A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO CUCAMONGA APPROVING TENTATIVE TRACT MAP NO. 12895
AND DESIGN REVIEW THEREOF, THE DEVELOPMENT OF 99 TOWN-
HOMES ON 9.03 ACRES OF LAND IN THE MEDIUM RESIDENTIAL
DISTRICT, LOCATED ON THE WEST SIDE OF BAKER AVENUE, SOUTH
OF FOOTHILL BOULEVARD - APN: 207-581-57, 58 and 207-571-
79.
A. Recitals.
(i ) R. J. Investments has filed an application for the approval of
Tentative Tract Map No. 12895 and design review thereof as described in the
title of this Resolution. Hereinafter in this Resolution, the subject
Tentative Tract Map request is referred to as "the application".
(ii ) On the 27th of January, 1988, the Planning Commission of the
City of Rancho Cucamonga conducted a duly noticed public hearing on the
application and concluded said hearing on that date.
(iii ) All legal prerequisites to the adoption of this Resolution
have occurred.
B. Resolution.
NOW, THEREFORE, it is hereby found, determined and resolved by the
Planning Commission of the City of Rancho Cucamonga as follows:
1. This Commission hereby specifically finds that all of the facts
set forth in the Recitals, Part A, of this Resolution are true and correct.
2. Based upon substantial evidence presented to this Commission
during the above-referenced public hearing on January 27, 1988, including
written and oral staff reports, together with public testimony, this
Commission hereby specifically finds as follows:
(a) The application applies to property located on the west
side of Baker Avenue, 950 feet south of Foothill Boulevard and is presently
vacant; and
(b) The property to the north is designated for residential
uses and is developed with townhouses, the property to the south is designated
for residential uses and is developed with single family homes, the property
to the east is designated for residential uses and is developed with
townhouses and a mobile home park and the property to the west is designated
for residential uses and is developed with single family homes; and
(c) The project with the recommended Conditions of Approval ,
complies with all minimum development standards of the City of Rancho
Cucamonga; and

(d) The development of 99 townhomes on 9.03 acres of land is
consistent with the Medium Residential land use designation of the General
Plan; and
(e) A building setback of 20 feet from the fault segment has
been provided consistent with the geologic report prepared pursuant to the
guidelines of the Alquist-Priolo Special Studies Zone Act; and
(f) Additional soil and foundation reports are to be provided
for review and approval prior to the issuance of building permits; and
(g) Only one mature Sycamore tree is to be removed and
replacement trees per City Standards shall be provided; and
(h) One story duplex units have been provided on the west side
of the property to provide a density transition to existing single family
dwellings.
3. Based upon the substantial evidence presented to this Commission
during the above-referenced public hearing and upon the specific findings of
facts set forth in paragraph 1 and 2 above, this Commission hereby finds and
concludes as follows:
(a) That tentative tract is consistent with the
General Plan, Development Code, and specific
plans; and
(b) The design or improvements of the tentative
tract is consistent with the General Plan,
Development Code, and specific plans; and
(c) The site is physically suitable for the type of
development proposed; and
(d) The design of the subdivision is not likely to
cause substantial environmental damage and
avoidable injury to humans and wildlife or
their habitat; and
(e) The tentative tract is not likely to cause
serious public health problems; and
(f) The design of the tentative tract will not
conflict with any easement acquired by the
public at large, now of record, for access
through or use of the property within the
proposed subdivision.
4. This Commission hereby finds and certifies that the project has
been reviewed and considered in compliance with the California Environmental
Quality Act of 1970 and, further, this Commission hereby issues a Negative
Declaration.

5. Based upon the findings and conclusions set forth in paragraph
1, 2 and 3 above, this Commission hereby approves the application subject to
each and every condition set forth below and in the attached Standard
Conditions attached hereto and incorporated herein by this reference.
Tract Map 12895
(1) An in-lieu fee as contribution to the future
undergrounding of the existing overhead utilities
(telecommunication and electrical ) on the opposite
side of Baker Avenue shall be paid to the City prior
to the issuance of building permits. The fee shall
be one-half the City adopted unit amount times the
length of the project frontage.
(2) A permit will be required from Southern Pacific
Railroad for any work within their right-of-way.
(3) The portion of Master Plan Storm Drain Line 32B from
the Southern Pacific Railroad to Baker Avenue
including a debris basin at the northern entrance
shall be constructed to the satisfaction of the City
Engineer. The developer shall be eligible for
credit and/or reimbursement of drainage fees per
City Ordinance.
Design Review
(1) The perimeter wall of the project shall be of
decorative masonry material . The developer shall
obtain authorization from the westerly property
owners to replace the existing wood fence with a
shared masonry wall . The plans shall be reviewed
and approved prior to the issuance of grading
permits.
(2) Special decorative wall treatment such as
indentations, reveals, raised planters, and
landscaping shall be provided to the westerly cul-
de-sac -- Fernleaf Drive, Ricardo Drive and Via
Carillo Avenue. Details of such treatment shall be
included in the final landscape and grading plan
which shall be reviewed and approved by the City
Planner prior to the issuance of building permits.
(3) Details and cross sections of all security gates and
the two emergency accesses shall be submitted to the
Planning Division, Foothill Fire District, and
Sheriff' s Department for review and approval prior
to issuance of building permits. A copy of such
plan signed off by the Fire District and Sheriff's
Department shall be submitted and kept on file with
the project.

(4) Contiguous dense landscaping shall be provided along
all property boundaries. This shall be incorporated
into the final landscape plan which shall be
reviewed and approved by the City Planner prior to
the issuance of building permits.
(5) The project entrance at Baker Avenue shall include 3
Sycamore trees to be a minimum size of 36" box.
This shall be incorporated into the final landscape
plan which shall be reviewed and approved by the
City Planner prior to the issuance of building
permits.
(6) Details and cross sections of the roof showing the
solar panels shall be included in the building plans
and shall be reviewed and approved by the Planning
Division prior to the issuance of building
permits. All roof mounted solar panels shall be
architecturally screened wherever feasible.
(7) All fence heights including the retaining wall
portion shall not exceed a maximum of nine (9) feet.
(8) The five trees to be removed shall be replaced with
the largest nursery grown stock available as
determined by the City Planner.
(9) Patio fencing along Baker Avenue shall be decorative
masonry.
6. The Deputy Secretary to this Commission shall certify to the
adoption of this Resolution.
