FD 91-003 A RESOLUTION OF THE BOARD OF D]RECIDRS OF THE RANCHO COCAMDNGA F/RE ~ON DISTRICT, RANC~O CUCAMONGA, CALIFORNIA, MAKING APPOIM/MSNPS IN A CCM~3NITY FACILITIES DISTRICT WHEREAS, the Board of Directors of the Rancho Cucamonga Fire Protection District (hereinafter referred to as the "legislative body of the local ~3ency"), at this time is desirous to annex territory to an existing Ommunity Facilities District pursuant to the terms and provisions of the '~ello-Roos Oa~Lunity Facilities Act of 1982", being Chapter 2.5, Part 1, Division 2, Title 5 of the Govet Code of the State of California. The existing C~mtunity Facilities District has been designated as ~TY FACILITIES DISTRICT NO. 88-1 (hereinafter referred to as the "District"); and WHEREAS, the area proposed to be annexed shall be known and designated as ~ FACILITIES DISTRICT NO. 88-1, ANNEXATION NO. 2 (here- inafter referred to as the "annexed territory"); and WH~IRFAS, the legislative body desires to make the required appoint- ments and designating persons to perform certain duties, in order to allow the proceedings to go forward to completion in accordance with the provisions of law. NOW, THEREFORE, the Board of Directors of the Rancho Cucamonga Fire Protection District does hereby resolve as follows: S~L'TION 1: That the above recitals are all true and correct. S}~3TION 2: That throughout the course of the proceedings, the Board of Directors of the Rancho Cucamonga Fire Protection District will be acting as the legislative body of the C~munity Facilities District No. 88-1, a legally constituted govexxmental entity as defined by Section 53317 of the Government Code of the State of California. SECTION 3: All regulatory rules of the Rancho Cucamonga Fire Protection District, including date, time and place of meetings, as well as notice requirements, shall be applicable for all proceedings conducted by this legislative body as the governing body of the Oam~unity Facilities District. SECTION 4: That the INLAND V~T I.Ry DAILY BUI .I.RIIN is hereby designated as the newspaper for all publications as required by law and as necessary for c~letion of this project. SECTION 5: That BROWN, HARPER, BURNS & HE~TSCHKE, Attorneys at Law, is hereby appointed to act as Special Counsel for the purposes of preparing, documentation and resolutions relatingto the annexation proceedings, and upon the completion of the election, Counsel shall be paid a flat fee of $1,000.00.
