I.. BACKGROUND. Tentative Tract 13873 was originally approved, on June 22,
1988. Although the final map has been recorded, no building permit's have
been issued. Hence, the ,81esign review portion of the project ,is dGe to
expire on June 22, 1990.'` According to the.Development. Code, extensions
may be granted in twelve fj10 month increments, not to exceed five'(5)
years from the original date of approval. Therefore, the applicant iIaay,
request two (2) addition:', time extensions extending the Design Review
for Tract 3873 'until :01ine 22, 1993. The applicant is currently
requesting a one (1) year .time extension which would expire on June 22,
1991.
II. ANALYSIS: Staff analyzed the proposed time extens`i`on and compared the
propasal with current development criteria outlined. in- the Development
Code and the Victoria Community Plana Based on this review, the tract
meets the development standards of the Medium-High Residential
District.
I.LI. RECOMMENDATION. Staff recommends that the Planning Commission grant .a
one 1, year time extension for he Design 'Review for Tract 1387,E through
the adoption of the attached) Resolution.

A. Recitals
(i) The William Lyon Company has 'filed an application for the
approval of Vesting Tentative Tract Map No. 13873 as described i,,.the' title:of
this Resolution. Hereinafter in this Resolution, the subject- Tentative Tract
Map request is referred to as "the application".`
(ii) On the 22nd of June, 1988, the Planning Commission of the City
of Rancho Cucamonga conducted a `duly noticed public hearing on the application
and concluded said hearing on,
that date.
(iii) All legal prerequisites =to the adoption of this Resolution
have oc;;urred.
B. Resolution. J
NOW, THEREFORE, it is hereby found, determined and resolved by the
Planning Commission of the City of Rancho Cucamonga as 'follows:
1. This Commission hereby specifically finds that all of the facts
set forth in the Recitals, Part A, of this Resolution are true and correct.
2. Based upon substantial evidence presented to this Commission
during the above-referenced public hearing on June 22, 1988, including written
and oral staff'r,eports, together with public testimony, this Commission hereby,
specifically finds follows:.
(a) . The application applies to property 'located at the
northwest corner of Victoria Park Lane and Atwood Street; and
(b) The property to the north of the subject site is existing
single family ;residences, the property to the south of that site is vacant
land, the property to the east is existing single family residences, and the
property to the west is vacant land; and
(c) Fiftea-jjr. Eucalyptus trees presently exist on the site. Due
to grading constraints, these trees will be removed. The trees will be r�1
replaced with a continuous windrow of Eucalyptus cladocalyx along',;the north'.
and west property boundaries.

3. Based upon the substantial evidence presented to this Commission
,during the above-referenced public hearing and upon the specific findings of
facts set forth in piragraphl 1 and 2 above, this Commission hereby;finds and
concludes as follows:
(a) That tentative tract,f is consistent with the
General Plan, Development Code, and specifics
plansi and
(b) Tha design or improvements of the tentatives
tract is consistent with the General Plan„
:Development Cade, and specific plans; and

(c) The site is physically suitable for the type of
_development 'proposed, and
(d) The design of,the subdivision is not likely to `
cause substantial environmental damage and
avoidable injury to ^humans and wildlife or
their habitat; and „
(e) The tentative tract .is not likely to cause
serious public heai,th problems, and
(f) The design of the tentative tract will not
conflict with any easement ' acquired by the
public at large, now of record, for access
through or use of the property ,within, the
proposed subdivision.
4. This Commission hereby finds, and certifies that the project has
been reviewed and considered in compliance with the California ,Environmental
quality Act of 1970 and, further, this Comnissio(" hereby issues a Negative
Declara 11i0-1i.
5. Based upon the findings and conclusions 'set forth in paragraph
1. 2 and 3 above, this Commission hereby. approves the application subject' to
each and every condition set forth below and, in the attached Standard-,
Conditions attached hereto and incorporated herein,.;ay this reference.
Desiqn Review
(1) The area below the second �;it oor balconies of
Buildings 1 and 3 shall be .carF�fully considered with
regard to plant selection. Tiie landscape materials
selected for these areas shall be tolerant of shade
and provide an accent backdrop to this area.

following requirements:
(ta) Construct a flood barrier wall along the 'north

(b) Raise the pad' elevations above the Q100 water
level per FEMA requirements'to the'satisfactio;h
of the City Engineer.
6. The Deputy Secretary to this Commission shall certify to the
adoption of this Resolution.

The property abuts the City limit and the Los Angeles
Department of Water and Power (LADWP) 1roperty on the. north
side of the lot, where the Variance is requested. The
unusual location of the lot and the shape of the lot m9ike
th,-�-s a unique situation. `*
The lot was 0, one time rectangular in shape (excluding the
driveway), until the Los Angeles_Department of ldater and ;
Power was later granted 'an easement for power lines and
towers to the north of,"i,he site. Eventually, the area within
ed
the easement was deed over to the Los Anget;'s D6;artment.of
Water and Power, thus creating the presenil shape of the
lot. The proposed ;garage addition adjoijls this common
boundary with the utility corridor. i1
The applicant could possibly build the .garai�e elsewhere .on
the site, but its construction would not be consistent vcith
the design of the existing residence. It mould also
constitute an _unnecessary hardship for the owner(due to the
unusual shape and topography of the site. a_
It does not appear that approval of this Variance will impact
adjacent properties in any way.
III;.A FACTS FOR FINDINGS: Before granting a- Variance, the Plann 11 ing
Commission must make all of the following required findings:
A. That strict or literal interpretation and enforcement of the
specified regulation would result in practical difficulty or
`unnecessary physical _ hardship inconsistent with the
objectives of this Code.
B. That there are exceptional or extrac,rdinary circumstan ssor'
conditions applicable to the property involved or to the
intended use of the property that do not apply generally to
other pfoperties in the same zone.

A. Recitals.
(i) Robert J. Witsk' has fi%d an application for the issuance
of the Variance No. 90-06 as described in the title of this Resolution;
Hereinafter in this Resolution, the subject Varia ,ce request is referred to as;
„the application."
(it) On May 9, 1990, the Planning ,Commission of the City of
Rancho Cucamonga conducted ,a,duly noticed public hearing on the application

B. Specific: The applicant intends to use a mobile'home as a
secondary ;dwelling unit. The trailer is currently,located on
the site and is occupied by the applicant's handicapped
father. The trailer is approximately 400 square feet and is a.
completely independent living facility.
The,unit is intended for use by a relative and meets all of the
applicable site development criteria for the 'Very Low
'Residentia District. There appears to be no obvious impacts
to adjacent property owners. ' However, it is recommended that
the trailer be <moved froar its present location to an :area
behind the garage so that it will be='set back approximately 30
feet from the rear property line, and a minimum of 20 feet from
the south property line.; The ,trailer will be screened from
Etiwanda'Avenue and adjacent properties by moving it to the
proposed location. It is also recommended that the trailer be
painted,to match the existing house and garage.
Landscaping, rather than a wall, should be required along the
south property line to screen the trailer, due to the location
of the adjacent windrows. A six-foot wall presently exists
along the north and east property lines, but landscaping should
be required along;the rear yard boundaries to help screen the
Aft trailer from adjacent residences-.
C. Environmental Assessment: Staff has found no significant
impacts on;the:envirorment as a result of this project.
III. FACTS, FOR FINDINGS: The project, as conditioned, is consistent
with the Development Code and General Plan'. The project will not
be detrimental "'.o adjacent properties or cause significant
environmental impacts; In addition, the proposed project is in
cornpliance with City Standards.
IV.- CORRESPONDENCE: This item has been advertised in The Daily Report
newspaper as a 'public hearing. The property has been posted and
notices were sent to allproperty owners within 300 feet of the
project site.
V. RECOMMENDATION': Staff recommends ;that the Planning Commission
Conditionally approve Conditional Use Permit 90-11, through
adoption of the attached Resolution and issuance of a Negative
Declaration.

BACKGROUND/ANALYSIS 1
`On December 14, 1988, the Planning Commitsion approved,. Resolution
No. 85.238 which set forth conditions for Ves*tng Tentative Tract:Map No.
13945.' Among the conditions was the req!jirement to construct full -
intersection ;improvements including traffic signals at the intersection
of Highland and East Avenues. Per this same condition the, developer is
to receive credit and a reimbursement for tbie`improvements and 'necessary
right-of-way acquisition from the Systems Development fee if
. approved by
the City Council. If not approved by the City Council, this candi is
to be waived. r;
4he original intent of this, candilion, to improve the ii,�arsection, was
with the idea that work -in this '`area for Route 30'was several years '
away. .Also, at that time' construdiion within Highland A43nue could be '
,processed through Caltrans on a permit basis.
Two items have occurred since the condition was imposed_, First, the
policy board for the Route 30 construction, as of March 29, 1990, gave
direction to design and construct the permanent interchange. of Route 30
near Highland` and East Avenues within ,2 112 years.= Second, Caltrsas
permit processing 'has, changed. With the new .processing, ,fw the '
magnitude of work of the full ieprovements at Highland and Eacit .Avonues',
it is anticipated to take approximately 2 years.,before construction'could `y!

1. BACKGROUND AND DISCUSSION: .>''The Community Development staff is
currently involved in; he planning ofthe roadway system around the
future regional mall,., The; plans presently call for,; a major
arterial roadway to runt east./west immediately adjacent to the north ,
side.of the mall siteliand align with Church`'Avenue on the west. On
the easterly end, it is anticipated to align with. Miller avenue and`
on the approNed parcel map for the mall site, the street has been
named Miller Avenue.
The implementation of this plan would result in a continuous street
with different names: It therefore has \seen suggested. by staff
that Miller Avenue bel'rhanged. to Church Street in anticipation of
the hookup with the exitension-of Church Street fr�;m the west. This
would provide a continuous name for the street from its western-
most point at 'Pepper, and Beryl Streets to the City';s eastern
boundary at East Avenuie (refer to Exhibit I). The recommendation
to use "Church" is based upon the 'follow.ing:.,
A.- The existing and planned length of Church Street is 4 miles
with'many.exi sting' residents living along it.
B. Miller Avenue at 1�-1/2 mil;;s (existing and planned) in length
has much .fenr addresses which would .need to be changed.
II. RECOMMENDATION: If the Planning Commission concurs with staffs
proposal to have the Church Street name continue along the entire
planned roadway length, it would be appropriate to approve the
attached, Resolution of, Intent to change Miller -Avenue to. Church
Street:
The Resolution -provides';; in Section 'B.3(b), for the initiation of
the name change upon ;the City Engineer's approval of the final
street improvement plan?' for the hookup of the two roadways. This
provision will prevent a premature name change before the precise
roadway alignment I. determined.

vehicles are parked behind the front yard setback, which is 42 feet from
the ultimate face of curb, and the vehicles are completely screened from
view, the appl; ant would be in compliance with the Development Code
vehicle ,parking+estrfctions,,
It should be noted that a determination cannot be made 'that 4.,p area in
question is a side yard"only=with respect to vehicular parking. Should
the Commission determine ghat the area is indeed a side yard, then all
of the side yard regulations would apply. For' example, the front yard
setback in this zone is 42 feet from curb face. The side yard setback
abutting a street is 27 feet. Hence, if the area is deemed to be a side
yard, then structures would be permitted to be built 291feet closer, to
the street than if the area were deemed a front yard.
It is Staff's opinion that the request by the BiSarios for the
Commission to determine that their front ;yard area, north of their
existing residence, is in actuality a side yard area and to allow for
the parking of, recreational vehicles would be contrary, .to the intent.of'
the Development Code regulations, A'r`ariance'request may be considered
if a demonstrated hardship exists that would actually prohibit the Aak
parking of recreational, 'vehicles within the bounds if current Code
regulations. As shown in Exhibit "A" sufficient area exists. on the
subject property to legally park the applicants` recreational vehicles.
III. RECOMMENDATION: Staff recommends that the Planting Commission reviews: »'
the material provided. If additional infdrmation is requested, staff.='
will attempt to provide said material at the next regularly scheduled
Planning' Commission'meeting.

tenant, Arco Steel,, Incorporated, Who is interested in moving into one of
the industrial buildings at Archicenter II. The site is:'located on,the
south 'side of 6th Street, east of Archlbaid and is desir;nated as General .
Industrial. Subarea 4 of the Industrial Specific Plan:' After reviewing
the proposed business, staff determined that it meets the definition of
radium Manufacturing instead of Light Manufacturing. In Subarea 4, Light
Manufacturing is a permitted use while Medium Manufacturing is not a
permitted'or conditional-ly permitted use. IThQ applicant disagreed with-'
stuffs determination and requested a-Use Determination .from the Plat-bino
Commission. Attached for your review is the April 9; 1990, lettr`` froin

A. Description of the proposed business: Arco 5teel Incorporated is a

B. Defi,iition of Light' and Mediu:a 'Manufacturing: Attached` for your
reftirenc� are the definitions of Light and Medium Manufacturing. The
und4r1ined words and phrases are the key elements in distinguishing
the;!two use categorises. As, ;a result of comparing the nature of the
proposed operation to thr,' use definitions, staff .found that the
proposed use fit ioto the!Medium Manufacturing category. The primary
reason is that "fabricated metal products made from sheet metals" is
_specifically listed" under the definition of Medium :Manufacturing.
Other reasor,'s=.include: the business generates truck traffic; the raw
`ma`terials ai,�.:.-end products are bulky in size; and the manufacturing

C. History of,,: he Site: The applicant' raised the issue that the site
developed for the type:of land uses in Subarea 5 than in Subarea
4. Attache&`&"b r your review is, Exhibit ,"D" which shows the two
Subarea` boundaries and Exhibit "C" which shows-the comparison of the
ia'nd uses between Subarea '5 and 'Subar'ea 4. The major difference
between the two subareas is that Subarea 4 has' a limited range of
manufacturing, warehouse, and distribution uses while Subarea 5 has a:
broader range.`
The site received Planning 'Commission approval in July of 1984 for
two, warehouse buildings totaling 79,000 square feet. Each building
has 4 dock-high doors. A total of 92 parkin, spaces have been
provided while the required number of parking sp�,zes for the site is
. ' 79 spaces. At that time, the Industrial Specific,+'Plan bias in effect,
so the site was designed for the intended uses in'}this Subarea.4 and
according to the Specific Plan standards.: Sirce)th` e "building type.:

Based upon the above analysis, staff concluded t!a The proposed
business, fabrication of metal products, fits into the Medium
Manufacturing category. Also, it is staff's opinion that the change
in the 'district boundary between Subarea 4 and I5 Warrants further;
study.
III. RECOMMENDATION: Staff recommends that the Planning Commission make the
determination that the proposed use is classified as Medium
Manufacturing.

RESOLUTION NO.
A RESOLUTION OF THE 'RANCHO CUCAMONGA PLANNING COMMISSION
APPROVING USE DETERMINATION 90-02 IN AFFIRMING .THE _
PROPOSD USE OF SHEET METAL CUTTING As MEDIUM
MANUFACTURING WHICH' IS NOT LISTED ;AS A PERMITTED USE IN
SUBAREA 4 OF THE INDUSTRIAL SPECIFIC PLAN',
A. Recitals.
(i) The . Barmakian Company has filed an application, Use
Determination No. 90-02, as described in the title .of this Resolution.
Hereinafter in this Resolution, the subject request is referred tb as "the
application."
(ii) On the 9th day of May, 1990, the Planning Commission of the
City of Rancho Cucamonga conducted a duly noticed pbbiic meeting on, the
application and concluded said hearing on that date.
(iii) All legal prerequisites to the adoption of this Resolution
_ have occurred.

NOW, THEREEME, it is hereby found, determined and resolved by the

Planning.Commission of`'the City of Rancho Cucamonga as follows:
I. This Comnistian hereby-specifically finds that all of the facts
set forth in the Recitals, 'Part A, of this Resolution are true and 'correct. ,
2. --Based upon substantial evidence presented to this CommissionY
during the above-referenced public hearing on May 9, 1990, including written
and oral staff reports, together with public testimony, this Commission hereby
specifically finds as follows:
(a) Fabricated metal products from sheet metals is
specifically listed under the definition of Medium
Manufacturing.
(b) The proposed use of sheep metal cutting fits into
the Category �of "Fabricated metal products from
sheet metals."
(c) ^'The proposed! use generates truck traffic the raw
materials are bulky in size; the end products are
bundled up in bulk; and the manufacturing .

3. Based upon the substantial evidence presented to this Commission
during the above-referenced public "hearing and upon the ,specific findings of
facts set forth in paragraph-.1 and 2 above, this Commission hereby finds and
concludes as follows: = -
(a) The use in ,;questian is listed under Medium
Manufacturing,'
(b) The use in question 'm'bats the definition of Medium
Manufacturing.
4. Based upon the findings and conclusions set forth in paragraph
1, 2 and 3 above, this Commission hereby 'raffirms the proposed use of sheet
metal cutting as Mediium Manufacturing. ,
S. The Secretary to this Commission shall certify to the adoption
of this Resolution.
