A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING COMMISSION
APPROVING VARIANCE NO. 86-09 TO DECREASE THE MINIMUM
BUILDING SETBACK AND LANDSCAPE AVERAGE ALONG 8TH STREET,
ELIMINATING THE SIDEYARD SETBACK ALONG THE RAILROAD
RIGHT-OF-WAY AND ELIMINATING THE OUTDOOR EATING AREA FOR
A PROPOSED MULTI-TENANT PROJECT LOCATED AT THE NORTHEAST
CORNER OF 8TH STREET AND BAKER AVENUE. IN THE GENERAL
DISTRICT - APN 207-271-01
WHEREAS, on the 29th day of December, 1986, an application was filed
and accepted on the above-described project; and
WHEREAS, the property is a minimum 71.02 feet in depth and a maximum
of 80.78 feet in depth with 1,290 feet of length; and
WHEREAS, a similar Variance was granted for 8th Street Industrial
Phase One; and
WHEREAS, on the 13th day of May, 1987, the Planning Commission held a
duly advertised public hearing pursuant to Section 65854 of the California
Government Code.
SECTION 1: The Rancho Cucamonga Planning Commission has made the
following findings:
1. That strict or literal interpretation and enforcement of
the specified regulation would result in practical
difficulty or unnecessary physical hardship inconsistent
with the objectives of the Industrial Specific Plan and
the Development Code.
2. That there are exceptional or extraordinary circumstances
or conditions applicable to the property involved or to
the intended use of the property that do not apply
generally to other properties in the same district.
3. That strict or literal interpretation and enforcement of
the specified regulation would deprive the applicant of
privileges enjoyed by the owners of other properties in
the same district.
4. That the granting of the Variance will not constitute a
grant of special privilege inconsistent with the
limitations on other properties classified in the same
district.
5. That the granting of the Variance will not be detrimental
to the public health, safety, or welfare, or materially
injurious to properties or improvements in the vicinity.

I, Brad Buller, Deputy Secretary of the Planning Commission of the City of
Rancho Cucamonga, do hereby certify that the foregoing Resolution was duly and
regularly introduced, passed, and adopted by the Planning Commission of the
City of Rancho Cucamonga, at a regular meeting of the Planning Commission held
on the 13th day of May, 1987, by the following vote-to-wit:
