A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING
COMMISSION APPROVING SITE APPROVAL NO. 80-07
LOCATED AT 9575 SAN BERNARDINO ROAD IN THE R-3
ZONE.•
WHEREAS, on May 9, 1980, a formal application was submitted
requesting review of the above-described project; and
WHEREAS, on June 25, 1980, the Planning Commission held a duly
advertised public hearing for the above-described project.
NOW, THEREFORE, THE RANCHO CUCAMONGA PLANNING COMMISSION RESOLVED
AS FOLLOWS:
SECTION 1: That the following findings have been made:
1. That the site is adequate in size and shape.
2. That the site has adequate access.
3. That the proposed use will have no adverse
effect on abutting property.
• 4. That the proposed use is consistent with the
General Plan.
5. That the conditions listed in this report
are necessary to protect the public health,
safety, comfort, convenience, and general
welfare.
SECTION 2: That this project will not create significant
adverse impacts on the environment and Negative Declaration is
issued on June 25, 1980.
SECTION 3: That Site Approval No. 80-07 is approved subject to
the following special conditions and the attached standard conditions:
APPLICANT SHALL CONTACT THE PLANNING DIVISION FOR COMPLIANCE WITH
THE FOLLOWING CONDITIONS:
1. Site shall be developed in accordance with the approved site
plans on file in the Planning Division and the conditions
contained herein.
2. Revised site plans and building elevations incorporating
all conditions of approval shall be submitted to the Planning
Division prior to issuance- of building permits.

• 3. Approval of this request shall not waive compliance with all
sections of the Zoning Ordinance and all other applicable City
Ordinances in effect at time of Building Permit issuance.
4. Trash receptacle areas shall be enclosed by a 6 foot high
masonry wall with view obstructing gates pursuant to City
standards. Location shall be subject to approval by the
Planning Division.
5. Prior to any use of the project site or business activity
being commenced thereon, all conditions of approval contained
herein shall be completed to the satisfaction of the Director
of Community Development.
6. A six (6) foot high masonry wall shall be installed around the
perimeter of the site and dense landscaping installed adjacent
to the wall.
7. Operation of the school shall be limited to the hours of 6:00
a.m. to 6:00 p.m.
8. The preschool and extended day care shall be limited to a
total of 36 children, age 5 and under.
9. This facility shall not be used for any other public assembly
uses, such as a church.
• 10. That all required State permits and licenses be obtained for
the facility and clearance by State Department be granted
priorto operation of the site.
11. All play equipment and high activity areas shall be kept a
minimun of twenty (20) feet from all perimeter walls.
12. Parking lot lights shall be a maximum height of 12"from the
finished grade of the parking surface and directed away from
all property lines, adjacent streets and residences.
13. Parking lot trees shall be a minimum 15 gallon size.
14. All two-way aisle widths shall be a minimum of 30 feet wide.
15. Emergency access shall be provided, maintenance free and
clear, a minimum of 24 feet wide at all times during construction
in accordance with Foothill Fire District requirements.
16. All parking spaces shall be double stripped.
17. A detailed landscape and irrigation plan shall be submitted
to and approved by the Planning Division prior to the issuance

18. A Master Plan of the Existing On-Site Trees shall be provided
to the Planning Division prior to the issuance of building
•
permits and prior to grading to determine which trees shall be
retained.
19. Existing Eucalyptus trees shall be retained wherever possible
and shall be trimmed and topped at 30' . Dead, decaying or
potentially dangerous trees shall be approved for removal at
the discretion of the Planning Division during the review of
the Master Plan of Existing On-Site Trees. Those trees which
are approved for removal shall be replaced on a tree-for-tree
basis as provided by the Planning Division.
20. Street trees, a minimum of 15 gallon size or larger, shall be
installed in accordance with the Master Plan of street trees
for the City of Rancho Cucamonga and shall be planted at an
average of every 30' on interior streets and 20' on exterior
streets.
21. All landscaped areas shall be maintained in a healthy and
thriving condition, free from weeds, trash, and debris.
22. Any signs proposed for this development shall be designed in
conformance with the Comprehensive Sign. Ordinance and shall
require review and approval by the Planning Division prior to
installation of such signs.
• 23. A minimum four square foot wide sidewalk shall be provided
along the western edge of the parking lot and the chain
link fence relocated to the west side of that sidewalk.
Parking stalls shall be provided with bumper stops.
APPLICANT SHALL CONTACT THE BUILDING DIVISION FOR COMPLIANCE WITH
THE FOLLOWING CONDITIONS:
24. The applicant shall comply with the latest adopted Uniform
Building Code, Uniform Mechanical Code, Uniform Plumbing Code,
National Electric Code, and all other applicable codes and
ordinances in effect at the time of approval of this project.
25. Prior to issuance of building permits for combustible construction,
evidence shall be submitted to the Foothill District Fire
Chief that water supply for fire protection is available.
26. Prior to the issuance of a building permit for a new commercial
or industrial development or addition to an existing development,
the applicant shall pay development fees at the established
rate. Such fees may include, but not be limited to: Systems
Development Fee, Drainage Fee, Permit and Plan Checking fees:
27. This approval shall become null and void if building permits
are not issued for this project within one year from the date
• of project approval.

28. Grading of the subject property shall be in accordance with
• • the Uniform Building Code, City Grading Standards and accepted
grading practices.
29. The final grading plan shall be subject to review and approval
by the Planning, Engineering and Building Divisions and shall
be completed prior to recordation of the final subdivision map
or issuance of building permit whichever comes first.
APPLICANT SHALL CONTACT THE ENGINEERING DIVISION FOR COMPLIANCE
WITH THE FOLLOWING CONDITIONS:
30. Construct the following missing improvements including, but
not limited to: San Bernardino Road; curb and gutter, sidewalk,
drive approach, street lights, and A.C. overlay.
31. Prior to any work being performed in the public right-of-way,
an encroachment permit and fees shall be obtained from the
City Engineer's Office, in addition to any other permits
required.
32. Street improvement plans approved by the City Engineer and
prepared by a Registered Civil Engineer shall be required, for
all street improvements, prior to issuance of an encroachment
permit.
• 33. Surety shall be posted and an agreement executed to the
satisfaction of the City Engineer and the City Attorney,
guaranteeing completion of the public improvements, prior to
recording of the map or the issuance of building permits,
whichever comes first.
34. All street improvements shall be installed to the satisfaction
of the City Engineer, prior to occupancy.
35. The applicant will be responsible for construction of all on-
site drainage facilities required by the City Engineer.
36. All proposed utilities within the project shall be installed
underground including utilities along major arterials less
than 12 KV.
37. Utility easements shall be provided to the specification of
the serving utility companies and the City Engineer.
38. Developer shall be responsible for the relocation of existing
public utilities, as required.
39. Developer shall be responsible for the installation of street
lighting in accordance with Southern California Edison Company
• and City standards.

• 40. Water and sewer system plans shall be designed and constructed
to meet requirements of the Cucamonga County Water District
(CCWD) , Foothill Fire District and the Environmental Health
Department of the County of San Bernardino. A letter of
compliance from CCWD will be required prior to recordation.
