A. Recitals.
( i ) Sahama Investments has filed an application for Vesting
Tentative Tract No. 14475 as described in the title of this Resolution.
Hereinafter, the subject Design Review request is referred to as "the
application."
(ii) On the 25th day of March 1992, and continued to the 8th day of
April 1992, the Planning C~u~Hssion of the City of Rancho Cucamonga conducted
a duly noticed public hearing. The hearing was subsequently continued to a
Planning Commission workshop on the 27th day of May 1992, to discuss design
alternatives.
(iii) On July 8, 1992, the Planning Cammission conducted a duly
noticed public hearing and continued said hearing to August 12, 1992. The
public hearing was again contim~_~_~__ to September 23, 1992.
(iv) On September 23, 1992, the Planning Commission conducted a
public hearing on the application and concluded said hearing on that date.
After receiving all public testimony, the Planning C~L..dssion approved the
application through adoption of their Resolution No. 92-122.
(v) On October 5, 1992, an appeal was filed with the City Clerk
within the time limits prescribed by law.
(vi) On November 18, 1992, the City Council conducted a duly noticed
public hearing on the application and concluded said hearing on that date.
(vii) All legal prerequisites have occurred prior to the adoption of
this Resolution.
B. Resolution
NOW, THEREFORE, it is found, determined and resolved by the City
Council of the City of Rancho Cucamonga as follows:
1. This Council hereby specifically finds that all of tba facts set
forth in the Recitals, Part A, of this Resolution are true and correct.

2. Based upon substantial evidenc~ presented to this Council during
the above-referenced public hearing on November 18, 1992, including written
and oral staff reports, together with public testimony, this Council hereby
specifically finds as follows:
(a) The application applies to property located north of Almond
Avenue, between Sap[b/re and Tu~-~a-~oise Streets, and the property is presently
vacant. Big Tree Road, serving the San Bernardino National Forest, is located
along the eastern tract boundary; and
(b) The property to the north is located within the San
Ber~ National Forest and is vacant. The property to the south is
designated for residential uses and is being developed for single family homes
and is vacant. The property to the east, located within the County of San
Bernardino, is designated by the City's General Plan for residential and open
space uses and is presently vacant. The property along the western boundary
includes the Cucamonga Wash which is designated as Open Space; and
(c) The application contemplates the development of 66 single
family lots on 58 bailsable acres (as defined by the Rancho Cucamonga
Develo[ment Code) which is consistent with the Hillside Residential
designation of the Development Code and the Very Low Residential designation
of the General Plan; and
(d) The project, with the reconmeraed conditions of approval,
complies with all minimum development standards of the City of Rancho
3. Based upon substantial evidence presented to this Council during
the above-referenced public hearing and upon the specific findings and
conclusions set forth in paragraphs 1 and 2 above, this ~il hereby finds
and concludes as follows:
(a) The tentative tract is consistent with the General Plan,
Development Code, and specific plans; and
(b) The design or improvements of the tentative tract are
consistent with the General Plan, Development Code, and specific plans; and
(c) The site is l~hysically suitable for the type of development
proposed; and
(d) The design of the subdivision is not likely to cause
substantial envirormental damage and avoiaahle injury to humans and wildlife
or their habitat; and
(e) Tne tentative tract is not likely to cause serious public
health problems; and

(f) The design of the tentative tract will not conflict with
any easement acquired by the public at large, now of record, for access
through or use of the property within the proposed subdivision.
4. This Council hereby finds and certifies that the project has
been reviewed and considered in cceplianoe with the California Env/romnental
Quality Act of 1970 and, further, this Council has certified the adequacy of
the Subsequent Environmental Impact Report for Vesting Tentative Tract Map
No. 14475.
5. Based upon the findings and conclusions set forth in paragraphs
1, 2, 3, and 4 above, this Council hereby approves the application subject to
each and every condition as set forth in Planning Cemnission Resolution
No. 92-122.
6. Tnis Council hereby provides notice to Sahama ~ that
the time within which judicial review of the decision represented by this
Resolution ~n/st be sought is governed by the provisions of California Code of
Civil Procedure Section 1094.6.
7. Tne City Clerk of the City of Rancho Cucamonga is hereby
directed to: (a) certify to the adoption of this Resolution, and (b)
forthwith transmit a certified copy of this Resolution, by certified mail,
return-receipt requested, to Sahama Investments at the address identified in
City records.
