A. Recitals
(i) California, Government Code Section 65402(a) provides, in

11. ANALYSIS:
The Purpose of this tentative Parcel Map is to separate the property
containing the existing single family residence from the remainder
portion.
Public Improvements for Parcel along the frontage of East Avenue are to
be constructed as a part of this parcel map. These improvements include
eliminating the current permanent access to parcel 1 from East Avenue..
Temporary access for Parcel t will be provided from East Avenue through
the remainder parcel. Upon development of the remainder parcel-,
permanent access to Parcel 1 will be provided' through an internal
street. One possible layout for the development of the remainder parcel
is shown as Exhibit "Cu.
III. ENVIRONMENTAL REVIEW: The applicant completed Part I- of the Initial
study, 5 a con ucted a field investigation and completed Part II cif
the Initial Study. No adverse impacts upon the environment are
anticipated as a result of this project. Thnrefore ,issuance of Negative
Declaration is appropriate.
IV. CORRESPONDENCE. Notices of Public hearing have been sent to surrounding
property owners and placed in the Daily Report Newspaper. Posting at the
site has also been completed.
V. RECOMMENDATION: It is recommended that the Planning Commission consider
all UpUt lements of the Tentative Parcel Map 12854. If after such
consideration, the Commission, can recommend approval, then the adoption
of the attached Resolution and issuance of a Negative Declaration would
be appropriate.

B. Analysis: Tentative Tract 1412I is the first=�>tract in the
victoria Planned Community to bedeveloped `under: the new
standards adopted-by the Planning Commission and City Council .
' in May '1988. The Design Review` applicat4on, as originally
"submitted, met, all of the ne}'vy� standards except, 'for the.
required combined,sideyard setbac of 15 feet.

In, order :to compTy with th ? requirement the. 'applicant
suggested, ; and the Design `Review' Committee recommended
approval of, the'- deletion of:-one lot. I'n addi'tion, the
Committee determined, that the proposed Plan 2 home was an
innovative^`product because it includes an enclosed tandem
garage space and a "pull:-through" garage door•which"provides
access to 'the rear yard: Thus,, lots with Plan 2 homes could
be (approved •with a combined sideyard setback of' 10 feet,,,
rather than the required 15 feet.
As it. is currentiydesigned, IO of the i46 lots do not o-f. `the

applicant has providetl 17" of the innovative 'Plan 2 homes, each
of which has a tandem space and "pull-through" garage door to

Staff Count: The revised site plan depicts that the 'number

III. FACTS FOR' FINDINGS: ;This project is consistent with the Victoria
Planned Community and the General 'Plan. The project wili not be
detrimental to adjacent ' properties, or cause significant
environmental impac,tsr.l. In ;addition, the proposed use, together
with the recommended Conditions of Approval, are in compliance
with the applicable provisions of-thrivictoria Planned;Community,
the Develnpment Code and City Standards.
IV. CORRESPONDENCE: Because this is an amended map,. it has been
advertised as a public hearing in The Daily Report newspaper, the
property posted, and notices were 'sent to ail property owners
within 300 feet of the project site.
V. RECOMMENDATION: Staff recommends that the Planning ;Commission

SUBJECT: USE DETERMINATION 90-01 DO - A reguest; for the Planning
Commission to determine whether a convenience 'store "land
use is aliowed as a' .permitted or a conditionally permitted
use in the Foothill Boulevard Specific Plan.
I. ABSTRACT: The Purpose of this report is for the Planning
Commission to provide staff with direction as to the -ppropriate
land use classification for convenience store uses within the
Foothill Boulevard Specific Plan.
II. ANALYSTS:
A. Background: The applicant, Nghia Do, is considering locating
a convenience store within the Community Commercial lend use
category of Subarea 3. However, the Foothill' Boulevard
Specific Plan dots not address convenience store uses nor does
the Development Code, which brought about this use
determinat-ion.
B. Code Issues: In the past, staff has interpreted the
convenience store use as being similar, to supermarkets or
liquor stores. In the Development Code, both uses are
identified separately and both"are 'pe"ritted in the General
Commercial and Neighborhood, Commercial Districta, while both
are prohibited in the 'Office Professional District. The
Foothill Boulevard Specific Plan permits supermarkets in the
Community Commercial and Regional-Related Commercial 'land use
categories, while liquor stores are conditionally ,permitted in
the Community Commercial and Specialty Commercial' land use
categories. Therefore, staff ha14 not been able to use the
same interpretations with the Foothill' Specific Plan. land'use
categories as - with the Development Code Development
Districts, Staff has researched the review and approval of
the Foothill Boulevard Specific Plan and, has not found any
discussion about convenience store uses during the adoption
process; therefore, it is assumled that they,were not intended
to be'.,-,specifically ,prohibited. : It should be noted that there
are'several existing convenience markets on, Foothill Boulevard
(See Exhibit 911).'
