A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING
COMMISSION APPROVING SITE APPROVAL NO. 79-19
LOCATED AT 9533 FOOTHILL BOULEVARD IN THE C-2
ZONE.
WHEREAS, on October 10, 1979, a formal application was submitted
requesting review of the above described project; and
WHEREAS, on November 28, 1979, the Planning Commission held a
duly advertised public hearing for the above described project.
NOW, THEREFORE, THE RANCHO CUCAMONGA PLANNING COMMISSION
RESOLVED AS FOLLOWS:
SECTION 1 : That the following findings have been made:
1. That the site is adequate in size and shape.
2. That the site has adequate access.
3. That the proposed use will have no adverse effect on
abutting property.
4. That the proposed use is consistent with the proposed
General Plan.
5. That the conditions listed in this report are necessary
to protect the public health, safety, comfort, convenience,
and general welfare.
SECTION 2: That Site Approval No. 79-19 is approved subject
to the following conditions:
Planning Division
1. Site shall be developed in accordance with the approved
site plans on file in the Planning Division and the
conditions contained herein.
2. Revised site plans and building elevations incorporating
all conditions of approval shall be submitted to the
Planning Division prior to issuance of building permits.
3. Approval of this request shall not waive compliance with
all sections of the Zoning Ordinance and all other applicable
City Ordinances in effect at time of Building Permit
issuance.
4. All roof appurtenances, including air conditioners, shall
be architecturally integrated, shielded from view and the
sound buffered from adjacent properties and streets as
required by the Planning and Building Divisions.

• 5. Prior to any use of the project site or business activity
being commenced thereon, all conditions of approval
contained herein shall be completed to the satisfaction
of the Director of Community Development.
6. A 22' landscape planter shall be fully landscaped and
mounded along Malachite.
7. All parking lot landscaped islands shall have a minimum
inside dimension of 4' and shall contain a 12" walk
adjacent to parking stall .
8. Parking lot trees shall be a minimum 15 gallon size.
9. A detailed landscape and irrigation plan shall be submitted
to and approved by the Design Review Committee prior to
the issuance of building permits. A minimum of ten (10)
specimen size trees shall be planted on the site to
implement the Special Boulevard Standard.
10. Street trees, a minimum of 15 gallon size or larger,
shall be installed in accordance with the Master Plan of
street trees for the City of Rancho Cucamonga and shall
be planted at an average of every 20' .
• 11. All landscaped areas shall be maintained in a healthy and
thriving condition, free from weeds, trash, and debris.
12. All planters shall be provided with substantial landscaping
and mounding where feasible.
13. The signs included on the plans are not approved and they
will require review and approval by the Planning Division
prior to installation of such signs.
14. Slump block Masonary Columns. shall be constructed around
the support posts of the canopy.
15. No outdoor display of products or special advertisement
signs shall be allowed other than that which is permitted
by the ordinance.
Building Division
16. The applicant shall comply with the latest adopted Uniform
Building Code, Uniform Mechanical Code, Uniform Plumbing
Code, National Electric Code, and all other applicable
codes and ordinances in effect at the time, of approval of
this project.
• 17. Prior to issuance of building permits for combustible
construction, evidence shall be submitted to the Foothill
District Fire Chief that water supply for fire protection
is available.

• 18. Prior to the issuance of a building permit for a new
commercial or industrial development or addition to an
existing development, the applicant shall pay development
fees at the established rate. Such fees may include, but
not be limited to: Systems Development Fee, Drainage
Fee, Permit and Plan Checking Fees.
19. This approval shall become null and void if building
permits are not issued for this project within one year
from the date of project approval .
20. Existing building(s) shall be made to comply with current
Building and Zoning regulations for the intended use or
the building shall be demolished.
Engineering Division
21. Dedication of the following missing rights-of-way on the
following streets: 10 additional feet on Foothill .
22. Corner P/L radius will be required per City standards (24
feet) .
23. Prior to any work being performed in the public right-of-
• way, an encroachment permit shall be obtained from the
City Engineer' s Office, in addition to any other permits
required.
24. All street improvements shall be installed to the satisfaction
of the City Engineer, prior to occupancy.
25. Surety shall be posted and an agreement executed to the
satisfaction of the City Engineer and the City Attorney,
guaranteeing completion of the public improvements, prior
to issuance of building permits.
26. Construct the following missing improvements on the
following streets:
Foothill : sidewalk, drive approach, street trees,
and street lights.
Malachite: curb & gutter, sidewalk, and remove drive.
27. All proposed utilities within the project shall be installed
underground.
28. Developer shall be responsible for the relocation of
existing public utilities, as required.

• 29. Developer shall be responsible for the installation of
street lighting in accordance with Southern California
Edison Company and City standards.
30. Water and sewer system shall meet requirements of the
Cucamonga County Water District (CCWD) , Foothill Fire
District and the Environmental Health Department of the
County of San Bernardino. A letter of complicance from
CCWD will be required.
31. Permits from other agencies will be required as follows:
Caltrans, for construction on Foothill Boulevard.
