A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO CUCAMONGA, CALIFORNIA, APPROVING A MODIFICATION
TO CONDITIONAL USE PERMIT NO. 86-24, THE DEVELOPMENT OF A
12,000 SQUARE FOOT CONVENIENCE SALES AND SERVICE CENTER
ON 1.18 ACRES OF LAND , LOCATED AT THE NORTHEAST CORNER
OF 8TH STREET AND VINEYARD AVENUE, IN THE GENERAL
INDUSTRIAL/RAIL SERVED DISTRICT (SUBAREA 2) , AND MAKING
FINDINGS IN SUPPORT THEREOF - APN: 209-013-15.
A. Recitals.
•
(i ) Matlock Associates has filed an application for the issuance of
the Conditional Use Permit No. 86-24 as described in the title of this
Resolution. Hereinafter in this Resolution, the subject Conditional Use
Permit request is referred to as "the application".
(ii ) On December 10, 1986, this Commission adopted its Resolution
No. 86-181, approving the application for a 24 month period subject to
specified conditions.
(iii ) On November 4, 1988, the applicant filed a request for a 12
month time extension.
(iv) On the 14th of December, 1988, the Planning Commission of the
City of Rancho Cucamonga conducted a duly noticed public hearing on the
application and concluded said hearing on that date.
(v) All legal prerequisites to the adoption of this Resolution have
occurred.
B. Resolution.
NOW, THEREFORE, it is hereby found, determined and resolved by the
Planning Commission of the City of Rancho Cucamonga as follows:
1. This Commission hereby specifically finds that all of the facts
set forth in the Recitals, Part A, of this Resolution are true and correct..
2. Based upon substantial evidence presented to this Commission
during the above-referenced public hearing on December 14, 1988, including
written and oral staff reports, together with public testimony, this
Commission hereby specifically finds as follows:
(a) The application applies to property located at the
northeast corner of 8th Street and Vineyard Avenue; and
(b) The property to the north of the subject site is vacant,
the property to the south of that site consists of single family homes, the
property to the east is vacant, and the property to the west is a restaurant
and the Scheu Steel manufacturing plant.

3. Based upon the substantial evidence presented to this Commission
during the above-referenced public hearing and upon the specific findings of
facts set forth in paragraph 1 and 2 above, this Commission hereby finds and
concludes as follows:
(a) That the proposed use is in accord with the
General Plan, the objectives of the Development
Code, and the purposes of the district in which
the site is located.
(b) That the proposed use, together with the
conditions applicable thereto, will not be
detrimental to the public health, safety, or
welfare, or materially injurious to properties
or improvements in the vicinity.
(c) That the proposed use complies with each of the
applicable provisions of the Development Code.
4. This Commission found and certified that the project has been
reviewed and considered in compliance with the California Environmental
Quality Act of 1970 and, further, this Commission issued a Negative
Declaration on December 10, 1986.
5. Based upon the findings and conclusions set forth in paragraph
1, 2, 3, and 4 above, this Commission hereby approves the application subject
to each and every condition set forth below and in the attached Standard
Conditions attached hereto and incorporated herein by this reference.
Planning Division:
(1) Approval shall expire on December 10, 1989, if building permits
are not issued, unless extended by the Planning Commission.
(2) The approval of this Conditional Use Permit is for Convenience
Sales and Services and Business Support Service land uses
only. Other types of land uses are subject to Subarea 2
(General Industrial District) of the Industrial Specific Plan.
(3) Vine pockets and freestanding potted plants shall be added
along the arcade of the front elevation. Detailed design shall
be included in the detailed landscape and irrigation plan and
submitted for Planning Division review and approval prior to
issuance of building permit.
(4) Detailed design of the monumentation sign located at the corner
of 8th Street and Vineyard Avenue including mounding and annual
color ground cover shall be submitted for City Planner review
and approval prior to issuance of building permit.

(5) Textured pavement such as brick pavers, exposed aggregate, or a
combination of both, shall be provided at the two main project
entrances, and at building entrances.
(6) Wood trellises should be of substantial size such as 3" x 8" to
the satisfaction of the City Planner.
(7) All trees planted along 8th Street and Vineyard Avenue shall be
minimum 24-inch box size or larger.
(8) Provision for the following design features shall be provided
in the trash enclosure to the satisfaction of the City Planner:
a. Architecturally integrated into the design of the shopping
center.
b. Separate pedestrian access that does not require opening
the main doors to include self-closing pedestrian door.
c. Large enough to accommodate two trash bins.
d. Roll-up doors.
e. Trash bins with counter-weighted lids.
f. Architecturally treated overhead shade trellis.
g. Chain link screen on top to prevent trash from blowing out
of enclosure and designed to be hidden from view.
(9) Trash collection shall occur between the hours of 9:00 a.m. and
10:00 p.m. only.
(10) Graffiti shall be removed within 72 hours.
(11) The entire site shall be kept free of trash and debris at all
times, and in no event shall trash and debris remain for more
than twenty-four (24) hours.
(12) All operations and businesses shall be conducted to comply with
the following standards, which shall be incorporated into the
lease agreement of all tenants:
a. Noise Levels. No commercial activities shall create any
noise that would exceed an exterior noise level of 60dBA
during the hours of 10:00 p.m. to 7:00 a.m. , unless
otherwise specified herein, in a manner which would cause a
noise disturbance to a residential area.

b. Loading and Unloading. No person shall cause the loading,
unloading, opening, closing, or other handling of boxed,
crates, containers, building materials, garbage cans, or
similar objects between the hours of 10:00 p.m. and 7:00
a.m. , unless otherwise specified herein, in a manner which
would cause a noise disturbance to a residential area.
Engineering Division :
(1) A permit from the AT&SF railroad shall be obtained prior to any
grading within the railroad right-of-way.
(2) All street improvements, except sidewalks, shall be extended
easterly along 8th Street from the property line to the
concrete bridge over the Cucamonga Creek Channel to the
satisfaction of the City Engineer.
(3) Existing overhead utilities:
a. Vineyard Avenue - An in-lieu fee as contribution to the
future undergrounding of the existing overhead utilities
(electrical , except for the 66 kv electrical ) on the
project side of Vineyard Avenue shall be paid to the City
prior to the issuance of building permits. The fee shall
be one-half the adopted unit amount times the length from
the center of the AT&SF Railroad right-of-way to the center
of 8th Street.
b. 8th Street - Existing overhead utilities (telecommunication
and electrical ) on the project side of 8th Street shall be
undergrounded along the entire project frontage and
extending from the first pole west of the Cucamonga Creek
Channel westerly to the first pole on the south side of 8th
Street, prior to public improvement acceptance or
occupancy, whichever occurs first. Reimbursement of one-
half of the adopted cost of undergrounding from future
development as it occurs on the opposite side of the street
is not feasible, because the property is presently
developed and in the City of Ontario.
(4) The sidewalk shall be extended along Vineyard Avenue to the
railroad track as approved by the AT&SF Railroad.
(5) A permit from the City of Ontario is required prior to any work
within their right-of-way including the storm drain connection.
(6) Sufficient dedication shall be provided at the northeast corner
of Vineyard Avenue and 8th Street to accommodate the
installation of a City Entry Monument.

6. The Secretary to this Commission shall certify to the adoption
of this Resolution.
