A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING COMMISSION
AMENDING DEVELOPMENT REVIEW NO. 84-22, A REQUEST TO AMEND
THE LYNNHAVEN MASTER PLAN TO ALLOW TWO-STORY UNITS ALONG
THE LEMON AVENUE FRONTAGE AND TO ALLOW AN INCREASE IN
DENSITY WITHIN THE NORTHERN PORTION OF THE SITE FROM 8
DWELLING UNITS PER ACRE TO 9.6 DWELLING UNITS PER ACRE
FOR PHASE III CONSISTING OF 265 CONDOMINIUMS ON 14.83
ACRES OF LAND IN THE MEDIUM-HIGH RESIDENTIAL DISTRICT
(14-24 DWELLING UNITS PER ACRE) LOCATED ON THE SOUTH SIDE
OF LEMON AVENUE, EAST OF HAVEN AVENUE - APN: 201-271-75
A. Recitals.
(i ) Alta Loma - Oxford Limited Partnership has filed an
application for an amendment to Development Review No. 84-22 as described in
the title of this Resolution. Hereinafter in this Resolution, the subject
Development Review request is referred to as "the application".
(ii ) On the 23rd of March, 1988, the Planning Commission of the
City of Rancho Cucamonga conducted a meeting on the application and concluded
said meeting on that date.
(iii ) All legal prerequisites to the adoption of this Resolution
have occurred.
B. Resolution.
NOW, THEREFORE, it is hereby found, determined and resolved by the
Planning Commission of the City of Rancho Cucamonga as follows:
1. This Commission hereby specifically finds that all of the facts
set forth in the Recitals, Part A, of this Resolution are true and correct.
2. Based upon substantial evidence presented to this Commission
during the above-referenced meeting on March 23, 1988, including written and
oral staff reports, this Commission hereby specifically finds as follows:
(a) The application applies to property located on the south
side of Lemon Avenue, east of Haven Avenue with a street frontage of 657 feet
and lot depth of 992 feet and is presently unimproved; and
(b) The properties to the north, east, and west are designated
for residential uses. The properties to the north and east are currently
vacant. The property to the west is presently being developed with
condominiums. The property to the south is designated for the future Foothill
Freeway and is currently vacant; and
(c) The project, with the recommended conditions of approval ,
complies with all minimum development standards of the City of Rancho
Cucamonga; and

(d) The development of 265 condominiums on 14.83 acres of land
is consistent with the Medium-High Residential land use designation of the
General Plan; and
(e) With the grade separation between Lemon Avenue and the
first row of units, the appearance from the streetscape will be that of single
story units; and
(f) The elevated building pads (6-13 feet) on the north side
of Lemon Avenue and the depressed building pads (6-10 feet) on the south side
of Lemon Avenue will mitigate the impact created by the use of two-story units
on the south side of Lemon Avenue; and
(g) The 9.6 dwelling unit per acre density within the northern
portion of the site will provide a better distribution of the units within the
site while still maintaining a transition from the Low-Medium Residential
District (4-8 dwelling units per acre) located to the north.
3. Based upon the substantial evidence presented to this Commission
during the above-referenced meeting and upon the specific findings of facts
set forth in paragraph 1 and 2 above, this Commission hereby finds and
concludes as follows:
(a) That the proposed amendment is consistent with
the objectives of the General Plan; and
(b) That the proposed amendment is in accord with
the objective of the Development Code and the
purposes of the district in which the site is
located; and
(c) That the proposed amendment is in compliance
with each of the applicable provisions of the
Development Code; and
(d) That the proposed amendment, together with the
conditions applicable thereto, will not be
detrimental to the public health, safety, or
welfare, or materially injurious to properties
or improvements in the vicinity.
4. This Commission hereby finds and certifies that the project has
been reviewed and considered in compliance with the California Environmental
Quality Act of 1970 and, further, this Commission hereby issues a Negative
Declaration.
5. Based upon the findings and conclusions set forth in paragraph
1, 2 and 3 above, this Commission hereby approves the application subject to
each and every condition set forth below.

(a) All applicable conditions of approval for
Vesting Tentative Tract 13823 shall apply.
6. The Deputy Secretary to this Commission shall certify to the
adoption of this Resolution.

Rancho Cucamonga, do hereby certify that the foregoing Resolution was duly and
regularly introduced, passed, and adopted by the Planning Commission of the
City of Rancho Cucamonga, at a regular meeting of the Planning Commission held
on the 23rd day of March, 1988, by the following vote-to-wit:
