A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING COMMISSION
DENYING WITHOUT PREJUDICE DEVELOPMENT REVIEW NO. 87-13
FOR THE ESTABLISHMENT OF A RETAIL GLASS SHOP IN AN
EXISTING ABANDONED SERVICE STATION LOCATED AT 9670
FOOTHILL BOULEVARD IN THE SPECIALTY COMMERCIAL DISTRICT,
ACTIVITY CENTER OF THE FOOTHILL BOULEVARD SPECIFIC PLAN -
APN 208-153-05
A. Recitals.
(i ) Ed Jaunzemis has filed an application for the approval of
Development Review No. 87-13 as described in the title of this Resolution.
Hereinafter in this Resolution, the subject Development Review request is
referred to as "the application".
(ii ) The application was deemed incomplete by the City Planner by
letter of June 9, 1986.
(iii ) Ed Jaunzemis resubmitted the application in February 1987 which
was deemed incomplete by the City Planner by letter of March 3, 1987.
(iv) The applicant has failed to submit revised plans and
information to complete the application.
(v) On the of 10th of February, 1988, the Planning Commission of
the City of Rancho Cucamonga conducted a meeting on the application and
concluded said meeting on that date.
(vi ) All legal prerequisites to the adoption of this Resolution have
occurred.
B. Resolution.
NOW, THEREFORE, it is hereby found, determined and resolved by the
Planning Commission of the City of Rancho Cucamonga as follows:
1. This Commission hereby specifically finds that all of the facts
set forth in the Recitals, Part A, of this Resolution are true and correct.
2. Based upon substantial evidence presented to this Commission
during the above-referenced meeting on February 10, 1988, including written
and oral staff reports, this Commission hereby specifically finds as follows:
(a) The application applies to property located at 9670
Foothill Boulevard with a street frontage of 73 feet and lot depth of 136 feet
and presently contains an abandoned gas station; and
(b) The property to the north of the subject site is single
family homes, the property to the south of that site is McDonald's, a liquor
store, and a restaurant, the property to the east is the Miller's Outpost
Shopping Center, and the property to the west is single family homes; and

(c) The proposed use is not in accord with the objective of
the Foothill Boulevard Specific Plan, in that the retail glass store is
classified as a hardware store and is not a permitted use in the Specialty
Commercial District in which the site is located; and
(d) Without the submittal of the development plans, which
include the Detailed Site Plan, Conceptual Grading Plan, and Conceptual
Landscape Plan, staff cannot determine whether the proposed use would comply
with all applicable City Codes. ; and
(e) Without the submittal of a Master Plan to address the
issues of non-conformity, strip commercial , access, circulation, integrated
development, the proposed use at this site may preclude an opportunity to
coordinate the land use and site planning for quality development consistent
with the Foothill Boulevard Specific Plan; and
(f) Without the submittal of the required development plans,
staff cannot prepare a legally adequate environmental document.
5. Based upon the findings and conclusions set forth in paragraphs
1 and 2 above, this Commission hereby denies the application without
prejudice.
6. The Deputy Secretary to this Commission shall certify to the
adoption of this Resolution.

I, Brad Buller, Deputy Secretary of the Planning Commission of the City of
Rancho Cucamonga, do hereby certify that the foregoing Resolution was duly and
regularly introduced, passed, and adopted by the Planning Commission of the
City of Rancho Cucamonga, at a regular meeting of the Planning Commission held
on the 10th day of February, 1988, by the following vote-to-wit:
