HomeMy WebLinkAbout86-112 - Resolutions RESOLUTION NO. 86-112 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, DENYING, WITHOUT PREJUDICE, A REQUEST FOR THE APPROVAL OF A DEVELOPMENT REVIEW 85-54, TO ALLOW THE DEVELOPMENT OF A 9200 SQUARE FOOT INDUSTRIAL BUILDING FOR A TRUCK REPAIR/MAINTENANCE SERVICE BUSINESS ON 3.5 ACRES OF LAND IN THE GENERAL INDUSTRIAL DISTRICT (SUBAREA 8) OF THE INDUSTRIAL SPECIFIC PLAN, LOCATED AT THE NORTH SIDE OF WHITTRAM AVENUE, 600 FEET WEST OF PECAN AVENUE - APN 209-211-40, WITHIN THE CITY RANCHO CUCMAONGA AND MAKING FINDS IN SUPPORT THEREOF A. Recitals. (i ) Roadrunner Enterprises has filed an application for the approval of Development Review 85-54, described above in the title of this Resolution. (ii ) On January 10, 1986, a notice of incompleteness was sent to the applicant regarding the above-described project. Attached with the letter was a list outlining the additional information needed prior to finding the application complete. Despite the incompleteness of the project, and at the request of the applicant, the project was scheduled for Technical Review Committee and Design Review Committees review on February 18, 1986 and February 20, 1986 respectively. Both the Technical Review Committee and the Design Review Committee reviewed the project on those dates and determined the proposed project was not in accord with the objectives of the Industrial Specific Plan and the General Plan, and did not recommend approval . Thereafter, on February 24, 1986, a follow-up letter was sent to the applicant summarizing the Technical Review Committee and the Design Review Committees comments with a list of items that must be completed prior to forwarding the project to the Planning Commission for review. On April 16, 1986, a notice of incompleteness for the revised flood report was sent to the applicant and the engineer representing the applicant. To date, the applicant has not responded to or submitted revised plans that address those items as listed in the February 24, 1986 letter, nor the April 16, 1986 letter. (iii ) All legal prerequisites to the adoption of this Resolution have occured. B. Resolution. NOW, THEREFORE, IT IS FOUND, determined and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: (i ) This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A of this Resolution are true and correct. (ii ) That the required information has not been supplied by the applicant where it is necessary to prepare a legally adequate environmental document. 'PLANNING COMMISSION RESOLUTION NO. DR 85-54 - ROADRUNNER August 13, 1986 Page 2 (iii ) That the required information without which the City' s decision to approve a project would not be supported by substantial evidence. (iv) That a proposed project without an adequate drainage study for providing mitigation measures for flood protection that would subject people and property to water-related hazards, such as flooding. (v) Based upon the findings and conclusions set forth above, this Commission hereby denies, without prejudice, to refile the Development Review. (vi ) The Deputy Secretary to this Commission shall certify through the adoption of this Resolution. APPROVED AND ADOPTED THIS 13TH DAY OF AUGUST, 1986.
