HomeMy WebLinkAbout88-51B - Resolutions RESOLUTION NO. 88-51B A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA APPROVING A REQUEST FOR A MODIFICATION OF A CONDITION OF APPROVAL FOR DEVELOPMENT REVIEW 88-01 FOR A 10 ACRE MEDICAL FACILITY LOCATED AT THE SOUTHEAST CORNER OF MILLIKEN AVENUE AND CHURCH STREET IN THE MIXED USE (MHO) DISTRICT WITHIN THE TERRA VISTA PLANNED COMMUNITY - APN 227-151-77 A. Recitals. ( i ) On March 9, 1988, the Planning Commission adopted Resolution No. 88-51, thereby approving, subject to specified conditions, Development Review 88-01 , which provides for the development of a medical facility on 10 acres of land within the Mixed Use (MHO) District within the Terra Vista Planned Community. (ii ) On February 26, 1990, a request was filed by Lewis Homes Management Corp. to modify the condition of approval requiring the completion of median island landscaping within Milliken Avenue prior to occupancy of Phase 1 of the project. ( iii ) On March 14 , 1990, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. (iv) All legal prerequisites to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1 . This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above-referenced public hearing on March 14, 1990, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows: (a) That the project is a phased project consisting of a Phase 1 and a Phase 2; and (b) That the deferral of the completion of the landscaping within the Milliken Avenue and Church Street median until Phase 2 of the project is consistent with City Council Resolution No. 88-557. Based upon the substantial evidence presented to this Commission during the above-referenced public hearing and upon the specific findings of facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and concludes as follows: (a) That project is consistent with the General Plan, Development Code, and specific plans; and (b) The design or improvements of the project is consistent with the General Plan, Development Code, and specific plans; and (c) The site is physically suitable for the type of development proposed; and (d) The design of the project is not likely to cause substantial environmental damage and avoidable injury to humans and wildlife or their habitat; and (e) The project is not likely to cause serious public health problems; and (f) The design of the project will not conflict with any easement acquired by the public at large, now of record, for access through or use of the property within the proposed subdivision. 4. This Commission hereby finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and that a Negative Declaration was issued on March 9, 1988. 5. Based upon the findings and conclusions set forth in paragraph 1 , 2 and 3 above, this Commission hereby modifies the Resolution No. 88-51 by adding a subsection (c) to condition No. 4 under Engineering Division to read as follows: (c) The landscaping within the Church Street and Milliken Avenue median islands shall be completed prior to occupancy release of the buildings within Phase 2 of the project. 6. All other conditions as contained in Resolution Nos. 88-51 and 88-51A shall apply. 7. The Secretary to this Commission shall certify to the adoption of this Resolution.
