Meeting
July 27, 1983
Chairman ;Dennis Stout called the Regular Meeting of the City of Rancho
Cucanonri% Planning Commission to order at 7:05 p.m. The meeting was held at
Lions F:;.rk Community Center, 9161 Base Line, Rancho Cucamonga, California.
Chairm, n Stout then led in the plede of allegiance.

COMMITTEE ASSIGNMENTS
It was a consensus of the Commission that Commissioners 2,_-ker and Juarez be
appointed to serve on the Design Review Committee. Commissioner Juarez would
serve a 12 -month term and Commissioner Barker's would serve 6- nonths on the
Committee, at which time Commissioner McNiel would begin at 12 -month
appointment. Commissioner McNiel will serve as an alternate in the interim,
with Chairman Stout serving as second _lternate.
It was a consensus of the Commission that Commissioner Stout be appointed to
serve on the Trails Committee, with Comr�ssioner Juarez serving as alternate.
APPROVAL OF MINUTES
Motion: Moved by Rempel, seconded by Juarez, carried, to adopt the Minutes of
the Planning Commission meeting of June 22, 1983. Commissioner Stout
abstained as he did not attend this meeting.
Motion: Moved by Repel, seconded by Juarez, carried, to adopt the Minutes of
the Planning Commission meeting of July 13, 1983 with a correction to page 5
to clarify Commissioner Rempei's statement regarding some trees do better in
smaller containers rather than in smaller sizes. Cormissioner McNiel
abstained as he did not attend this meeting.

Dan Coleman, Associate Planner, reviewed the staff report advising that the
Minutes of this meeting as well as any changes desired by tm; Commission would
become part of an addendum to the printing of the final Environmental In.pact
Report.
Chairman Stout opened the public hearing. There were no comet entsr therefore
the public hearing was closed.
Commissioner :uarez asked why an ZIR had been done for this projec�.

proposal, staff determined that several areA.s needed further study and
recomme,:ded that the Planning Commission recui.e a focused Environmental
Impact Report for the project to research mitigation measures. The project
was then brought before the Commission, at which time the COSmSssion agreed
that certain areas needed further study.
Ch ?'r�.an Stout stated that traffic circulation north or this project was the
sus:;;: -, of a great deal of discussion during the Commission's initial review
and asked if this issued had been addressed.
Mr. Gomez replied that the cul -de -sac at the northern part of the tract will
ailaw an opportunity for EXteriSiura of circulation needs to the foothills area
above the tract.
Chairman Stout asked i`: *.::e additional traffic from the north was considered
at the time the :tateraent was made that -Zai-yl could handle the additionai
traffic.
Mr. Coleman replie,1 that this was no: specifically discussed in the EIR,
however based upon the acreage availaole for development in that area, traffi:
would not exceed Beryl's capacity.

Commissioner Barker referred to the Engineering conditions of the Resolution,
and asked what "slope stabilizing devices" meant in condition 14.
Paul Rougeau, Senior Civil Engineer, replied that there is a wide selection of
stabilizing devices which could be used in the canyon and the City would meet
with the project's engineers to come up with the best stabilizers for that
area.. Further, that it would not be a completely concrete channel which would
cau, >e visual impacts, but something that would fit into the natural environment.

Chairman Stout as -ed if there was a reason why the runoff was not being
channeled straight down Beryl and dumping it into Demens Channel, instead of
turning at Almond.
Mr. Rougeau replied that going straight down Beryl is a shorter route,
requi:':s less storm drain and does not r;1�-ire digging up the existing
streets.

Robert Curtis, 9171 Can:elia Court, Rancho Cucamonga, addressed t!!° Commission
asking if a trail would be provided so that area residents could still get to
the mountain areas.
Dan Coleman replied that there is a community trail that comes from the custom
lot subdivision to the west which will be continued along the north side of
the exist: g homes and go through the project to the existing dirt road, which
will provide access to the mountain areas. Further that this project had been
re:ewed by the Equestrian Trails Committee.
Curtis stated his concern with runoff con 3 down Beryl and asked if this
would be minimized.
Mr. Rougeau replied that the street will convey most of the drainage to the
storm drain facility, however a minimal amount of runoff would still surface
drain onto Beryl.
There were no further comments, therefore the public h -aring was closed.
Commissions. Renpel expressed his appreciation to the a�.ulicair for what they
have done mace this project, in his opinion, one of _�,e nicest in the City.
Commissia a Barker sta ,d that the developer had been agreeable to the
suggestions Gf the De.-vn Review Committee and staff to mitigate impacts.
Further, -�n at he consi::ered this a sensitive area and would like to see 'the
loo sizes ;arger to provide a transition.
Chairman Stout agreed with Commissioners Rempel and Rarker and stated the area
is extremely sensitive due to the erosion and seismic;,:y. Further, that if
the area has to be developed, which is the right of the property owner, this
project is one of the nicest to be found.

Paul Rougeau, Senior Civil Engineer, reviewed the staff report. He - eferred
to Planning Commission RescA ution 79 -07, adapting the City's arrpcc
Improvement Policy, which requires the dedication .ad improvements of a
private rad to the nearest public street. He advised that Bella Vista is a
very wail maintained private street, therefore staff did not feel that the
requirement for full dedication to Carne7� ?n Street would be necessary,
however would require an offer of dedicat•, -ln. He advised that the street
would remain private and maintained totally by the property owners involved.
He pointed out that the offer of dedication provides assurance that should all
the surrounding property cwners decide they want the City to take over the
street, the provisions for dedication for these parcels would exist. He
further stated the City has no intention in the foreseeable future to take
over the street as it is adequate the way it is. Mr. Rougeau also stated that
the map has been reviewed by the Equestrian Committee which recommended that
if a utility easement exists along the east or west property line, equestrian
easements should be provided.

Commissioner Barker asked if he was corract in that the 25-feat on Bella Vista
would not be maintained by the City, b::t by *_he property owniar.
Chairman Stout replied that the difference between the dedication and cffer of
dedication would be that the landowner of these lots woulu be responsible for
the maintenance of Bella Vist and also would be liable fcr maintenance
problems anti also any accidents in that area which would be an incentive to
keep the street maintained :n front of the parcels.
Mr. Rorgeau replied that this is crrrect.
Chairmar Stout opened the public hearing.
Gary Sanderson, Linville /Sanderson & Associates, representing the applicant,
addressed the Cog nission stating that the applicant was in full agreement with
the fin.'ings of the staff reports, resolutions and conditions of approval. He
advised that the builder was also present this evening and had brought along
an exhibit cf a douse proposing to be built on one of the lots.
Chairman, Stout asked Mr. Sanderson if he was aware of a utility easevent on
the back of these parcels.
Mr. Sanderson replied that a utility easement exists at the southeast and
southwest corners of the parcels and applicant would be agreeable to an
equestrian trail running along the south property lne.
Cairman Stout asked if the exhibits could be viewed by the Commission.
John Olson, the builder for the proposal, presented an exhibit of a 3100
square foot house he is planning to build on one of the parcels.
Chair:an Stout asked Mr. Olson if he understood that it would be thf7 property
owner, not the CiLy 0 Rancho Cucamonga, who would be responsible f,.r the
maintenance of the private road.
Mr. Olson replied that he understood this and had no problems.
Doug Hone, general partner in Hillside Vista Associates, contiguous. property
uwner to this parcel, addressed the Commission stating that he would like the
insertion of a condition for agreement of drainage thus giving Hillside Vista
an opportunity to view the drainage plans for this proposal.
Commissioner Rempel replied that such a condition already exists i:^ the
conditions of approval for thr_ project.
Mr. Hone asked Commissioner Rempel if he would recite this conditian so it
would be understood by all parties.

Commissioner Rempei replied that the item was covered in condition number 2 of
the City Engineer's Report, under Drainage and flood Control, and Mated that
", ^q °uate previsions sha-!! be made for acceptance and disposal of su—face
drainage entering the property from adjacent areas ".
Paul Pougeau, Seniar Civ:1 Engineer, stated that condition 11 also requires
easements for drainage from adjacent property prior to issuance of uuilding
permits.
Gary Sanderson staled that he felt there would be no significant increese to
the natural drainage as it exists today as a result of this project. However,
tiio engineer and applicant would be more than happy to work with the property
owners to the south of the proposal.
Paul Rougeau stated that the current equestrian trail standards requires the
ability to handle drainage as well which woulli necessitate a gutter to handle
the runoff from these parcels.
There were no further public comments, therefore Chairman Stout closed the
public hearing.
Commissioner Barker asked if the equestrian trail requirements had been taken
care of in the conditions of approval.
Chairman Stout replied that these would have to be added.
Mr. Rougeau stated that staff mould suggest that condition 8 under General
Requirements and Approvals be added to tha City Engineer's Report and that it
be ended after the first sentence. The condition would merely read "Loc-%l and
Master Planned Trails shall be pruvided in accordance with the Trail Plan ".
Motion: Moved by Rempee, seconded by McNiel, unanimously carried, to adopt
Resolution 83 -5E approving Variance 83 -03.

Paul Rougeau, Senior Civil Engineer, reviewed the staff report, advising that
staff recommended that the first sentence of condition 8 of the City
Engineer's Repr,;t, under General Requirements and Approvals be added.

Gary Sanderson, representing the ap p•lir--

Commission stating that the applicant is in agreement with most of the items
listed in the Resolution with the exception of the requirement for street
improvements on Hillside and the requirement for construction of a sidewalk on
Hermosa. Mr. Sanderson advised that the applicant is requesting that the curb
and gutter requirements for Hillside and Hermosa be waived until parcel 1 is
sold. Further, the applicant did not want to have to remove additional
vineyards due to the dejication on Hermosa.
Commissioner McNiel asked what the rock house is now being used for.
Janine Tibbits, daughter of the applicant, addressed the Commission and
replied that the rock house is now an occupied rental unit. She stated that
there are no sidewalks in t?-e area and did not '•^derstand the need for
sidewalks on Hermosa ,nd :54.kson.
Mr. Rougeau replied that the sidewalk is required on Wilson because it is e.
secondary highway and will be a route for school children in the area.
However, the sidewalk requirement for Hermosa is in error and should be
removed from the conditions.
Cg nissioner Rempel if the resolution could contain a condition that the
sidewalks be waived until such time as development occurs.
Mr. Rcu3eau replied that the sidewalks could be included in a lien agreement.
ms. Titbits stated that two rows of vir, ?yards would have to be removed in
order to do the required improvements and did not see the reasoniig behind
requiring sidewalks or. Wilson and Hermosa. rurth-r' the applicant would be
agreeable to installing these improvements when the adjacent trzct begins
development, or the proper -,v is sold, as it is not his intention to develop
any of the parcels.
Comimissicner Rempel advised that these are requirements which cannot be waived
by the Planning Commission, but must be appealed by the applicant to the City
Council, with the Commission's recommendation that they be waived.

Motion: Moved by Resmpel, seconded by Juarez, unanimously carried to adopt
Resolution 83 -98 approving Parcel Map 8007 with the deletion, of the sidewalk
requirement on Hermosa and the addition of the first sentence of condition 8,
City Engineer's Report, under General Requirements and Approvals. Further the
Commission recommended that the City Council issue lien agreements to waive
street improvements until development of the adjacent tract or if parcels 2
and 4 are built prior to the devel-,went of the tract, parcel 3 would then
nave to install the irpYnvem!nts.

rights as a potential property owner.
Ted Hopson, Assistant City Attorney, advised teat signatures of all propertyme
owners would be required prior to recordation of the final
ii= Mr. Rawchuck objected to any aspect, he could refuse to sign the map.
Mr. Rougeau stated that the property is in litigation and suggested that
possibly staff could meet w;th Mr. Rawchuck and discuss his concerns.

after approval of the parcel map City staff had advised the applicant the`

Design to bring additional employees and revenue to the City, and urged the
approval of the Cor,jitional Use Permit.
Co^missioner Barker asked if the bond required installation of improvements

Mr. Pougeau replied that there are lien agreements whi:h require installation
prior to construction, however it was his opinion the'. this applicant had a
12 -month bond.
Co:mnissicner Rempel stated that the improvements on Haven were the only ones
he recalled being deferred by Vie Commission in its previous review. Further,
normally these improvements wruld have been required prior to recordation of
the final map.
14r. Salvati advised the r ,)mmission of the importance of the approval of the
Conditional Use Permit '.o allow the installation of the trailers so that
employees could begin work on August 2. He further advised that he would be
in the City offices the next day to sign the lien agreement extension.
Chairman Stout asked Mr. Salvati to erpiain his position on the improvements
and if tie fel* that the improvements on Center Avenue were necessary after the
installation of the trailers.
Mr. S °'.vati replied he did not fell them necessary at this time.
Chairman Stout advised that the staff is recommending a 6 -month extension to
install the improvements and not 6 months to come back to the Commission for
discussion.
Mr. Salvati replied that the improvements would be put in upon construction of
additional buildings. Furthers he was not in a position to make a decision
regarding the improvements, but did not see why the CUP could not be granted
and then have the Commission call in the bends if the improvements were not
installed in 6 months.
Mr. Rougeau stated that the agreenent would be for a 6 -month extension at
which time the applicant could apply for an additional extension. However, at
tt.at time, the extension could be denied and the City could call in the bonds.
There were no further comments, therefore the public hearing was closed.

Chairman Stout stated that he was not in favor of approving the Resolution for
;he CUP unless it contained a requirement that the street improvements be
nstalled prior to occupancy of the trailers. Further, that the improvements
should have been done a long time ago and did not see vihj the City should be
sutiected to the expense of calling in bonds.
Commissioner Rempel stated that staff's proposal is a fair compromise for both
the applicant and the City that the street improvements go in; however, did
not fee' an additional extension should be granted.
Commission,ir McN5el stated that approval of the Conditional Use Permit could
be for 6 moths and if the improvements are not installed in that time, the
CUP could be revoked.

83 -101 approving Conditional Use Permit 83 -11 with an amendment to Planning
Division corditio,i one to read that the temporary trailers are approved for 6

It was the consensus of tine Commission that the following meeting dates be
established for the review of the Draft Developrnrent Code: August 16,
September 6, September 20, G_tober 4, and October 12. All meetings will be

PUBUC COMMENTS
Commissioner Rempel stated that he would like to see the crosswalk in the
middle of of the street at Alta Loma Nigh School on Base Line removed as soon
as possible.
Coucnissioner Barker expressed his app:ec;ation to staff- for their good faith
effort to mitioate concerns expressed by area residents who are upset with the
construction of a local project. He also romnended Chairman Stout on his
first meeting as Planning Commission Chairman.
Chairman Stout asked staff to find out who the property owner is who has
fenced off the equestrian trail on Demens Channel near the equestrian bric;ge
between Sapphire and Carnelian r�y,:est that it be removed.

A. General: Part I of the Initial Study has been completed by the

Staff has completed Part II of the Environmental Assessment and
found no significant impacts on the environment as a result of
this project. This review is for environmental consideration
only. The City Pianner will approve the development review
application upon submittal of revised rawings as requested by
the Development Review Committee.

However, these increases are insignificant since the
surrounding streets and drainage facilities exist to handle the

Calle Zorrazen (Exhibit °A"). The project consists of 38 custom lots cn
15.7 acres of land in the R -1 -12 zone. The current expiration date is
Septenber 25, 1983.
ANALYSIS: Tentative tracts in the City of Ranci.L Cucamonga are valid
for a max,m-im of four (4) years wit.i: appropriate extEnsions per the originally
Subdi�:ision Map Art. This tract we.s originally approved eighteen for month
months on March 2-", 1981 and subsecuently granted an eighteen month
extension. Therefors, the tract is eligible for a final eighteen (18)
month extE lion. The property was recently sold to RH Associates, and
the new landowner is requesting the extension to allow adequate time for
recordation of the final map.
RECOMMENDATION: It is recommended that the final eighteen (38) month
extension be granted for Tract 10035. The new expiration date would be
March 25, 1985.

WHEREAS, a request has been filed for a time extension for the
above - described project, pursuant to Sectior. 1.401.11.2 of Ordinance 28 -9, the
Sutdivision Ordinance; and

SECTION 1: The Rancho Cucamonga Planning Commission has made the
following findings:
A. That prevaiiing econommic conditions have caused a
distressed market climate for residential projects.
B. That rurrent economic, marketing, and inventory
conditions make it unreasonable to record the Tract
at this time.
C. That strict enforcement of the conditions of approval
regarding expirations would not be consistent with
the intent of the Zoning Code.
D. That the granting of said time extension will not be
detrimental to the public health, safety, or welfare,
or materially injurious to properties or improvements
in the vicinity.
SECTION 2: The Rancho Cucamonga Planning Commission hereby grants a

II. ANALYSIS:
A. Genera]: TnE major issue is the comparibilit_•- cf 'Lite proposed
dance school gith adja-cent uses. Typically, the concerns are
nr se, traffic, parking, and 'hours of operation. To mitigate
any potential corf'licis. the applicant h %s proposed to offer
classes from 4 o.m. to 9 p.m. on weekdays and 9 a.m. to 1 p.m.

standards of the Industrial Specific Plan. Most dance stu:ients
are dropped off and picked up by par2nts, thus minimizing the
parking demand. Activities similar to a dance school are
successfully operated in othar industrial areas of Rancho
Cucamonga.
ill. FACTS FOR FINDINGS: this project is consistent with the Industrial
Area Spec iFT Plan and the General Plan. The proposed use,
together, with the recommended cond "Lions of approval, will not be
detrimental to the public health or materially injurious to
properties in the vicinity.
IV. CORRESPONDENCE: This item has been advertised as a public hearing
in The Daily Report Newspaper, the property posted, and notices
were sent to property owners within 300 feet of the project site.
To date, no correspondence has been received either for or against
this project.
V. RECOMMENDATION: it is recommended that the Planning Commissior
consider all material and input regarding this project. If after
such consideration the Commission can support the facts for finding
and cond-itions cf approval, adoption of the attached Resolution
would be appropriate.

b:y partner, Carol Pierson, and I, Martha Smith, are
planning to open a dance school in the Rancho Cucamonga area.
Carol has been employeed as a jeweler in a local firm for the
last six years. I am a partner in Backstage dancewear stores
with shops in Upland and 'Vest Covina. I have earned my B.A. in
Dance from the University of California at Irvine. Carol and T-
have both been studying ballet seriously for the past nii:e years
and have taught locally. Our experience has sho%II us that there
is need for a professional ballet school in this area.
We have found that industrial units suit our needs best.
These buildings have a large floor area and a high ceiling which
gives a dancer the feeling of spaciousness -- similar to being
on stage -- and more importantly, it helps protect a dancer from
injury. Also, buildings in an indus.-ial area are of the proper
dimensions at an affordable cost.
The plans for our fiance school are as fellows:
1) Hours - our proposed hours of business are I41ondar
trrcuE;h Friday from 4 P.i.i. to 9 P.I.I. and Saturday
m ,3rninzs from 9 A.K. to 1 P.Io1. Because our hours
of operation are late afte noon, evenings, anc
Saturdays, we will be using the streets and park-
ing facilities at a time when they are not normally
busy. Therefore, the safety of our students would
not be Jeopardized by traffic. We :could require that
all child_en be accompanied by an adult to their cars.

2) Parking - The nine par:i Z spaces allotted for the
buildings we &wire should be ample since most of
^.Ir students are dropped off and picked up by
parent-'.
3) "lass Z7ize - We anticipale having, ten students per
class.
4) Classes Offered -- in addition to all levels of
ballet, we wi =1 also offer jazz and tap.
5) Access - We are easily accessible to the entire
"lest End area through freeways and major boulevards.
6) Clientele - Our students, their parents, and our
staff will be drawn from local families interested
in creating an atmosphere of appreciation for the
fine arts. The introduction of a professional
quality ballet school is an addition to the
cultural life of the community.
We feel that our s nhool would be a quality use of industrial
property for the followii :S reasons:

it would be less a :.-pensive for the building owner to Aaft
maintain
2) it doesn't waste water
3) it uses little power
4) it would cause a minimum amount of traffic
$) there would be no noise or poilution
There is precedent for t!-.Is type of service in an industrial
complex. Locally, Chaffey Ccllege extension classes, Beth Aru1's
Dance Studio, and Sonis Gymnastic School are all held in indus-
trial u- its in this area.
Therefore, 1 request your approval and issuance of a
Corditioaal Ilse Permit for a dances school in the Rancho
Cucanonta Business Park.

A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING COMMISSION
APPROVING CONDITIONAL USE PERMIT NO. 83 -12 FOR A DANCE
SCHOOL LOCATED AT 10722 ARROW, SUITE 604 AND 606 IN THE
INDUSTRIAL PARK ZONE
WHEREAS, on the 22nd day of July, 1983, a complete application was
filed by Martha Smith and Carol Pierson for review of the above- described
project; and

Planning Commission held a. public hearing to consider the above- described
project.
NOW, THEREFORE, the Rancho Cucamonga Planning Commission resolved as
fcllows:
SECTION 1: That the following findings can be met:
1. That the proposed use is in accord with the General
Plan, and the purposes of the zone in which the use
is proposed; and
2. That the proposed use, together with the conditions
applicable thereto, will not be detrimental to the
public health, safety, or welfare, or materially
injurious to properties or improvements in the
vicinity; and
3. That the proposed use will comply with each of the
applicable provisions of the Zoning Ordinance.
SECTION 2• That Conditional Use Permit No. 83 -12 is approved
subject to thefollowing conditions:
PLANNING COMMISSION
1. This approval shall become null and void if a
Certificate of Occupancy is not issued within 18
montns from the date of aproval, unless an extension
has been granted by the Planning Commission.
?. Approval of this request shall not waive compliance
with all sections of the Loning Ordinance and all
other applicable city ordinances in effect at the
time a Certificate of Occupancy is granted.
3. This approval shall run with the applicants and
shall become void upon a change of ownership that
does not include the original applicants or if the
business operation ceases.

4. All exterior signs shall require Planning Division
approval in acordance with the Sign Ordinance.
5. The operation of the use shall comply with the Class
A performance standards of the Industrial Area
Specific Plan, particularly noise and vibration.

The subject t:•act was conditionally approved by Planning Commission on January
12, 1983 by Resolution No. 83 -08. The developer has approached Staff with a
request to place the final approval of the tract map on the next available
City Council Agenda, August 10, 1983: The ensuing discussions on bending and
design of the tract_ :nap led to a decision to waive Engineering Condition #14
of Section 2 of the said Resolution for the construction of a storm drain.
Therefore, Staff took action to place the item on this agenda. However,
further analysis of the required conditions has indicated that a change now is
premature. Therefore, no changes should be made at this time.
RECOMMENDATION: It is recommended that Planning Commission complete the
Public Hearing and take no action on this item since no amendment is
recommended at this time.

WHEREAS, Tentative Tract Map No. 12237, hereinafter "Map" submitted
by Woodland Pacific, applicant, for the purpose of subdividing the real
Property situated in the City of Rancho Cucamonga, County of San Bernardino,

Planning Commission for public hearing and action on January 12, 1983; and
WHEREAS, the City Planner has reconmtenued approval of the Map subject
to all conditions set forth in the Engineering and Planning Division's
reports; and
WHEREAS, the Planning Commission has read and considered the
Engineering and Planning Division's reports and has considered other evidence
presented at the public hearing.
NOW, THEREFORE, the Planning Commission of the City of Rancho
Cucamonga does resolve as follows:
SECTION 1: The Planning Commission makes the following findings in
regard to Tentative Tract No. 12237 and the Map thereof:
(a) The tentative tract is consistent with all
applicable interim and proposed generai and specific
plans;
(b) The design or improvPmen� of nhetentative proposed

general and specific plans;
(c) The site is physically suitable for the type of
development proposed;
(d) The design of the subdivision is not likely to cause
substantial environmental damage and avoidable
injury to humans and wildlife or their habitat;
(e) The tentative tract is not likely to cause serious
public health problems;
(f) The design of the tentative tract will not conflict
with any easement acquired by the public at large,
now of record, for access through or use of the
property within the proposed subdivision.

SECTION 2: Tentative Tract Map No. 12237, a copy of which
attached hereto, is hereby approvesi subject to all of the following conditions
and the attached Standard Conditions:
PLANNING DIVISION
1. CUR's shall be prepared for the project to preserve
existing trees, maintenance of trails, and minimize
grading. The CC&R °s shall be developed by the
applicant and submitted to the City for review and
approval prior tc approval of the final map.
2. Lot 36 has not been accepted for park and
recreational uses.
3. The final design of the perimeter parkways, walls
and fences shall be completed by the applicant and
approved by the City Planner prior to final map
approval,
4. The Hermosa parkway shall be designed and developed
by the applicant as a trail.
5. All trails, fences, drainage structures and site
clean up shall be done in conjunction with street
improvei-nent installations.
6. The two trail crossings over Hermosa shall be
texturized and appropriately signed by the
applicant.
7. No structures for human occupancy shall be built.
within 75 feet of the fault line or north cf the
fault line.
3. All structures in this project shall be designed to
confcrm with all seismic requirements of the Uniform
Building, Code and City standards.
9. If any evidence of cultural remains is found during
the development of this project, work shall be
stopped and a qualified archeologist shall be
ccnsuited for a proper evaluation of i.he remains.

ENGINEERING DIVISION
10. Developer shall be required to install a concrete
drainage structure along Alta Loma Channel from its
northerly tract boundary to the proposed channel at
Wilson Avenue. The cost of this stormdrainage
system shall be credited against the stormdrainage
fee for this project and a oei -i-' —cemont Agreement
per City rdinance contributions which7exceed the fee executed
amount cover the
il. The above condition shall be waived when and if the
Alta Loma Assessment District is formed to complete
the installation of an improved channel.
12. Developer shall submit a letter to the City Engineer
requesting the extension of the Alta Loma Channel
boundary to include the portion of the tract as
noted on the Tentative Tract Map. Execution of
Payment Guarantee Agreement for participation in
consulting cost relative to formation of Alta Loma
® Channel shall be required.
13. Developer shall be required to install a
stormdrainage system along the southerly tract
boundary from its easterly boundary to the proposed
Alta Loma Channel.
14. The above condition shall be waived when and if the
Alta Loma Assessment District is farmed to complete
the installation of an imprcved channel.

This tentative tract was approved by the Commission on Decem:er 8, 1982. The
attached request from Mr. Charles Roy is for the elimination of a requirement
to construct a storm drain pipe on 19th Street (State Route 30). Engineering
calculations from Mr. Ray's consultant show that the street widening will
carry the same flows as would the pipe and will eliminate a number of puddles
which now occur on 19th Street during rains.
The required pipe is not a master planned storm drain has met with
resistance from CalTrans. The existing and proposed pipes have a nearly level
slope, thereby creating a maintenance nuisance and limiting the capacity of
the drain system. An increase in the overall capacity of the drain will not.
be allowed by CalTrans due to the unsatisfactory downstream conditions and
resultant liability.
For these reasons, it is apparent that an improvement to the north side of the
street will accomplish the same or better drainage while improving access and
driveway connections to the properties on 19th Street between the prcJect and
Amethyst Street.
RECOMMENDATION: It is recommended that the Planning Commission approve the
requested c ange from storm drain to street work on 19th Street and authorize
the Engineering Diviss ;u to work with the developer and Cc1T -ar-s ,c - lzy e
Improvements Plans to show widening of 19th Street +o carry aaticlpated
drainage flans. A resolution providing the change in conditions of approval
is attaches for your approval.

1 request that the requirement for a storm drain installation along
l9th St. be removed from our project and replaced with the construction
of a curb to contain flows fran our tract along the widened northerly
section of 19th St. to Amethyst St.
My engineer, Andreasen Engineering has devised a solution to the rrmoff
problem that affords advantages to the cite over the previous requirerent.
1)_ The northerly side of !9th St. is widened 3' +, bringing the
street nearly to its ultimate planned Width from our project
to A - i -thyst St.
2). The proposed surface drainage does not pose a maintenance
problem to the city, as does the drain. (The existing drain
fran Amethyst eastward wis 50% silted up as of 6- 1 -83).
1 understand that City Council bzlieves a public hearing is necessary
to discuss this situation. Accordingly, enclosed is a list of current
property owners in a 300' radius and a check necessary for the hearing
fee.

WHEREAS, Tentative Tract Map No. 12305 hereinafter "Map" submitted by

California, described as a residential subdivision for condominium purposes of

A. RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO CUCAMONGA AMENDING THE CONDITIONS OF APPROVAL FOR
TENTATIVE TRACT MAP 12305
WHEREAS, the Planning Commission tentatively approved Tract Map No.
12305 on December 8, 1982, by Resolution No. 82 -112; and
WHEREAS, the Planning Commision has held a duly advertised public

same to such Amendment.
SECTION 1: The Rancho Cucamonga Planning Commission has made the
following finings:
A. The Tentative Tract Map No. 12305 is consistent with
the adopted General Plan.
SECTION 2: The Rancho Cucamonga Planning Commission hereby grants a
revision to Resolution No. 82 -112 for the abovE- described project for the
following items:
ENGINEERING DIVISION
8. Installation of a storm drain along 19th Street from
the project boundary to the existing water course
across 19th Street, east of Amethyst Street, shall be
required. The applicant's Engineer shall submit
additional detailed drainage analysis for the City
Engineer to determine the scope and extent of the
work required.
SECTION 3: The Rancho Cucamonga Planning Commission hereby amends
Resolution No. 82 -112 to read as follows:
S. The northerly side of 19th Street shall be widened
4.00 feet (31 feet from centerline to front face of
an A.C. berm) from the east property line of the
subject tract to the west curb line of Amethyst
Street. Improvements will include asphalt paving,
asphalt berm, grading and catch basin modifications
to the satisfaction of the City Engineer and
Cal Trans.

ii. ANALYSIS:
A. General: The request for the change of zone is in conjunction
with a 24 unit apartment project on 1.93 acres of land located
on the west side of Vineyard Avenue between Arrow Route and
Footrill Boulevard (Exhibit "B "). The development proposal, OR
83 -18, is also on the agenda for the Commission's review and
consideration. A description of the project is provided with
the Development Review staff report.
The project site is adequate in size and si:aps to accornodate
the types of uses that would be permitted within the R -3
zone. The zone change, in conjunction with the of
12.4 du /ac, will not create adverse impacts to the surrounding
properties and will be compatible with the medium density
General Plan designation of 4 -14 du /ac.
III. ENVIRONMENTAL ASSESSMENT: Part I of the Initial Study has been
completed by t.e ap jcant. Staff has completed the Environmental
Checklist and found no significant adverse environmental impacts
related to the project.
IV. FACTS FOR FINDINGS: The project site is adequate in size and shape
to accommodate the- proposed project. The change of zone is
consistent with the General Dian and has a density within the range
allowed. The approval of this zone change will not create adverse
impacts on surrounding properties.
V. CORRESPONDENCE: This item has been advertised as a public hearing
to The Dail y Report newspaper and all property owners within 300
feet of the subject property have been notific:;. To date, no
correspondence related to the zone change has been received,

Site Characteristics: The site consists of a vacant
which slopes gently from the northeast to soul
Currently, the site contains a variety of indigenouF
grasses and native plant materials. No structures are
on the site and street improvements do not exist.
General: ili0 proposed dove l0ynuent w l I I consist Of 24 apartfiient
units with attached enclosed garages. In addition, the project
contains a limited recreation area which includes a swimming
pool, tot lot, and cabana. Two parking spaces have been
provided per unit with an additional five spaces provided for
guest parking. In addition, the applicant is requesting a
change in zone from A -1 (Limited Agriculture) to R -3
(Multi - Family Residential). The project site is adequate in
size and shape to accommodate the proposed apartment
development which conforms to R -3 standards. The change in
zone and density of 12.4 du /ac are also consistent with the
General Plan iand use designations of Medium Density
Residential (4-14 du /ac).
Design Review Committee: The Design Review Committee was
generally pleased with the design of the project but was
concerne�_ with providing additional detail to garage doors and
"breaking" garage eave lines in order to provide greater
distinction between individual units. In addition, the
Committee recommended providing low privacy walls designed to
a'_'^ine unit en,rances. Lastly, the Committee recommended that
apartment units be setback eight (3) feet from the circulation
aisle in order to prevent vehicles from parking in front of
garage units.
Development Review Committee: The Development Review Committee
was primarily concerned with surface drainage and suggested
that the project drain to the southwest corner of the property,
to be accepted by Tract 11144. The Committee also suggested
that the development may be able to drain to the adjacent
County flood corridor. Lastly, the Committee requires full
street improvements along Vineyard Avenue including curbs,
gutters, sidewalk, drive approaches, street lights, pavement,
etc.
Environmental Assessment: Part I of the Initial Study has been
completed by t e app licant. Staff has completed the
Environmental Checklist and found no sigrsificant adverse
envirormmental impacts related to the project.

Ill. FACTS FOR FINDINGS: The findings listed on the attached Resolution
are supporte by the following facts:
The project site is adequate in size and shape to accommodate
the development and the proposed residential uses are in
accordance with the objectives of the General Plan and Zoning
Ordinance.
o The proposed site plan, in conjunction with the conditions of
approval, is consistent with the current development standards
of the City.
IV. CORPESFCNDFjiCE- This item has been advertised for environmental
review in The Dail Report newspaper. To this date, no
correspondence has been received either for or against this
project.
V. RECOMMENDATION: It is recommended that the Planning Commission
c,!n uct— a public hearing and receive all public input on this
;nutter. If after such consideration the Commission can support the
facts for findings and conditions of approval, adoption of the
attached Resolution is recommended.

DEVELOPMENT REVIEW NO. 83 -18 LOCATED ON THE

WHEREAS, on the 24th day of June, 1983, a complete application was
filed by Bill Lee for review of the above - described project; and
WHEREAS, on the loth day of August, 1983, the Rancho Cucamonga
Planning Commission held a meeting to consider the above - described project.
NOW, THEREFORE, the Rancho Cucamonga Planning Commission resolved as
follows:
SECTION 1: That ttte following can be met:
1. That the proposed use is in accord with the
objectives of the Zoning Ordinance and the purposes
of the zone in Nhich the use is proposed; and
2 That the proposed use, together with the conditions
applicable thereto, will not be detrimental to the
public health, safety, or welfare, or materially
injurious to properties or improvements in the
vicinity; and
3. That the proposed use is in compliance with each of
the applicable provisions of the Zoning Ordinance;
and
4. That the proposed project is consistent with the
General Plan.
SECTION 2: That this project will not create adverse impacts on the
environment and that a Negative Dec'.aratio is issued on August 10, 1933.
SECTION 3: That Develcpment Review No. 83 -18 is approved subject to
the following conditions and attached Standard Conditions:
PLANNING DIVISION
1. Additional garage door detzil _hall be added and
garage roof eaves shall be broken in order to
pro• ;ide additional variety and visual interest.
2. Low* wing walls shall be provided at building
entrances designed to give additional ident'ty to
individual units.

3. All trash enclosures shall be provided with lattice,
trellis covers, or similar shade structure designed
to shade trash areas.
4. Apartment units shall be setback from the 25'
circuiativ,, aisle a maximum of eight feet.
B. A six foot high solid concrete block wail shall be
constructed adjacent to the existing single family
residence (northeast corner).
5. No Building Permits shall be issued until the City
Council approves the associated Zone Change.
