A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING COMMISSION
MODIFYING RESOLUTION 88-54 CONDITIONALLY APPROVING DESIGN
REVIEW FOR LOTS 37, 38, 40, 41, 43-50 AND 72-82 OF TRACT
NO. 11626 FOR THE DEVELOPMENT OF 23 SINGLE FAMILY LOTS
LOCATED NORTH OF ALMOND STREET AT BERYL STREET IN THE
VERY LOW RESIDENTIAL DISTRICT (LESS THAN 2 DWELLING UNITS
PER ACRE) - APN: 1061-811-12-16 AND 1061-821-3, 4, 6, 7,
9-22.
A. Recitals.
(i ) Brimar Development has filed a request to modify a condition of
approval regarding Community Trail construction through Lots A and B of Tract
11626. Hereinafter, the subject request is referred to as "the application".
(ii ) On July 27, 1988, the Planning Commission of the City of
Rancho Cucamonga held a meeting to consider the application.
(iii ) All legal prerequisites to the adoption of this Resolution
have occurred.
B. Resolution.
NOW, THEREFORE, it is hereby found, determined and resolved by the
Planning Commission of the City of Rancho Cucamonga as follows:
1. This Commission hereby specifically finds that all of the facts
set forth in the Recitals, Part A, of this Resolution are true and correct.
2. Based upon substantial evidence presented to this Commission
during the above-referenced meeting on July 27, 1988, including written and
oral staff reports, this Commission hereby specifically finds as follows:
A. That the proposed project is consistent with the
objectives of the General Plan; and
B. That the proposed design is in accord with the
objective of the Development Code and the purposes
of the district in which the site is located; and
C. That the proposed design is in compliance with each
of the applicable provisions of the Development
Code; and
D. That the proposed design, together with the
conditions applicable thereto, will not be
detrimental to the public health, safety, or
welfare, or materially injurious to properties or
improvements in the vicinity.

3. Based upon the findings and conclusions set forth in paragraph 1
and 2 above, this Commission hereby modifies Condition No. 6 of Resolution 88-
54 to read as follows :
(6) The Community Trail through Lots A and B shall be
constructed as follows:
a) Public improvement plans for this Community
Trail shall be submitted and approved, prior to
the issuance of building permits for Phase I ,
to the satisfaction of the City Engineer and
the Trail Advisory Committee. The trail design
shall address the potential for erosion in the
area of the channel .
b) Surety shall be posted and an agreement
executed to the satisfaction of the City
Engineer and the City Attorney prior to the
issuance of building permits for Phase I ,
guaranteeing the completion of the trail as
follows:
1. The portion from Mohave Drive to the
vicinity of the creek crossing shall be
constructed prior to occupancy of Phase I ,
and
2. The remainder of the trail shall be
completed prior to occupancy of Phase III .
4. The Deputy Secretary to this Commission shall certify to the
adoption of this Resolution.

I , Brad Buller, Deputy Secretary of the Planning Commission of the City of
Rancho Cucamonga, do hereby certify that the foregoing Resolution was duly and
regularly introduced, passed, and adopted by the Planning Commission of the
City of Rancho Cucamonga, at a regular meeting of the Planning Commission held
on the 27th day of July, 1988, by the following vote-to-wit:
