FD 12-057 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE RANCHO CUCAMONGA FIRE PROTECTION DISTRICT, RANCHO CUCAMONGA, CALIFORNIA, ESTABLISHING, REVISING, AND UPDATING VARIOUS FEES AND REVISING RESOLUTION NO. FD 06-015, RESOLUTION NO. FD 09-026, AND RESOLUTION NO. FD 10-040. A. RECITALS (i) The Government Code requires that prior to levying a new fee or increasing an existing fee or service charge as hereinafter set forth, the local agency shall hold a noticed public hearing to consider the matter. (ii) On December 19, 2012, the Rancho Cucamonga Fire Protection District conducted and concluded a duly noticed public hearing concerning the proposed fees and service charges, as required by law. (iii) All legal prerequisites to adoption of this Resolution have occurred. B. RESOLUTION NOW, THEREFORE, the Board of Directors of the Rancho Cucamonga Fire Protection District hereby finds and resolves as follows: 1. The facts set forth in Recitals, Part A of this Resolution, are true and correct. 2. The Board of Directors has determined that none of the fees established herein exceeds the reasonable estimated cost of providing the service to which each such fee applies or the actual cost recovery of the materials, products, and/or use of facilities. 3. The following fee schedule is hereby approved and adopted: SECTION 1: Resolution No. FD 06-015 is hereby revised as follows: A. Development Review Fees are repealed. B. Special Services Fees are revised as follows: 1. Per mile mileage charges for use of the K-9 Team by other agencies is revised to be the current IRS Rate. 2. The fee for Fire District issued access padlocks is revised to be the actual cost of materials plus the fully burdened hourly rate. 3. The fee for possession or use of dangerous fireworks is repealed. 4. The fee for unlawful use of safe and sane fireworks is repealed. 5. The fees for Special Permit and Inspections are repealed. C. All Other Fees. All other fees in Resolution No. FD 06-015 remain unchanged and are incorporated by reference. SECTION 2: Resolution No. FD 09-026 and Resolution No. FD 10-040 are revised as follows: A. Page 6 of 8 SECTION 3: The following fees are established or updated: A. Signs and Placards. Fees charged for Fire District supplied signs and placards are established to be the actual materials cost plus fully burdened hourly rate. B. After Hours Requested Inspection. The fee for a Requested Inspection or Standby after regular work hours is established to be $165.00 per hour with a one hour minimum charge. C. Technology Fee. A Technology Fee is established in the amount of four and one half percent (4.5%) of inspection and permit fees. D. Community Facilities District. The application fee for annexation into a community facilities district is updated as follows: 1. One (1) to four (4) single family residential parcels .........................$ 560.00 2. More than four(4) single family residential parcels, commercial parcels/projects, and industrial parcels/projects ...............................$700.00 SECTION 4: Date of Effect This Resolution shall take effect 60 days from the date of approval. 4. The Secretary to the Rancho Cucamonga Fire Protection District shall certify to the adoption of this Resolution. Please see the following page for formal adoption,certification and signatures.
