North - Multi-Family Residential/Medium (M) Residential, 8 to14 dwelling units per acre South - Terra Vista Town Center/Community Commercial (CC) District East - VacanVHigh Residential (H) District, 24 to 30 dwelling units per acre West - Terra Vista Business Park/Office Park (OP) District B. Backoround: The project site is the 14.77-acre master planned Terra Vista Business Park (Conditional Use Permit 86-20) and is comprised of three parcels of 5.36, 5.31, and 4.1 acres. Calvary Chapel, located on the 4.1-acre parcel, was reviewed through Conditional Use Permit DRC2002-00290. At that time, two phases of development were proposed. The first phase of development included a multi-purpose building of 17,733 square feet, basketball and volleyball courts, children's turf play area, an outdoor courtyard, and associated parking and landscaping. The second phase included the primary worship center of 21,500 square feet and completion of the surrounding parking • spaces. The first phase was reviewed and approved by the Planning Commission at a public hearing held on September 11, 2002, while the second phase was approved by the City Planner on August 4, 2004.. According to City records, construction of Phases 1 and 2 were completed by January 2004 and November 2005, respectively. ITEM A PLANNING COMMISSION STAFF REPORT DRC2006-01051 -CALVARY CHAPEL July 9, 2008 Page 2 D. Site Characteristics: The Terra Vista Business Park is comprised of six buildings. The two previously described church buildings are situated in a reverse 'L' pattern. The parking areas are located near the perimeter of the property along the street frontages. All of the recreational improvements are located within the interior of the site. To the west, are the four office buildings and associated parking of the Terra Vista Business Park. On the remaining three sides, are Town Center Drive, Elm Avenue West, and Church Avenue. Vehicle access to the church complex is via shared driveways at Church Avenue and Town Center Drive. E. Parking Calculations: The parking calculation for churches and similar places of assembly are dependent exclusively on the size of the sanctuary/worship areas. The requirements for ancillary activities of the church including offices, day care, or schools are usually not considered as the parking requirements for those activities are generally lower and occur during the weekday. Since most worship services occur on weekends and/or during the evening hours of the weekday, the parking requirements for the ancillary uses can be accommodated by the parking provided for the sanctuary/worship areas. Upon reviewing the table below illustrating this comparison, staff believes that there will not be a parking deficiency on-site that would affect the operation of the church or its neighbors. '"A shared parking arrangement provides 164 parking spaces with the Terra Vista Business Park. • • ANALYSIS: A. General: The applicant proposes to add to their existing church aparochial/private school for children between kindergarten and 6th grade. The school will be operated in, and occupy about 8,852 square feet of the multi-purpose building (Exhibit D). Because of occupancy restrictions as specified by building codes, the maximum occupancy (children and teacher) is limited to a range between 19 and 39 persons depending on the floor area • of the room. Therefore, the total maximum occupancy is 240 persons or 231 students and 9 teachers. There will also be other staff members including a principal, proctor, and administrative support. The hours of operation for the school will be Monday through A-2 PLANNING COMMISSION STAFF REPORT DRC2006-01051 -CALVARY CHAPEL July 9, 2008 • Page 3 . Friday, 8:00 a.m. - 4:00 p.m. (Exhibit E). These operating hours will not interfere or coincide with worship activities as services are held Monday through Friday beginning at 7:00 p.m. and on Sundays. Aside from interior improvements, there will not be any new construction. As the students are below driving age, there will be drop-off/pick-up of children at the beginning and end of the school day. To ensure public safety and efficient traffic flow in the public streets, a condition has been incorporated into the draft Resolution of Approval requiring that all passenger loading/unloading activities must occur on-site in the parking lot. B. Environmental Assessment: The Planning Department staff has determined that the project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) and the City's CEQA Guidelines. The project qualifies as a Class 1 exemption under State CEQA Guidelines Section 15301 Existing Facilities as the site is fully constructed and no additional construction is necessary except for interior improvements. Our school office hours will be from 8:00 A.M. to 4:00 P.M. Rancho Christian Academy school hours will run from 8:30 A.M. to 3:00 P.M. There are currently 10 full time staff members employed by the church. During the school year, we anticipate approximately 225 students, with a faculty including 9, teachers, a principal, proctor, and administrative support. PROJECT AND SITE DESCRIPTION: A. Surrounding Land Use and Zoning (Terra Vista Community Plan): North - Multi-family ResidentiaVMedium Residential (8-14 dwelling units per acre) South - Terra Vista Town Center/Community Commercial East - Vacant Land/High Residential (24-30 dwelling units per acre) West - Terra Vista Business Park/Office Park B. The project will participate in a shared parking arrangement with the Terra Vista Business Park, as supported by a parking study prepared for the project by Jerry L. Hahs, dated July 2002. The parking study included taking actual parking counts at Calvary Chapel in Upland during a Sunday morning (7 a.m. to 1:30 p.m.), a Sunday evening (5 p.m. to 9 p.m.), and Wednesday • evening (6 p.m. to 9 p.m.). At the same time, parking counts were taken at the Terra Vista Business Park to understand the current usage at the Business Park during the period when the Church experiences its highest use (i.e. Sunday morning, Sunday evening, and Wednesday evening). The conclusions of the study are summarized below. The church will be adding 210 parking spaces to the current total of 257 parking stalls within the business park. The peak parking demand for the entire business park is • actually Wednesday evening at approximately 8:00 p.m. when both the proposed church and the other businesses will require approximately 317 spaces on-site. ANALYSIS: A. General: The Terra Vista Business Park was approved in 1996 as a three phased business park master plan. To date only the first two phases have been developed. Calvary Chapel has purchased the remaining 4.1-acre portion of the site from Lewis Operating Corp. for development of a church campus. The entire perimeter of the site, including Church Street, Elm Avenue, and Town Center Drive are completely improved with all street and parkway improvements. This includes the Terra Vista Greenway Trail featuring the parallel bicycle and pedestrian paths that were developed along Elm Avenue. The Terra Vista Business Park includes a variety of existing uses such as Central School District, Madole and Associates, Architerra Design Group, San Joaquin Valley College, Mountain View Faith Community Church, and a variety of similar professional and medical offices. Calvary Chapel proposes a first phase of development that includes a 17,733 square foot multi-purpose building, basketball and volleyball courts, turf children's play area, an outdoor courtyard, and associated parking and landscaping. The second phase will include the primary worship center and completion of the surrounding parking spaces. The • applicant hopes to begin the second phase of construction in 2 to 3 years. B. Design Review Committee: The Design Review Committee reviewed the project on August 6, 2002 (McNeil, Stewart, Fong). The Committee approved modifications to the phasing plan as recommended by staff, that includes the entire area surrounding the multi-purpose building and the sport courts with Phase One. The Committee recommended the following modifications to the architecture that are subject to staff review and approval: The extended height elements of the building facade shall project away from the building face no less than 24 inches. Where walkways are present, they shall extend out over the walkway as an arcade. In each case these elements shall also return no less than 36 inches, to avoid the "false-front" appearance. The church shall incorporate the use of awnings that match the business park. The darkest "salmon" color presented to DRC, shall be replaced with a warm tone (potentially gray) that compliments the existing business park as well as the proposed stacked stone veneer. C. Technical Review Committee: The Technical Review Committee reviewed the project on August 7, 2002. All requirements of the Committee are included in the Conditions of Approval. The Committee further reviewed the details related to on-site improvements involved in the phasing scenario consistent with DRC recommendations. • D. Environmental Assessment: The Initial Study has been prepared for the project. The attached resolution contains the mitigation measures for air quality and noise impacts associated with protect construction. Should the Planning Commission concur, then issuance of a Mitigated Negative Declaration of environmental impacts would be in order. CORRESPONDENCE: This item was advertised as a public hearing in the Inland Vallev Dailv Bulletin newspaper, the property was posted, and notices were mailed to all property owners within a 300-foot radius of the project site. RECOMMENDATION: Staff recommends approval of Conditional Use Permit DRC2002-00290 by adoption of the attached resolution with conditions. Design Parameters: The Terra Vista Business Park (Conditional Use Permit 86-20) was approved as athree-phased project, however, since the time of approval only two phases of the project have been constructed. The east portion of the block constitutes the third phase (4.10 acres) and is the site of the proposed Calvary Chapel. The entire perimeter of the block bound by Church Street, Elm Street, Town Center Drive, and Terra Vista Parkway were completed with the initial phases of the project. The Terra Vista GreenwayTrail Type B, which includes the parallel bicycle and pedestrian paths within the parkway, was developed along the Elm Avenue frontage. The Business Park currently includes such businesses as Madole and Associates, Central School District, Mountain Faith Community Church, San Joaquin Valley College, and an assortment of professional and medical offices. Seven suites within the businesses park are currently vacant. The proposal by Calvary Chapel would complete the development of the Terra Vista Business Park. Staff Comments: The following comments are intended to provide an outline for Committee • discussion. Architectural Issues: Minor modifications to the architecture of the proposed church would provide greater compatibility and sense of completion to the business park. Photographs of the existing business park will be available at the meeting for comparison: 1. The proposed multi-purpose building shall incorporate the use the architectural patterns of the existing business park, including the use of glass, awnings and decorative file insets. The use of stone can be users to set the church apart from the remainder of the business park. 2. Eliminate the brow over the arch on the east elevation and over the doorways on the north and south elevations, which are not'in keeping wfth the architectural scheme. Site Planning Issues: Minor modifications to the phasing of the Site Plan would provide a more logical progression of development of the site: 1. The parking for Phase 1 should complete the improvements around the Multi-purpose :,- .building along both sides of the drive aisle, so that future construction does not further disrupt this portion of the site. 2. All landscaping and walkways around the Multi-purpose building and the volleybalUbasketball courts and play area should be completed with Phase I. 3. The walkways from the corners of Elm/Town Center and Elm StreeUChurch Street should be continued across the drive aisle using decorative/colored pavement. Eliminate the offset • shown at the connection at Elm Street/Town Center Drive. The Committee made the following recommendations in response to the architectural style and theme as presented in the staff comments and modifications as presented by the applicant: 1. The extended height elements that distinguish the church from the business park shall project away from the building no less than 24-inches. Where walkways are present, they shall extend out over the walkway as an arcade. • 2. Each of these same extended architectural elements shall have a return of no less than 36-inches, to avoid the "false front" appearance. 3. The church shall incorporate the use of the awnings that match the existing Business Parkin place of the straight metal awnings shown on the plans reviewed by DRC. 4. The darkest "salmon" color shall be replaced with a warm gray tone that compliments the existing color scheme, as well as the stacked stone proposed at the primary focal points. Pursuant to the provisions of Section 753.5(c) of Title 14 of the California Code of Regulations, the Planning Commission finds as follows: In considering the record as a whole, the Initial Study and Mitigated Negative Declaration for the project, there is no evidence that the proposed project will have potential for an adverse impact upon wildlife resources or the habitat upon which wildlife depends. Further, based upon the substantial evidence contained in the Mitigated Negative Declaration, the staff reports and exhibits, and the information provided to the Planning Commission during the public hearing, the Planning Commission hereby rebuts the presumption of adverse effect as set forth in Section 753.5(c-1-d) of Title 14 of the California Code of Regulations. 5. Based upon the findings and conclusions set forth in paragraphs t, 2, 3, and 4 above, this Commission hereby approves the application subject to each and every condition set forth below and in the Standard Conditions, attached hereto and incorporated herein by this reference. In each case these elements shall also return not less than 36 inches, to avoid the "false-front" appearance. 5) The project shall participate in a shared parking arrangement with the Terra Vista Business Park, as supported by a parking study prepared for the project by Jerry L. Hahs, dated July 2002. At least 164 parking spaces shall be allocated for use by the church on Wednesday evening, Sunday mornings, and Sunday evenings, through the shared parking agreement. A copy of the shared parking agreement shall be submitted prior to issuance of building permits. 6) Signs shall complywith the propertyowner's Uniform Sign Program forthe Terra Vista Business Park. 7) The arcades on the north and west elevations shall use the same covered element that is used on the Porte-cochere, which is featured on the south elevation. 8) Drive aisles along the north and east sides of the Phase 2 property shall include AC curb to prevent off-pavement parking. 9) The Phase 2 property shall be appropriately hydroseeded, irrigated and maintained. Engineering Division 1) Church Street frontage improvements to be in accordance with the City "Major Street" standards as required, including: a) Protect existing curb and gutter, street trees, and sidewalk as required. b) Joint use of the existing commercial drive approach must be utilized. No new driveways are permitted on Church Street. c) No new median island openings are permitted in the Church Street median. • d) Protect existing streetlights along Church Street frontage. Environmental Mitigation Air Quality 1) The site shall be treated with water or other soil-stabilizing agent (approved by SCAOMD and RW OCB) daily to reduce PM,o emissions, in accordance with SCAOMD Rule 403. 2) Perimeter streets adjacent to the site shall be swept according to a schedule established by the City to reduce PM,o emissions associated ' with vehicle tracking of soil off-site. Timing may vary depending upon time of year of construction. 3) Grading operations shall be suspended when wind speeds exceed 25 mph to minimize PM,o emissions from the site during such episodes. 4) Chemical soil-stabilizers (approved by SCAOMD and RWOCB) shall be • applied to all inactive construction areas that remain inactive for 96 hours or more to reduce PM,a emissions. Noise 1) During all project site excavation and grading onsite, the project contractors shall equip all construction equipment, fixed or mobile, with properly operating and maintained mufflers consistent with manufacturers' standards. 2) The project contractor shall place all stationary construction equipment so • that emitted noise is directed away from sensitive receptors adjacent to the project site. 3) The construction contractor shall locate equipment staging in areas that will create the greatest distance between construction related noise sources and noise sensitive receptors nearest the project site during all project construction- 4) During all project site construction, the construction contractor shall limit all construction related activities to between the hours of 6:30 a.m. and 8:00 p.m. Monday through Saturday. The property is bound on the east by vacant property; on the north by an apartment complex; on the south by the Terra Vista Town Center; and on the west bythe Terra Vista Business Park: and d. The church is comprised of two buildings - a primary worship center of 21,500 square feet and amulti-purpose room of 17,733 and outdoor recreational areas; and • e. The applicant proposes to add a private school use within the multi-purpose room for children between kindergarten and 6th grade that will operate Mondaythrough Friday, 8:00 a.m. to 4:00 p.m.; and g. The required parking for churches and similar places of assembly is dictated bythe size of the sanctuary/worship area as it is the dominant use and has the highest parking demand. At 1 stall per 35 square feet of this area, the required parking for this area (374 parking stalls) exceeds the required parking for the school use (55 parking stalls). School activities will not coincide with church activities; therefore, no parking conflict is anticipated. 3. Based upon the substantial evidence presented to this Commission during the above-referenced public hearing and upon the specific findings of facts set forth in Paragraphs 1 and 2 above, this Commission hereby finds and concludes as follows: a. The proposed development is in accord with the General Plan, the objectives of the Development Code, and the purposes of the district in which the site is located. The proposed project is to establish aparochial/private school within an existing multi-purpose building. J b. The proposed development, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. The surrounding properties are zoned Office Park, and the surrounding uses are office oriented. • c. The proposed development complies with each of the applicable provisions of the Development Code. The proposed development meets all standards outlined in the Development Code and the design and development standards and policies of the Planning Commission and the City. 4. The Planning Department Staff has determined that the project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) and the City's CEQA Guidelines. The project qualifies as a Class 1 exemption under State CEQA Guidelines Section 15301 Existing Facilities as the project consists of the permitting and operation of existing a private structure/facility involving negligible or no expansion of use beyond that existing. There is no substantial evidence that the project may have a significant effect on the environment. The Planning Commission has reviewed the Planning Department's determination of exemption, and based on its own independent judgment, concurs in the staff's determinatioh of exemption. 5. Based upon the findings and conclusions set forth in Paragraphs 1, 2, 3, and 4 above, this Commission hereby approves the application subject to each and every condition set forth below and in the Standard Conditions, attached hereto and incorporated herein by this reference. Planning Department 1) Approval is for the establishment of a private parochial school within the multi-purpose building of an existing church located in the Office Park (OP) District, Terra Vista Community Plan, at 10700 Town Center Drive - APN: 1077-422-14. • 2) The applicant shall continue to comply with all applicable conditions of approval as provided in Conditional Use Permit DRC2002-00290. Parking (including temporary parking) in the public right-of-way is not permitted. 5) Maximum occupancy of the multi-purpose building is subject to occupancy limits as specified by the Fire Department. 6) Approval of this request shall not waive compliance with any sections of the Development Code, State Fire Marshal's regulations, Uniform Building Code, or any other City Ordinances. 7) The church shall operate in conformance with the performance standards as defined in the Development Code including, but not limited to, noise levels. If the operation of the facility causes adverse effects upon adjacent businesses or operations, the Conditional Use Permit shall be brought before the Planning Director for consideration and possible revocation of the Conditional Use Permit. • 8) Any modification of the operating hours or days or any intensification of the use beyond what is specifically approved by Conditional Use Permits DRC2002-00290 and DRC2006-01051 shall require review and approval by the City Planner. Buildino and Safety Department Change of Occupancy Standard Conditions for Existing Structures 1) An Occupancy Change is required because of the scope of the project. Submit plans to the Building and Safety Department to determine compliance for the proposed use. 2) Provide compliance with the California Building Code (CBC) for use, area, and fire-resistiveness of existing buildings. 3) The project shall be designed to comply with the CBC regarding mixed occupancy ratio. 4) Provide the required restroom facilities per Chapter 4 of the CPC. 5) All exiting must comply with the requirements of CBC Chapter 10 (adjoining rooms, rated corridors, door swings, separation of exits, • etc.). 6) Accessibility for the disabled must be provided to the school and church buildings in accordance with the 2001 CA Building Code. Part of that Update involves the formation of various committees that participate in • information gathering, community outreach, or act on an advisory basis. The General Plan Advisory Committee (GPAC) will meet throughout the course of the update process to discuss and resolve any issues of public process and outreach and act as a sounding board for the values, visions, choices and strategic direction that arises from the outreach process. This Committee is more focused on process rather than policy. The Committee discussions will ultimately assist the Council in Council's review, comment, consideration and the formation policy that subsequently will be foundational to the direction of the General Plan. Typically, members of a General Plan Advisory Committee are those who are already actively involved in the Community and are informed about community interests and therefore seek to collaborate towards the goal of a meaningful General Plan. This Committee will be comprised of selected members of City boards and commissions as well as members from all sectors of the community including the Chamber of Commerce, the school districts, the Etiwanda Historical Society, and the Alta Loma Riding Club, to name a few.
