A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO CUCAMONGA, CALIFORNIA, APPROVING ENTERTAINMENT
PERMIT DRC2003-00044 ITO'Y ATIN RESTAURANT,A REQUEST TO ADD
KARAOKE ENTERTAINMENT AND BALLROOM DANCING AT AN
EXISTING RESTAURANT THAT, FOLLOWING A FLOOR AREA
EXPANSION, WILL HAVE A FLOOR AREA OF ABOUT 3,300 SQUARE
FEET IN THE COMMERCIAL OFFICE (CO) DISTRICT OF THE FOOTHILL
BOULEVARD DISTRICTS(SUBAREA 3)AT 9625 FOOTHILL BOULEVARD,
AND MAKING FINDINGS IN SUPPORT THEREOF - APN: 0208-261-48.
A. Recitals.
1. Romeo Concepcion of Ito'y Atin Restaurant filed an application for the issuance of
Entertainment Permit No. DRC2003-00044, as described in the title of this Resolution. Hereinafter in
this Resolution, the subject Entertainment Permit request is referred to as "the application."
2. On May 21, 1986, the City Council of the City of Rancho Cucamonga adopted Ordinance
No. 290 providing for the regulation of entertainment.
3. On the 10th day of September 2003, the Planning Commission of the City of Rancho
Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing
on that date.
4. All legal prerequisites prior to the adoption of this Resolution have occurred.
B. Resolution.
NOW, THEREFORE, it is herebyfound, determined, and resolved bythe Planning Commission
of the City of Rancho Cucamonga as follows:
1. This Commission hereby specifically finds that all of the facts set forth in the Recitals,
Part A, of this Resolution are true and correct.
2. Based upon the substantial evidence presented to this Commission during the above-
referenced public hearing on September 10, 2003, including written and oral staff reports, together
with public testimony, this Commissiorn hereby specifically finds as follows:
a. The application applies to property in the Commercial Office District, Foothill
Boulevard Districts (Subarea 3) located at.9625 Foothill Boulevard and is presently improved with a
commercial shopping center; and
b. The properties to the north are zoned Specialty Commercial/Community
Commercial, the property to the east is zoned Specialty Commercial, and the properties to the west
are zoned Commercial Office. These referenced properties are all within the Foothill Boulevard
District(Subarea 3)and are improved with commercial uses. The properties to the south are zoned
Low Residential and are improved with single-family residences; and
C. The applicant's request is to add entertainment consisting of karaoke singing and
ballroom dancing in conjunction with an existing restaurant; and

d. Because of the nature of the business, there is a potential for nuisance problems
such as loud music, loud noise, and loitering in the parking. These types of nuisance problems could
adversely impact the adjacent single-family residences. However, staff believes that if the applicant
conforms to all conditions of approval, including staffs recommended hours of entertainment stated
in the Staff Report and included in this Resolution, the surrounding businesses and adjacent
residences to the south will not be significantly impacted.
3. Based upon the substantial evidence presented to this Commission during the above-
referenced public hearing, and upon the specific findings of facts set forth in paragraphs 1 and 2
above, this Commission hereby finds and concludes as follows:
a. That the conduct of the establishment and the granting of the application would not
be contrary to the public health, safety, morals, or welfare; and
b. That the premises or establishment is not likely to be operated in an illegal,
improper, or disorderly manner; and
C. That the applicant, or any person associated with him as principal or partner or in a
position or capacity involving partial or total control over the conduct of the business for which such
permit is sought to be issued, has not been convicted in any court of competent jurisdiction of any
offense involving the presentation, exhibition or performance of any obscene show of any kind or of a
felony or of any crime involving moral turpitude or has not had any approval, permit,or license issued
in conjunction with the sale of alcohol or the provisions of entertainment revoked within the preceding
five years; and
d. That granting the application would not create a public nuisance; and
e. That the normal operation of the premises would not interfere with the peace and
quiet of the surrounding commercial center and adjacent single-family residences; and
f. That the applicant has not made any false, misleading or fraudulent statement of
material fact in the required application.
4. This Commission hereby finds and determines that the project identified in this Resolution
is categorically exempt from the requirements of the California Environmental Quality Act of 1970,as
amended, and the Guidelines promulgated thereunder, pursuant to Section 15301 of the State
CEQA Guidelines.
5. Based upon the findings and conclusions set forth in paragraphs 1, 2, 3, and 4 above,
this Commission hereby approves the application, subject to each and every condition set forth
below and in the Standard Conditions, attached hereto and incorporated herein by this reference.
Planning Division
1) This approval is for an entertainment permit allowing only karaoke and
ballroom dancing in conjunction-with an existing restaurant in the
Commercial Office District, Foothill Boulevard Districts (Subarea 3)
located at 9625 Foothill Boulevard. Any change of intensity or type of
entertainment shall require a modification to this permit.

2) Entertainment shall be limited to karaoke Monday through Wednesday
from 7:30 p.m. to 10:30 p.m. and ballroom dancing Thursday through
Saturday from 7:30 p.m. to 11:30 p.m. Any expansion or change of
days and/or hours shall require modification to this permit.
3) The dining area of the restaurant shall be closed before any
entertainment is conducted. Conversely, the entertainment area shall
be closed during the restaurant's regular business hours.
4) No adult entertainment as defined in Section 17.04.090 of the Rancho
Cucamonga Municipal Code is permitted.
5) Entertainment shall be conducted entirely within the building.
6) While entertainment is being conducted, all doors and windows shall
remain closed for noise attenuation purposes.
7) Outdoor seating and dining activities shall not be permitted at anytime.
8) Exterior noise levels shall not exceed 60 dBA during the hours between
7:00 a.m. to 10:00 p.m. and 55 dBA during the hours between
10:00 p.m. to 7:00 a.m.
9) Access to the entertainment area must be from the main entrance of
the primary use and not from a separate exterior entrance. Other exits
shall be for"Fire Exit Only."
10) If operation of this Entertainment Permit causes adverse effects upon
adjacent residences, businesses, or operations including, but not
limited to noise, loitering, parking or disturbances, the Entertainment
Permit shall be brought before the Planning Commission for
consideration and possible suspension or revocation of the permit.
11) Approval of this request shall not waive compliance with any sections of
the Development Code, State Fire Marshal's regulations, Uniform
Building Code, or any other City Ordinances.
12) The applicant shall submit an annual Entertainment Renewal Permit
and fee of$75.00 per Municipal Code Section 5.12.115.
13) A minimum of one duly licensed, certified or trained, and regularly
employed security guard from a reputable security firm shall be required
to be on the premises during the scheduled hours when ballroom
dancing is provided until the parking lot is cleared after the conclusion
of any entertainment. The guard shall be in peace officer attire and
shall remain on duty in the parking area and outside adjacent areas of
the facility to avert problems such as loud noise, disorderly conduct
from patrons or anyone in the parking lot, loitering activities, and any
other nuisances or disturbance.

14) This permit shall be brought before the Planning Commission in six
months for review of compliance with conditions of approval.
15) Parking in the street or in the alley behind the commercial center is
prohibited and it shall be posted with the ability for enforcement by the
City's Police Department.
6. The Secretary to this Commission shall certify to the adoption of this Resolution.

ALL OF THE FOLLOWING CONDITIONS APPLY TO YOUR PROJECT.
APPLICANT SHALL CONTACTTHE PLANNING DIVISION,(909)477-2750, FOR COMPLIANCE
WITH THE FOLLOWING CONDITIONS:
A. General Requirements Completion Date
1. The applicant shall agree to defend at his sole expense any action brought against the City, its
agents,officers,or employees,because of the issuance of such approval,or in the alternative,to
relinquish such approval. The applicant shall reimburse the City, its agents, officers, or
employees, for any Court costs and attorney's fees which the City, its agents, officers, or
employees may be required by a court to pay as a result of such action. The City may,at its sole
discretion, participate at its own expense in the defense of any such action but such participation
shall not relieve applicant of his obligations under this condition.
2. Copies of the signed Planning Commission Resolution of Approval No. 03-123, Standard
Conditions, and all environmental mitigations shall be included on the plans (full size). The
sheet(s)are for information only to all parties involved in the construction/grading activities and
are not required to be wet sealed/stamped by a licensed Engineer/Architect.
B. Time Limits
1. Entertainment Permit Review approval shall expire if building permits are not issued or approved
use has not commenced within 5 years from the date of approval. No extensions are allowed.
C. Site Development
1. The site shall be developed and maintained in accordance with the approved plans which include
site plans,architectural elevations,exterior materials and colors,landscaping,sign program,and
grading on file in the Planning Division, the conditions contained herein, Development Code
regulations. .
2. Prior to any use of the project site or business activity being commenced thereon,all Conditions
of Approval shall be completed to the satisfaction of the City Planner.

3. Occupancy of the facilities shall not commence until such time as all Uniform Building Code and __J_/_
State Fire Marshal regulations have been complied with. Prior to occupancy, plans shall be
submitted to the Rancho Cucamonga Fire Protection District and the Building and Safety Division
to show compliance. The buildings shall be inspected for compliance prior to occupancy.
4. Revised site plans and building elevations incorporating all Conditions of Approval shall be
submitted for City Planner review and approval prior to the issuance of building permits.
5. Approval of this request shall not waive compliance with all sections of the Development Code,all
other applicable City Ordinances, and applicable Community or Specific Plans in effect at the
time of building permit issuance.
6. If no centralized trash receptacles are provided,all trash pick-up shall be for individual units with
all receptacles shielded from public view.
7. Trash receptacle(s)are required and shall meet City standards. The final design,locations,and
the number of trash receptacles shall be subject to City Planner review and approval prior to the
issuance of building permits.
D. Shopping Centers
1. Graffiti shall be removed within 72 hours. _/—/-
2. The entire site shall be kept free from trash and debris at all times and in no event shall trash and
debris remain for more than 24 hours.
3. All operations and businesses shall be conducted to comply with the following standards which
shall be incorporated into the lease agreements for all tenants:
a. Noise Level - All commercial activities shall not create any noise that would exceed an
exterior noise level of 55 dB during the hours of 10 p.m. until 7 a.m.and 60 dB during the
hours of 7 a.m. until 10 p.m.
b. Loading and Unloading-No person shall cause the loading,unloading,opening,closing,or
other handling of boxes, crates, containers, building materials, garbage cans, or other
similar objects between the hours of 10 p.m.and 7 a.m.unless otherwise specified herein,
in a manner which would cause a noise disturbance to a residential area.
E. Building Design
1. All roof appurtenances, including air conditioners and other roof mounted equipment and/or
projections, shall be shielded from view and the sound buffered from adjacent properties and
streets as required by the Planning Division. Such screening shall be architecturally integrated
with the building design and constructed to the satisfaction of the City Planner. Details shall be
included in building plans.
F. Signs
1. Any signs proposed for this development shall comply with the Sign Ordinance and shall require
separate application and approval by the Planning Division prior to installation of any signs.

G. Site Development
1. Plans shall be submitted for plan check and approved prior to construction. All plans shall be
marked with the project file number(i.e., DRC2003-00044). The applicant shall comply with the
latest adopted California Codes, and all other applicable codes, ordinances, and regulations in

effect at the time of permit application. Contact the Building and Safety Division for availability of
the Code Adoption Ordinance and applicable handouts.
2. Construction activity shall not occur between the hours of 8:00 p.m. and 6:30 a.m. Monday
through Saturday, with no construction on Sunday or holidays.
H. Existing Structures
1. Due to the scope of the project, an Occupancy Change review is required. Submit plans to the
Building and Safety Division to determine compliance for the proposed use.
APPLICANT SHALL CONTACT THE POLICE DEPARTMENT, (909) 477-2800, FOR
COMPLIANCE WITH THE FOLLOWING CONDITIONS:
I. Security Lighting
1. All parking, common, and storage areas shall have minimum maintained 1-foot candle power.
These areas should be lighted from sunset to sunrise and on photo sensored cell.
2. All buildings shall have minimal security lighting to eliminate dark areas around the buildings,with
direct lighting to be provided by all entryways. Lighting shall be consistent around the entire
development.
3. Lighting in exterior areas shall be in vandal-resistant fixtures.
J. Windows
1. Storefront windows shall be visible to passing pedestrians and traffic.
K. Building Numbering
1. Numbers and the backgrounds shall be of contrasting color and shall be reflective for nighttime
visibility.
2. At the entrances of commercial or residential complexes, an illuminated map or directory of
project shall be erected with vandal-resistant cover. North shall be at the top and so indicated.
Sign shall be in compliance with Sign Ordinance, including an application for a Sign Permit and
approval by the Planning Division.
L. Alarm Systems
1. Install a burglar alarm system and a panic alarm if needed. Instructing management and
employees on the operation of the alarm system will reduce the amount of false alarms and in
turn save dollars and lives.
2. Alarm companies shall be provided with the 24-hour Sheriff's dispatch number: (909) 941-1488.

FSC-3 Automatic Fire Sprinkler Systems-Technical Comments
1. Required Installations:
Rancho Cucamonga Fire District Ordinance 15 or other adopted code or standard, requires an approved
automatic fire sprinkler system to be installed in any of the following:
a. Commercial or industrial structures greater than 7,500 square feet
b. Group A Occupancies
c. E Occupancies with an occupant load of 50 or more persons
d. Multi-family residential structures. May require an approved means of occupant notification of
water flow switch operation.
e. All structures that do not meet Fire District access requirements (See Fire Access)
I. When required fire flow cannot be provided due to inadequate flow or pressure.

FSC-8 Fire Alarm System
1. Required Installation: An automatic fire alarm (and detection)system is required by RCFPD
Ordinance 15, based on use or floor area,or by another adopted code or standard. Refer to Ordinance
15 and/or the California Fire Code for specific requirements.
2. Remodel and Changes: Prior to any remodel, modification, additions, or exchange of devices, Fire
District approval and a permit are required. Plans and specifications shall be submitted to Fire
Construction Services.
FSC-10 Hazard Control Permits-Technical Comments
The below indicated permit requirements are based on those permits commonly associated with the projects
operations or building construction. As noted below Special Permits may be required, dependent upon
approved use(s) the applicant must contact the Fire Safety Division for specific information:

1. General Use Permit shall be required for any activity or operation not specifically described below,
which in the judgment of the Fire Chief is likely to produce conditions that may be hazardous to life or
property.
2. Operate a place of public assembly.
FSC-12 Plan Submittal Required Notice
Required plans shall be submitted and approved prior to construction in accordance with 1997/98 Building,
Fire, Mechanical,and Plumbing Codes; 1999 Electrical Code; Health and Safety Code•, Public Resources
Code; and RCFPD Ordinances FD15 and FD32, Guidelines and Standards.
NOTE: In addition to the fees due at this time please note that separate plan check fees for tenant
improvements,fire protection systems and/or any consultant reviews will be assessed at time of submittal of
plans.
FSC-14 Alternate Materials and Methods
The Fire Safety Division will review requests for alternate materials and methods within the scope of our
authority. The request must be submitted on the Fire District"Application for Alternate Method"form along with

PRIOR TO OCCUPANCY OR FINAL INSPECTION- Complete the following:
1. Fire Sprinkler System- Plans and Permit: Plans for the required automatic fire sprinkler system
shall be submitted to Fire Construction Services for review and approval. No work is allowed without
a Fire Construction Services permit. Contact Building and Safety/Fire Construction Services (909)

2. Fire Sprinkler System- Final Inspection: Prior to the issuance of a Certificate of Occupancy, the
fire sprinkler system(s)shall be tested and accepted by Fire Construction Services. Contact Building
and Safety/Fire Construction Services (909) 477-2713.
3. Fire Suppression System: Plans and specifications for the fire suppression system for the protection of
commercial-type cooking equipment or other special hazard shall be submitted to Fire Construction
Services for review and approval. No work is allowed without a Fire Construction Services permit.

4. Fire Alarm System: Plans for the fire alarm system shall be submitted to Fire Construction Services for
review and approval. No work is allowed without a Fire District permit. Contact Building and Safety/Fire

5. Knox Rapid Entry System: A Knox rapid entry key vault shall be installed prior to final inspection.
Proof of purchase shall be submitted prior to final building plan approval. Contact the Fire Safety
Division for specific details and ordering information. Contact Building and Safety/Fire Construction
Services (909) 477-2713 for inspection.
6. Address-Other Than Single-family: New buildings other than single-family dwellings shall post the
address with minimum 8-inch numbers on contrasting background,visible from the street and electrically
illuminated during periods of darkness. When the building setback exceeds 200 feet from the public
street an additional non-illuminated 6-inch minimum number address shall be provided at the property

7. Multi-unit Complexes: In multi-unit complexes approved address numbers, and/or building identification
letters shall be provided on the front and back of all units, suites, or buildings. The Fire District shall
review and approve the numbering plan in coordination with the City of Rancho Cucamonga. Contact

B. Fire Suppression Systems- Final Inspection and Testing: Prior to the issuance of a Certificate of
Occupancy, the fire suppression system(s)shall be tested and accepted by Fire Service Construction

9. Fire Alarm System- Final Inspection and Testing: Prior to the issuance of a Certificate of Occupancy,
the fire alarm (and detection) system(s) shall be tested and accepted by Fire Construction Services.

Items or Issues Not Identified Elsewhere
1. The proposed CUP will change the occupancy classification from a"B"occupancy to an "A-3"
occupancy. Based on the documentation supplied, your occupant load is approximately 120 people.
This will necessitate several Fire and Building Code requirements to be completed prior to the
approval of the CUP or Entertainment Permit from the City of Rancho Cucamonga. Contact Fire
Construction Services at 909-477-2713 to begin this process. Some code concerns for this proposed
occupancy include:
• A minimum of 2 exits are required
• Exit signage is required
• Emergency exit illumination is required
• All hangings and decorations shall be flame retardant
• Fire extinguishers are required
• A permit to conduct a place of Public Assembly is required from the Fire
District
• Panic hardware is required on exits
• Occupant load signage is required
• Use of candies is strictly regulated: This will be covered in you permit

RANCHO CUCAMONGA FIRE DISTRICT- STANDARD CONDITIONS & REQUIREMENTS —
General, Procedural, Technical, or Operational Information that shall be Included,
Corrected, or Completed as noted below. The following is applicable to the above
project.
1. Minimum Fire Flow: The required fire flow for this project is 2250 gallons per minute at a minimum
residual pressure of 20 pounds per square inch. This requirement is made in accordance with Fire Code
Appendix III-A, as amended. Please see "Water Availability" attachment for required verification of fire
flow availability for the proposed project. Contact the Fire Safety Division (909)477-2770
PRIOR TO OCCUPANCY OR FINAL INSPECTION- Complete the following:
1. Address Single-family: New single-family dwellings shall post the address with minimum 4-inch
numbers on a contrasting background. The numbers shall be internally or externally illuminated during
periods of darkness. The numbers shall be visible from the street. When building setback from the
public roadway exceeds 100 feet, additional 4-inch numbers shall be displayed at the property entry.

Note: If these conditions are part of the final Standard Conditions issued by the Planning Division referenced
Fire District forms and letters are not included. Contact the Fire Safety Division for copies of forms or letters. The
forms and letter are also found in previously issued Fire District comments.

1. All sliding glass windows shall have secondary locking devices and should not be able to be lifted
from frame or track in any manner.
