HomeMy WebLinkAbout02-59 - Resolutions RESOLUTION NO. 02-59 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT DRC2002-00018, THE DEVELOPMENT OF A 3,248 SQUARE FOOT CONVENIENCE STORE WITH GASOLINE DISPENSING; A 2,570 SQUARE FOOT FAST FOOD RESTAURANT WITH DRIVE-THRU; AND 3,600 SQUARE FEET OF OTHER RETAIL SPACE WITH DRIVE-THRU CAPABILITY ON 2.7 ACRES OF LAND IN THE OFFICE/PROFESSIONAL DISTRICT, LOCATED ON THE SOUTHWEST CORNER OF HAVEN AVENUE AND ALTA LOMA DRIVE,AND MAKING FINDINGS IN SUPPORT THEREOF—APN: 201-262-30 AND 40. A. Recitals. 1. Panorama Development filed an application for the issuance of Conditional Use Permit DRC2002-00018, as described in the title of this Resolution. Hereinafter in this Resolution, the subject Conditional Use Permit request is referred to as "the application." 2. On the 10th day of July 2002, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. 3. All legal prerequisites prior to the adoption of this Resolution have occurred. B. Resolution. NOW,THEREFORE, it is hereby found, determined, and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon the substantial evidence presented to this Commission during the above- referenced public hearing on July 10, 2002, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows: a. The application applies to property located on the southwest comer of Haven Avenue and Alta Loma Drive; and b. The property is rectangular in shape with a street frontage of approximately 799 feet along Alta Loma Drive and 238 feet along Haven Avenue; and C. The property is vacant with 13 mature trees that are proposed to be removed as part of the development; and d. The property to the north of the subject site is the proposed Tutor Time Learning Center and improved with a drive-thru Walgreen's Pharmacy, the property to the south is the future SR 210 Freeway, the property to the east is improved with the Haven Village Shopping Center, and the property to the west is improved with single-family homes; and e. The project will require the importation of 24,600 cubic yards of soil; and PLANNING COMMISSION RESOLUTION NO. 02-59 CONDITIONAL USE PERMIT DRC2002-00018— PANORAMA DEVELOPMENT June 10, 2002 Page 2 f. A Variance (DRC2002-00246) is proposed for a retaining wall of up to 12.5 feet in height along the south property line; and g. A 16-foot high Caltrans sound wall made of split face block with a fluted cap runs along the western half of the southern property boundary. 3. Based upon the substantial evidence presented to this Commission during the above- referenced public hearing and upon the specific findings of facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and concludes as follows: a. The proposed use is in accord with the General Plan, the objectives of the Development Code, and the purposes of the district in which the site is located. b. The proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. C. The proposed use complies with each of the applicable provisions of the Development Code. 4. Based upon the facts and information contained in the proposed Mitigated Negative Declaration, together with all written and oral reports included for the environmental assessment for the application, the Planning Commission finds that there is no substantial evidence that the project will have a significant effect upon the environment and adopts a Mitigated Negative Declaration and Monitoring Program attached hereto, and incorporated herein by this reference, based upon the findings as follows: a. That the Mitigated Negative Declaration has been prepared in compliance with the California Environmental Quality Act of 1970, as amended, and the State CEQA guidelines promulgated thereunder; that said Mitigated Negative Declaration and the Initial Study prepared therefore reflect the independent judgment of the Planning Commission; and, further, this Commission has reviewed and considered the information contained in said Mitigated Negative Declaration with regard to the application. b. Although the Mitigated Negative Declaration identifies certain significant environmental effects that will result if the project is approved, all significant effects have been reduced to an acceptable level by imposition of mitigation measures on the project,which are listed below as conditions of approval. C. Pursuant to the provisions of Section 753.5(c) of Title 14 of the California Code of Regulations, the Planning Commission finds as follows: In considering the record as a whole, the Initial Study and Mitigated Negative Declaration for the project, there is no evidence that the proposed project will have potential for an adverse impact upon wildlife resources orthe habitat upon which wildlife depends. Further, based upon the substantial evidence contained in the Negative Declaration, the staff reports and exhibits, and the information provided to the Planning Commission during the public hearing,the Planning Commission hereby rebuts the presumption of adverse effect as set forth in Section 753.5(c-1-d) of Title 14 of the California Code of Regulations. PLANNING COMMISSION RESOLUTION NO. 02-59 CONDITIONAL USE PERMIT DRC2002-00018 — PANORAMA DEVELOPMENT June 10, 2002 Page 3 5. Based upon the findings and conclusions set forth in paragraphs 1, 2, 3, and 4 above, this Commission hereby approves the application subject to each and every condition set forth below and in the Standard Conditions, attached hereto and incorporated herein by this reference. Planning Division 1) Add foam stucco details along the building's arches. 2) Provide a recessed down lit lighting treatment under the arches of the 7-Eleven building to match the other buildings. 3) Design all walls to match with pilasters and cap. Final design shall be to the satisfaction of the City Planner. 4) All pilasters shall be a minimum of 30 inches by 30 inches in size. 5) Remove 6-inch retaining wall at the southeast comer of the property, or add an additional terrace retaining wall to match the existing terrace retaining walls to the west. 6) No public pay phones shall be provided within the project. 7) The applicant shall conduct a survey of the surrounding residents (south of Lemon Avenue, east of Mayberry Avenue, west of Haven Avenue, north of Alta Loma Drive) and Vineyard Junior High School every six months and submit the survey results to the City Planner. The form and method of the survey shall be approved by the City Planner. The City Planner shall consider the survey results and determine compliance with the project's conditions of approval and address any issues that warrant enforcement of modification to the conditions of approval. 8) Uniformed security patrol shall be provided from 10 p.m. to 6 a.m. Ennineerina Division 1) Caltrans is constructing Alta Loma Drive and Haven Avenue adjacent to the project. The developer shall provide for the completion of missing public improvements after Caltrans construction. However, should the Route 30 Freeway (SR 210) project not progress in a timely manner, this development shall be required to provide approved final or interim (to be determined) improvements on both Alta Loma Drive and Haven Avenue frontages. 2) Missing Haven Avenue improvements outside the limits of the freeway project shall be improved per improvement plans. 3) Haven Avenue is a City"Major Street;"Alta Loma Drive is a"Collector Street." 4) No access to Haven Avenue is allowed. PLANNING COMMISSION RESOLUTION NO. 02-59 CONDITIONAL USE PERMIT DRC2002-00018— PANORAMA DEVELOPMENT June 10, 2002 Page 4 5) The developer shall pay an in lieu fee for the reimbursement of the overhead utility undergrounding (telecommunication and electrical except for any 66 KV electrical lines)on the opposite side of Alta Loma Drive. The fee shall be half the actual cost. 6) Provide "Two Way Left Tum" lane in Alta Loma Drive. 7) Site drainage to Alta Loma Drive requires permit/approval from Caltrans. 8) Substantiate the structural integrity of the storm drainpipe with the additional fill and structure placement of this development. Environmental Mitigation Air Quality 1) The site shall be treated with water or other soil-stabilizing agent (approved by SCAQMD and RWQCB) daily to reduce PM10 emissions, in accordance with SCAQMD Rule 403. 2) Alta Loma Drive shall be swept according to a schedule established by the City to reduce PM10 emissions associated with vehicle tracking of soil off-site. Timing may vary depending upon time of year of construction. 3) Grading operations shall be suspended when wind speeds exceed 25 miles per hour to minimize PM10 emissions from the site during such episodes. 4) Chemical soil stabilizers(approved by SCAQMD and RWQCB)shall be applied to all inactive construction areas that remain inactive for 96 hours or more to reduce PM10 emissions. 5) The construction contractor shall select the construction equipment used on-site based on low emission factors and high-energy efficiency. The construction contractor shall ensure the construction grading plans include a statement that all construction equipment will be tuned and maintained in accordance with the manufacturers' specifications. 6) The construction contractor shall utilize electric or clean alternative fuel powered equipment where feasible. 7) The construction contractor shall ensure that construction grading plans include a statement that work crews will shut off equipment when not in use. 8) Contractor shall use low volatile organic compound(VOC)coatings and asphalt. PLANNING COMMISSION RESOLUTION NO. 02-59 CONDITIONAL USE PERMIT DRC2002-00018— PANORAMA DEVELOPMENT June 10, 2002 Page 5 Hazards 1) All appropriate permits will be obtained prior to certificate of occupancy and must be documented in a Business Emergency/Contingency Plan to be approved by the City Emergency Services (Fire Protection District) Office. Noise 1) During all project site excavation and grading, the project contractors shall equip all construction equipment, fixed or mobile, with property operating and maintained mufflers consistent with manufacturers' standards. 2) The project contractor shall place all stationary construction equipment so that emitted noise is directed away from sensitive receptors nearest the project site. 3) The construction contractor shall locate equipment staging areas that will create the greatest distance between construction related noise and the noise sensitive receptors nearest the project site during all project construction. 4) During all project site construction, the construction contractor shall limit all construction related activities that would result in high noise level between the hours of 6:30 a.m. and 8:00 p.m., Monday through Saturday. No construction shall be allowed on Sundays and National Holidays. Aesthetics 1) The design of the retaining wall shall be coordinated with the design of the freeway sound wall in order to provide a smooth visual transition along the surface of the wall. 6. This program has been prepared in compliance with State law to ensure that adopted mitigation measures are implemented (Section 21081.6 of the Public Resources Code). Program Components -This MMP contains the following elements: 1. Conditions of approval that act as impact mitigation measures are recorded with the action and the procedure necessary to ensure compliance.The mitigation measure conditions of approval are contained in the adopted Resolution of Approval for the project. 2. A procedure of compliance and verification has been outlined for each action necessary. This procedure designates who will take action, what action will be taken and when, and to whom and when compliance will be reported. 3. The MMP has been designed to provide focused, yet flexible guidelines. As monitoring progresses, changes to compliance procedures may be necessary based upon recommendations by those responsible for the program. Program Management - The MMP will be in place through all phases of the project. The project planner, assigned by the City Planner, shall coordinate enforcement of the MMP. The project planner oversees the MMP and reviews the Reporting Forms to ensure they are filled out correctly and proper action is taken on each mitigation. Each City department shall ensure compliance of the conditions (mitigation) that relate to that department. Procedures -The following steps will be followed by the City of Rancho Cucamonga. 1. A fee covering all costs and expenses, including any consultants'fees, incurred by the City in performing monitoring or reporting programs shall be charged to the applicant. 2. A MMP Reporting Form will be prepared for each potentially significant impact and its corresponding mitigation measure identified in the Mitigation Monitoring Checklist, attached hereto. This procedure designates who will take action,what action will be taken and when,and to whom and when compliance will be reported. All monitoring and reporting documentation will be kept in the project file with the department having the original authority for processing the project. Appropriate specialists will be retained if technical expertise beyond the City staff's is needed,as determined by the project planner or responsible City department, to monitor specific mitigation activities and provide appropriate written approvals to the project planner. 4. The project planner or responsible City department will approve, by signature and date, the completion of each action item that was identified on the MMP Reporting Form. After each measure is verified for compliance, no further action is required for the specific phase of development. 5. All MMP Reporting Forms for an impact issue requiring no further monitoring will be signed off as completed by the project planner or responsible City department at the bottom of the MMP Reporting Form. 6. Unanticipated circumstances may arise requiring the refinement or addition of mitigation measures. The project planner is responsible for approving any such refinements or additions. An MMP Reporting Form will be completed by the project planner or responsible City department and a copy provided to the appropriate design, construction, or operational personnel. 7. The project planner or responsible City department has the authority to stop the work of construction contractors if compliance with any aspects of the MMP is not occurring after written notification has been issued. The project planner or responsible City department also has the authority to hold certificates of occupancies if compliance with a mitigation measure attached hereto is not occurring. The project planner or responsible City department has the authority to hold issuance of a business license until all mitigation measures are implemented. 8. Any conditions (mitigation) that require monitoring after project completion shall be the responsibility of the City of Rancho Cucamonga Community Development Department. The Department shall require the applicant to post any necessaryfunds(or otherforms of guarantee) with the City. These funds shall be used by the City to retain consultants and/or pay for City staff time to monitor and report on the mitigation measure for the required period of time. 9. In those instances requiring long-term project monitoring, the applicant shall provide the City with a plan for monitoring the mitigation activities at the project site and reporting the monitoring results to the City. Said plan shall identify the reporter as an individual qualified to know whether the particular mitigation measure has been implemented. The monitoring/reporting plan shall conform to the City's MMP and shall be approved by the Community Development Director prior to the issuance of building permits. The applicant shall agree to defend at his sole expense any action brought against the City, its agents, officers, or employees, because of the issuance of such approval, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or employees, for any Court costs and attorney's fees which the City, its agents, officers, or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of his obligations under this condition. 2. B. Time Limits 1. Conditional Use Permit, Variance, or Development/Design Review approval shall expire if building permits are not issued or approved use has not commenced within 5 years from the date of approval. No extensions are allowed. C. Site Development 1. The site shall be developed and maintained in accordance with the approved plans which include site plans, architectural elevations, exterior materials and colors, landscaping, sign program, and grading on file in the Planning Division, the conditions contained herein, Development Code regulations. 2. Prior to any use of the project site or business activity being commenced thereon, all Conditions of Approval shall be completed to the satisfaction of the City Planner. Occupancy of the facilities shall not commence until such time as all Uniform Building Code and State Fire Marshal regulations have been complied with. Prior to occupancy, plans shall be submitted to the Rancho Cucamonga Fire Protection District and the Building and Safety Division to show compliance. The buildings shall be inspected for compliance prior to occupancy. 4. Revised site plans and building elevations incorporating all Conditions of Approval shall be submitted for City Planner review and approval prior to the issuance of building permits. 5. All site, grading, landscape, irrigation, and street improvement plans shall be coordinated for __J_/ consistency prior to issuance of any permits (such as grading, tree removal, encroachment, building, etc.) or prior to final map approval in the case of a custom lot subdivision, or approved use has commenced, whichever comes first. 6. Approval of this request shall not waive compliance with all sections of the Development Code, all other applicable City Ordinances, and applicable Community or Specific Plans in effect at the time of building permit issuance. 7. A detailed on-site lighting plan, including a photometric diagram, shall be reviewed and approved by the City Planner and Police Department (477-2800) prior to the issuance of building permits. Such plan shall indicate style, illumination, location, height, and method of shielding so as not to adversely affect adjacent properties. 8. Trash receptacle(s) are required and shall meet City standards. The final design, locations, and the number of trash receptacles shall be subject to City Planner review and approval prior to the issuance of building permits. 9. All ground-mounted utility appurtenances such as transformers, AC condensers, etc., shall be located located out of public view and adequately screened through the use of a combination of concrete or masonry walls, berming, and/or landscaping to the satisfaction of the City Planner. For single-family residential developments, transformers shall be placed in underground vaults. 10. All building numbers and individual units shall be identified in a clear and concise manner, —/_ including proper illumination. 11. All parkways, open areas, and landscaping shall be permanently maintained by the property owner, homeowners' association, or other means acceptable to the City. Proof of this landscape maintenance shall be submitted for City Planner and City Engineer review and approved prior to the issuance of building permits. D. Shopping Centers 1. The Master Plan is approved in concept only. Future development for (each building pad/parcel) shall be subject to separate Development/Design Review process for Planning Commission approval. Modifications to the Shopping Center Master Plan shall be subject to Planning Commission approval. 2. A uniform hardscape and street furniture design including seating benches, trash receptacles, free-standing potted plants, bike racks, light bollards, etc., shall be utilized and be compatible with the architectural style. Detailed designs shall be submitted for Planning Division review and approval prior to the issuance of building permits. 3. Provide for the following design features in each trash enclosure, to the satisfaction of the City Planner: a. Architecturally integrated into the design of (the shopping center/the project). b. Separate pedestrian access that does not require the opening of the main doors and to include self-closing pedestrian doors. C. Large enough to accommodate two trash bins. Signs shall be conveniently posted for "no overnight parking" and for "employee parking Jam_ only." 8. All operations and businesses shall be conducted to comply with the following standards which shall be incorporated into the lease agreements for all tenants: a. Noise Level - All commercial activities shall not create any noise that would exceed an exterior noise level of 60 dB during the hours of 10 p.m. until 7 a.m. and 65 dB during the hours of 7 a.m. until 10 p.m. b. Loading and Unloading - No person shall cause the loading, unloading, opening, _/_/_ closing, or other handling of boxes, crates, containers, building materials, garbage cans, or other similar objects between the hours of 10 p.m. and 7 a.m. unless otherwise specified herein, in a manner which would cause a noise disturbance to a residential area. 9. Textured pavement shall be provided across circulation aisle, pedestrian walkway, and plaza. They shall be of brick/tile pavers, exposed aggregate, integral color concrete, or any combination thereof. Full samples shall be submitted for City Planner review and approval prior to the issuance of building permits. 10. All future building pads shall be seeded and irrigated for erosion control. Detailed plans shall be included in the landscape and irrigation plans to be submitted for Planning Division approval prior to the issuance of building permits. 11. The lighting fixture design shall compliment the architectural program. It shall include the plaza area lighting fixtures, building lighting fixtures (exterior), and parking lot lighting fixtures. 12. The design of store fronts shall compliment the architectural program and shall have subtle variations subject to Design Review Committee approval prior to the issuance of building permits. 13. All future projects within the shopping center shall be designed to be compatible and consistent with the architectural program established. 14. Any outdoor vending machines shall be recessed into the building faces and shall not extend into the pedestrian walkways. The design details shall be reviewed and approved by the City Planner prior to the issuance of building permits. E. Building Design 1. All roof appurtenances, including air conditioners and other roof mounted equipment and/or projections, shall be shielded from view and the sound buffered from adjacent properties and streets as required by the Planning Division. Such screening shall be architecturally integrated with the building design and constructed to the satisfaction of the City Planner. Details shall be included in building plans. Landscaping 1. A detailed landscape and irrigation plan, including slope planting and model home landscaping in the case of residential development, shall be prepared by a licensed landscape architect and submitted for City Planner review and approval prior to the issuance of building permits or prior final map approval in the case of a custom lot subdivision. 2. A minimum of 20% of trees planted within industrial projects, and a minimum of 30% within commercial and office projects, shall be specimen size trees - 24-inch box or larger. 3. General Guidance for Fire Hydrants: The following provides general guidance for the spacing and location of fire hydrants. Remember these are the maximum permitted distances between fire hydrants: a. The maximum distance between fire hydrants in commerciaVindustrial projects is 300-feet. b. Fire hydrants are to be located: • At the entrance(s) to a project from the existing public roadways. This includes subdivisions and industrial parks. • At intersections. • On the right side of the street, whenever practical and possible. • As required by the Fire Safety Division to meet operational needs. C. The distance from a fire hydrant to the building or structure protected shall not exceed one-half of the maximum allowable separation. d. The location of fire hydrants is based upon the operational needs of the Fire District to control a fire. e. Fire hydrants shall be located a minimum of forty(40) from any building. 7. Hydrants Used to Supply Fire Flow: Public fire hydrants located within a 500-foot radius of the proposed project may be used to provide the required fire flow subject to Fire District review and approval. Private fire hydrants on adjacent property shall not be used to provide required fire flow. 8. Public Installation: All required public fire hydrants shall be installed, flushed, and operable prior to delivering any combustible building materials on-site (i.e., lumber, roofing materials, etc.). Water District personnel shall inspect the installation and witness hydrant flushing. The builder/developer shall submit a copy of the Water District inspection report to the Fire Safety Division. 9. Private/On-site Installation: All private on-site fire hydrants shall be installed, flushed, and operable prior to delivering any combustible building materials on-site (i.e., lumber, roofing materials, etc.). A representative of Fire Construction Services shall inspect the installation and witness hydrant flushing. The builder/developer shall submit final test and inspection report to the Fire Safety Division. 10. Final Acceptance: For the purpose of final acceptance, an additional test of the on- site fire hydrants shall be conducted by the builder/developer in the presence of the Water District or Fire Construction Services, as appropriate. The builder/developer shall submit the final test report to the Fire Safety Division. 11. Show Existing Fire Hydrants and Mains: Existing fire hydrants and mains within 600-feet of the project shall be shown on the water plan submitted for review and approval. Include main size. 12. Fire Sprinkler Underground: Prior to the issuance of a fire sprinkler system permit, the applicant shall submit construction plans, specifications, and calculations for the fire sprinkler system underground to the Fire Safety Division for approval. 13. Maintenance Agreement: If the system is private the applicant shall do the following prior to the issuance of the building permit: a. Submit proof that provisions have been made for the annual testing, repair, and maintenance of the system. A copy of the maintenance agreement shall be submitted to the District. b. For developments with multiple owners, they shall establish a reciprocal maintenance agreement that shall be submitted to the Fire District for acceptance. 14. Hydrant Markers: Prior to the issuance of any Certificate of Occupancy, all fire hydrants shall have a blue reflective pavement marker indicating the fire hydrant location on the street or driveway in accordance with Rancho Cucamonga Fire Protection District and City of Rancho Cucamonga Engineering Standard Plan 134, "Installation of Reflective Hydrant Markers." On private property these markers are to be maintained in good condition by the property owner. D. Available Water Supply-Confirmation Required 1. Prior to the issuance of a building permit, the applicant shall provide evidence of adequate fire flow. The Rancho Cucamonga Fire Protection District Water Availability for Fire Protection Form shall be signed by the Water District and submitted for approval by the Rancho Cucamonga Fire Protection District. If sufficient water to meet fire flow requirements is not available, an automatic fire extinguishing system may be required in each structure affected by the insufficient flow. A copy of the required form is attached at the end of this notice. E. Automatic Fire Sprinkler Systems 1. Required Installations: a. Rancho Cucamonga Fire District Ordinance 15 or other adopted code or standard, requires an approved automatic fire sprinkler system to be installed in any of the following: Group A Occupancies-Jack in the Box 2. Plans and Permit: Plans for the required automatic fire sprinkler system shall be submitted to Fire Construction Services for review and approval. No work is allowed without a Fire Construction Services permit. 3. Remodels and Changes: Any modification or remodel to a fire sprinkler system requires Fire District approval, and a permit. NO WORK is permitted without a permit issued by Fire Construction Services 4. Final Inspection: Prior to the issuance of a Certificate of Occupancy, the fire sprinkler system(s) shall be tested and accepted by Fire Construction Services. 5. Sprinkler Monitoring: The fire sprinkler system monitoring system shall be installed, tested, and operational immediately following the completion of the fire sprinkler system. Monitoring is required with 20 sprinklers in Group I Occupancies, or 100 or more sprinklers in all other Occupancies. F. Fire Access 1. Access Roadways Defined: Fire District access roadways include public roads, streets, and highways, as well as private roads, streets, drive aisles and designated fire lanes. 2. Location of Access: All portions of the structure or facility or any portion of the exterior wall of the first story shall be located within 150-feet of Fire District vehicle access, measured by an unobstructed approved route around the exterior of the building. Landscaped areas, unpaved changes in elevation, gates, and fences are an obstruction. 3. Private Roadways and Fire Lanes: The minimum specifications for private fire district access roadways are: a. The minimum unobstructed width is 26-feet. b. The inside tum radius shall be 20-feet. C. The outside turn radius shall be not less than 50-feet. d. The minimum radius for cul-de-sacs is 45-feet. e. The minimum vertical clearance is 14 feet, 6 inches. f. At any private entry median,the minimum width of traffic lanes shall be 20-feet. g. The angle of departure and approach shall not exceed 9 degrees or 20 percent. h. The maximum grade of the driving surface shall not exceed 12%. i. Support a minimum load of 70,000 pounds gross vehicle weight (GVW). 4. Access Control/Traffic Calming Device Permit: A Fire District permit is required to install any access control device, traffic-calming device, or gate on any access roadway. Applicable CC&R's, or other approved documents, shall contain provisions that prohibit obstructions such as traffic-calming devices (speed bumps, humps, etc.), control gates, bollards, or other modifications in fire lanes or access roadways without prior written approval of the Fire District, Fire Safety Division 5. Fire District Site Access Plan- Required Note: Prior to the issuance of any grading permit the applicant shall submit a Fire District Site Access Plan to the Fire District for review and approval. The following, minimum information and detail shall be included a on a scaled site plan: a. All roadways shall be clearly indicated. Including roadway width, vertical clearances, cul-de-sac width, turn radii, curb cuts, angle of departure, grades, etc. b. For private roadways or drive aisles less than 40-feet or less in width where parking may be permitted, identify the location of proposed fire lanes. C. Include a note stating all required fire lanes shall be identified by red curbing and signage. d. Include details) to identify which of the methods set forth in the Fire District "Fire Lane"standard will be used to mark the fire lane. A copy of the Fire District"Fire Lane" Standard can be obtained by calling (909) 477-2770. e. Roadway with a width of more than 40-feet parking is permitted on both sides. f. Roadway with a width of 32-feet or more parking is permitted on one side only. g. The angle of departure and approach shall not exceed 9 degrees or 20 percent. h. The grade of any fire district access roadway shall not exceed 12 percent. i. If water plans have been approved include fire hydrant and fire department connection locations. 6. Knox Rapid Entry System: A Knox rapid entry key vault shall be installed prior to final inspection. Proof of purchase shall be submitted prior to final building plan approval. Contact the Fire Safety Division for specific details and ordering information. 7. Vegetation: Trees and shrubs planted in any median shall be kept trimmed to a minimum of 14-feet, 6-inches from the ground up, so as not to impede fire vehicles. 8. Site Directory: A building or site directory shall be required, as noted below: Lighted directory within 20-feet of main entrance(s)to the site. 9. Construction Access: Fire District access, a minimum 26-feet in width and 14-feet, 6- inches minimum clear height shall be provided. These minimum clearances shall be maintained free and clear of any obstructions at all times, in accordance with Fire District Standards. 10. Fire Lane Identification: All required fire lanes shall be identified by red curbing and signage. A drawing of the proposed signage that meets the minimum Fire District standards shall be submitted to and approved. Contact the Rancho Cucamonga Fire Protection District at(909)477-2770 for a copy of the FD Fire Lanes standard. 11. Fire Lanes: Prior to the issuance of any Certificate of Occupancy, the fire lanes shall be installed in accordance with the approved fire lane plan. The CC&R's or other approved documents shall contain an approved fire lane map and provisions that prohibit parking in the fire lanes. The method of enforcement shall be documented. The CC&R's shall also identify who is responsible for not less than annual inspection and maintenance of all required fire lanes. 12. Address- Other Than Single-family: New buildings other than single-family dwellings shall post the address with minimum 8-inch numbers on contrasting background, visible from the street and electrically illuminated during periods of darkness. When the building setback exceeds 200 feet from the public street an additional non-illuminated 6-inch minimum number address shall be provided at the property entrance. 13. Multi-unit Complexes: In multi-unit complexes approved address numbers, and/or building identification letters shall be provided on the front and back of all units, suites, or buildings. The Fire District shall review and approve the numbering plan in coordination with the City of Rancho Cucamonga. G. Combustible Construction Letter "Required Letter: Prior to the issuance of a building permit for combustible construction, the builder shall submit a letter to the Fire District on company letterhead stating that the minimum water supply for fire fighting purposes and the all-weather fire protection access roadway that meets Fire District Standards shall be in place and operational before any combustible material is placed on-site. The roadway shall be maintained at all times. H. Building Use Letter "Required Letter: Prior to the issuance of any building permits,the applicant shall submit a detailed letter of intended use for each building on-site to the Fire District for review and approval. A form that may be used to meet this requirement is attached at the end of the Fire District comments. I. Fire Suppression System (Required for Commercial Cooking Equipment or Special Hazards) 1. Plans and Permits: Prior to the issuance of a building permit, plans, and specifications for the fire suppression system for the protection of commercial-type cooking equipment or other special hazard shall be submitted to Fire Construction Services for review and approval. No work is allowed without a Fire Construction Services permit. 2. Final Inspection and Testing: Prior to the issuance of a Certificate of Occupancy, the fire suppression system(s) shall be tested and accepted by Fire Service Construction Services. J. Fire Alarm System 1. Required Installation: An automatic fire alar (and detection) system is required by RCFPD Ordinance 15, based on use or floor area, or by another adopted code or standard. Refer to Ordinance 15 for spec fic requirements. 2. Plans and Permits: Prior to issuance of a building permit, plans for the fire alar system shall be submitted to Fire Construction Services for review and approval. No work is allowed without a Fire District permit. 3. Final Inspection and Testing: Prior to the issuance of a Certificate of Occupancy, the fire alarm (and detection) system(s) shall be tested and accepted by Fire Construction Services. K. Fire District Service Fees' 1. The following service fees are due to the Fire District and payable at this time: $82 Start-up fee for commercial, industrial or multi-family dwelling units (Paid prior to TRC) $132 Conditional Use Permit Review Fee (CUP) $132-Total due at this time. Remit payment by check made payable to: "Rancho Cucamonga Fire District." "Plus a microfiche/laser-fiche fee of $1.00 per plan sheet for all final plans approved by the Fire Safety Division. 'Note: Separate plan check fees will be assessed by the Fire Construction Services Unit for review of tenant improvement work, fire protection systems (fire sprinklers, alarm systems,fire extinguishing systems,etc.), and/or any consultant reviews upon submittal of tans. L. Hazard Control Permits 1. As noted below Special Permits may be required, dependent upon approved use(s): a. General Use Permit shall be required for any activity or operation not specifically described below, which in the judgment of the Fire Chief is likely to produce conditions that may be hazardous to life or property. b. Operate a place of public assembly. C. To install any access control device, system, or any material under, upon or within the required fire district access roadway. This includes any gate, barrier, traffic-calming device, speed bump, speed hump or any device that delays or slows Fire District response. d. Flammable and combustible liquid (storage, handling, and/or use). e. Motor vehicle fuel-dispensing operation. M. Hazardous Materials—Compliance with Disclosure and Reporting Regulations The below listed businesses, operations, uses or conditions require that the San Bernardino County Fire Department review your Business Emergency/Contingency Plan for compliance with minimum standards. Contact the San Bernardino County Fire, Hazardous Materials Division at (909) 387-3041 for forms and assistance. The County Fire Department is the Cal/EPA Certified Unified Program Agency(CUPA) for the City of Rancho Cucamonga. a. Quantities: Any business that uses, generates, processes, produces, treats, stores, emits, or discharges a hazardous material in quantities at or exceeding 55 gallons, 500 pounds, or 200 cubic feet (compressed gas) at any one time in the course of a year. b. Waste: All hazardous waste generators, regardless of quantity generated. C. Pesticides: Any business that handles, stores, or uses Category (1) or (II) pesticides, as defined by FIFRA, regardless of amount. d. Explosives: Any business that handles DOT Hazard Class 1 (explosives, found in 49 CFR) regardless of amount. e. Extremely Hazardous Substances (EHS): Any business that handles extremely hazardous substances (EHS's) in quantities exceeding the threshold planning quantity (T.P.Q.). Extremely Hazardous Substances are designated pursuant to the Emergency Planning and Community Right to Know Act Section 302, and are listed in 40 CFR Part 355. I. SARA Title III: Any business subject to the Emergency Planning and Community Right to Know Act (EPCRA), also known as SARA Title III. Generally, EPCRA includes facilities that handle hazardous substances above 10,000 pounds, or extremely hazardous substances above threshold planning quantities. There are some exceptions, including retail gas stations with up to 75,000 gallons of gasoline or 100,000 gallons of diesel fuel in Underground Storage Tanks (UST's) that meet the 1998 upgrade requirements. To get more information on EPCRA requirements call 1-800-535-0202. Due to State disclosure consolidation laws, Tier II forms need not be submitted to the various State and Federal agencies. Submission of your Business Emergency/ Contingency Plan will meet this requirement; however, EPCRA does require full annual inventory submission rather than a certification statement each March 1. Also, EPCRA facilities are bound by the trade secret limitations of EPCRA, and must sign every page of inventory. g. Radioactive Materials: Any business that handles radioactive material that is listed in Appendix B of Chapter 1, of 10 CFR. h. Certificate of Occupancy Restrictions: If the facility is a NEW business, a Certificate of Occupancy issued by Building and Safety will not be finalized until the San Bernardino County Fire Department reviews your Business Emergency/Contingency Plan. California Government Code, Section 65850.2 prohibits the City from issuing a final Certificate of Occupancy unless the applicant has met or is meeting specific hazardous material disclosure requirements. A Risk Management Program (RMP) may also be required if regulated substances are to be used or stored at the new facility. Rental or Lease Properties: Any business that operates on rented or leased property, and is required to submit a Plan, is required to submit a notice to the owner of the property in writing stating that the business is subject to the Business Emergency/Contingency Plan mandates, and has complied with the provision, and must provide a copy of the Plan to the property owner within 5 working days after receiving a request from the owner. j. Fire District Code Adoption: The Fire Code adopted by the Fire District has a provision requiring collection of information regarding hazardous materials at facilities for purposes of Fire Code implementation and emergency response. k. Submittal to the Fire District: Prior to issuance of a Certificate of Occupancy a copy of the County Fire Department approved Business Emergency/Contingency Plan - New Business (Hazardous Materials Release Response Plans and Inventory) shall be submitted to the Fire District. In some cases additional information that is not in the Business Emergency/Contingency Plan may be required in order to support local fire prevention and emergency response programs. N. Plan Submittal Required Notice Required plans shall be submitted and approved prior to construction in accordance with 1997/98 Building, Fire, Mechanical, and Plumbing Codes; 1999 Electrical and RCFPD Ordinances FD15 and FD32, Guidelines and Standards. "NOTE: In addition to the fees due at this time please note that separate plan check fees for tenant improvements, fire protection systems and/or any consultant reviews will be assessed at time of submittal of plans. O. Alternate Materials and Methods The Fire Safety Division will review requests for alternate materials and methods within the scope of our authority.
