A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING
COMMISSION APPROVING CONDITIONAL USE PERMIT
NO. 80-01 FOR A THEME RETAIL CENTER LOCATED
ON THE SWC OF RAMONA AND FOOTHILL IN THE C-2
ZONE
WHEREAS, on the 21st day of May, 1980, a complete application
was filed for review on the above described property; and
WHEREAS, on the 13th day of August, 1980, the Rancho Cucamonga
Planning Commission held a public hearing to consider the above described
project.
NOW, THEREFORE, the Rancho Cucamonga Planning Commission
resolved as follows :
SECTION 1 : That the following findings have been made:
1 . That the site for the proposed development is
consistent with the proposed General Plan.
• 2. That the proposed use will not have an adverse
effect on abutting property and the permitted
use thereof.
3. That this development will not be injurious to
the health, safety, and general welfare of the
community.
SECTION 2: That this project will not create adverse impacts on
the environment and that a Negative Declaration is issued on
August 13, 1980.
SECTION 3: That Conditional Use Permit No. 80-01 is approved
subject to the following conditions.
Applicant shall contact the Planning Division for
compliance with the following conditions :
1 . All parking lot landscaped islands shall have a
minimum inside dimension of 4' and shall contain
a 12" walk adjacent to parking stall .
2. Parking lot lights shall be a maximum height of
12' from the finished grade of the parking surface
and directed away from all property lines , adjacent
411 streets and residences.

3. Parking lot trees shall be a minimum 15 gallon
size.
4. All two-way aisle widths shall be a minimum of
24 feet wide.
5. Emergency access shall be provided, maintenance
free and clear, a minimum of 24 feet wide at all
times during construction in accordance with
Foothill Fire District requirements .
6. All parking spaces shall be double striped.
7. A detailed landscape and irrigation plan shall be
submitted to and approved by the Planning Division
prior to the issuance of building permits .
8. A Master Plan of the existing on-site trees shall
be provided to the Planning Division prior to the
issuance of building permits and prior to grading
to determine which trees shall be retained.
9. Existing Eucalyptus trees shall be retained where-
ever possible and shall be trimmed and topped at

30' . Dead, decaying or potentially dangerous
trees shall be approved for removal at the descretion
of the Planning Division during the review of the
Master Plan of existing on-site trees. Those trees
which are approved for removal shall be replaced on
a tree-for-tree basis as provided by the Planning
Division.
10. Street trees , a minimum of 15 gallon size or larger
shall be installed in accordance with the Master
Plan of street trees for the City of Rancho Cuca-
monga and shall be planted at an average of every
30' on interior streets and 20' on exterior streets .
11 . All landscaped areas shall be maintained in .a healthy
and thriving condition, free from weeds , trash, and
debris.
12. Site shall be developed in accordance with the
approved site plans on file in the Planning Division
and the conditions contained herein.

13 . Approval of this request shall not waive compliance
with all sections of the Zoning Ordinance and all
other applicable City Ordinances in effect at time
of Building Permit issuance.
14. Trash receptacle areas shall be enclosed by a 6
foot high masonry wall with view obstructing gates
pursuant to City standards . Location shall be
subject to approval by the Planning Division.
15. All roof appurtenances, including air conditioners ,
shall be architecturally integrated, shielded from
view and the sound buffered from adjacent properties
and streets as required by the Planning and Building
Division.
16. Prior to any use of the project site or business
activity being commenced thereon, all conditions of
approval contained herein shall be completed to
the satisfaction of the Director of Community Develop-
ment.
17. Specific site and design review is required for the
restaurant pad. Such restaurant may not exceed a
seating capacity of 213 unless additional parking
is provided on site.
18. Any signs proposed for this development shall be
designed in conformance with the Comprehensive Sign
Ordinance and shall require review and approval by
the Planning Division prior to installation of such
signs.
1(9,. A uniform sign program for this development shall
be submitted to the Planning Division for their
review and approval prior to issuance of Building
Permits.
Applicant shall contact the Building Division for
compliance with the following conditions :
20. The applicant shall comply with the latest adopted
Uniform Building Code, Uniform Mechanical Code,
Uniform Plumbing Code, National Electric Code, and
all other applicable codes and ordinances in effect
at the time of approval of this project.
21. Prior to issuance of building permits for combustible
construction, evidence shall be submitted to the
• Foohtill Fire District Chief that water supply for
fire protection is available.

22. Prior to the issuance of a building permit for
a new commercial or industrial development or
addition to an existing development, the applicant
shall pay development fees at the established rate.
Such fees may include, but not be limited to:
Systems Development Fee, Drainage Fee, Permit and
Plan Checking fees .
23. This approval shall become null and void if building
permits are not issued for this project within 18
months from the date of project approval .
24. Street names and addresses shall be provided by the
building official .
25. Grading of the subject property shall be in ac-
cordance with the Uniform Building Code, City
Grading Standards and accepted grading practices.
26. The final grading plan shall be subject to review
and approval by the Planning, Engineering and
Building Divisions and shall be completed prior to
recordation of the final subdivision map or issuance
• of building permit, whichever comes first.
Applicant shall contact the Engineering Division for
compliance with the following conditions :
27. Corner property line radius will be required per
City Standards.
28. Reciprocal easements shall be provided ensuring
access to all parcels over private roads, drives ,
or parking areas.
29. Adequate provisions shall be made for the ingress ,
egress and internal circulation of any trucks which
will be used for delivery of goods to the property
or in the operation of the proposed business .
30. Initiate Abandonement procedures for frontage road
by letter of request and filing fee of $100.
31. Construct the following missing inprovements including,
but not limited to:
Foothill : curb and gutter, sidewalk, drive approach,
street lights, A.C. overlay, wheelchair
ramps, and a commercial (std 306) drive
• approach shall be installed west of west
property line, to Foothill , to allow for

circulation of frontage road, that will
be cut off.
Ramona: Sidewalk, drive approach, street lights,
aneA.C. overlay.
Alley (full ) : A.C. pavement and A.C. overlay
32 . Prior to any work being performed in the public
right-of-way, an encroachment permit and fees shall
be obtained from the City Engineer' s Office, in
addition to any other permits required such as
Caltrans for Foothill .
33. Street improvement plans approved by the City
Engineer and prepared by a Registered Civil Engineer
shall be required, for all street improvements ,
prior to issuance of an encroachment permit.
34 . Surety shall be posted and an agreement executed
to the satisfaction of the City Engineer and the
City Attorney, guaranteeing completion of the
public improvements, prior to recording of the map
• or the issuance of building permits , whichever comes
first.
35 . All street improvements shall be installed to the
satisfaction of the City Engiener, prior to oc-
cupancy.
36 . Pavement striping, marking, traffic and street name
signing shall be installed per the requirements of
the City Engineer.
37 . A lien agreement or Improvement Certificate (on the
parcel map) shall be signed, agreeing to construct
future median island on Foothill Boulevard, or
participate in same.
38. The applicant will be responsible for construction
of all onsite drainage facilities required by the
City Engineer.
39: Intersection drains will be required at the future
east end of existing frontage road, to allow road
to drain to alley.

40i. All proposed utilities within the project shall be
installed underground including utilities along
major arterials less than 12 KV.
'41. Utility easements shall be provided to the speci-
fication of the serving utility companies and the
City Engineer.
42. Developer shall be responsible for the relocation
of existing public utilities , as required.
43. Developer shall be responsible for the installation
of street lighting in accordance with Southern
California Edison Company and City standards.
44. Water and sewer system plans shall be designed and
constructed to meet requirements of the Cucamonga
County Water District (CCWD) , Foothill Fire District
and the Environmental Health Department of the
County of San Bernardino. A letter of compliance
from CCWD will be required prior to recordation.
45. Approvals have not been secured from all utilities
and other interested agencies involved. Approval
•
of the final map will be subject to any require-
ments that may be received from them.
46. Permits from other agencies will be required as
follows : Caltrans for Foothill Boulevard and
Cucamonga County Water District.
47. A copy of the Covenants , Conditions and Restrictions
(CC&R' s) subject to the approval of the City
Attorney, shall be recorded with this map and
a copy provided to the City.
48. Final parcel and tract maps shall conform to City
standards and procedures.
49. Should owners of existing developed lots fronting
the existing frontage road desire abandonment'.of
the road in total , they will be encouraged to remove
road and reconstruct (concurrently with development
of "Foothill Plaza") to current standards for street
construction.
