ABSTRACT: The applicant is -equesting a 9-month extension. to continue-the church use at the above-referenced location (see E::hibits "A" - "D"). Th;.; Planning Commission may grant time extensions in twelve (12) month increments. The applicant is making this request in order to allow enough time to complete improvements on another proposed church site which will not be ready for occupancy until October 1989. The approval for this use pill expire on Dune 24, 1989. An extension of time could be granted by the Planning Commission if facts for findings cen be made. 11. BACKGROUND: Ccnditional Use Permit 87-20 was originally approved y tne Piannine, Commission on June 24, 1987. The approval for CUP 87-20 Included conditions revating to the operation of the church at the "For Kids ,Only" facility {see attached Resolution No. 87- 99). 111. ANALYSIS:: Staff has not observed any problems associated with the Chu -c operation at this site. The church has complied with the Conditions of Approval. Preliminary discussions have been conducted between staff and the church in re-locating to an existing building within the City. This, in conjunction with the fact that no alterations have taken place with the Development Code and General Plan in this area, results in a project that remains consistent with the requirements of the City. IV. FACTS FOR FINDINGS: The Planning Commission may grant time extensions for projects in 12-month increments (up to a maximum of 5 years), -if there have been no significant changes in the Land Use Element, Development Code, or character of an area within which a project is located that would cause the approved project to become inconsistent or nonconforming. We have purchased property at the corner of 19th and Amethyst, and have started the processing of applying for a Conditional Use Permit to use the facility at that location for a church. However, if small operation building contractors do not use heavy equipment or store materials in outdoor storage yards, j they may be compatible in subareas which permit such uses as building maintenance services and tight manufacturing. In this case, the only area which may be of concern is the vehicle uses by the small operation contractor. Frequently, a small operation contractor will use pick-up trucks to travel and transport small building materials between the AWL office and the Job site. He said their typical units were 800 feet and all units have office space with some industrial space. He said they do not rent to welders or cabinetmakers, because their uses would be noisy and dusty. He said their proposed users were genera;7ly not on site except for the offi;e staff.. He ;requested that the use be allowed in the zone without a Conditional Use Permit. Jack Corrigan, BCE Development, original master planners of the business park, stated that when the property was originally developed, provisions wert trade to avoid having contractors storage yards in the area. He stated that when the Arrow Industrial Condominiums were originally built, small general contractors were allowed and there had never been airy problems, {e felt the modification was warranted. He felt the management corporation would police any weathered trucks being stored on-site. Commiso ones Tolstoy asked if the rC&Rs 'restrict outdoor storage at Arrow Industrial Condominiums. Mr. Lcit stated that their leases prohibit outdoor storage. There were no further public comments.
