drive-thru restaurant on a .46-acre pad within the Victoria Commons Retail Center
within the General Commercial District at 12009 Foothill Boulevard -
APN: 0229-023-04. On January 24, 2007, a Mitigated Negative Declaration was
adopted by the Planning Commission for Tentative Parcel Map SUBTPM17818.
The California Environmental Quality Act provides that no further environmental
review or Negative Declaration is required for subsequent projects or minor
revisions to projects within the scope of a previous Mitigated Negative Declaration.

Design Parameters: The applicant is proposing to construct a 700 square foot outdoor patio eating area
with a fire pit at an existing 7,600 square foot BJ's Restaurant & Brew house at the northwest corner of
4th Street and Pittsburgh Avenue within the Industrial Park (IP) District, (Subarea 12).
Background: The original approval of the restaurant was on September 8, 2004, for Conditional Use
Permit DRC2004-00243, which was for the development of the 7,600 square foot restaurant on a 2-acre
parcel. This approval was for the development of the building and the sale of alcoholic beverages
on-site. The site is also part of an approved Master Plan DRC2003-00770 that master planned
14.8 acres of land and included the development of 3 four-story hotel buildings and 4 restaurant/retail
pads.
Proposal: The applicant has submitted a Minor Development Review for the proposed construction of
the outdoor patio area and the Conditional Use Permit (CUP) to amend the original CUP to allow for the
consumption of alcoholic beverages in the patio area. The proposed outdoor patio eating area will be
located on the southeast corner of the site, near the corner of 4th Street and Pittsburgh Avenue. The
design of the patio will reflect the current character and ambiance of the restaurant. The patio area will
be bordered with a wall that will be approximately 20 inches in height constructed of CMU block with a
used brick veneer over it to replicate the existing materials used on the building. A 5-foot glass wind and
sound screen will be placed above the wall to reduce the sound of the traffic on 4th.Street and the winds
that are prominent in the area. The pit area will a have similar construction, but the wall will be
approximately 4 feet tall and the glass will be 18 inches in height. A metal trellis will also be constructed
around a portion of the pit area. The landscaping around the patio area will be similar to the existing
landscape.
Staff Comments: The following comments are intended to provide an outline for the Committee
discussion regarding this project.
Maior Issues:
1. The applicant worked hard with staff to follow the criteria outlined in the Development Code. There
are no major issues regarding this project at this time.

Background: The original approval on December 11, 1996, was for Conditional Use Permit DRC96-21
which addressed the design of the 1.15-acre site with a 2,862 square foot service station with a
drive-thru, mini-mart, and two quick service restaurants inside.
On September 8, 2010, a Planning Workshop was conducted to review a proposed automated carwash
at 11108 Foothill Boulevard. At this meeting, the Commissioners supported the carwash as it was
presented, but they were concerned with the noise and possible effects to the surrounding area.
Design Parameters: The applicant is proposing to construct a 756 square foot automated carwash at an
existing 2,862 square foot gas station and minimart at the northeast corner of Foothill Boulevard and
Elm Avenue within the Terra Vista Community Plan Mixed Use Financial District.
The restaurants have vacated the building, and the mini-mart has expanded into the areas where the
restaurants were previously located. The drive-thru aisle remains intact and is still screened from
Foothill Boulevard. The proposed automated carwash will be located on the east side of the building
where the drive-thru window was located. The architectural style and elements of the proposed building
will mimic the existing building. The walls will be of smooth stucco with a stucco covered cornice. The
design is simple as the north and south elevations will be the most visible, but the east elevation does
have the potential to be seen. The east and west elevations are between buildings. The lattice
structures will remain along the south elevations of the drive-thru aisle to aide with the screening of the
structure. The vegetation around the drive-thru aisle is established and currently screens most of the
drive-thru use.
Staff Comments: The following comments are intended to provide an outline for the Committee
discussion regarding this project.
Major Issues:
1. The applicant worked hard with staff to follow the criteria outlined in the Development Code. There
are no major issues regarding this project at this time.
Minor Issues:
1. Add arched elements on the east elevation of the automated carwash building to mimic the arched
elements on the south elevation to provide a themed approach to the architecture and provide
360 degree architecture to the building.
2. Add a tile element over the entrance and exit of the proposed building to enhance the south and
north elevations and create a cohesive design theme between the existing building and the
proposed building.

3. The trellis at the southeast corner of the drive aisle shall remain.
Policy Issues: No policy issues at this time.
Staff recommendation: With the Minor Issues resolved to the satisfaction of the Committee, staff
recommends that the Design Review Committee recommend approval of this Development Review to
the Planning Commission.
Design Review Committee Action:
The Design Review Committee recommended approval of the project but requested that the applicant
reconsider using wood on the trellis features and use a wood composite instead. The applicant agreed.

Desiqn Parameters: The applicant is proposing to construct a 2,361 square foot drive-thru restaurant on
a .46-acre pad at 12009 Foothill Boulevard. This site is on the south side of Foothill Boulevard in the
General Commercial District.
The site layout for Victoria Commons was previously approved under DRC2005-01084. The .46-acre
parcel is a vacant pad towards the east end of the previously approved project that sits approximately
6 feet below street level. The proposed building is a single-story structure with a winery-inspired
architectural style. Some of the elements utilized are three heavy trellises located on both the east and
west elevations, with one slightly wrapping around to the north elevation. The exterior of the building
consists of a mixture of earth-tone colored stucco and stone veneer. The stone veneer is utilized for the
wainscot and the supports columns of the trellis features and on the columns of the two tower elements
on the north and south elevations. The two towers are accented with exposed tails at the roof lines,
Tuscany blend "S" tile on the roof, and wrought iron accent feature on the east and west elevations of the
tower. The tower on the south elevation utilizes a window with shutters as an accent piece. Wood doors
will be utilized on the north elevations to reflect the winery theme. Murals have been proposed on the
east and west elevations near the north end of the building to help provide visual interest to these areas.
The roof-mounted equipment will be screened by the parapet walls and the shed roofs are utilizing the
same Tuscany "S" tile as the towers. The building utilizes materials from the existing buildings to
incorporate it into the center but not duplicate the style.
The proposed landscape around the building will compliment the existing site landscaping. The signage
locations have been indicated on the plans to allow for the review of future placement as it corresponds
with the building. The signage will be submitted under a Sign Permit package at a later date.
Staff Comments: The following comments are intended to provide an outline for the Committee
discussion regarding this project.
