The regular meeting of the Planning Commission of the City of Rancho Cuca-
monga was hold in the Carnelian Elementary School Multipurpose Room, 7105
Cnrnalion, Rancho Cucamonga, oat Wednesday, August 0, 1979.
Meeting was called to order at 7t00 p.m. by Acting Chairman Peter Tolotoy
who led the meeting with the Pledge of Allegiance.

ALSO PRESENT: Jack Lam, Director of Community Development; Barry llogan, Senior
Plattner; Ted Hopson, City Attorney; Paul Rougenu, Assistant Civil
Engineer; and Nancy McAllister, Secretary
APPROVAL OF MINUTES
Due to the fact there was not a quorum of the members present from the July
16, 1979 Special Study Session, no action was taken on the minutes.
Upon motion by Commissioner Dahl, seconded by Commissioner Jones and unanimously
carried, the minutes of July 25, 1979 were approved subject to the following change:
Ted Hopson, City Attorney, was shown as present at the meeting;
and should be changed to indicate Bob Dougherty, City Attorney,
was present.

ANNOUNCEMENTS:
Mr. Lnm reported the Growth Management Plan is being revised and will be
available for the Commissions' review next Friday. Ile indicated perhaps the
Commission would like to set another study session prior to the public hearing
which has been set for August 22, 1979.
It was the concensus of the Commission that an additional study session be
scheduled for Thursday, August 16, 1979 at 4:00 p.m. in the Library Conference
Room. .

residential for property located on the south side of 19th Street between Archi-
bald and Amethyst Avenues.

Jack Lain, Director of Conmunity Development, reviewed 'tile utoff report. Staff
recommends that'tho Colaminsion adopt Rusolutioti No. 79 -56 rotonnending adoption'
of General Plan Amendment No. 79 -01E.
Acting Chairman Tolutoy naked for questions from the Commission of the staff.
There being tnona, Acting Chairman Tolstay opened the public hearing.
Mrs. Leln Jobin, one of the principals in Alta Loma Propertion, stated she
believes the Commission and the staff considered the effect on the whole com-
munity in approving the zone change. It also 1.elped solve to sonic degree the
drainage problem that has plagued that area and also helped to widen 19th
Street. They had developed a project that was to be built in the highest stan-
dard and attract a very nice typo of people into this city. The wren, -ir her
opinion, is best suited for higher density in that it is located clone to
chopping and it is n logical place for this type of development on a major
arterial such no 19th Street. She would like to go on record as saying it
would be in the beat interest of the City to keep this area high density.
Mr. Nate Rosenberg, Staff Attorney for Inland Counties Legal Services, stated
their Service is to address the housing needs for the lower income family.
They are in objection to down - toning or redesignating this area for low den-
sity residential. lie understands that there are fewer than 8 sites in the
entire city that are ovailnble for high density use which commitments have not
already been made. The number of available rental housing units is already
much too small. It does not make much sense to rezone an area which is already
approved for high density back to low density. lie would like to ask what has
changed on this lot to make it undesirable when a year ago, it was recommended
for high density.
Acting Chairman Tolutoy stated some of Mr. Rosenberg's assumptions are incorrect.
The City has approved. over 600 units for development within the City. They
have not been built yet but they have been approved. This Commission has to be
sensitive to the wishes of those people who live in our community. Thn fact that
this Commission is entertaining this motion is no indication that the Commission
or the City is trying to defent Mr. Rosenberg's interests.
Mr. Rosenberg indicated lie is aware multi - family projects have been approved;
however none of them are subsidized housing. Ile is nice concerned that the
very serious situation involving sewer capacity and school capacity may make
it impossible to bring about such subsidized housing. People living in single
family tracts are in almost every case in opposition to multi - family developments
adjoining their properties.
Commissioner Dahl stated in our city there is presently 300 to 400 units that
rent under $200 a month. This is pretty high for a city of roughly 45,000 and
still growing. As we work on our Growth Management Plan there is a very strong
emphasis in the program to encourage developers and builders to put aside or
build within their projects affordable housing. The City is trying to make the
best decisions that will improve our community and yet serve all of our citizens.
It is very important to this city to encourage affordable housing.

Mr. Rosenberg stated lie would still like the City to increase the number U.
high density areas within the City limits and in, no calls should they be
decreaned. .
Conmianioner Toletoy stated the Commission needs to be sensitive to the publics
wishen and also line to take into consideration many other factara. one of these
factors is traffic an Comminoioner Jones indicated. Thin community has n very
bad circulation problem.
Mr. Frank Venti, one of the proposed developers for thin project, naked how
the EIR was approved for high density development on thin property. They have
expended a great deal of money in this project an the General Plan did indicate
this area for high density and the zone change was previously approved by the
Commission. Tito only people opposed to the apartments are those living. adjacent
to thie proposed development and no othern opposed it. It is his opinion this
matter can be solved if they were allowed to work with the City rather than the
City changing the General Plan designation.
Mr. Joe Hardin, living in the adjacent tract, otatdd the Council line made the
decision to deny the zone chsngc to R -1. It was very obvious to the Council
thnt the area tied a lot of questions concerning traffic and safety. There are
already a number of units appro•red in this area and he believes ttie saturation
point has already been reached.
Mr. Nano Peterson stated lie in representing a number of property owners in the
area and they are in favor of the general plan amendment an proposed by staff.
There being no further comments from the audience, Chairman Hempel closed the
public hearing.
Commissioner Dahl stated lie ill not in favor of multiple family residences in
thin area.
Commissioner Tolstoy stated at the time the General Plan process was under review,
he felt that this property would be beat put into high density. At this time it
is his opinion there is.a number of problems with high density on the property.
One of the problems is traffic on 19th Street. 19th Street is also under the
jurisdiction of the State (Caltrane). The area is already built up so that it
would be very difficult to widen the street. Also with the pressure brought
to the Council by the people living in the area, this should certainly be
listened to. The proposed project could be excellent with some changes and
he would hope that the applicant will propose another development within the
city.
Commissioner Dahl stated this amendment would be compatible with surrounding uses
and logically bring together existing development in thie area. Also, single family
residential in the area should be considered due to public safety and circulation .
A Motion was made by Commissioner Dahl. and seconded by Commissioner Jones to
adopt Resolution No. 79 -56 recommending adoption of General Plan Amendment No.
79 -01E.

mously carried, the Joint City Council /Planning Commission minutes of August 29,
1979 were approved as submitted.
ANNOUNCEMENTS
1. Mr. Lam presented to, the Commission a draft version of a Planned Community
Ordinance. This is an ordinance that is intended to provide legal backing
for the community plan that the Commission and Council will be considering
soon. This draft ordinance is for the Comnissions' information and to request
that the Commission set up a special study session for next Thursday, September
20, 1919 at 7:00 p.m. in the Community Services Building located on Arrow Route,
near Archibald.
2. Mr. Lam stated staff changes have been made in the Growth Management Plan pre-
sented to the Commission. lie stated the changes will be reviewed during the
public hearing on the Growth Management Plan.

to the next regular meeting of September 26, 1979. Thin item was continued
from a previous meeting duo to the fact a full Commission was not present.

P.A.U. BASELINE RECONSTRUCTION PROJECT AND NEGATIVE DECLARATION - Minor widening
where required to obtain two lanes of traffic each direction within the existing
right -of -way on Bnaeline from Agate to ldellman and Archibald to Cambridge.
Improvements may require reconstruction, A.C. overlay, striping and A.C. berming.
Lloyd llubbs, City Engineer, reviewed the staff report. Staff recommends that
the Commission approve the Negative Declaration for the minor widening and
resurfacing of Base Line Street and recommend to the City Council the appro-
priation of funds for the separate construction of the ultimate widening on
the south side of Base Line bet-eon Beryl Avenue and Lion Street.
Chairman Rempel asked for questions from the Commission of the staff.
Chairman Rempel opened the public hearing.

indicated concurrence with the project.

to approve the negative declaration for the minor widening and resurfacing of
Base Line Street and recommend to tl:e City Council the appropriation of funds
for the separate construction of the ultimate widening on the south side of

Juck Lam, Director of Community Development, reviewed the staff report in
detail, this being on file in the Planning Division. Staff line recommended
some additional changes to the Plan which have been given to the Commission
for review. Ile reviewed cacti of the suggested changes in detail for the
Connsisnion. Staff recommends that the Commission adopt Resolution No. 79 -50
end 79 -59 with the additions an mentioned and that ouch recommendation be
traneforred to the City Council.
Mr. Lam indicated Ben Mackall of the Foothill Fire District is present to
speak concerning the fire response map and will be available to explain one
answer any questions the Cosmsission or audience might have.
Ben Mackall, Foothill Fire District, reviewed the fire response tima mnp
for the Commission. lie stated at the request of Planning Staff, the Fire
District took their engine companies and had then physically respond to
various areas in the district. There will be periodic reviuions to the map
no traffic signals, stop signs and development occurs.
Commissioner Garcia asked for an explanation of the colored portions on
the fire response map.
Bill ilofman, Assistant Planner, reviewed the map in detail for the Commission
and audience.
Chairman Rempel opened the public hearing, asking for comments on Resolution
No. 79 -58 at this time.
Mr. Ken Willis, stated under Section 6 -A, in regard to school facilities and /or
water and sewer facilities not being available to meet the mandatory criteria
conditions, it is his understanding that the issuance of school and sewer letters
are in fact the responsibility of the school district, water district, etc. Ile
stated there in some misunderstanding as to the relationship of the developer and
the schual district. It may be worthwhile to spell out in the Resolution that
the City in not issuing letters for school and sewer.
Mr. Lam stated this is covered in the section under mandatory criteria.

exclusive financial and legal arrangements with affected school and /or sewor
and water districts for acceptable additional capacity shall have priority
over residential development projects that have not made such arrangements
except that said priority among those projects that have made such arrange -
mants shall go to those projects having the highest point ratings." He
indicated it is his opinion this laxiguage will allow the same opportunity
for everyone to participate in a solution and provide everyone the equal
opportunity to compete for the priorities and dons not asks any claim toward
the large or small developer.
Commissioner Garcia stated it is his opinion the proposed statement is not
equitable. lie would not reconanend its inclusion at this time.
Chairman Rempel stated he is in favor of the statement no it is something
for everybody to work together on.

titan 500 acres.
Mr. Kan Willis, DIA, stated lie is alao in agreement that a Planned Community
consist of a minimum of 300 sores. Thin could lead to better land development.
Mr. Dill John, Director for Vanguard Duildera, stated it is hie opinion that
those tracts that were filed before tlae City incorporated deserve additional
bonus points. This is only fair as they have been 'hold up by the moratorium
for three years.
Kay Matlock, Lewis Boston, stated tlae way the Resolution is worded, a Planned
Unit Development adjoining an existing development could got 9 points whereas
a planned community, unless surrounded by existing davelopment, gets G or 7
points. This does not reflect benefits to' the City of a planned community
development where tlae city has a chance to completely plan a whole cuunk of the
city.
Mr. Ilona stated thin may work in the City of Irvine as one person owns property
in Irvine. This is not the case for Rancho Cucamonga. Planned Community
Developments are allowed points for doing about anything it wants to do. If
n person line a hundred acres or less alongside a Planned Community Development
it has no way in the world of competing with them. it is ilia opinion you can
do as good a job with a smaller piece of property as with a largo piece of
property as long as all services are satisfied.
There being no further commonto from the audience, Chairman Rampel closed the
public hearing.
Commissioner Garcia stated he does not understand the issuE of affordable
housing. Is this defined in terms of promoting renter occupied units.
Mr. Lam reviewed affordable housing for the Commission. This section is to
provide an incentive for affordable housing within the City; either owner
or renter occupied. This section does not state any priority of rental over
owner occupied as long as it meets the criteria set within the section.
Chairman Rempel stated it 'is his opinion the Resolution should be amended
under affordable housing, renter occupied section, that the rental rates
can not continue to increase. If the rental rates do continue to increase
not many apartment unite will be available to those having low incomes.
Mr. Lam suggested that the following be added to the renter occupied section
of Affordable Housing: The figures include the price of utilities and may
be increased by not more than 10Z if allowable by the provisions of the
Housing and Community Development Act.

was distributed at the previous meeting. Tito ordinance basically establishes
the committee, jurisdiction of review, design considerations and review pro-
cedurea. Staff is requesting input and direction for finalization of the
ordinance at this time. If the Commission after further review has some
comments these may be aubmitted in writing to the Planning Division prior
to the public hearing which has been set for October 3, 1979.
Commissioner Garcia asked if the appointments on the committee will take
place after the ordinance is adopted.

Mr. Lain stated an the Commission is aware, the Council approved Chu selection
of Sedwny /Cooke and Associates of San Francisco as the new General Plan Consul-
tant. At the last Council mating, they not only approved Sedway /Cooke but
they approved the inclusion of the park and recreational element and urban
design nlen mt in the contract for tho General Plan. Furthermore, Sedway/
Cooke will. pr4rparc a complete EUt draft and final. The Council will have
before than for review and approval at their next meeting the Agreement
between the City and Scdway /Cooks.

The development of approximately 30,000 square foot
space at 7925 Center Avenue within the M -R zone.
DACKGROUNDs Data Design in proposing to construct one building comprising
approximataly 6,200 square feet and 24,600 square foot of office and industrial
space, respectively. Thin project represents the fourth building to be constructed
in accordance with a Maxtor Plan for industrial development along the east side of
Cantor Avenue between Stanford and Hemlock Stroets. The architecture of the
building and the landscaping of the site will be similar to that which exists on
the adjacent industrial sites.
ENVIRONMENTAL SETTINGS The site in presontly vacant, contains a vineyard and
slopes in a southeasterly direction towards Door Creak. To the south and the wont
of the site are existing industrial buildingol to the oast is Door Crack, and to
the north are vineyards. The site is not known to contain any cultural, historical,
or scenic aspects that would be disturbed by this project.
ENVIRONMENTAL IMPACTS Attached for your review is Part I of the Initial Study as
completed by the applicant. Staff has completed a field chock and Part II of the
Initial Study, and has found no significant adverse impacts upon the environment
as a result of this project.
RECOMMENDATION: After review and completion of the Initial Study, staff rocommenda
that the Planning Commission issue a Negative Declaration for this project and
find that this project would not create any significant adverse impacts on the
environment.

BACKGROUND: Tito applicant is requesting to divide an approximately 0.98
acre parcel of land into two (2) parcels each containing approximately
0.49 acres (21.344 square feet).
Thin review is for environmental clearance of the parcel map only and does
not constitute an approval of either the parcel map or future development.
This subdivision will create one (1) "buildable" residential lot containing
21,344 square fact. Tito minimum lot sixa In this zone is 8,500 square feet.
Tito subdivision in consistent with Section 1 of Ordinance No. 73 "Land Divi-
sion Moratorium" which provides that said moratorium shall not apply to resi-

ENVIRONMENTAL SETTING: Light industrial buildings currently exist on Parcels
2, 3, 4, 70 8 and 9; Parcels 19 5, 6 and 10 are vacant. No significant wildlife
or flora exists on the site and there are no known significant cultural or his-
torical artifacts on the site. The site slopes gently to the southwest and
drainage is into the Atchison, Topeka and Santa Fe Railroad right -of -way which
abuts the property to the south.

for a change in the present dosignation of high density residential
to eommurcial for property lactated on the northwest corner of
Tutnor and 'Arrow Route.
DACKGROUrroi On July 17, 1979, tor. Arnold Anderson submitted a request for A
general plan amendment that would bring his property into conformity with the
existing C -1 Zoning that the County placed on the property. No dosiros to
establish a neighborhood convenience atoro, a take -out food store and a coin -
operated car wash on the project site.
In 1970, the City of Rancho Cucamonga designated on it's General Plan Land Una
Mnp commoreinl alternative sites near the intersections of Archibald Avenue and
Arrow Routo and haven Avenue and Arrow Route. Both of those areas arc within
half a mile of the requested general plan amendment site. Please refer to the
attached letter from the applicant for further background.
ENVIRONMENTAL SETTING& Thy project site moaourou 300 feet by 206 foot an the
northwant corner of Arrow Routo and Turner Avenue. No troos or existing buildings
occur on the site. The area is fairly even with assorted areas of rocks and top
soil scattered throughout the site. There arc no largo animals and few wild
species except rodants, insooto and birds all native to the area. ProLporty to the
north and west is occttpiod b•1 single story apartment complexes. South, across Arrow,
is an existing neighborhood store located in an older structure. East across
Turner lies vacant lands.
ANALYSIS& The General Plan designation which is compatible with the proposed
activity is the Service Commercial Designation. Service Commercial would allow
the coin - operated car wash, restaurant and neighborhood convenience store. The
intention of the General Plan in establishing the Service Commercial area was
to allow those activities currently pursued along Foothill Boulevard between Hallman
and Hermosa.
Since the General Plan recognizes two alternative sites for Neighborhood Commercial
within half a r ilo of the project, the request for a Service Commercial use at
the proposud project site does not appear to be justified.
The goal pursued by the City in establishing Service Commercial in preparation of
the Land Use Elemont of the General Plan was to encourage the consolidation of
commercial uses into cantors and attempt to restrict the proliferation of smaller
more numerous commercial developments in the random manner allowed prior to
incorporation.

Dear Gentlemen:
I have owned the North West corner of Arrow Highway and Turner
Avenue for over 5 years. About 1974 we commenced building apart-
ments on %be property and were requested by County Planning Depart-
ment to develop a master plan for the approximate 35 acres.
This plan provided for the construction of approximately 450 apart-
ment units and a commercial corner, 300 ft. by 300 ft., designed
® to provide facilities for the servicing of the apartment units.
In the adoption of the master plan by your city this commercial
area was designated high density, residential.
It is my desire at this time to develop this corner with a con-
venience store, a take out food store - possibly with an indoor
eating area and a coin - operated car wash. I feel the car wash
is particularly important to alleviate a problem we currently
have in the apartment project with tenants washing their cars in
the parking areas. Therefore I respectfully request your approval
of the desired development.
Enclosed please find an application fe initial study with a
$70.00 fee and a check of $1,000.00 +,r the general plan amend-
ment plus the requested exhibits and gummed labels.

from the present designation of medium done ty rosidotttial (5 to 15
units par groan acro) to low density residential (2 to 5 units par groan
acro) for proporty located on the northwest corner of Baseline and Haven
BACKGROUND$ When this area was in the county, a single family convontional dwelling
subdivision was approved. Over the past year and a half the project wan completed.
The 45 lot subdivision covers an approximate area of 600' X 0001, near 11 acres
total for an average of 4.09 lots per gross acro, within the low density residential
general plan designation.
ANALYSISt The subject property is bordered to the north and want by an existing
® mobile home park. East across Ilavon Avenue lioa grapa vineyards. South across
III Bass Lino Avonua Sa a now, subdivision of single family dwellings. The proposed
amendment is compatible with the existing lend unes both on -site and off -site in
the area and will logically bring together the existing general plan designations.
Staff prepared the Initial Study for this amendment and have determined that no
significant adverse environmental impacts will occur as a result of this amendment.
Part I cf the Initial Study is attached for your review. Staff recommends issuance
of a Negative Declaration for this project.

DACKCROUNDt Under the direction of the Planning Commission, Staff has prepared a
Donign Itoviow Ordinance for your consideration. Based upon diacunsiona and spacial
study sosnions hold with the Planning Commiasion, staff Ilan prepared the attached
Ordinance. Generally, tho Ordinance creates a Design Review Committos consisting
of two Planning Commission mombarn and the Director of Community Development or
his designee. The Committee moots twice monthly or more often if needed. The
time of the meetings shall be eat by Resolution of the Planning Commianion. An
Committee members change, there may be need for change in the mooting time depending
upon the ability of the Committee to meat. Therefore, a Resolution Batting the
meeting time can be easily changed to moot the needs of the Committee.
The ordinance also Dote forth criteria which the Committee will use in reviewing
the design of a project. In addition to the criteria listed in the Ordinancot the
ordinance gives the authority to the Committee to develop further design criteria
and elements.
The intent of the proposed Ordinance is to create an informal Design Review Committee
rather than a formal architectural review commission. An has been previously
diocuasod in study sessions and discussions with the Commiusion, it was felt that
the informal committee would land itself to some flexibility. If the Commission
chose to create a more formalized review process or architectural review commission,
than it would entail a significant amount of administration, such as formalized
agondau, staff reports, and minutes. In addition, a formalized commission would
normally be composed of other mumbare of the community in addition to members of
the Planning Commission, staff or City Council.
Part I of the Initial Study is attached for your review. Staff has completed
Part II of the Initial Study and hoe found no significant adverse impacts on the
environment as a result of this proposal.
RECOMMENDATIONt It is recommended that the Planning Commission adopt and approve
Resolution No. 79 -61 and forward ouch recommendation to the City Coun'Al for their
consideration.

SECTION le PURPOSES
A. The City of Rancho Cucamonga finds that a design review
process will support the implementation of the Rancho
Cucamonga General Plan, as it strosoos quality urban design
standards. The City further finds that the quality of
certain residential, institutional, commercial, and
industrial uses has a oubatantial impact upon the visual
appeal, environmental soundneso, economic stability, and
property values of the City. This Resolution is not
intended to restriot imagination, innovation or variety,
but rather to focus on design prinoiplae which can result
in creative anCt imaginative solutions for the project and
a quality dasign for the City. it is, therefore, the
purpose of this Resolution toe
1. Recognize the interdependence of land values and
aesthetics and provide a method by which t %. City
may implement this interdependence to its benefit.
2. Encourage the orderly and harmonious aippearance os'
structures and property within the City along with
associated facilities, such as signet landscnping,
parking areas, and streets.
3. Maintain the public health, safety and general
welfare, and property throughout the City.
q. Assist private and public developmentu to be more
cognizant of public cnncernn for the aesthetics
of developments.
S. Reasonably ensure that now developments, including
residential, institutional, commercial and industrial
developments, do not have an advarse aesthotic,.health,

SECTION %► CHFAY`ION OF TIM 0913TGN PL'VIEW COMMITTCB
A. A Donign Review Comittoo (DRC) is hereby created and
and shall be responuiblo for the implementation and
administration of this Resolution.
1. Composition
The Design Review Cotmnittoo shall consist of throe
(3) members. One shall be the Director of Community
Development or his donignoo and two shall be mambors
of thm Planning Commission.
2. Appointment and Toren of Office
The Planning Commission shall elect two of its mombors
to the DRC. The Director of Community Development or
his designee shall be the Socrotary of the DRC. Of
the first two Commission members appointed, one shall
have a term of nix (6) months and the other shall have
a, term of twol.vo (12) months. Thereafter, all t:orms
shall be twelve (12) months.
3. Removal from Office
Any member of t►,o Committeo may be removed at any time
by the Planning Commission.
4. Meetings
The Design Review Committee Shall moot at leant twice
monthly, i4l needed. The time and place of ouch meeting
shall, be sot by Resolution of the Planning Commission.
The Design Review Committee may arrange additional
meetings at any time in order to process applications
within required time periods.

The Committee shall review a project in accordance with
the Resolution and file recommendations with the approving
authority. Such rocommondations ►hall be consulidated
by the Planning Division of the Community Development
Department as conditions for final approval. The DRC
shall have the right to davolop its own rules and
regulations for conducting its meetings in addition , to
developing and adopting design criteria and standards. r

SECTION 31 JURISDICTION OP REVIEW
A. Tito Daaign'Roviow Committee shall havo the authority to
review the architecture and site plan elements of all
residential (resulting in 4 or more units and houne
relocations), commercial and industrial dovolopmonts,
additions, romodolingo, relocations, issuance of a
building permit or which require a Conditional Una
Permit, Site Approval or Director Review. The review
can consider the use of design elements such as, but
not limited to, exterior design and materials, land -
nonping, architecturo, site plan relationships,
grading, signs, wall or buffering techniques.
SECTION 4t DESIGN CONSIDERATIONS
A. Tito DRC shall, in reviewing projects covered by this
Resolution, consider such design aspoctn an the relation-
ship of building to sites the relationship of building
and site to surrounding areal landscape and site trnat-
mont; building design and materials; signet and
miscellaneous structures and ati:uQt furniture.
The recommandatione of the DRC will be based upon the
project conforming to the following criteriat
® 1. The design and layout of the pn)posed development in
consistent with the applicable elements of the City's
General Plan and any adopted architectural criteria
for specialized area, such as designated historic
districts, theme areas, specific plans, community
plan, boulevards, or planned developments.
2. The design and layout of the proposed development will
not unreasonably interfere with the use and enjoyment
of neighboring existing or futuro developments, aid
will not create traffic or podostcian hazards.
3. The architectural design of the proposed development
is compatible with the character of the surrounding
neighborhood and will maintain the harmonious,
orderly and attractive: development contemplated by
this Rasolution and the General Plan of the City.
4. The design of the proposed development would provide
a desirable environment for its occupants and visiting
public as wall as its neighbors through good aesthetic
use of materials, texture and color that will remain
aesthetically appealing and will retain a reasonably
adequate level of maintenance.
s£CTION St PROCEDURE
A. An applicant shall submit the appropriate application, as
required by the Zoning Ordinance, an application fee as
set by the City Council, and required materials as
specified in the filing requirements set forth by the

Division on or before the filing deadline. once an
application hoo'boen anceptnd, it will be achodalod•

and tits applicant will be notified of the time and place
of such mooting. All plena and applicable materials
will be distributed to all members and support staff
of tits DRC a weak prior to.tho scheduled mooting.
B. Thu Design Reviow Conuniottoo shall meet with tits appli-
cant to review and discuss the proposed project and its
conformity with this Resolution. The DRC may formulate
recommendations on the design of tho project relative
to tits criteria listed in this Resolution or other
design criteria or development standards as adopted by
the City of Rancho Cucamonga. Such rocotm:andations shall
be filed in tits project fila to become final conditions
of approval. In addition, the applicant shall receive
written notice of such recommendations.
C. if, after review by the DRC, the Committee fools that the
project needs substantial revision, the project review
may be continued by the DRC to enable the applicant to
make appropriate changes and alterations. The - applicant
shall receive written notification of such decision and
the data when the DRC will moot again to review the
project.
SECTION 61 APPEAL
A. whore a project application has been acted upon by the
DRC, and the applicant or any interested person is
aggrieved by the action, may file an appeal to the
Planning Commission. The appeal shall state wherein the
actions of the DRC are not consistent or in conformance
with the provisions of this Resolution. At a regularly
scheduled meeting, the Planning Commission may affirm,
modify or reverse the recommendations of the DRC.
Decisions by the Planning Commission are appealable to
the City Council using thu same procedures.
SECTION 7s ENFORCEMENT
A. No building permit, for the construction of any building
or project described in this ordinance, may be issued
until the Design Review Committee has reviewed the project
for conformance with this Resolution, design criteria, a,,.td
development standards as adopted by the City of Rancho
Cucamonga.
B. Further, prior to final inspection or occupancy, the
completed project must be inspected by the Planning ;•'
Division for compliance with the conditions of approval.
No occupancy permit shall be issued unless all elements
are completed according to the approved plans. If for any
reason this cannot be accomplished, a cash deposit shall be
submitted by the developer to ensure compliance.
SECTION 0: ENVIRONMrNTAL REVIEW
The Rancho Cucamonga Planning Commission has found, based on review of
the Initial study, that this project will not create a significant
adverse impact on the onvtronmont and raeommonda the innuaneo of a Negative
Declaration by the City Council.
SECTION 9: OTHER LAWS, ORDERS AND ORDINANCES
Nothing in this Resolution shall be doomed to affect, annul or abrogate
any other laws or ordinancon pertaining or applicable to this properties
and areas affected by this Resolution, nor shall it be doem,ad to conflict
with any State laws, orders of requirements affecting such proportion or
areas. In the event that a conflict dons arise, the more rnstrietivo
ordinance shall apply.
SECTION 10: SEVERADILITY
The invalidity of any word, uootion, clause, paragraph, sentence, part or
provisions of thin Resolution shall not affect the validity of any other
part of thin Resolution which can be given affect without such invalid
part or parts.
NOW, THEREFORE, DE IT RESOLVER:
® 1. That the Planning Commission of the City of Rancho Cucamonga hereby
adopts Resolution No. .9 -61 recommending that the City Council approve
and adopt the Design R:viow Ordinance on the 26th day of September,
1979.
2. That a Certified copy of the Resolution and related material hereby
adopted by the Planning Commission shall be forwarded to the City
Council,

SUDJECTt REQUEST FOR PARTIAL PARK TATS CREDIT ON TRACT 9582 -1 — DEER CREEK
DACKOROUNDt The Planning Commission, at its meeting of July 25, 1979, Initially
reviewed the request for partial park tax credit on Tract 9582 -1. A copy of that
staff report and the minutes of the meeting are attached for your review. The
Commission continued review and consideration of this request to this meeting in
order to allow for full participation and attendance of thu Coutmiasion.
As was stated in the previous staff report, Section 7 of Ordinance U eats forth
the criteria by which partial credit is determined. The intent of the Ordinance
is to allow for partial credit when a dovolopmont provides recreational facilities
that relieve the City of a partial obligation of providing park and recreational
facilities. Door Crook development is a high quality residential development;
however, it is staff's opinion that the bridle trails provided do not meet the
mandatory criteria (specifically itom (d)) and that such credit is not the intent
of the Ordinance.
RECOMMENDATIONt
It is recommended that the Planning Commission recommend to the City Council that
no Park Tax Credit be given to this development based upon the criteria not forth
in Ordinance No. 8.

SUBJECT: REQUEST FOR PARTIAL PARK TAX CREDIT ON TRACT 9582 -1
BAC1WROIIND: Rancho Cucamonga han adopted Ordinance No. 8 regulating a Park and
Recreation Tax on now residential development (attached) . In addition to sott•.ing
the park foe, the Ordinance also has provisions for partial credits for those
developments which provide private open space for park and recreational purposes.
The Door Crook Company has submitted a latter raquasting partial credit of tt:e
park foe (attached). The applicant's request is based on the fact that the
development is providing a fully maintained landscaped bridle system throughout
the development.
®o ANALYSIS: Section 7 of Ordinance 8 sets forth the criteria by which partial credit
in determined. This development does not moot item (d) under Section 7 which
requiron that the open apace be reasonably adaptable for use for park and
recreational purposes. Bridle trails are not reasonably adaptable to other types
of park and recreational uses. The size and shape of the bridle trail rostricts
its uea.
The Commission must also consider, should credit be given on bridle trails for
this development, that all other future residential developments with bridle
trails woulJ be entitled to a similar credit. As the Commission is aware, the
City has a significant amount of half -acres and acre developments that utilize
bridle trails. In addition, the specific, plans are using traile and pathways.
If park tax credit in given for those types of restricted use open spaces, then
it will significantly reduce the ability of the City to develop a park system
consistent with the master plan for Parks and Recreation.
RECOMMENDATION: The Planning Division staff recommends that the Planning Commission
recommend to the City Council that no Park Tax Credit be given to this development
based upon the criteria set forth in Ordinance No. 8.

SECTION 1. Intent• and Puroosa.
The City Council of the City of Rancho Cucat7ongej
hereby declare, a tax on all new renidenL•ial development within
the City for the sole purpose of oroducinq revenue for the
acquisition, development And initiial equioment of new parks
or additional park lands. This is declared pursuant to the
taxing power granted to the City of Rancho Cucamonga by the
Government Code of the State of California.
The purvose of the tax is to .^.ssist in financing tile olanning,
acquisition and development of parl:s to maintain the level of
Dark service as the City's population increases.
SECTION 2. Definitions.
a. , "City" shall mean the City of Rancho Cucamonga.
b. "Residential Dave]opment" shall include all
dwelling units constructed for the first time on open land or
when existing structures are remodeled, added to or otherwise
altered to increase the number of dwelling units.
C. "Dwelling Unit" shall inclule each single family
dwelling, each unit of an apartment, duplex dwelling grouo or
multiple dwelling structure or condominium or planned residential
development as a separate habitat for one or more persons or each
mobile home space designed to contain a mobile home trailer on
a semi - permanent or permanent basis.
d. "Person" includes every oarson, firm or cornorat:ion
constructing a dwelling unit directly or through the services Of
any employee, agent or independent contractor.

SECTION 3. Taxi Imnonition and Aooliration.

this ordinance and shall be known an the Parks and Recreation
Tax.
SECTION 4. Tars Amount.
Every parson constructing any duelling unit within
ttsa City of Cucamonga shall pay tkle Cite{ the followings
For each single family dwelling unit, the sum of $300.00
For each multiple dwelling unit, the sum of. $180.00
For each mobile home unit 4 $150.00
SECTION 5. Tnxs When Payable.
The tax imposed in this chapter shall be due and
payabin upon issuance by the City of a building permit for the
construction of any dwelling unit and shall be refunded only in
the event that the building permit issued has expired and no
construction has been commenced.
SECTION 6. Disposition of Tax Receipts.
® There is heroby established a Park: Development Fund.
All sums collected pursuant to this chaoter shall be deposited
in said Park Develooment Fund and shall bs used solely for
acouisition, development and initial equipment of new parks
or the expansion of land or services on existing parks in
accordance with the Park, Parkway and Open Space element of the
Rancho Cucamonga. General Plan.
SECTION 7, Partial Credit.

of the subdivision, partial credit, not to exceed 50g, may be
given against the requirement if the City Council finds that it
is in the public interest to do so and that all the following
standards are met:
a. That yards, court areas, setbacY.s, and other
open �ireas required to be maintained by the zoning and buildings
ordinances and regulations shall not be included in the commuta-
tion of such private open space; and
b. That the private_ ownership and maintenance of
® the open space is adequately provided for by recorded viriLten
.agreement, conveyance, or restrictions; and

restricted for park and recreational purpona:i by recorded
covannnt which runs with the lto nd in favor. Of the future

adaptable for use for park and recreational purposas, taking
into consideration such factors an size, shape, touography,
geology, accoss, and locations, and

in substantial accordance with tho provisions of the recreational
element of the Master Plan of Parl:s and Recreation; and
f. That the open space for which credit is given is
a ninimum of three acres and provides for adcauate developmant
and naintenanco of the area for recreation purpoaea.
Before credit is given the' City llanager or his designated reorc-
nentaLive ahall make written recommendations to the City Council
for Lheir approval.
SECTION S. Periodic Revision.
Inasmuch as the ta:c set forth in this chanter is based
on average costs of land and daveloomant, a review shall be con-
ducted periodically to dotormire whether the Lax needs revisions
to reflect current costs of such acquisition and development.
SECTION 9. Repaal of San Be
San Bernardino County'Ordinance Ila. 2126, heretofore
adopted as an Ordinance Of the City of Rancho Cucamonga as re-
quired by Section 34328.5 of the Government Code of the State of
California is hereby expressly declared revealed, and is super -
ceded as an ordinance of the City of Rancho Cucamonga by this
ordinance.
SECTION 10. The Citv of Rancho Cucamonga has just been
incorporated and has no funds whatsoever to orovide for Like ulnnning,
acquisition and development of public narks. It is necessary
that the City acquire funds for such Tauroosee; without delay. This
Ordinance is therefore necossary for the protection of the public
health, welfr.re and general safet; and shall ta1:e effect innediately
uson its adoption as an urgency ordinance.

Gentlemen:
This letter in submitted as n request for a Tax Credit in accordance
with Section 7 of your Ordinance No. 8 and the following materials are
submitted to acaint you and your staff in evaluating, the request:
a. Copy of Landscaping plans for Tract 95 82 -1.
b. Copy of overall tentative map.
c. Copy of Conditiona, Covenants and Restrictions for the
improvement and development of the Doer Creek Project,
d. Copy of the By -Lava and Articles of Incorporation of the Deer
Creek homeowners Association.
e. Copy of the report of the Department of Real Estate of the State
of California.
The basis of the consideration of a Tax Credit against the fee of
$14,700.00 paid on the first unit of 49 houcea, (two lots otill vacant of
the total 51'lots) is set forth as follows:

1. Thin is the first planned Equestrian vnit provided with adequate bridle
trails in front of the lots, planted, fa:,red with decorative fence and
provided for continuing care, including irrigation system. The trails
are not located where they become weed infested and uninviting, usually
merely providing oceans to corals.
2. Automatic irrigation systems have been installed; trees, shrubs, and
ground cover have been planted and established at a total coot for
the 51 lots of $112,000.00

reception of ditch of over 6,000 feet in length across the upper portion of
Section 24, which provides major flood protection to roads in the area, to
Chaffey College, and to other private and public facilities. The coat to
provide this protection was approximately $100,000. Thin exp- rditure wag

Commissioner Dahl asked if he understands correctly that the trai ?. system
within thin development in maintained by n homeowner's association and
the City does not maintain those trails.
Mr. Vairin stated yes, it in the reoponsibillty of the humeowner's associa-
tion to maintain this area. lite insuo is whether or not the Convnission Loelq
credit should be given for bridle trails,. If this credit is allowed, all other
future residential developments with trails could be entitled to a similar
credit. If credit is given for these types of restricted use open spaccu,
tile% it will significantly reduce thn ability of the city to develop adequate
park sites.
Mr. Harold tons, representing the Door Creek Company, stated the homeowners
association to responsible for the upkeep of all lnndncaping within this
development no well an maintenance of the bridle trails. The City in not
required to maintain any of these areas. it in his opinion by approving
a partial park tax credit for thin tract it will not lead many of the other
developers within the city to request the same type of conaid oration, especially
those that were in operation prior to the Deer Crack Developments, Fie requested
that the Commission consider a partial credit be given for Tract 9582 -1.
Chairman Rempel stated hie understanding of the ordinance is that partial
credit may be given where private open apace for a park is developed for
the purpose of the people in the developnent, not necessarily for the
community as a whole.
Mr. Lam stated the ordinance is subject to interpretation. Staff feels that
the Deer Creek project in one of the beat residential projects in this com-
munity and is an asset to the City. However, it is his interpretation of
the c Ainance that When a developer provides recreational facilities that
relieve the City of a partial obligation of providing park and recreational
facilities (such as a private park and open space), u partial tax credit is
justifiable.
Cnimnissioner Dahl stated this trail system in very unique from other trail
systems within the city. This trail system fronts onto the street and runs
along the streets. This should be taken into consideration being that it is
a unique situation. The ordinance as he seen it is to promote more open
space and more recreational arena. Ile believes a partial credit should be
considered for this tract.
Mr. Doug Hone stated if any type of recreational use is developed within a
project and maintained by a homeowners association it in his opinion it is
providing the need for recreational facilities within the community and soma
type of credit should be given.
