RESOLUTION NO. 11-109 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, FINDING THAT SAID VEHICULAR ACCESS RIGHTS MORE PARTICULARLY DESCRIBED HEREIN TO BE UNNECESSARY AND RESTRICTIVE, AND AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE THAT CERTAIN DEED, A COPY OF WHICH IS ATTACHED HERETO AND TO CAUSE THE SAME TO BE RECORDED WHEREAS, the vehicular access restrictions governing Tract 18710, applicable to Lot 1 of said tract, were determined to be unnecessary and restrictive in nature; and WHEREAS,the Planning Commission of the City of Rancho Cucamonga heretofore made the findings on June 8, 2011, that authorizing the quitclaim of vehicular access rights would be in conformity with the General Plan of the City of Rancho Cucamonga; and NOW THEREFORE BE IT RESOLVED by the City Council of the City of Rancho Cucamonga as follows: SECTION 1: That the City Council of the City of Rancho Cucamonga hereby quitclaims the vehicular access restrictions on southerly line of Lot 1 of Tract 18710 abutting Church Street, east of Milliken Avenue, on file in the office of the City Clerk of the City of Rancho Cucamonga,which has been further described in a legal description which is attached hereto, and by reference made a part hereof. SECTION 2: That from and after the date of resolution is recorded, said vehicular access restriction is no longer constitute a public easement. SECTION 1 That the City Clerk shall cause a certified copy of this resolution to be recorded in the office of the County Recorded of San Bernardino County, California. SECTION 4: That the City Clerk shall certify to the passage and adoption of the resolution, and it shall thereupon take effect and be in force. SECTION 5: The City Engineer is hereby authorized and directed to execute the deed, a full, true and correct copy of which is attached hereto, and cause the same to be recorded forthwith upon adoption of this Resolution.
