to any pending litigation, Just to clarify Councilwoman Wright -3 question
Councilwoman Wright then asked if this relates to A bettor technology,
James Markman, City Attcrnay, sand possibly, and that they will possibly find
corrections, and that there may be design errors in the fist place. He did not
nay for obtain if a pending case would pay for this unless there in an error
found, One that would probably be a different lawsuit.
Councilwoman Wright Stated that she would like Council to give direction to
Staff to let the Council know if this is for better technology, or if there are
any design it ionstruction error*, and for this information to come back to the
Council.

James Markman, City Attorney, stated It was probably around October or November
of 1988
councilwoman Wright stated that she had naked for a financial impact report on
thin 60 days ago, and was supposed to have received the information at the nut
msat_ng and did not, out was told that It would be forthcoming later. She
stated that she got the financial Impact report on December 7, 1988, which
completely changed her point of view about the Ordinance She said after
roceiving the financial Impact rerort, she was confusal about this Ordinance,
and why it wan going to cost $91,000.00 to rex a the graffiti from public
property for the 1939/90 fiscal year. She said that this was not counting the
$35,000 00 that it Is going to coat to remove ohs graffitt from the private
property.
She felt this information made the whole thing seam c=pletely different, and
had she had this information before, she didn't think this would have gone to
second reading. She felt the graffiti on public property should be raeovod
first, and then the graffiti on the private property • aid look less abundant
She said it was also tell)-" her the service level was only covering gang and
obscene graffiti. She said that ties In with another report she haw asked for,
and that is the gang activity in the City. She said she was told there was no
gang activity in the City, yet she is being told there is $91,000 n0 worth of
graffiti that needs to be removed. Sbe said she would like for it to be
invevtigated on other sources of funding to get the ;lrafflti removed like athar
cities are doing, such as by fining, and would like to find out about this
before she goaa ahead and approves the Ordinance, to sea if there is name way
to rogaii thin $91,000 3O that it will cost for this program.
She also felt there were problems in the funding of tha Ordinance as it was
precented tonight, and felt that the public property should be tekea care of
first, and her reawon for that was because she got the information so late

Jack Ix, Acting City Manager, informed the Council of the request he had
received, and the steps taken to compile the /nformntion that was in the
Ordinance, and what has been given to Council so far in reports.
James Markman, City Attorney, added that this is an enabling Ordinance, and that
it ion -t a budgeted item. He informed the Council that you usually don't catch
anyone who is creating a graffiti problem, and that the City probably would not
get any money back on this.
Councilman euquot added that the City It currently removing the graffiti, and
that they are already spending swnuy for thin. He felt : %at if this is on
1. public property, it should be removed. He still Colt the onablL.J factor should
be there.
Councilman Alexander stated that he would like to a" the Gtariff•■ report on
gang activity. He also felt that samethinq needed to be done about the graffiti
problem. He also asked staff if there was a way to eallect the money tram

my disagree with what the City Council has done in regards to the
termination of Lauren Wasserman, City Manager, he felt the cc¢munity
should band together. He stated that although there is a group out there
astablishiug a recall, tnat there is also a group that does ,lot support
the recall. He is not in favor of the recall himself.
Fred Doe, 11306 Shaw Street, otated he Supports Councilwoman Deborah Brown
on the Task Farce for Orooth Management Issue. He also stated he is in
support of what the Council has dome with the termination of Lauren

It is reciamended that City Council approve the Resolution granting authorization
to destroy records as listed an the attached list.
Under the authorit7 of Government Code Section 34090, a department head may
destroy certain city records which are two years old under his charge as long
as such destruction is first approved by the city attorney and city council.
Also under the same Government Coda Section, authoeity is granted to destroy
records which have been microfilmed.
Under consideration at this time Are some City :lark Record% which are no longer
required to be kept as these records are have Lean microfilmed.

City Council declare the following vehicles as surplus and authorize the sale
of the vehicles through public auction:
1980 Ford Fairmont 1985/85
1981 Mercury Zepher 1946/87
1980 Chevrolet C -20 1985/86

From time -to -time the City must dispose of vehicles that become too costly to
ope•ste due to a high increase of repair, or the vehicles have simply outlived
their useful lives.
The Ford Fairmont and Chevrolet C -20 were scheduled for replacement during the
1985/86 fiscal year and the Mercury Zephyr wa: scheduled for 1986/87 fiscal
year replacement. At that time, it was decided to postpone replacement of the
veh +cles until they were no longer reliable vehicles. It is now requested
these vehicles be declared surplus and authorize SOP through public auction.

RECOMMENDATION:
It is hereby recommended that the City Council adopt the attached Reeolutlon
accepting and approving the Environmental initial Study Parts I and II for the
Proposed Improvements to said crossing and the Issuance of a Categorical
EReoption therefor and direct the City Clerk to file a Notice of Exemption
pursuant to the California Environmental Quality Act
This report presents an Environmental Assessment Initial Study for the
;roposed crossing improvements to the Atchison, Topeka and Santa Fe Crossing
(PUC No 2 -98 7) on Vineyard Avenue north of 8th Street.
In conformance tiith the California Environmental Quality Act and State
Guidelines, the attached document has been prepared to permit construction of
said improvements.
The improvements g_nerally entail the installation of rubberized railway
crossing pads with roadway, psvement approach improvements, sidewalk and street
lighting where applicable.
It is the Engineering Staff's finding that the proposed project will not
create a styyn•flcant adverse Impact on the Environment and therefore recommend
thst these leprovements be classified as Categorleally Exeapt.
