G. ENVIROte?sNTAL ASSESSMENT AND DEVELOPMENT REVIEW 83 -17 - BARMAKIAN - The
development of 68 apartment units on 4.86 acres i the R -3 zone located on
the east side of Ramona, north of Foothill - APN 1077- 621 -31 (a
portion). (Continued from Planning Commission meeting of August 24,
1983.)
Associate Planner,, Dan Coleman, reviewed the staff reports, discussing the
Development Review Committee and staff concerns regarding the project's roof
design.
Commissioner Rempel stated that in the report on the parcel map a :soils report
and finished grading plan is called out. He asked i_° it is nece nary at this
time, or if it could be deferred to the time of developm ^nt.
Mr. Rougeau replied that it could be deferred.
Chairman Stout opened the public hearing.
Mr. Andrew Barmakian, 9375 Archibald Avenue, Rancho Cucamonga, the developer,
stated that he has worked closely with the Design Review Committee and
interested persons to bring this project to a level of harmony and to the
criteria established by the City. However, he was concerned with a change to
the elevations requested at the Design Review meeting to lower the roof
parapet. He indicated his strong feeling in leaving the elevations design as
originally proposed because it would hide the air conditioning and other
equipment which would be on the roof.
Mr. Barmakian asked that the condition requiring installation of a catch basin
at Ramona and Foothill be changed as no water from his Project would be
running into it. Further, the V shaped channel would adequately serve this
project.
Commissioner Mc Niel asked what the revised height of the parapet wall is.
Mr. Barmakian replied it is at the roof line or possibly 3-4 inches above it.
Chairman Stout asked, if when this project was designed, consideration was
given to the comaatibility of the residential area to the north and whether a
more conventional roof type could have been designed.

Barmakian stated that a drainage study has been provided to the
Engineering Department by Anacai Engineering and they have to deal with the
drainage structure at the southeast corner of their property.
Chairman Stout stated that they are also talking about replacing an open
channel with ur erground pipe.
Mr. Coleman stated that it is condition no. 8.
Mr. Rougeau stated that they refer to the standard onditioon with indicated that
drainage and they would like this open channel to b piped.

Mr, Barmakian stated that he did not understand whY they must replace an open
channel because it would make a lot more sense to correct the channel rather
than put the pipe underground.

Mr. Barmakian stated that weeds and dirt get into the channel and an
underground pipe will not correct the problem. Further, that anything that
gets into the pipe will clog it. He felt that keeping the channel clear and
open would be better because it would create further problems with no place
for the water to go on parcel 2.
Commissioner MP-Niel asked if there is any Pipe to the north coming out of the
channel.

Chairman. Stout replied that the pipe is almost all the way down to the end of

Mr. %ugea•. stated that from a nuisance standpoint this is an ideal time to
deal with the water problems; however, it could also be done when parcel 2
develops.
Chairman Stout asked if a hydrology study was done and what is said.
Mr. Rougeau replied That what it said is that what is proposed is adequate but
that he did not know what size pipe is recommended.
Xr. Coleman replied that tae recommendation is for a 24 -32 inch concrete pipe.
ft- . 'n stated that the recommendation by M gineering is that the
applicant take responsibility for all on -site drainage facilities. Further,
that if the channel is closed by a pipe it will be a mistake as far as parcel
2 is concerned.
Commissioner McNiel stated that there is very little of parcel 2 not already
plumbed and that the problem occurs immediately at the end of the pipe.
Mr. Rougeau stated that most of the problem is at the south side of parcel 2
and right now it is a private facility. Further, that the City occasionally
goes in and nleans it out to assist in the drainage. He indicated that the
County required the easement but this has never been taken care of.
Chairman Stout asked if a flooding problem exists that would affect property
owners to the east.
Mr. Rougeau replied that Equi's restaurant frequently floods.
Mr. Barmakian stated that a possible solution would be to create an earth berm
along the west side of the channel so that the water would not get to the
restaurant, or to build an 8 -15 Lich course of blocks as a wall to keep the
water out. He said that closing the channel with pipe is not the solution.
Mr. Rougeau stated that engineering condition no. 8 in the resolution would
also take care of the problem. He indicated that a combination of pipe are-
channel could be worked out and xaen parcel 2 comes in, the work can be
finished.
Commissioner Rempel stated that another thing that will enter in is grading
and the channel might not have the right eletiation to accept the water.
There were no further comments and the public hearing was closed.
Commissioner Juarez stated that in the resolution, engineering condition no.
12 speaks of reimbursement of cost to the developer by the City. She asked
for an explanation.
ptr. Rougeau explained the reimbursement policy of the City, how it works and
what the systems development fees do.

Chairman Stout atated that it 'is more economical to install the improvements
when the development is taking place.
Commissioner Rempel explained how Ramona is a storm drain being used as a
street.
Commissioner Barker asked about the staff recommendation relative to 20 -foot
and 15 -foot setbacks for residences and garages, respectively.
Mr. Colemji replied that as shown on the map, 20 feet would be required for
all one stoz- buildings.
Commissioner Barker stated that it does not appear that this requirement will
have a drastic impact or, the general placement of the buildings nor constitute
a major redesign_.

man stated that the Engincering Division would like to add a condition
that the applicant would hare to join a landscaping and lighting district.
Commissioner Rempel stated that the lighting district is citywide.
Chairman Stout stated that the requirement for a pipe would be resolved
between the applicant and the City Engineer. He asked if this is understood.
Mr. Aougeau replied that it is; however, only in new tracts.

Mr. Lam explained the concept of reimbursement and how projects are sometimes
bottlenecked. He further explained the systems development fee.
Chairman Stout stated that if we desire a catch basin as a condition, the
applicant can appeal this to the city council. He indicated that it would be
a violation of the Commission's authority to handle this any other way.
Mr. Lam stated that the Commission would have to decide if it wants to have
the catch basin there or not because the applicant could then appeal this to
the City Council.
Chairman Stout stated that all City policies are set by the Council.
W. Lam stated that the issue is whether the catch basin should be placed
there or not.
Mr. Barmakian

Commissioner Rempel stated that he thinks the parapet will be about a foot
high and the way this prcieQt is laid out you would see the air conditioning
units on the roof even with a 2 -3 foot parapet. He felt that the two lines,
that of the roof and the parapet, should not blend in and the slices L. at were
shown by for. Barmakian of the I =a Verre project show parapets that are not very
high.

Commissioner Barker --tatad that he is not big on looking at equipment on a

indicated that he would p: ^efer the original d ^sign with a guarantee of hiding
the roof apparatus from the surrounding residential area.
Chairman Stout stated that- he, too, liked the original proposal with the air
conditioning units screened off and the dense landscaping. He indicated that
he would like to see landscaping between the northern units and the southern
units so t:2at the project fits in better with the single family residences.
Chairman Stout did rot mink that the flat roofs fit in with the homes and The
property to the north.
Chairman Stout indica`•ad that if the applicant provided the landscaping and
the change to the original design, this project would not have to come back to
the Design Review Comm::tt:ee. He indicated further, that the catch basin must
go in and be completed by this project. He stated that if the applicant felt
this issue to be unfair, he could appeal it to the City Council, explaining
the process to the app:icant.
The consensus of the ; oommission was that th-. roof design be changed to the
original proposal, t *,e requirement for the catch basin stand, landscaping be
provided as a srreer (in the north side for the single family homes, and that
the applicant work wits the engineering division on the pipe extension.
Motion: Moved by Reapel, seconded by Barker, carried unanimously, to adopt
Resolution No. 83 -101) approving Parcel Map 8100 and iasuing � negative
declaration.
Motion: Moved by Barker, seconded by Rempel, carried unanimously, to adopt
Resolution No. 83 -110 with the modifications set forth by the Commission and
issuing a Negative Declaration.
H. CONDITIONAL USE PERMIT 83 -13 - LOYAL ORDER OF MOOSE - She establishment of
a Moose Lodge in a 1550 square foot unit of an industrial complex, in the
General Industrial area (Subarea k), located at 9375 Archibald Avenue -
APN 210 - 071 -48.
City Planner, Rick Goner, reviewed the staff report.
Chairman Stout opened the public hearing.

Mr. George Rushe, representing the Moose Lodge, advised that he would answer
any questions the Commission minht have.
Chairman Stout asked Mr • Rushe is the lodge had a preference for any of the
four alternatives listed in the staff report.
w. Rushe replied that they would hope for a permanent conditional use permit,
but barring that, they would hope for the best. He p kg r
information to the Commission on how long the Lodge has been established and
the agreement with the landlord, Andrew Barmakian, regarding parking spaces.
Chairman Stout asked Mr. Rushe if he felt the parking spaces to be adequate
and whether it iu -le = teat of the Moose Lodge to use this as a permanent
facility.
Mr. Rushe replied that is their intent until or unless they outgrow this
facility.
Chairman Stout explained what the Commission has done in the past with
institutional uses such as a church and the provision for a time extension.
Mr. Rushe replied that if that is all they can get they would accept it and
reapply in two years. He indicated that they would hope to be able to buy
their own facility.
Chairman Stout asked if their organization intends to have provisions for an
alcoholic beverage license and whether they would apply for one.
Mr. Rushe replied that they intend to apply for one at a later time; however,
the sale of alcoholic beverages would be to members only.
Mr. 14hiten Chestnut, a Noose representative, spoke in favor of the application
and indicated that if adequate parking spaces are unavailable, members are
lost.
Chairman Stout asked Mr. Brmakian what percentage of his complex is rented at
this time.
Mr. Barmakian replied approximately 90 percent and that only the east half of
the front building on Sixth Street is not leased.
Commissioner MnNiel asked how many of the renters have extended or weekend
hours.
Mr. Barmakian replied that the only tenant would be the Moose Lodge and no one
is open on Saturdays or Sundays.
There being no further questions or comments, the public hearing was closed.

Commissioner Rempel stated that perhaps the General Plan should be looked into
because eventually other groups will want a facility and there currently are
no provisions as to where they should be built. He indicated that they will
develop traffic when they get going but this use is quite similar to. the
institutional uses. Commissioner Rempel suggested that t,i.i be approved with
a provison for automatic review in two years.
Commissioner Barker -Asked what the difference is bet.w>en `.:he automatic renewal
and the automatic review.
Commissioner P.empel replied it is the cost factor becau,-e ti.ey would have to
reapply.
Chairman $tGUt stated that = ^- the evening hours there is unlimited parking and
asked if the applicant would have some problem with a con :iition that limits
the parking to evening hours only.
Mr. Rushe stated that they do have Sunday breakfasts.
Commisioner Barker asked if the wording "group meetin g" has a connotation that
they can still have an officers meeting.
Chairman Stout stated a group meeting would require more than six parking
spaces.
Fbtion Moved by RempeI seconded by Barker, carried unanimously, that
Resolution No. 83 -111 be adopted approving Conditional Use Permit 83 -13,
requiring an automatic review of this application in two years and with a
limitation of 40 parking spaces.
Mr. Gomez asked if there would have to be a condition so that this CUP could
be recalled at some time.
Mr. Hopson replied that such a condition is not required because it exists
implicitly under condition no. 6 of the resolution.

1. CONDITIONAL USE PERMIT 83 -16 - HOUSER - The expansion of an existing pet
hospital i_zto a contiguous unit located at 8681 19th Street in the C -1
zone - AP11 202 - 024 -11.
Mr. Gomez, City Planner, reviewed the staff report.
Commissioner Barker stated that the applicant's letter states that there will
be no animal holding structures at the back wall or at any common e
building to minimize noise; however, the modified presentation p p a dog
run area next to the common wall of another building.
Mr. Coleman replied that that is considered a cage.

Commissioner Barker stated that the holding area should be built to further
minimize noise and asked if it would be odor proofed.
M--. Gomez replied that condition 1 of the resolution takes care of this and
that the applicant can speak to this.
Chairman Stout stated that this veterinary hospital has ' been in operation
since 1979 and he asked if there have been any complaints against. it.
Mr. Coleman replied that there have not been any.
Chairman Stout opened the public hearing.
Dr. Richard Hauser, the applicant, explained the expansion plans and
improvements proposed for the pet hospital. He indicated he did not foresee
any noise problems and Dr. Ilauser described the nearest neighbors and their
distance from the rospital.
Chairman Stout asked if on the vacant building with the storage wall, will the
wall go all the uay.
Dr. Hauser replied that it would.
Dr. Hauser then asked the Commission for permission to board animals in order
to compete more effectively with other veterinarians in the area.

Dr. Hauser replied that he has four that are 4 X 4 feet and that the new runs
will be 5-8 feet long and 3 feet wide.

N.^. Gomez stated that staff has not set down the type but there is flexibility
and the ultimate construction of the wall would be w attenuate noise. He
sZ;ated that otherwise this conditional use permit would have to come back.
Further, this type of Lase as proposed Cy the applicant is permitted in the C -1
zone, but the Zoning Ordinance does not specify kenneling accessory uses to
the clinic. Mr. Gomez indicated the Commisicn would have to make a
determination on whether this would be permitted in a C -1 zone with a
conditional use permit.
Commisioner Mc Niel asked what Dr. Hauser sees as a boarding facility.

Dr. Hauser replied just a place for his client's animals when they need to use
it.
Commissioner Mc Niel stated that there will be 19 dog runs and a..ed what
portion will be used for everday work and what portion for boarding.
Dr. Hauser replied that he envisions approximately one -half for each Ilse,
although the medical practice takes prece::ence over everything else. Dr.
Hauser stated that he would also like to do low cost neutering as an extra
service to the community but he needs a physical facility to house the
animals.
Mr. Gomez stated that under Resolution No. 79 -44 this could be interpreted to
=ear that there could be post - operative care.
Commissioner Rampel felt that it is necessary that the animal hospital have
the option of boarding animals belonging to those people who are the doctor's
clients. He Suggested that the conditions of the conditional use permit be
changed to allow this.

Resolution No. 79 -44A with an amendment to allow the use of dog runs for the

J. ENVIRONMENTAL ASSESSMENT AND CCNDITIONAL USE PERMIT 83 -09 - ALTA LOMA
BRETHREN IN CHRIST C'URCH - The development of a 2800 square foot
education facility for the Alva Loma Brethren in Christ Church on 6.8
acres of land in the R- 1-8500 zone, locatad at 9974 19th Street -
APN 202 - 171 -01.
Senior Planner, Michael Vairin, reviewed the staff report. He stated that the
Engineering Division has requested that the west driveway be constructed half
way and that the other half be used for street access.
Further, that the conditions listed on the Resolution are from the standard
condition listing but have been incorporated into the one document for ease of
information.
Chairman Stout stated that the initial report stated that Design Review had
some concerns that were addressed by the applicant.
Mr. Vairin stated that the operational problems were addressed and the
applicant outlined what the uses would be on the site.
Chairman Stout asked if the Resolution addresses these adequately.
Mr. Vairin replied that most of the concerns were with parking and it was felt
it is adequate.
Chairman Stout asked if the driveway can be shared with the proposed
development adjacent to this property and whether what staff is saying is that
they should not go on there and complete the driveway.

indicated that they would have to get the permission of the other property
owner to do it, but as far as they are concerned, they will do it.

could build what they can.
Mr. Wilkins, a property owner to the north of this property, asked what the
requirements are for notification of adjacent property owners.

Associate Planner, Dan Coleman, reviewed the staff report. He indicated that
staff recommended the addition of as amendment to condition no. 10 on page two
of the resolution to include the requirement of a wrought iron or tubular
fence to prevent children from getting caught in the storm drain.
Chairman Stout asked with respect to the V gutter, could a pipe be put in
rather than destroy the landscaping.
Mr. Coleman stated that th -s could not be done because all the width they have
is from 4 -5 feet.

Mr. Larry Wolff representing the applicant stated that he would be happy to
answer any questions of the Commission and also advised that Mr. Dor Ring
would answer any of the engineering questions. Further, that they agreed with
the conditions in the staff report.
Mr. Robert Tomelow, a resident adjacent to this project stated that they but
complied with their requests as far as grading and duaing
they would like to see a block :call go in as soon as possible after the rough
grading is complete in order to minimize dust and noise to the residents. He
indicated that this would also provide additional privacy e p o bewp eked
that the parkways be wider with landscaping
further back into the project. He further asked that Castro and Eastwood
Streets not be used during construction.
Mr. William Runyan, property owner south of this project, felt that more than
six feet of landscaping is required on this property. He suggested 75 feet
and requested that drainage be undergrounded and flow into a catch basin as
there would be no reason except for the expense of not doing

apartments would be and expressed his concern of whether these would be low
income apartments that would attract crime.
Chairman Stout replied that this does not look like a low - income project.

compatible with others in the area. He explained that additional setbacks

Commissioner Barker stated that it would be appropriate to have the wrought
iron fence built prior to construction on the site and asked that this be
placed in the resolution.

to accomplish is increased security for their residents and explained the
motorcycle patrols they would have.
Mr. Edwards stated that they have a comment and question on conditions 5 and 7
relative to incorporation of the triangular piece and also providing access
and ownership to the Flood Control District. He asked if this could be done
on the final map or as a provision to the final map.

to give the land owner some protection and asked about inserting some wording
to indicate reasonable cause.
Mr. Hopson stated that `wi° is no different a requirement than that of any
common interest subdivision built within the city with private streets and he
did not see a whole lot of reason for such wording. He indicated that even
though it is private, the City could still remove the gate by condemning the
whole system. Further, from the City's standpoint he did not see why there
should be any additional wording.
Chairman Stout stated that when this came before the Commission the last time
the applicant was dead set against a homeowner association.

association as this will not be acceptable without one.

Mr. Beverly replied that they proposF to build homes that are between 1800-
2000 square feet and they want to leave as much open space as possible.

individually but they are trying to build as a joint venture.
Chairman Stout stated that he considers this area to be very sensitive and
open to view to everyone driving down Foothill Boulevard.
Commissioner Rempel stated that when discussing the grading to the area north
of the City in the Foothill Community Plan lot size requirements were very
high. He indicated that size is important here as well since slope grades
could be as high as 15 percent. He indicated that access to the parcels down
on Foothill are also important because if this project goes in, others will be
landlocked. Commissioner Rempel stated that some provision should be made for
access by commercial developments.
Mr. Beverly stated that from a practical sense, they are the same property
owner.
Commissioner Rempel stated that they are not all the same owner.
Mr. Vairin stated that any change in terms of access to other properties would

Commissioner Rempel stated that there is a problem here that needs to be
solved regarding access and he felt that a certain condition for review should
be built in relative to the size of the homes.
Commissioner Barker stated that the property having the difficulty is
commercial, but he was unable to determine what would go there and stated,
while it is a problem, he did not know what to do about it.
Commissioner McHiel asked what czn be done about the commercial designation in
the area.
Mr. Hopson replied that if a majority of the property owners feel that a
General Plan Amendment is in order and there are some City slots available,
they could ask the City to sponsor the amendment for lots 13 and 31 or
whatever is appropriate. He indicated that the City does have the power to do
this.
W. Vairin stated that this property is general planned for general
commercial, C-2, and there are a lot uV alternatives for conditional type
uses.
There was discussion as to what types of access cc-ald be found with the
consensus of the Commission that this entire area be looked at as a whole
rather than parcel by parcel.
Mr. Beverly stated that there is something he does not understand in that this
whole thing had been looked at previously and approved. He asked what facts
in the area have changed.
Chairman Stout replied that the Planning Commission has changed.
Mr. Hopson asked if it is important for M-. Beverly to know because it is not
legally important.
Chairman Stout stated that this property is but one piece in a puzzle, and if
it goes through as it is presently proposed, it could destroy something else.
Commissioner MoNiel stated that he has no qualms with the project but is
concerned with the guy next door. He indicated that if the roles were
reversed and Mr. Beverly was being landlocked, he would let the Commission
know.
Mr. Beverly stated that it appears that there is no reasonable access and that
his project should not be held up because of this.

Mr. Gary Johnson stated that he was not involved in the original conceptual
plan and going over the minutes this was thoroughly discussed by the prevous
Commission. He indicated that this property was general planned R -1 and
changed to commercial after the general plan was adopted. Further, that at
that time the Commission felt nothing could be done regarding access. He
indicated that the cost of a master plan for this could be considerable and
was not sure that they would be able to proceed.
Chairman Stout stated that the applicant can request a continuance or can
accept denial of the tima extension.
Mr. Vairin ;tested that it ;° important to get the applicant's agreement for a
`i=, exte. -sion and that it be conditioned so that the other property owners
=.-et to make a decision relative to access.
Commissioner Barker stateO that he is concerned with having the whole burden
of the access issue fall on this property owner.

I. BACKGROUND: The developer is requesting a time extension for
Tent— at—ive Tract 11928 as described above and as shown on the d by the
attached exhibits. The project was originally app
Planning Commission on October 15, 1981, but an appeal was filed by
homeowners protesting this project and an adjacent tract located at
the northeast corner of Archibald and Highland (TT 11869 - Roberts
Group). After numerous public hearings and meetings with the
homeowners, the City Council granted approval of the project on May
19, 1982 with several conditions. The conditions included reducing
the project density from 67 to 59 units, increasing the number of
visitor parking spaces, and requiring doors on the garages. In
addition, the Council required that the Design Review Co�rdaitY.ee
review the revisions and that they be brought back to the City
Council for final approval. To date, these revisions have not been
submitted.
II. ANALYSIS: A review of the Tentative Tract Map and site plan
in icated that the project is consistent with current development
standards. In addition, the building elevations appear to meet the
current design standards.
Tentative tracts in the City of Rancho Cucamonga are valid for a
maximum of four (4) years from the date of Planning Commission
approval with appropriate extensions per the Subdivision Map Act.
This tract was originally approved for two years and is now
eligible for the firs*_ of two possible twelve month extensions.
A copy of the amended Planning Commission Resolution of approval
with condition,, and the Planning Commission and City Council
minutes are attached for your review.

RESOLUTION NO. 81 -117
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RI:NCHO CUCAMONGA. CALIFORNIA, CONDITIONALLY APPROVING
TENTATIVE TRACT MAP NO. 11928
WHEREAS, Tentative Tract Map *a. 1_1928, hereinafter °Map° submitted
by Shaffer & Sones /Westland Venture Co., applicant, for the purpose of
subdividing the real property situated in the City of Rancho Cucamonga, County
of San Bernardino, State of California, described as a total planned
development of 67 condominium units on 5.85 acres of land in the R -1 -10 zone,
located on the north side of Highland Avenue, east of Archibald Avenue - APN
201- 252 -32 into 1 lot, regularly came before the Planning Commission fo:-
public hearing and action on October 14, 1981; and _
WHEREAS, the City Planner has recommended approval of the Map subject
to all conditions set forth in the Engineering and Planning Division's
reports; and
WHEREAS, the Planning Commission has read and considered the
Engineering and Planning Division's reports and has considered other evidence
presented at the public hearing.
NOW, THEREFORE, the Planning Commission of the City of Rancho
Cucamonga does resolve as follows:
SECTION 1: The Planning Commission makes the following findings in
regard to Tentative Tract No. 11928 and the Map thereof:
(a) ppli ab ea interim and proposed gene al and ?
specific
plans;
(b) The design or improvements of the tentative tract is
consistent with all applicable interim and proposed
yenerai and specific plans;
(c) The site is physically suitable for the type of
developmen-� proposed;
(d) The design of the subdivision is not likely to cause
substantial environmental damage and avoidable
injury to humans and wildlife or their habitat;
(e) The tentative tract is not likely to cause serious
public health problems;

(f) The design of the tentative tract wi ;I -lot confl :ct
with any easement acquired by the put iic at large,
now of record, for access through �.,r use of the
property within the ;proposed subdivision.
(g) That this project will not create adverse impacts on
the environment and a Negative Declaration is
issued.
SECTION 2: Tentative Tract Map No. 11928, a copy of which is
attached here`o, is hereby approved subject to all of the following conditions
and the attached Standard Conditions:
PLANNING DIVISION
1. A directory shall be provided near the entrance of
the project to direct visitors to appropriate units.
ENGINEEP.ING DIVISION
2. The existing Hermosa Water Company easement for
pipelines and reservoir shall be vacated prior to
recordation of the Final Tract Map.
3. The applicant shall address the merger of the
Railroad right -af -way on the north with the project
area, to the satisfaction of the City Engineer.
4. The applicant shall construct an adequate, concrete
lined channel with inlet and outlet structures over
the Alta Loma Overflow Channel, contiguous to the
subject tract. It shall be constructed to ultimate
design capacity per San Bernardino County Flood
Control District's standards and specifications.
The cost of constructing the channel shall be
credited towards the storm drain fee for the
project. The City's standard storm drain
reimbursment agreemnt will be executed to cover the
contributions which exceed the fee amount.
5. Ail *_Prior private streets shall have crown
sections.
6. The Commission recommends, to the Council, that the
Systems Fees generated by this project, be earmarked
to widen the Archibald and Highland Avenues
intersection.

Cucamonga, do hereby certify that the foregoing_ Resolution was duly and
regularly introduced, passed, and adopted by the Planning Commission of the
City of Rancho Cucamonga, at a regular greeting of the Planning Commission held
on the 14th day of October, 1982, by the following vote -to -wit:
AYES: COMMISSIONERS: Rempel, Sceranka, Dahl, Tolstoy, King

This project was appealed to City Council and the City Council -held a duly
advertised hearing and made the following modifications to the project:
1. The maximum density permitted for this development
shall not exceed to a total of 59 units on the 5.85
acres, plus the additional condition to increase the
visitor parking within the development, doors on the
garages, and to refer the design to the Design
Review Committee for approval, and for the' item to
come back to Council as a Consent Calendar item for
final approval.

Cor=issioner Dahl stated that he recommended that the City also try to
obtain the dedication necessary for the widening of the intersection.
Commissioner Rempel stated that this was part of the motion.

property.
MI. Vairin stated to the audience that they would receive notice cf the

Senior Planner, Michael Vairin, reviewed the staff report pointing out for
the record that this particular project would be utilizing the Alta Loma
channel for drainage and would be required to be fully improved. He
indicated that this was a recuirement in meeting threshold and should the
applicant not agree to this condition, this project would have to go back
for further consideration.

Mr. Tom Davis, 9331 Business Center Drive, concurred with the staff findings
and stated that he had nothing to add. Fie asked for clarification of Item

Mr. Vairin explained the definition of affordable housing and asked if
the applicant was also accepting the improvement of the channel at this

at San Bernardino Road - APN 207- 191 -50.
I.
BACKGROUND: The applicant is requesting a time extension for
Deve opment Review 81 -06 as described above and shown on the
attached exhibits. The project was originally approved on April 8,
1981, and subsequently granted an eighteen month extension. The
developer is requesting this time extension due to the current
economic conditions and interest rates adversely affecting the
project.
II. ANALYSIS: A review of the development plans indicates that the
project is consistent with current development standards. In
addition, the building elevations appear to meet current design
standards.
Regarding the length of the time extension, the informal policy is
to allow a four year approval, with the appropriate extensions.
Since eighteen months remain of the four year maximum for this
project, it is suggested that a final extension, be granted for the
full 18- months. A copy of the c•iginai Resolution of approval with
conditions and the Planning Commission :minutes of April 8, 1981 are
attached for your review.
RECOMMENDATION: It is recommended that a final extension for
eighteen S months be granted for this project. The new
expiration date would be April 8, 1985.

LOCATED ON THE SOUTH SIDE OF FOOTHILL BOUL =VARD
AT SAN BERNARDINO ROAD IN THE C -2 ZONE.
WHEREAS, on the 30th day of January, 1981, a complete application
was filed by Bert C. Francis for review of the above- described project;
and
,WHEREAS, on the 8t`1 day of April, 1981, the Rancho Cucamonga
Planning Commission meld a meeting to consider the above-described
project.
how, THEREFORE, the Rancho Cucam -inga Planning Commission
resolved as follows:
SECTION 1: That the following findings can be met:
1. That the proposed use is in accord with the objectives of -
the Zoning Ordinance and the purposes of the zone in
which the use is proposed; and,
2. That the proposed use, together with the conditions
applicable thereto, will not be detrimental to the public
health, safety, or welfare, or materially injurious to
properties or improvements in the vicinity; and,
3. That the proposed use -is in compliance with each of the
applicable provisions of the Zoning Ordinance; and
4. That the proposed project is consistent with the General
Plan.
SECTION 2: That this project will not create adverse
impacts on the en7ironment and that a Negative Declaration is issued on
April 8, 1981. '
SECTION 3: That Development Review No. 81 -05 is approved
subject to the following conditions and attached standard conditions:
PLANNING DIVISIOT, 1
1. That a five foot wide plart(.r shall be provided along the
east side of the easterly driveway, which shall include
shrubs, trees, and mounding to the satisfaction of the
City Planner.
2. That a dry stream bed, using natural alluvial rock, be
incorporated into parkway and on -site landscaping to the
satisfaction of the City P i annei%

Mr. Vairin replied that the landscape plan does have an entirely land-
scaped median aisle along the parking area and will contain canopy trees.
Commissioner Tolstoy asked if that will be a requirement.

Commissioner Tolstoy stated that he would like to see that as a condition.

Commissioner Rempel stated that they- had beer. a comment that there is
a 35 -foot turn radius and in order to facilitate that turn, it needs to
be checked into because it will become a rough turn. he indicated that
trey will want to cut the corner and the high curb will make it difficult
in turning.
Commissioner Tolstoy stated that is really a traffic problem and Engineering
should look at this.
F FESOLUTION ON SIDEWALKS
Senior Civil Engineer, Paul Rougeau, re;-iewed the staff report stating
that although a Resolution has bee,. drafted, there is still room for a
project -by- project discussion on sidewalks, especially in the industrial
area and it may be needed to be examined on that basis. He asked that
the Commission review this to be sure that it reflected their feelings
on the sidewalk issue.
Commissioner Rempel stated that he has some problems with this. Special
boulevards were all right; however, on major arterials and collectors, he
did not think that the industrial area really needs to have sidewalks on
both sides in all areas. He indicated that only a short section to the
building is ample. He further stated that on a collector street, it depends
on the area and is not necessary in an industrial area. He stated that
in one -half acre areas the Commission had stated that sidewalks would
be placed on one side of the street.

II. ANALYSIS: At the present time, this site consists of six (6) small
lots. F'r. Mayhew, owner of the lots, has submitted the attached parcel
map to divide the property into two 1/2 acre parcels which conform
to the minimum lnt size of the Industrial Specific Plan Subarea 4.
Along with the parcel map, Ar. Masilew has revuested the vacation of the
northerly 20 foot alley, 10 feet of which would revert to his property
allowing the property to meet the 1/2 acre minimum.
The fature building sites as shown on the tentative map are preliminary
to show what size building can be constructed on the sites.
If the tentative map is approved and the alley vacation recommended to
r °tv Council, Mr. Mayhew will proceed with the building plans. Those
_flans wile require Planning Comm=ission approval at that tine.
The alley is unimproved and is not providing access to t::e lot to the
north. The drive appre--h on the lot is located on Cottage Avenue. _

Spacial Considerations
If a commuter train service occurs along the AT&SF
Railroad line, the existing station should be con-
sidered as a temporary location for a transit stop.
This would provide the most direct access to the
existing employment area. Any future permanent
transity stop location should be studied as part of
the Regional Transportation Plan.

This is the final public hearing before the Planning
fnr review and comment on the proposed Development Code and
District Map. A Resolution for a final recommendation to
Council is being provided for action by the Planning
I. BACKGROUND: Since August 16, 1983, the Planning Commission has
been conducting a number of public workshops for the specific
purpose of reviewing the Draft Development Code text and the
Development District Map. During these workshops the Building
Industry Association, as well as the Chamber of Commerce, has
provided input with regard to the text, graphics and map and are in
basic support of its general concepts and programs. The Commission
has modified the Code to best reflect the implementation of the
General Plan goals and policies and public input.
Tonight's meeting is intended to be a public hearing to review the
Commission's actions, as well as any final actions desired by the
Commission. The remainder of this report focuses upon the major
actions of the Planning Commission o^ a chapter -by- chapter basis.
Additionally, this report discusses the environmental assessment
for the Development Code.
II. HIGHLIGHTS OF COMMISSION ACTIONS:
A. Chapter 1 - Administration:
Section 1.7 - Revisions/Modifications: This was rewritten to
include a description and isLing of the difference betwpen
minor and major revisions and the process by which such
revisions would be made.
2. Section 1.8 - Appeals: The existing appeal process which the
City currently ollows, which includes appeals to the City
Council for all staff and Commission actions.

3. Business License Section: This section was eliminated in favor
of having appropriate. statements and signatures on the Business
License application.
4. Section 1.13 - Code Enforcement: This section was modified to
e iF nate the majority of the reference to code enforcemnt as
this is covered in another section of the Municipal Code. The
remainder of this section was modified to deal mainly with
ncise abatement procedures.
5. Non- Conformin, Use Section: This was modified to eliminate
precise amortization time periods for non - conforming uses.
Instead, non - conforming uses will be regulated in terms of
expansion and intensifications and would be eliminated over a
long period of time through natural attrition.
b. Section 1.14 - Definitions: This section has been continually
imo-ditiee, to incorporate comments received throughout the
hearings on terms which require definitions. The final
document which will be presented to the City Council will
contain all of the final definitions and c`anges.
B. CHAPTER 2 - PERMITS:
1. Section 2.3 - Conditional Use Permits: This section, was
modified to provide precise procedures for an applicant or the
Planning Commission to modify, suspend, or 2 any
Conditional Use Permit.
2. Section 2.5 - Minor Exce tion: The title of this section was
reworded from "Minor Variance. to "Minor Exception' in order
not to conflict with existing state law regarding variances.

current growth management philosophies and requirements are

D. CHAPTER 4 - RESIDENTIAL DISTRICTS
1. Modifications to Table 4.3, Use Regulations were made to list

2. Table 4.3 E was amended to clarify the keeping of Donie` in

Conditional Use Permit. The Commission decided that the basic
number regulations in conjunction with the performance
standards and noise regulations would be utilized to control
this area.

Tables 4.4 -B and C Develo m-nt Standards have been modified
and fine tune to become more feasible and workable. As the
staff has been reporting to the Commission, the basic and
optional standards were developed in an attempt to implement
the original objectives of the General Plan ranges to create
transitions and neighborhood compatibilities. Under the
optional standards if a developer desires to go beyond the
mid -paint of a density range, there would be additional
requirements expected of the development. Some of these
requirements include increased open space, solar energy,
increased setbacks, and landscaping. Based on the Commission's
last review of these tables,a copy of the latest revised tables
is attached for your review and any final comments.

Section 4.5 - Absolute Policies were added to Chapter 4 to
complement the other requirements of the Growth Management
system such as the development standards, design guidelines,
and the performance standards.

Section 4.6 - F was added to include the policies with regard
to the instal ation of sidewalks.

Section 4.6 - H.4 was added to regulate sattelite dish antennas
within the re tial districts.

Section 4.7 -D was modified to simplify the vehicle "and
equipment repair and storage regulations.

1. Section 5.2 - Districts: The Administrative Professional (AP)
District was change to a titled "Office Professional'r(OP).

reduced from a maximum of 50% to 35 %.

2. Section 8.4 - Site Develo ment Regulations: Site dimensions
and setbacks were ecided to '3e etd ermined on a site -by -site
basis based upon topography, water and drainage, circulation,
and other environmental factors.
CHAPTER 9 - HILLSIDE RESIDENTIAL DISTRICT
1. Fire safety re ulatons were changed to reflect the
reS_ rements of the O-Oihi 1 Fire Protection District.
2. Tae Planning Commission decided to require that a statement be
placed on all deeds for parcels which are located along fault
lines to inform them of the location of faults and the
possibility for seismic activity.

CHAPTER 10 - OVERLAY DISTRICTS
1. All of the Overlay Districts were combined into one chapter.
2. The Mobile Home Overlay District was eliminated by the
Commission as a result of state legislation which limits the
amount of control the City has over the design and regulation
of mobile hole parks.
3. An Equestrian Overlay District was added to implement the
resolutions adopted by the Planning Commission and Cite Council
with regard to the equestrian area and the keeping of anima's
within that area.
ENVIRONMENTAL ASSESSMENT: The Development Code is considered part
of the same Fro j ect as the General Plan, since it is the
implementation of the General Plan goals and policies. Since the
Development Code is a related project to the General Plan, state
environmental planning law allows thA Planning Commission to
determine that the Environmental Impact Report which was prepared
for the General Plan is adequate in covering any potential
significant adverse impacts that could be created as a result of
the Development Code. This finding can be made as long as the
® Planning Commission finds that the Development Code does not cause
a substantial change in any of the goals or policies, or that no
new additional information beyond which was presented in the
General Plan EIR has become available that would alter the findings
of the General Plan EIR. Therefore, staff recommends that the
Planning Co.nmission make the findings required pursuant to Division
13, Chapter 6, Section 21166 of the Public Resources Code that
would not require a subsequent or supplemental Environmental Impact
Report. This finding is based upon the fact that the Development
Code is implementing the existing goals and policies of the General
Plan which were fully analyzed with regard to environmental impacts
during the General Plan EIR.
IV. RECOMMENDATION: It is recommended that the Planning Commission
conduct the final public hearing for final consideration of the
proposed Development Code and Development District Map. Attached
is a Resolution recommending approval and adoption of the
Development Code and the Map to the City Council. Additionally,
attached is the draft Ordinance that will be presented to the City
Council which repeals the existing interim ordinances and other
development- oriented ordinances that have been incorporated into
the Development Code.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCHO
CUCAMONGA, CALIFORNIA, ADOPTING TITLE 17, DEVELOPMENT
CODE OF THE RANCHO CUCAMONGA MUNICIPAL CODE, INCLUDING
ADOPTION OF A DEVLOPMENT DISTRICT MAP, REPEALING THE
INTERIM ZONING ORDINANCE, AND REPEALING CHAPTERS 17.04,
17.08, 17.12, 17.16, 17.20 AND CERTAIN SECTIONS OF THE
RANCHO CUc.4MONGA MUNICIPAL CODE
The City Council of the City of Rancho Cucam,+nga, California, does
ordain as follows:
SECTION 1: That the Interim Zoning Ordinance, and all amendments
thereto, are hereby repealed.
SECTION 2: The following sections of the San Bernardino County Code,
previously adopted by reference, are hereby ren,aled:
(a) 61.021 through 61.029C, inclusive;
(b) 61.02131 through 61.0219P, inclusive;
(c) 61.0220 through 61.0223, inclusive.
SECTION 3: The following chapters of the San Bernardino County Code,
previously adopted by reference, are hereby repealed in their entirety:
(a) Chapter 3. Subdivision Code;
(b) Chapter 4. Mobilehome Parks.
SECTION 4: The following chapters of the Rancho Cucamonga Municipal
Code are hereby repealed in their entirety:
(a) Chapter 17.04. Growth Managenent Plan;
(b) Chapter 17.08. Design Review Procedure;
(C) Chapter 17.12. Planned Community Develop<>>ents;
(d) Chapter 17.16. Condominiiu'T Conversions;
(e) Chapter 17.20. Adult Businesses.

SECTION 5: The following sections of the Rancho Cucamonga Municipal
Cooi are hereby repealed:
(a) 1.08.090. Director Review;
(b) 1.08.150 through 1.08.170, inclusive. Home Occupations;
(c) 1.08.180 through 1.08.190, inclusive. Pyramidal Zoning.
SECTION 6: That certain code to be known as the "Development Code of
,ae City of Rancho Cucamonga ", including a Development District Hap, attached
as Exhibit "R ", a copy of which Code is on file in the office of the City
Clerk, is hereby adopted as Title 17 of the Rancho Cucamonga Municipal Code,
pursuant to the provisions of Government Code Section 65800 et. deq. as

SECTION 7: Chapter 17.16, Condominium Conversions, is hereby
reenacted in its entirety as Chapter 17.^ , Condominium Conversions.
SECTION 8: The City Council finds that the Development Code is an
implementation of the General Plan goals and policies and that the General
Plan Environmental Impact Report adequately covers any potential significant
adverse impacts. Further, the City Council finds that no subsequent or
supplemental environmental impact report is required pursuant to Division 13,
Chapter 6, Section 21166 of the Public Resources Code. Specifically, the city
Council.
A. No substantial changes are proposed in any goals or
policies which would require major revisions to the
EIR.
B_ No substantial cha-;es have occurred with respect to
the circumstances -rider which the project is being
undertaken.
C. No new information on the project has become
available.
SECTION 9: The Mayor shall sign this Ordinance and the City Official

I. Site Characteristics: The site consists of a vacant parcel
which slopes in a gentle north /south direction from Base Line
Road to the Pacific Electric railroad tracks. Currently, the
site contains various indigenous plant materials and field
grasses. No structures are located on the site.
II. ANALYSIS•
A.
General: The proposed administrative professional building is
designed to accommodate 20,000 sq. ft. of space for ^ffice and
related uses. As illustrated on the site plan ( Exhibit "A"),
the proposed office complex will occupy the northeast corner of
the parcel, fronting Base Line Road. A future phase office
building located in the southwest corner of the parcel (Exhibit
"A") may be approved at a later date, subject to precise
approval by the Planning Commission.

Design Review Committee: The Design Review Committee was
generally pleased with the design of the office complex stating
that the proposal exhibits a great amount of - ariety and visual
interest.
C.
Develocment Review Committee: The Develp� .:._ Review Committee

was concerned with contro g access to Base Line Road due to
the existing offset drive approach situation (Exhibit "B ").
Currently, the drive approach located on the north side of Base
Line Road (City Hall entrance) does not align with the existing
Mobil drive-day on the south side of the street (project
location). Because of the present configuration, a safety
problem exists due to the risk of a head -on confrontation with
opposing vehicles wishing to turn left (Exhibit "B ").
In an effort to mitigate the present situation, the applicant
has relocated the existirc Mobil drive approach to the east,
ultimately aligning with th? 'ity Hall entrance (Exhibit "A ").

'Ea din Committee: Conccp ual grading approval has been
granted for the app icant s project.

Signing: As illustrated on the building elevations, the
applicant is proposing signs which consist of 16 -inch high
translucent plastic letters, surface mounted to the building
exterior. The conceptual signing appears adequate in terms of
uniformity of style and scale of lettering. However, prior to
issuance of building permits, the City Planner will review the
final sign plans to assure conformity with the intent of the
Sign Ordinance.

D. Environmental Assessment: Part I of the Initial Study has been
completed by the applicant. Staff has completed the
Environmental Checklist and found no significant adverse
environmental impacts related to the construction of the

III. FACTS FOR FINDINGS: The findings listed on the attached Resolution
were supporteo by The following facts:
• The project provides adequate setbacks, landscaping, and
improvements which make it compatible with surrounding land
uses.
• The project site is adequate in size and shape to accommodate
the development and the proposed uses are in accordance with
the objectives of the General Flan and Zoning Ordinance.
o The proposed design and site plan, in conjunction with the
conditions of approvai: are consistent with the current
development standards of the City.
IV. CORRESPONDENCE: This item has been advertised for environmental
review in The Daily Report newspaper.
V. RECOMMENDATION: It is recommended that the Planning Commission
consider all input and elements of this project. If after such
consideration the Commission can support the facts for findings,
adoption of the attached Resolution would be appropriate.

would develop land use alternatives with a series of policies,
standards, and design guidelines, as well as imrlementation
strategy.

2. Fiscal Model /Finance Plan - Staff has been in the process of
working with a Council sub- committee in preparing a Request
for Proposals (RFP) to select a consultant to develop a
financial plan for the City's future capital improvement
programs. A. major portion of this plan will be the
development of a fiscal model to aid in analyzing the impacts
that land use decisions will have on services and capital
improvements.

Housin /Mort age Bonds - Staff will be reviewing the potential
of facilitating another single family mortgage revenue bond
issue. The staff is exploring the possibility of developing a
bond issue which coul:i be used throughout the City rather than
only in Lie RPA project area. Additionally, staff may also
investigate Lhe possibility of a multi- family bond issue to
help facilitate development of approved apartment protects in
the City.
