridor Beautification Project between Archibald and Haven
Avenues and approve the attached resolution authorizing the City Clerk to advertise "Notice Inviting Bids."
BACKG ROUNI)/ANA LYS IS:
in 1998, the City was successtiff in oNaining a grant from the State of California Environmental
Enhancement and Mitigation Program in the amount of $103,2.17 for the bcautification of the Metrolink
Corridor from Archib.akt Avenue to I lavcn Avenue. The City's contribution towards the construction is
$91,783, mainly for an upgraded irrigatkm system to better sustain the plantings ofthe grant. Also, the City
intends to use volunteers to plant trees ilar the project.
The subject project plans and specifications have been completed and approved by tile City Engineer. The
Engineer's estimate for construction is $195,000. Adequate funding is currently budgeted in Account
Nos. 21-4647-9813 and 10-4637-9813. Legal advertising is scheduled for September 7,. 1999, and
September 14, 1999, with tile bid opening schcdtflcd for Tuesday, September 2 I, i 999.

HAVEN AVENUES IN THE CITY OF ILANCI--tO CUCAMONGA
AND AUTHOP,.IZING AND DIRECTING THE CITY CLERK TO
ADVERTISE TO RECEIVE BIDS
WHER.EAS, i.t is the intention of the City of Rancho Cucamonga to construct certain
improvements in the City of Rancho Cucamonga.
WHEREAS, the City of Rancho Cucan~onga has prepared plans and specifications for the
construction of certain improvements.
NOW, THEREFORE, BE IT RESOLVED that tile plans and specifications presented by the
City of Rancho Cucamonga be and are hereby approved as the plans and specifications for
"Metrolink Corridor Beautification Project between Archibald and Haven Avenues."

advertise as required by law tbr the receipt of sealed bids or proposals for doing the work specified

PREVAILING WAGE: Notice is hcrcby given that in accordance with the provisions of Califomia
Labor Code, Division 2, Part 7, Chapter 1, Articles I and 2, the Contractor is required to pay not less
than the general prevailing rate ofpcr diem wages tbr work of a similar character in the locality in
which the public work is pcrtbnncd, and not less than the general prevailing rate ofper diem wages
for holiday and overtime work. In that regard, the Director ofthe Department of Industrial Relations
of the State of California is required to and has determined such general prevailing rates ofper diem
wages. Copies of such prevailing rates of per diem wages are on file in the office of the City Clerk
of the City of Rancho Cucamonga, 10500 Civic Center Drive, Rancho Cucamonga, California, and
are available to any interested party on request. The Contracting Agency also shall cause a copy of
such determinations to be posted at the job site.

Pursuant to provisions of I,abor Code Section 1775, the Contractor shall tbrfcit, as penalty to the
City of Rancho Cucamonga, not more than twenty-five dollars ($25.00) for each laborer, workman,
or mechanic employed for each calendar day or portion thereof, if such laborer, workman or
mechanic is paid less than the general prevailing rate o17 wages hereinbefore stipulated for any work
done under the attached contract, by him or by any subcontractor under him, in violation of the pro-
visions of said Labor Code.
Attention is directed to the provisions in Sections 1777.5 and 1777.6 of the Labor Code concerning
the employment of apprentices by the Contractor or any subcontractor under him.
Section 1777.5, as amended, requires the Contractor or subcontractor employing tradesmen in any
apprenticable occupation to apply to the joint apprenticeship committee nearest the site of the
public works project and which administers the apprenticeship program in that trade for a certificate
of approval. The certificate ,,,,,ill also fix the ratio of apprentices to journeymen that will be used in
the performance ofthe'contract. The ratio of'apprentices to journeymen in such cases shall not be
less than one to five except:
When unemployment in the area of coverage by the joint apprenticeship committee
has exceeded an average o1:' 15 percent in the 90 days prior to the request of
certi ticate, or
When the number oFapprcnticcs in training in the area exceeds a ratio of one to five,
or
Wllcn the trade cun show that it is replacing at least 1/30 of its membership through
apprenticeship training on an annual basis statewide or locally, or
When the Contractor lwovidcs cvidcnc:e that he employs registered apprentices on all
of his contracts o~ an annual average of not less than one apprentice to eight
journeymen.
The Contractor is required to make contributions to funds established for the administration
ofapprenticeship programs if he employs registered apprentices or journeymen in any apprenticable
trade on such contract.,; and iF other Centfactors on the public works site are making such
contributions.
The Contractor a~d subcontractor tinder him shall comply with tile requiremerits of Sections

dollars ($25.00) for each laborer, workman, or mechanic cmploycd in the execution of the contract,

Contractor agrees to pay travel and subsistence pay to each workman needed to execute the

RECOMMENDATION
The Park and Recreation Commission recommends that the City Council approve the revised banner
policy eliminating limit to number of banners to be displayed annually per location.
BACKGROUND/ANALYSIS
Annually the Community Services Department requests applications for banner displays on Baseline
Road and Archibald Avenue. The policy regulating the display of banners has been in effect for the
past eight years. During this period, the number of requests for banner displays has increased
annually. For this reason, the Park and Recreation Commission is requesting a policy change by
eliminating the current limit of ten special event banners per banner display location per year.

PURPOSE: To establish guidelines for the selection of events for marketing through street
banners and procedures for the display of said banners.
GENERAL POLICY AND RULES:
Definitions:
1. Community-Wide Event. Open to General Public:
Events which the entire City is encouraged to be involved in or invited to.
2. Significance to the City's Heritage:
Events that promote, enhance or portray the City's history.
3. Sponsored by the City:
Events or activities provided and sponsored by the City of Rancho Cucamonga.
Duration: Only tcn Limited to approved number of special event banners per location are
permitted each calendar year and may be displayed for a period up to two weeks. The
City reserves the right to take any and all tcrrdisplay periods.
Procedure:
1. Obtain City banner application from Community Services Department.
2. Return application and corresponding fees to Community Service Department before
August 1 of each year. Fees should be made payable to the City of Rancho Cucamonga.
3. Only applications which are fully complete will advance to the approval process.

1. Application must fulfill both of the following conditions to be considered by the Park and
Recreation Commission and City Council.

If the above conditions are met, the application will be submitted, along with all other
applications, to the Park and Recreation Commission.
The Commission will review all applications at their August Commission meeting and
forward their recommendations to the City Council for final approval. During the review
process, when two applications have conflicting or overlapping dates. The applicants
will need to chose which banner location is preferred and only one banner from each
application will be flown. The City will always take priority in determining the preferred
site if they are one of the conflicting applications. If 'the conflict or overlap can be
resolved by flying the banners for a shortened amount of time, then the Commission will
make that recommendation to Council, i.e., applicant submits for two weeks which
creates conflict, so Commission limits use to one week.
Final approval will occur at the next Council :meeting following the monthly Park and
Recreation Commission meeting.
Applications 'for events which occur after the filing deadline will be considered on a
case-by- case basis by City Administrative Staff. These requesters will be included in
the notification process and required to meet the policy deadline ibr the next annual
application cycle.
Once final approval has been obtained, Community Services Department staff will notify
applicant on the status of their application.
Terms & Conditions:
No banner can be made or displayed in advance of final approval by the City Council or
Administrative Staff. The City assumes no liability or costs for banners which applicant
has made prior to final approval by the City Council or Administrative Staff.

Three feet high by thirty feet long.
Is limited to event name, date, time and location of the event, logo, admission
fee, slogan or message. Wording should be kept to a minimum so passerby
can view quickly.
Be able to withstand elements for a two week period of time.
Display of a banner will not exceed two weeks. No banner will be allowed to fly after
the event as passed unless the event is on a weekend and City crews are not scheduled
until Monday.

The City will be responsible tbr the installation and removal of the banner. The City is
not responsible for sign damage occurring during the installation, display and removal
of the banner.
5. The City reserves the right to take down any banner which has become a hazard to the
public.
If desired by the applicant, the City will have the banner made by a vendor. Applicant
is responsible fbr paying in advance for the banner production. If banner is donated, the
sign age cannot be created until after the approval process is finished.
7. Banners should be delivered to the City's Corporate Yard, 9 t 53 Ninth Street, Monday
thru Friday from 8:00 a.m. to 5:00 ip.m.
Banners cannot be installed by City crews until a representative of the Community
Services Department has checked the banner for compliance with the Banner Policy and
corresponding approved application.
9. No changes in the approved banner message can be made once approved by the City
Council or Administrative Staff.
10. The City reserves the right to refuse installation of banners that do not meet the approved
application. The applicant forfeits all money and expenses incurred in such sign age.
11.
Banners once removed from their location will be available for pick up at the City's
Corporate Yard, 9153 Ninth Street, Monday thru Friday, from 8:00 a.m. to 5:00 p.m.
Any unclaimed banners will be discarded after two weeks.
12.
Banners can be reused annually if the sign age is in good repair as determined by
Community Services and Engineering Departments Staff. The organization will still
need to apply annually via the Banner Policy Procedure for banner display.

RECOMMENDATION
The Park and Recreation Commission recommends that the City Council approve the attached street
banner applications and schedule for Fiscal Year 1999/2000.
BACKGROUND/ANALYSIS
Annually the Community Services Department requests applications for banner displays on Base
Line Road and Archibald Avenue. The only new applications for Fiscal Year 1999-2000 are that
from the Rotary Club for "Grape Day at Winery" and from the Police and Fire Departments for
"Summer Games 2000." The Rancho Cucamonga Chamber of Commerce did not submit a banner
display for the Grape Harvest Festivak Staff had followed up with the Chamber; however, the
Chamber had not selected an event date and could not anticipate a banner display date. Attached is
a schedule of banner displays for Fiscal Year 1999-2000.

General City and Etiwanda Area Master Plan Drainage Reimbursement Agreements are based on the net

agreements, $109,920.00 of the $439,651.36 received from last year's General City revenue and $12,970.00
of the $25,931.86 received from last year's Etiwanda revenue need to be need to be appropriated for
reimbursements. The remaining funds will be utilized for City projects.

Wt-tEREAS, the City Council of the City of Rancho Cucamonga, California, has previously
tbrmed a special maintenance district pursuant to tile terms of the "Landscaping and Lighting Act
of 1972", being Division 15, Part 2 of the Streets and Highways Code of the State of California, said
special maintenance district known and designated as Landscape Maintenance District No. 3B, Street
Lighting Maintenance District No. i and Street Lighting Maintenance District No. 6 (hereinafter
referred to as the "Maintenance District"); and
WHEREAS, the provisions ofArticle 2 of Chapter 2 of the "Landscaping and Lighting Act
of 1972" authorize the annexation of additional territory to the lVlaintenance District; and
WHEREAS, at this time the City Council is desirous to take proceedings to annex the

That the City award the contract for the services specified below for the 1999 Founder's Day Parade to
Pageantry Productions in the amount of $7,958.11
BACKGROUND AND ANALYSIS:
The City's Annual Founder's Day Parade and Celebration is scheduled for Saturday, November 1:3,
1999. The parade, which beings at 9:30 a.m., will feature 150 entries that include bands and drill
squads, equestrian groups, floats, youth organizations, and novelty acts. The parade theme is "The
Magical World of Kids." Emphasis this year has been placed on uniting the Parade and Celebration
Events, by making adjustments to the parade route and moving the Celebration to Red Hill Park. By
uniting the events, more public enthusiasm can be generated to result in stronger participation for both
events.
The parade route will remain the same, but the parade will be run from East to West on Base Line Road,
beginning at Archibald and ending near the park. This change allows participants and spectators to more
easily make the transition from one event to the other. The Celebration will focus on family-style
entertainment with interactive games and contests, music, more food variety and entertainment, all in
a relaxing park atmosphere. There will be lots of opportunities for children to be entertained and join
in on the fun. The awards ceremony for the parade will also be held during the Celebration.
The City has contracted parade services for the past eight years with Pageantry Productions, a Long
Beach special events company. Pageantry provides the following services to the City: design and
mailing of parade applications, receipt of'all entries, parade line up, script, awards, judges, automobiles
for dignitaries, announcer and public address system for main reviewing stand, provides staff on parade
day in the formation area and coordinates all aspects of the parade with the City. City staff makes all the
logistical arrangements fi)r the parade (street closures, police, resident notifications, etc.)

and connections make them the ideal choice for the City. Our working relationship with them in the past
has been exemplary.

APPROVAL OF AN AMENDMENT TO SECTION 25 OF THE AMENDED AND
RESTATED LEASE AGREEMENT (CO92-064) BETWEEN THE CITY OF
RANCH() CUCAMONGA AND VALLEY BASEBALL CLUB, INC., RELATING
TO SECURITY (AMENDMENT NO. 1)
RECOMMENDATION
It is recommended that the City Council approve an amendment to Section 25 of the Amended and
Restated Lease Agreement between the City of Rancho Cucamonga and Valley Baseball Club, Inc.,
relating to security (Amendment No. 1).
BACKGROUND/ANALYSIS
At the City Council Meeting on August 18, 1999, the Council approved the Amended and Restated
Lease between the City and Valley Baseball Club, Inc., which will permit the Quakes Professional
Baseball Team to continue to play in the Epicenter until 2012.
During final negotiations of the amended lease, Valley Baseball Club, Inc., originated the request
that they be allowed to assume responsibility for non-game after hours security at the Epicenter and
it's adjoining lhcilities. Currently the City provides for this security and a portion of the total costs
are reimbursed by the Quakes. The Quakes have requested to provide this service at their sole cost,
potentially in an amount which is less than they are now paying to the City.
To provide for this change, the City Attorney ihas prepared the attached lease amendment (Exhibit
No. 1) for City Council consideration. This amendment outlines the specific duties and requirements
necessary for security at the Epicenter which are all consistent with the level of service the City is
currently providing through a contract security guard company.
At the time this report was prepared, Valley Baseball Club, Inc., had not yet signed the proposed
amendment. Staff is anticipating that they will sign the proposed amendment prior to the September
1 st City Council Meeting.

FISCAL IMPACTS
The Quakes will assume the total cost of providing the required security services at the Epicenter.
This change will result in an expenditure reduction to the City of approximately $5,000.00 per year.
This equates to the difference between the City's actual costs of providing the service and the
amount which the Quakes are required to reimburse the City.

EXHIBIT "A"
TO AMENDED AND RESTATED LEASE BETWEEN THE CITY OF
RANCHO CUCAMONGA ("CITY" HEREINAFTER) AND VALLEY BASEBALL
CLUB, INC. ("TENANT" HEREINAFTER).
A. Recitals
(i) During August 1999, City and Tenant entered into the above-referenced
Amended and Restated Lease ("the Lease" hereinafter).
(ii) Paragraph 25 of the [,ease requires that City provide security for the
Stadium during certain time periods and City now does so by contracting with a private
company which provides such services to the Stadium and adjoining playing fields,
parking lots, maintenance building, and animal shelter.
(iii) Tenant currently reimburses City for a portion of City's costs incurred in
supplying the security services refen'ed to in Recital (ii) above.
(iv) Tenant denies to assume responsibility to provide the services discussed
herein as of January 1, 2000.
B. Amendment No. 1.
NOW, THEREFORE, the parties hereto agree as follows:
1. Paragraph 25 of the Lease hereby is amended as follows:
Effective January 1, 2000, and continuing through the term of the Lease, Valley
Baseball, Inc. will be responsible for providing security guard services to the Stadium
and adjoining facilities in a manner and quality equal to, or greater than, City is currently
providing. This security guard service will be provided by Valley Baseball, Inc. at the

sole cost and expense of Valley Baseball, Inc. The parties understand that Valley
Baseball, Inc. may contract with an independent security guard service to discharge its
above-described obligations.
In order to provide security guard services in a manner at least equal to City's
current service, Valley Baseball, Inc. shall be responsible for provided the following
service levels and requirements, at a minimum:
SCOPE OF SERVICES:
Security guard shall be responsible for patrol and supervision of the Stadium,
three (3) softball fields, one (1) baseball field, two (2) soccer fields, all parking lots,
maintenance building/yard and Animal Shelter located on or near the premises. Patrols
of each area shall be conducted on at least an hourly basis. Security guard shall be visible
at all times. Guard shall provide a regular patrol of all facilities, observe suspicious
vehicles and/or visitors and immediately report any violations of law to the Rancho
Cucamonga Police Department. In the case of vandalism, security guard shall
immediately report the same to the City's Public Works maintenance personnel. The
patrol route of the security guards will be subject to the approval of City to insure
adequacy.
SECURITY GUARD SCHEDULE:
Hours of security guard services shall include, but not be limited to:
From the completion of any event conducted at the Stadium until dawn of the
following day.
From dusk of a weekday upon which no event is conducted at the Stadium until
dawn of the following day; and
For all twenty-four (24) hours of each Saturday, Sunday, and Holiday when no
event is conducted at the Stadium.
REQUIRED SECURITY GUARD EQUIPMENT:
The security guard shall be provided with the following equipment, at a
minimum:

SECURITY GUARD MINIMUM REQUIREMENTS:
All security guards must meet the following minimum requirements:
Guard must: have completed high school.
Guard must possess, or have applied for a State Guard License.
Guard must be able to comprehend directions and instructions provided and be
able to fill out forms and write reports required in the performance of his or her duties.
Guard must pass required criminal and civil background checks.
Guard must be certified in the use of pepper spray and/or mace and shall carry the
same while on duty.
REQUIRED TRAINING:
Valley Baseball, Inc. shall provide security guards with the appropriate training
required including, but not limited to, the following:
Patrol requirements and procedures.
Facility fire protection systems, protective alarm systems and access control
systems.
Legal authority, responsibility, and limitations.
Communications requirements, equipment, and responsibilities.
Handling of special problem and emergency situations.
Tenant shall be responsible for providing all necessary security for the Stadium at
each and every Class A baseball garne held at the Stadium. Tenant agrees to use such
security officers in type and amount described in Exhibit "E" hereto. It is anticipated that

four (4) police officers shall be required for forty-seven (47) weekday games, five (5)
police officers for twenty-three (23) weekend games and seven (7) police officers for the
July 4 game. During each year of the term hereof, Tenant shall pay for security costs
calculated in accordance with Exhibit "E" hereto in five (5). equal installments at the
same time as minimum annual rent shall be paid. Notwithstanding any other term or
provision contained in this Section, security shall be provided in accordance with the
above-referenced criteria, and should attendance compel the employment of officers in
addition to those referred to above, Tenant shall reimburse City for the cost of providing
such additional officers within thirty (30) day of City providing to Tenant a statement
reflecting such additional costs.
2. Other than as expressly amended hereby, the Lease and each and every term and
provision thereof shall remain in full force and effect.

DEVELOPMENT DISTRICT AMENDMENT 99-02, A PROPOSAL
TO CHANGE THE DEVELOPMENT DISTRICT DESIGNATION
FROM LOW RESIDENTIAL (2-4 DWELLING UNITS PER ACRE)
TO LOW-MEDIUM RESIDENTIAL (4-8 DWELLING UNITS PER
ACRE), FOR APPROXliMAT'ELY 5.1 ACRES OF LAND, LOCATED
ON THE SOUTHEAST CORNER OF HERMOSA AVENUE AND
19TH STREET, AND MAKING FINDINGS IN SUPPORT THEREOF

RECITALS.
1.
The applicant, Curry Brandaw Architects, has filed an application for
Development District Amendment No. 99-02 as described in the title of this
Ordinance. Hereinafter in this Ordinance, the subject Development District
Amendment is referred to as "the application."
2. On May 12, and June 9, t999, the Planning Commission of the City of Rancho
Cucamonga recommended approval of the associated General Plan
Amendment No. 99-02 to change the Land Use Map from Low Residential (2-4
dwelling units per Acre) to Low-Medium Residential (4-8 dwelling units per acre)
for the property located at the southeast corner of Hermosa Avenue and 19th
Street.
3. On May 12, and June 9, 1999, the Planning Commission of the City of Rancho
Cucamonga conducted a duly noticed public hearing on this application.
4. On August 18, 1999, the City Council of the City of Rancho Cucamonga
approved the associated General Plan Amendment No. 99-02 to change the
General Plan Land Use Map from Low Residential (2-4 dwelling units per acre)
to Low-Medium Residential (4-8 dwelling units per acre) for property located at
the southeast corner of 19th Street and Carnelian Avenue.
5. On July 7, and continued to August 4, and August 18, 1999, the City Council of
the City of Rancho Cucamonga conducted a duly noticed public hearing on the
application.
6. All legal prerequisites prior to the adoption of this Ordinance have occurred.
ORDINANCE.
The

City Council of the City of Rancho Cucamonga does hereby ordain as follows:
This Council hereby specifically finds that all of the facts set forth in the Recitals,
Part A, of this Ordinance are true and correct.
Based upon the substantial evidence presented to this Council during the
above-referenced public hearing on July7, August 4, and August 18, 1999,
including written and oral staff reports, together with public testimony, this
Council hereby specifically finds as follows:

a. The application applies to a single parcel of land totaling
approximately 5.1 acres, with a rectangular shape, located on the
southeast corner of Hermosa Avenue and 19th Street and is
presently improved with a single family house and citrus groves.
Said property is currently designated as Low Residential (2-4
dwelling units per acre); and
b. The properties to the north of the subject site are designated
Low-Medium Residential (4-8 dwelling units per acre) and are
improved with a single family residential project. The property to the
west is designated Low Residential (2-4 dwelling units per acre) and
is developed with a single family residential project. The property to
the east is designated Low Residential (2-4 dwelling units per acre)
and is improved with a single family home. The properties to the
south are designated as Open Space and are developed with a park
and school; and
c. This amendment does not conflict with the Land Use Policies of
the General Plan and will provide for development within the district
in a manner consistent with the General Plan and with related
development upon the approval of General Plan Amendment; and
d. This amendment promotes the goals and objectives of the
Development Code; and
e. This amendment would not be materially injurious or detrimental
to the adjacent properties and would not have a significant impact on
the environment nor the surrounding properties.
Based upon the substantial evidence presented to this Council during the
above-referenced public hearing and upon the specific findings of facts set forth
in paragraphs 1 and 2 above, this Council hereby finds and concludes as
follows:
a. The subject property is suitable for the uses permitted in the
proposed district in terms of access, size, and compatibility with
existing land uses in the surrounding area; and
b. The proposed amendment would not have significant impacts on
the environment nor the surrounding properties; and
c. The proposed amendment is in conformance with the General
Plan by the adoption of General Plan Amendment 99-02.
4. Based upon the facts and information contained in the proposed Mitigated Negative
Declaration, together with all written and oral reports included for the environmental assessment
for the application, the City Council finds that there is no substantial evidence that the project will
have a significant effect upon the environment and adopts a Mitigated Negative Declaration and
Monitoring Program attached hereto, and incorporated herein by this reference based upon the
findings as follows:

a. That the Mitigated Negative Declaration has been prepared in
compliance with the California Environmental Quality Act of 1970, as
amended, and the State CEQA guidelines promulgated thereunder;
that said Negative Declaration and the Initial Study prepared
therefore reflect the independent judgment of the City Council; and,
further, this Council has reviewed and considered the information
contained in said Mitigated Negative Declaration with regard to the
application.
b. Although the Mitigated Negative Declaration identifies certain
significant environmental effects that will result if the project is
approved, all significant effects have been reduced to an acceptable
level by imposition of mitigation measures on the project which are

¢. Pursuant to the provisions of Section 753.5(c) of Title 14 of the
California Code of Regulations, the Planning Commission finds as
follows: In considering the record as a whole, the Initial Study and
Mitigated Negative Declaration for the project, there is no evidence
that the proposed project will have potential for an adverse impact
upon wildlife resources or the habitat upon which wildlife depends.
Further, based upon the substantial evidence contained in the
Mitigated Negative Declaration, the staff reports and exhibits, and
the information provided to the Planning Commission during the
public hearing, the Planning Commission hereby rebuts the
presumption of adverse effect as set forth in Section 753.5(c-l-d) of
Title 14 of the California Code of Regulations.
Based upon the findings and conclusions set forth in paragraphs 1,2, 3, and 4
above, this Council hereby approves Development District Amendment 99-02
to change the Land Use Map for the subject properties to Low-Medium
Residential (4-8 dwelling units per acre), as shown on the attached Exhibit "A."
6. The City Clerk shall certify to the adoption of this Ordinance.

It is recommended that the City Council:

requires additional time.

(Central Park) and the proposed debt issue.
BACKGROUND/ANALYSIS:
The City Council has begun the necessary proceedings to tbrm a Citywide community facilities
district to pay tbr the construction of capital improvements and operations and maintenance for a
portion of Central Park. The proposed Central Park project consists of approximately 100 acres, and
is described roughly as that property on the north side of Base Line Road from Milliken Avenue
west to Deer Creek Chinreel.
On July 21, 1999, the C:ity Council adopted Resolution No. 99-164,, which declared the City
Council's intent to establish City of Rancho Cucamonga Community Facilities District No. 99-1
(Central Park) and set a public hearing for September 1, 1999 on the proposed formation of the
District.

On July 21, 1999, the City Council also adopted Resolution No. 99-165, which also declared the
City Council's intention to issue bonds in a an aggregate principal amount of not to exceed $30
million and set a Public Hearing for September 1, 1999 on the proposed issuance of bonds.
Pursuant to Resolution No. 99-164, the City's Special Tax Consultant and Engineer, Willdan
Associates, has filed a report with the City Clerk which contains a description of the public facilities
and services proposed to be financed fixrough the levy of a special tax within the District and an
estimate oftlhe cost of providing those facilities and services, including incidental expenses. The
report is on file in the office of the City Clerk and has been open to public review.
Pursuant to tlhe California Environmental Quality Act ("CEQA") and the City's Local CEQA
Guidelines, the City staff prepared an Initial Study of the potential environmental effects of the
proposed formation of Community Facilities District No. 99-1, the calling of an election for a special
tax to fund development of Central Park, taking other actions to implement the District and the
eventual construction and operation of Central Park, all of which actions are referred to herein as (the
"project"). A more complete description of the project is contained in the Initial Study and is
incorporated herein by retErence.
Based upon the findings contained in the Initial Study, including the imposition of mitigation
measures, City staff determined that there was no substantial evidence that the project could have
a significant effect on the environment. Based on that Study, a Mitigated Negative Declaration has
been prepared. In addition, a Mitigation Monitoring Program for the Mitigated Negative Declaration
that has been prepared pursuant to the requirements of Public Resources Code Section 21081.6.
City staff has provided public notice of the public comment period and of the City's intent to adopt
the Mitigated Negative Declaration by a statutory notice published at least 20 days prior to the
hearing on this matter. An additional notice will be published providing notice of the date at which
the Mitigated Negative Declaration will be considered and when other actions are proposed to be
taken with respect to the project.
The Initial Study, Mitigated Negative Declaration, Mitigation Monitoring Program and all other
materials which constitute the record of proceeding upon which the City Council's decision will be
available for public review in the City Clerk's Office.
Prior to acting; on a resolution to establish the Community Facilities District, the City Council should
review the Mitigated Negative Declaration and the Mitigation Monitoring Report and adopt a
resolution approving those documents. Upon approval of the Mitigated Negative Declaration, the
City Clerk will :file a Notice of Determination with the County Clerk and commence a thirty-day
statue of limitations period to challenge the Cit:y's determinations made pursuant to the CEQA.

The Public Hearing on the establishment of the Community Facilities District and the proposed debt
issue may be continued fi'om time to time for a period not to exceed six months if the City Council
finds that the complexity of the proposed District or the need for public participation requires
additional time. Due to the size, nature and complexity of the proposed District, staff recommends
that the City Council provide additional time by continuing the hearing.
At the Public Hearing on the establishment of the District and the proposed debt issue, all interested
persons may testify for or against the establishment of the District, the extent of the District, the
furnishing of specified types of public facilities or services within the District and the proposed debt
issuance.
If 50 percent or more of the registered voters residing within the proposed District or the owners of
one-half or more of the area of the land in the proposed District and not exempt from the special tax
file (and do not withdraw) written protests against the establishment of the District, no further
proceedings to establish the District or to levy the special tax may be taken for a period of one year.
In the absence of a majority protest, the City Council may determine to establish the District:
The levy of the special tax and the proposed debt issue must then be submitted to the registered
voters of the District for' approval. It is proposed that the City Council will hold a special election
on May 9, 2000. The City Council may levy the special tax and issue bonds if more than two-thirds
of the votes cast are in favor of levying the special tax and issuing bonds.
