A. Recitals.
( i ) A Final Subsequent Environmental Impact Report has been
presented to this Council in conjunction with the Council's consideration of
approval of Vesting Tentative Tract Map 14475.
(ii) Tne Final Suksequent Environmental Impact Report referred to in
this Resolution consists of that document (dated August 1991, and entitled
"Final Subsequent Environmental Impact Report for Proposed Tentative Tract No.
14475"), written comments on the draft report, written responses thereto
suhnitted by the staff and consultant of the City of Rancho Cucamonga, and
testimony presented during hearings of the Planning Cc~mission (conducted on
June 12 and September 11, 1991) on the approval of said Tentative Tract Map
insofar as that testimony pertained to environmental matters. The entirety of
the Final Subsequent Environmental Impact Report is incorporated in this
Resolution by this reference.
(iii) On April 8, 1992, the Planning C~mmission of the City of Rancho
Cucamonga conducted a duly noticed public hearing concern/rig the Final
Subsequent Environmental Impact Report and said public hearing was continued
to allow for additional studies.
(iv) On July 8, 1992, the Planning C~dssion of the City of Rancho
Cucamonga conducted a duly noticed public hearing concerning the Final
Subsequent Environmental Impact R~port and continued said hearing to
August 12, 1992.
(v) On August 12, 1992, the Planning C~mHssion continued the public
hearing on the Envirormental Impact Report to September 23, 1992.
(vi) On September 23, 1992, the Planning C~t.,tdssion conducted a
public hearing on the Environmental Impact Report and concluded said hearing
on that date. After receiving all public testimony, the Planning C~,,~dssion
certified the Final Suksequent Environmental Impact Report as adequate.

(vii) On October 5, 1992, an appeal was filed with the City Clerk with
regards to the Planning Oam~-Hssion's certification of the Environmental Lmpact
Report within the time limits prescribed by law.
(viii) All legal prerequisites have occurred prior to the adoption of
this Resolution.
B. Resolution
NCW, THEREFORE, it is found, determined and resolved by the City
Council of the City of Rancho Cucamonga as follows:
1. This COUrK~il hereby specifically finds that all of the facts set
forth in the Recitals, Part A, of this Resolution are true and correct.
2. This Council hereby finds and certifies that the Final
Subsequent Environmental Impact Report has been prepared on Vesting Tentative
Tract 14475 in accor~___ance with the provisions of the California ~vironmental
Quality Act, California Public Resources Code Sections 21000 et seq. and in
accordance with the regulations promulgated thereunder. Further, this Council
certifies that it ham considered the contents of the Final Sul~equent
Environmental Lmpact Report in ccrsidering the approval of Vesting Tentative
Tract 14475 and such Final Subsequent Environmental Impact Raport reflects the
independent judgment of this Council.
3. This Council hereby finds that the Final Subsequent
Envirormlental Impact R~port does identify physical environmental impacts
inherent in the project and changes or conditions have been incorporated in
the project which mitigate or avoid all significant environmental effects
thereof.
4. This Council hereby adopts the Mitigation Monitoring Program
included as Section 8 of the Final Subsequent Environmental Impact Report.
5. This Council hereby provides notice to Sahama Investments that
the time within which judicial review of the decision represented by this
Resolution must be sought is governed by the provisions of California Code of
Civil Procedure Section 1094.6.
6. The City Clerk of the City of Rancho Cucamonga is hereby
d/rected to: (a) certify to the adoption of this Resolution, and (b)
forthwith transmit a certified copy of this Resolution, by certified mail,
return-receipt requested, to Sahama Investments at the address identified in
City records.
