HomeMy WebLinkAbout83-70 - Resolutions RESOLUTION NO. 83-70 • A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, CONDITIONALLY APPROVING TENTATIVE TRACT MAP NO. 12317 & 12317-1 WHEREAS, Tentative Tract Map No. 12317 & 12317-1 hereinafter "Map" submitted by Lewis Development Company, applicant, for the purpose of subdividing the real property situated in the City of Rancho Cucamonga, County of San Bernardino, State of California, described as residential subdivisions on 14.29 acres of land, located on the east side of Haven, south of Base Line into 100 lots, regularly came before the Planning Commission for public hearing and action on May 25, 1983; and WHEREAS, the City Planner has recommended approval of the Map subject to all conditions set forth in the Engineering and Planning Division's reports; and WHEREAS, the Planning Commission has read and considered the Engineering and Planning Division 's reports and has considered other evidence presented at the public hearing. NOW, THEREFORE, the Planning Commission of the City of Rancho Cucamonga does resolve as follows: • SECTION 1: The Planning Commission makes the following findings in regard to Tentative Tract No. 12317 & 12317-1 and the Map thereof: (a) The tentative tract is consistent with all applicable interim and proposed general and specific plans; (b) The design or improvements of the tentative tract is consistent with all applicable interim and proposed general and specific plans; (c) The site is physically suitable for the type of development proposed; (d) The design of the subdivision is not likely to cause substantial environmental damage and avoidable injury to humans and wildlife or their habitat; (e) The tentative tract is not likely to cause serious public health problems; (f) The design of the tentative tract will not conflict with any easement acquired by the public at large, now of record, for access through or use of the property within the proposed subdivision. Resolution No. 83-70 Page 2 (g) That this project will not create adverse impacts on the environment and a Negative Declaration is issued. SECTION 2: Tentative Tract Map No. 12317 & 12317-1, a copy of which is attached hereto, is hereby approved subject to all of the following conditions and the attached Standard Conditions: PLANNING DIVISION 1. All flag lot front yards shall be landscaped and irrigated by the developer. Details shall be included in the detailed landscape and irrigation plans. 2. The north end of cul-de-sac Street "E" shall be landscaped and irrigated by the developer. 3. Whenever the regulations of the Terra Vista Community Plan differ from the standard conditions, the Community Plan regulations shall supersede those of the standard conditions. • ENGINEERING DIVISION 4. A pedestrian bridge shall be constructed across Deer Creek Channel at the time of development of the tract on the east side of Deer Creek Channel that will include the major trail designated by the Community Plan. Detailed plans and flood control approval shall be submitted prior to issuance of building permits for said tract on the east side of the channel . 5. Prior to recordation, a Notice of Intention to form and/or join landscape and lighting districts or other maintenance entity acceptable to the City Engineer shall be filed with the City Council . The engineering costs involved in the formation of the district or other vehicle shall be borne by the developer. This shall include maintenance of perimeter landscape parkways, trail and Lot "A". 6. This tract shall drain into an acceptable easement and/or structure for runoff from Street "F", as approved by the City Engineer.
