A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO CUCAMONGA APPROVING TENTATIVE TRACT MAP NO.
13281. A RESIDENTIAL SUBDIVISION OF 32.86 ACRES OF LAND
INTO 205 SINGLE FAMILY LOTS AND A 6 ACRE PARK SITE IN THE
MEDIUM RESIDENTIAL DISTRICT (8-14 DWELLING UNITS PER
ACRE) WITHIN THE VICTORIA PLANNED COMMUNITY, LOCATED AT
THE NORTHWEST CORNER OF BASE LINE ROAD AND ROCHESTER
AVENUE - APN: 227-081-06.
A. Recitals.
(i ) The William Lyon Co. has filed an application for the approval
of Tentative Tract Map No. 13281 as described in the title of this
Resolution. Hereinafter in this Resolution, the subject Tentative Tract Map
request is referred to as "the application".
(ii ) On the 27th of January, 1988, the Planning Commission of the
City of Rancho Cucamonga conducted a duly noticed public hearing on the
application and concluded said hearing on that date.
(iii ) All legal prerequisites to the adoption of this Resolution
have occurred.
B. Resolution.
NOW, THEREFORE, it is hereby found, determined and resolved by the
Planning Commission of the City of Rancho Cucamonga as follows:
1. This Commission hereby specifically finds that all of the facts
set forth in the Recitals, Part A, of this Resolution are true and correct.
2. Based upon substantial evidence presented to this Commission
during the above-referenced public hearing on January 27, 1988, including
written and oral staff reports, together with public testimony, this
Commission hereby specifically finds as follows:
(a) The application applies to property located at the
northwest corner of Base Line Road and Rochester Avenue which is an
irregularly shaped parcel with ±867 feet fronting Base Line Road and ±175 feet
fronting Rochester Avenue and is presently unimproved; and
(b) The property to the north of the subject site is vacant,
the property to the south of that site consists of vacant, the property to the
east is an existing lumber yard, and the property to the west is vacant.
3. Based upon the substantial evidence presented to this Commission
during the above-referenced public hearing and upon the specific findings of
facts set forth in paragraph 1 and 2 above, this Commission hereby finds and
concludes as follows:

(a) That tentative tract is consistent with the
General Plan, Development Code, and specific
plans; and
(b) The design or improvements of the tentative
tract is consistent with the General Plan,
Development Code, and specific plans; and
(c) The site is physically suitable for the type of
development proposed; and
(d) The design of the subdivision is not likely to
cause substantial environmental damage and
avoidable injury to humans and wildlife or
their habitat; and
(e) The tentative tract is not likely to cause
serious public health problems; and
(f) The design of the tentative tract will not
conflict with any easement acquired by the
public at large, now of record, for access
through or use of the property within the
proposed subdivision.
4. This Commission hereby finds and certifies that the project has
been reviewed and considered in compliance with the California Environmental
Quality Act of 1970 and, further, this Commission hereby issues a Negative
Declaration.
5. Based upon the findings and conclusions set forth in paragraph
1, 2 and 3 above, this Commission hereby approves the application subject to
each and every condition set forth below and in the attached Standard
Conditions attached hereto and incorporated herein by this reference.
Planning Division:
(1) Prior to the recordation of Tract 13281, Parcel Map 9350
shall be recorded.
(2) This map is being approved as a Tract Subdivision only.
Any future proposals for the development of five or more
residential units shall require Design Review approval
prior to the issuance of building permits for any units.
(3) The William Lyon Company shall submit a disclosure
statement for this tract to be reviewed and approved by
the City Planner prior to distribution to prospective
developers of this tract. The disclosure statement shall
include the City of Rancho Cucamonga's conditions,
requirements, and expectations for development standards
and product types for this tract.

(4) The fencing/walls required for the tract shall be
consistent with the fencing/walls indicated on the
conceptual landscaping plan. Wood fencing exposed to
public view shall be treated with stain, paint or water
sealant. Fencing on corner side yards and fencing along
the Belvino Loop Road shall be decorative block.
(5) Prior to occupancy of more than 50 percent of the units
within the tract, the pedestrian trails shall be improved
with sidewalks, landscaping, irrigation, and lighting.
The plans are to be reviewed and approved by the City
Planner and the City Engineer prior to the issuance of
building permits.
(6) Any retaining walls used are to be a maximum of four feet
high.
(7) All retaining walls visible to the general public, i .e. ,
on the street side of corner side yards and within the
front yard, are to be constructed of a decorative material
to the satisfaction of the City Planner.
(8) All back of lot grade differentials are to be a maximum of
12 feet.
(9) Concurrent with any application for Design Review, the
applicant shall also submit an acoustical study detailing
what mitigation measures, if any, are required to achieve
noise levels, both exterior and interior, consistent with
City Standards for lots abutting either Base Line Road,
Rochester Avenue.
(10) Recreational Vehicle Storage shall be provided based on
the following:
a. Fifteen percent of the required storage shall be
provided on individual lots through the use of drive
through garages. The garage doors are to be of a
height that can accommodate "Blazer"-type vehciles.
b. Ten percent of the required storage shall be provided
by using expanded side yards or an off-site facility.
Engineering Division:
(1) The entire Belvino Street (east and west) shall be
constructed full width except that off-site sidewalks and
parkway landscaping on the opposite side of the street may
be deferred until development of the adjacent property.
(2) Base Line Road shall be constructed from Milliken Avenue
to Rochester Avenue as follows:

a. Full width for the north roadbed, including sidewalk
and parkway landscaping adjacent to the development;
b. Full median island including landscaping;
c. Minimum 26' pavement for the south roadbed; and
d. The cost of one-half of the median island and the
additional 26' wide pavement for the south roadbed
shall be subject to reimbursement from the adjacent
property owner upon that property's development.
(3) Occupancy permits shall not be issued for any buildings,
except model homes, until the completion of Phase II of
the Day Creek Channel .
(4) The storm drain system shall be constructed in Base Line
Road from Milliken Avenue to Day Creek Channel to the
satisfaction of the City Engineer prior to occupancy of
any buildings.
(5) The existing overhead utilities (telecommunications and
electrical , except for the 66KV electrical ) on the project
side of Base Line Road shall be undergrounded from the
first pole on the west side of Milliken Avenue to the
first pole on the east side of Rochester Avenue, prior to
public improvement acceptance or occupancy, whichever
occurs first. The Developer may request a reimbursement
agreement to recover one-half the City adopted cost for
undergrounding from future development (redevelopment) as
it occurs on the opposite side of the street.
(6) The existing 66KV electrical poles on the project side of
Base Line Road from the first pole on the west side of
Milliken Avenue to the first pole on the east side of
Rochester Avenue shall be relocated to a minimum clear
distance of ten (10) feet from the ultimate curb face and
shall be shown on the Street Improvement Plan. In
addition, the existing poles shall be replaced with white,
bleached, or similarly treated poles.
(7) All public improvements including, but not limited to,
sidewalks, street lights, landscaping, and the access curb
to the 66 KV electrical poles shall be subject to the
approval of the City Engineer and City Planner.
Additional landscape easements or reduction in the total
number of lots may be required along Base Line Road to
appropriately landscape this street frontage due to the
planting limitations under and around the relocated
utility poles. All public improvement plans including
landscaping shall be reviewed and approved by the City
Engineer and City Planner prior to recordation of the
final map.

(9) An in-lieu fee as contribution to the future
undergrounding of the existing overhead utilities
(telecommunication and electrical ) on the opposite side of
Rochester Avenue shall be paid to the City prior to the
recordation of the Final Map. The fee shall be one-half
the City adopted unit amount times the length from the
center of Base Line Road to the northerly terminus pole,
approximately at the north project boundary.
(10) Rochester Avenue shall be constructed full width except
that off-site sidewalks and parkway landscaping on the
opposite side of the street may be deferred until
development of the adjacent property from Rochester Avenue
to and including the railroad crossing of the Southern
Pacific Railroad to the north.
(11) No building permits, with the exception of model homes,
shall be issued for any units within the existing FEMA
Flood Hazard Zone until the flood hazard is mitigated to
the satisfaction of the City Engineer.
6. The Deputy Secretary to this Commission shall certify to
the adoption of this Resolution.
