SUBJECT: LANDMARK ALTERATION PERMIT DRC2010-00852 — JIM BANKS — A request for an
approval to construct an arbor and porte-cochere structure to mark arrival at the historic
Hippard Rancho Residence on 9.4 acres of land within the Very Low Residential District
(up to 2 dwelling units per acre), located at 13181 Victoria Avenue—APN: 0227-121-22.
PROJECT AND SITE DESCRIPTION:
A. Surrounding Land Use and Zoning:
North - Single-Family Residences; Very Low Residential (up to 2 dwelling units per acre)
South - Vineyards; Low Residential (2-4 dwelling units per acre)
East - Single-Family Residences; Low Residential (2-4 dwelling units per acre)
West - Junior High School; Schools
B. General Plan Designations:
Project Site - Very Low Residential (up to 2 dwelling units per acre); Low Residential (2-4
• dwelling units per acre)
North - Very Low Residential
South - Low Residential
East - Low Residential
West - Schools
C. Site Characteristics: The historic Hippard Rancho Residence is located on 9.4 acres of land,
located on Victoria Avenue, east of Etiwanda Avenue. A long driveway provides access to the
early craftsman-style residence. The driveway splits into two pathways; one way leads to the
house, and the other access leads to the garage that is adjacent to the residence.
D. Action requested: The Historic Preservation Commission is asked to review the proposed
timber arbor and porte-cochere that will extend from the existing arbor of the residence to the
garage. The alteration will tie the house and the garage together and provide a shelter
between the two structures. Construction materials will be of the same material, size, and
color of the existing arbor. The timbers will be stained and treated with a UV protector, and
will match the existing arbor. Approval of the landmark alteration permit is necessary before
the applicant can begin construction. Chapter 2.24.120 of the Rancho Cucamonga Municipal
Code requires a Landmark Alteration Permit for a material change on a designated landmark.
Section 2.24.020 — A "material change" means any change in the exterior appearance of a
structure or feature, through alteration, construction, relocation, grading, demolition, or
otherwise.
ANALYSIS: The initial set of plans did not indicate that real river rock would be used for the column
• supports. The applicant submitted a revised set of plans to indicate that real river rock will be used.
The arbor and porte-cochere is compatible in style, design, and materials with the primary

residence and existing arbor. Because the construction materials for the alteration are consistent
with the existing, staff supports the Landmark Alteration Permit DRC2010-00852.
FACTS FOR FINDING: The proposed landmark alteration meets the following criteria established
in Chapter 2.24.120 of the Rancho Cucamonga Municipal Code.
A. The proposed alteration meets the criteria in Section 2.24.120 of the Historic Preservation
Ordinance that requires the proposed alteration to be consistent with the purposes of the
Ordinance and that it is not detrimental to a structure of aesthetic, cultural, architectural, or
engineering interest or value of a historic nature.
B. The proposal meets the requirements of the Historic Preservation Ordinance because the
materials are similar to the original, it does not harm important features of the original building,
and it enhances the livability and value of the building as a residence.
C. The proposal increases the likelihood that the house will be preserved for future generations
to enjoy.
ENVIRONMENTAL ASSESSMENT: The proposed alterations to the historic
Hippard Rancho Residence are categorically exempt from CEQA under Section 15301.
CORRESPONDENCE: This item was advertised as a public hearing in the Inland Valley Daily
Bulletin newspaper, the property was posted, and notices were mailed to all property owners within •
a 660-foot radius of the project site.
RECOMMENDATION: Staff recommends that the Historic Preservation Committee approve
Landmark Alteration Permit DRC2010-00852 with conditions.

RESOLUTION NO. 11-01
• A RESOLUTION OF THE HISTORIC PRESERVATION COMMISSION OF
THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, APPROVING
LANDMARK ALTERATION PERMIT DRC2010-00852, FOR ALTERATIONS
AT THE HISTORIC HIPPARD RANCHO RESIDENCE, LOCATED AT
13181 VICTORIA AVENUE, AND MAKING FINDINGS IN SUPPORT
THEREOF-APN: 0227-121-22.
A. Recitals.
1. Jim Banks filed an application for the approval of Landmark Alteration Permit
DRC2010-00852, as described in the title of this Resolution. Hereinafter in this Resolution, the
subject Landmark Alteration Permit request is referred to as "the application."
2. On the 12th day of January 2011, the Historic Preservation Commission of the City of
Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said
hearing on that date.
3. All legal prerequisites prior to the adoption of this Resolution have occurred.
B. Resolution.
NOW, THEREFORE, it is hereby found, determined, and resolved by the Historic Preservation
Commission of the City of Rancho Cucamonga as follows:
• 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals,
. Part A, of this Resolution are true and correct.
2. Based upon the substantial evidence presented to this Commission during the
above-referenced public hearing on January 12, 2011, including written and oral staff reports,
together with public testimony, and pursuant to Section 2.24.120,G of the Rancho Cucamonga
Municipal Code, this Commission hereby specifically finds as follows:
a. The application applies to the property located at 13181 Victoria Avenue, with a
street frontage of 300 feet and a lot depth of approximately 660 feet and is presently improved with
the historic Hippard Rancho Residence.
b. The property to the north of the subject site is single-family residential;the property
to the south is a vineyard;the property to the east is developed with single-family residential; and the
property to the west is a school; and
c. The Hippard Rancho Residence, on the property of the proposed application,was
designated as a Historic Landmark by the City Council in 1989; and
3. Based upon the substantial evidence presented to this Commission during the
above-referenced public hearing and upon the specific findings of facts set forth in Paragraphs 1
and 2 above, this Commission hereby finds and concludes as follows:
• a. The proposed alteration is in accord with the General Plan, the objectives of the
Development Code, and the purposes of the district in which the site is located; and

b. The proposed Landmark Alteration Permit will not be detrimental to the public
health, safety or welfare, or materially injurious to properties or improvements in the vicinity.
c. The proposed project will have no significant adverse environmental effects.

CREATION OF A RANCHO CUCAMONGA HISTORIC PRESERVATION ADVISORY
COMMITTEE
BACKGROUND: During a Planning/Historic Preservation Subcommittee meeting to review the Historic
Preservation Ordinance Update, the possibility of creating an advisory committee was discussed. At the
December 8, 2010 meeting, the Historic Preservation Commission requested that staff bring back
information on creating a Historic Preservation Advisory Committee. Staff has been researching the
process of creating and establishing this committee.
Additionally, staff submitted an application requesting the City of Rancho Cucamonga be considered as a
Certified Local Government in early 2009. The City was denied largely due to the dual roll of our
Planning Commission sitting as the Historic Preservation Commission.
•CLG Status
On November 19, 2008, the City Council authorized staff to submit an application to the State Office of
Historic Preservation (OHP) requesting the City of Rancho Cucamonga be considered as a Certified
Local Government (CLG). Staff formally submitted the application in February 2009. The OHP
forwarded a negative recommendation to the National Park Service (NPS) in April of 2009 largely
because our Planning and Historic Preservation Commission sit as the same body. Additionally, NPS
noted in their response that the Historic Preservation Commissioners do not meet the CLG requirements
in that they "shall have a demonstrated interest, competence, or knowledge in historic preservation."
Staff responded to NPS and OHP in May 2009. The NPS denied our application based on the OHP
recommendation.
Survey of Surrounding Cities
Staff conducted a survey of five neighboring cities (three have CLG status) to see if they have a
formalized Historic Preservation Commission or an Advisory Committee/Subcommittee that reviews
historic preservation projects. Of the five cities surveyed staff found that four of the cities have a separate
Historic Preservation Commission. Only the City of Ontario has a separate Historic Preservation
Subcommittee. Although OHP recommended CLG status for the City of Ontario they no longer support
this type of an advisory committee and will no longer consider it towards meeting the requirements for
CLG status.
Historic Preservation Advisory Committee
It is possible that at their Goal Setting Session on January 12, 2011, the City Council may discuss the
appropriateness of an Advisory Committee and then provide direction to staff. If the City determines that
an Advisory Committee is appropriate, the Historic Preservation Commission will need to adopt
•dministrative Regulations. The Historic Preservation Ordinance will codify the Administrative
egulations including the following:

Staff will need to create the Administrative Regulations language and guidelines for the Advisory
Committee and add it to the Historic Preservation Ordinance update prior to adoption.
CONCLUSION:
Staff will update the Commission at the January 12, 2011 Historic Preservation Commission meeting
regarding any discussion taken from the City Council Goal Setting Session about creating an Advisory
Committee. The Historic Preservation Commission should then determine if creating an Advisory
Committee is needed and, if so, direct staff to bring back a report to the Historic Preservation
Commission at a later date.
Planning Department staff is currently responsible for eleven Commissions/Committees (Planning •
Commission, Historic Preservation Commission, Design Review Committee, Planning Director, Trails
Advisory Committee, Grading Review Committee, Technical Review Committee, Planning and
Engineering Committee, Historic Preservation Ordinance Stakeholders Ad Hoc Committee,
Planning/Historic Preservation Commission Subcommittee, and the SR (210) (Foothill) Freeway Corridor
Design Authority Joint Powers Authority) including the preparation of agendas, minutes, staff reports, and
minute actions. If the direction is to create this Advisory Committee, staff will be responsible for the
preparation of all materials related to the committee.
The Historic Preservation Advisory Committee could be responsible for review of historic applications
prior to the Historic Preservation Commission review and action. Creation of this committee would add
an additional level of review for each project. Although it is understood that an Advisory Committee may
not meet the requirements of OHP and NPS for CLG status this may still be the most appropriate
instrument for the City at this time.
RECOMMENDATION: Staff recommends that the Historic Preservation Commission receive the report
for discussion and provide direction to staff.

BACKGROUND: At the December 8, 2010, Historic Preservation Commission meeting, the
Commission requested information on the Historic Preservation Ordinance Update and the
language that is being added to create historic districts and Neighborhood Character Areas
(Conservation Districts) in the City. The draft Sections 2.24.070 and 2.24.100 of the draft Historic
Preservation Ordinance are attached as Exhibit A.
Historic District: According to the California Register of Historical Resources, a historic district is
"a definable unified geographic entity that possesses a significant concentration, linkage, or
• continuity of sites, buildings, structures, or objects united historically or aesthetically by plan or
physical development." Additionally, it is a definable geographic area that can be distinguished
from surrounding properties. A district has the same constraints and opportunities as individually
listed properties. For a district to retain integrity as a whole, the majority of the components that
make up the district's historic character must possess integrity even if they are individually
undistinguished. The National Park Service further notes that, "the number of noncontributing
properties a district can contain yet still convey its sense of time and place and historical
development depends on how these properties affect the district's integrity."
Conservation District: A conservation district is a grouping of significant historic resources that do
not retain adequate integrity to qualify as local historic districts, but still maintain important levels of
cultural, historical, and architectural significance. It focuses on maintaining basic community
character of an area, but not necessarily specific historic details of buildings. It may be designated
as an overlay on a basic land-use category or geographically over a neighborhood, and/or may be
coupled with other zoning regulations.
FINDINGS: The Historic Preservation consultants for the General Plan Update, Chattel
Architecture, surveyed the City of Rancho Cucamonga and found that the City does not appear to
have any potential historic districts that would be eligible at the local, State or National levels at this
time. They did, however, identify eight NCAs (Neighborhood Character Areas aka Conservation
Districts), located in the historic town centers of Cucamonga, Alta Loma, Etiwanda, North Town,
Red Hill, the Bear Gulch area of Foothill Boulevard/Route 66 and in two early postwar tract housing
developments: Cucamonga Vineyard Tract Subdivision B, Tract No. 5576 (Hellman Avenue,
San Bernardino Road, Harvard Street, Montara Avenue, Selma Avenue) and Tracts No's. 5592,
• 5593, and 8892 (Effen Street, Dorset Street, Stafford Street, Hermosa Avenue, Center Avenue,
Ashford Street, Norwick Street, and Kinlock Avenue).

For all of the NCA's identified, lack of integrity to individual properties prevent the areas from
appearing eligible as potential historic districts. However, NCA's may still warrant special
considerations in local planning, such as in design review.
HISTORIC PRESERVATION ORDINANCE UPDATE: Staff is currently in the process of updating
the Historic Preservation Ordinance to include the goals and policies of the 2010 General Plan and
to make the ordinance consistent with Federal and State standards. As part of the ordinance
update, staff has created procedures to designate districts and NCA's. Although there are currently
no historic districts identified for designation, designation criteria is included in the ordinance for the
future possibility of historic districts. A petition in support of an NCA or Historic District application
must be signed by at least 51 percent of the owners of the properties within the proposed
district/area. Once the ordinance is adopted and the designation criteria is in place, staff can move
forward with designating NCA's identified in the General Plan. In the meantime, staff can begin
researching the identified NCA's. As part of the designation process, staff will need to create new
and modify existing specific plans (i.e., Etiwanda and Foothill Boulevard Specific Plans) to_guide
development of historic districts and NCA's (General Plan - Policy LU-19.2). The plans should
reflect the City's design context, setting, and community character established by historic patterns
of development in a manner that is consistent with the secretary's standards.
RECOMMENDATION: Staff recommends that the Historic Preservation Commission receive the •
staff report and file for future reference.

1. It has an identifiable, clear, and distinct boundary that possesses a •
significant concentration of structures sharing common historical, visual, aesthetical,
cultural, archaeological, or architectural plan or physical development; or
2. It demonstrates character, interest, or value as part of the
development, heritage, or cultural characteristics of the community, state, or country; or
3. It is the site of a significant local, state, or national event; or
4. It is associated with the lives of persons important to local, state, or
national history, •
5. It is identifiable as the work of a master builder, designer, architect,
artist, or landscape architect whose individual work has influenced the development of
the community, county, state, or country.
C. Historic districts must retain integrity from their,period of significance with
respect to its location, design, setting, materials, workmanship, feeling, and association.
Not all properties or structures in a proposed district need to retain all such original
aspects, but a substantial number of such properties and structures must retain
sufficient integrity to convey the historic, cultural, or architectural significance of the
district. Neither deferred maintenance within a proposed district nor the dilapidated
condition of its constituent buildings and landscapes shall, on its own, be equated with a
loss of integrity. Integrity shall be judged with reference to the particular characteristics •
that support the district's eligibility.
D. Conservation Districts: The Council may designate a property or
collection of properties that do not qualify as a historic district as a conservation district
if the proposed district has either:
1. A distinctive, cohesive, and identifiable setting, character, or
association that make it unique and an integral part of the city's identity; or
2. A recognized neighborhood identity and a definable physical
character and either high artistic value or a relationship to urban centers or historic
districts that makes conservation of the proposed conservation district essential to the
city's history or function.
2.24.080 Owner Consent.
Owner consent is not required for a structure or property to be designated as a
point of historic interest, historic landmark, or a contributing resource. However, a
structure or property cannot be designated as either a historic landmark or a
contributing resource over the owner's objection unless the Council makes all of the
following findings:
A. The structure or property is on the City's historical inventory;

• excepting that an application for the designation of a point of historic interest may be
approved via the consent calendar without public hearing. The Council shall adopt a
resolution approving, conditionally approving, or denying the application. If the Council
has not taken action on the application within 180 days of the Commission's
recommendation, then the application shall be deemed denied.
F. The Planning Director shall forward a copy of the any resolution approving
the designation of a historic landmark or point of historic interest to any department or
agency that the Planning Director deems appropriate.
G. Upon designation by the Council, the Planning Director shall record the
location, characteristics, and significance of the historic landmark or point of historic
interest on a California Department of Parks and Recreation Historic Resources
Inventory Form 523, and include therewith a description of the particular features that
are to be preserved and the legal description of the historic resource.
H. A designated historic landmark or point of historic interest may be
identified by an approved city marker, but such a marker is not required.
;;2:24.:1.002/ Designation Procedures — Historic Districts and Conservation
Districts.
A. Procedures for the application and designation of historic districts and
• conservation districts shall be the same as those applicable to historic landmarks and
points of historic interest except as modified by this section.
B. Applications: In addition to all other information and materials required by
Section 2.27.090(A), all applications for designation of historic districts and conservation
districts shall include the following:
1. A petition in support of the application that is signed by at least 51
percent of the owners of the properties within the proposed district. For purposes of the
petition requirement, only one signature shall be allowed per parcel.
2. A depiction of the district that includes a clear and distinct
description of its boundaries and an inventory of all contributing and non-contributing
resources within the district.
3. A proposed conservation plan to regulate the manner in which the
preservation objectives of the district will be attained.
C. Except as necessary to correct an unsafe or dangerous condition pursuant
to Section 2.24.190, it shall be unlawful for any person to carry out or cause to be
carried out any activity requiring a Certificate of Appropriateness for any property within
the boundaries of a proposed historic or conservation district for which an application is
pending.

D. Whenever the Council designates a historic district or conservation district, •
it shall also adopt: (1) a written description and clear depiction of the district boundaries;
(2) an inventory that identifies and describes contributing resources for the district; and
(3) a conservation plan to regulate the manner in which the preservation objectives of
the district will be attained.
2.24.110 Maintenance of Historic Landmarks and Contributing Resources.
A. The owner, occupant, or other person having legal custody and control of
a historic landmark or contributing resource shall keep in good repair all exterior
portions thereof, all interior portions thereof regulated by the applicable designation
statement or adopted conservation plan, and all interior portions thereof whose
maintenance is necessary to prevent deterioration and decay of any exterior
architectural feature.
B. The owner, occupant or other person having legal custody and control of a
historic landmark or contributing resource shall promptly repair such building or
structure consistent with all other applicable local, state, and federal laws, if it is found to
have any of the following defects:
1. Building elements in danger of falling and injuring persons or
property.
2. Deteriorated or inadequate foundation. •
3. Defective or deteriorated flooring.
4. Walls, partitions, or other vertical supports that split, lean, list,
buckle, or are otherwise failing due to defective material or deterioration.
5. Ceilings, roofs, ceiling, roof supports, or other horizontal members
that sag, split, buckle, or are otherwise failing due to defective materials or deterioration.
6. Fireplaces or chimneys that list, bulge, settle, or are otherwise
failing due to defective material or deterioration.
7. Deteriorated, crumbling or loose exterior plaster.
8. Deteriorated or ineffective waterproofing of exterior walls, roofs,
foundations or floors; including but not limited to broken windows or doors.
9. Defective or insufficient weather protection for exterior wall •
coverings, including lack of paint, or weathering due to lack of paint or other protective
covering.
10. Any fault, defect, or deterioration in the building that renders it
structurally unsafe or insufficiently watertight.

Subject: REMEDIES FOR HISTORIC PRESERVATION VIOLATIONS
SUMMARY: At its fast meeting, the Historic Preservation Commission asked that this item be •
placed on a future agenda for discussion of remedies available for violations of the City's
Historic Preservation regulations. In order to provide context for the Commission's discussion,
the Assistant City Attorney will present an overview of remedies currently in the Municipal Code,
remedies in the draft Historic Preservation Ordinance, and other possible remedial options.
III RECOMMENDATION: Following the presentation by the Assistant City Attorney, staff
recommends the Historic Preservation Commission provide staff with direction regarding any
changes the Commission would like to see in the remedial provisions of the draft Historic
Preservation Ordinance.
