A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING COMMISSION
APPROVING MODIFICATIONS TO CONDITIONAL USE PERMIT NO. 85-
19 FOR A NEIGHBORHOOD RETAIL CENTER LOCATED AT THE
SOUTHWEST CORNER OF FOOTHILL BOULEVARD AND RAMONA AVENUE
IN THE COMMUNITY COMMERCIAL DISTRICT, SUBAREA 3 OF THE
FOOTHILL BOULEVARD SPECIFIC PLAN - APN: 208-301-15, 16,
AND 17
A. Recitals.
(i ) Parco Development has filed an application for the modification
of the Conditional Use Permit No. 85-19 as described in the title of this
Resolution. Hereinafter in this Resolution, the subject Conditional Use
Permit request is referred to as "the application".
(ii) On the 11th day of May, 1988, the Planning Commission of the
City of Rancho Cucamonga conducted a duly noticed public hearing on the
application and concluded said hearing on that date.
(iii ) All legal prerequisites to the adoption of this Resolution
have occurred.
B. Resolution.
NOW, THEREFORE, it is hereby found, determined and resolved by the
Planning Commission of the City of Rancho Cucamonga as follows:
1. This Commission hereby specifically finds that all of the facts
set forth in the Recitals, Part A, of this Resolution are true and correct.
2. Based upon substantial evidence presented to this Commission
during the above-referenced public hearing on May 11, 1988, including written
and oral staff reports, together with public testimony, this Commission hereby
specifically finds as follows:
(a) The application applies to property located at the
southwest corner of Foothill and Ramona; and
(b) The property to the north of the subject site is existing
commercial uses, the property to the south of that site consists of single
family residential homes, the property to the east is an existing restaurant,
and the property to the west is existing commercial uses.
3. Based upon the substantial evidence presented to this Commission
during the above-referenced public hearing and upon the specific findings of
facts set forth in paragraph 1 and 2 above, this Commission hereby finds and
concludes as follows:
(a) That the proposed use is in accord with the
General Plan, the objectives of the Development
Code and Foothill Boulevard Specific Plan, and
the purposes of the district in which the site
is located.

(b) That the proposed use, together with the
conditions applicable thereto, will not be
detrimental to the public health, safety, or
welfare, or materially injurious to properties
or improvements in the vicinity.
(c) That the proposed use complies with each of the
applicable provisions of the Foothill Boulevard
Specific Plan.
(d) That the architectural design is appropriate
for the specific location and the Community
Commercial District.
4. This Commission hereby finds and certifies that the project has
been reviewed and considered in compliance with the California Environmental
Quality Act of 1970 and, further, this Commission hereby issues a Negative
Declaration.
5. Based upon the findings and conclusions set forth in paragraph
1, 2 and 3 above, this Commission hereby approves the application subject to
each and every condition set forth below and in the attached Standard
Conditions attached hereto and incorporated herein by this reference.
Planning Division:
(1) Provide texturized connections from the public
sidewalks to the interior of the center.
(2) The tile treatment on the parapet walls shall
continue around all corners visible from pedestrian
traffic areas.
(3) Plaza areas similar to the original proposal shall
be provided at the eastern end of the main building
and at the satellite building (refer to Exhibit
"C"). Pedestrian furniture and trash receptacles
shall be provided. The design and materials of
these plazas shall be reviewed by the Design Review
Committee prior to the issuance of building permits.
(4) The final color scheme and material samples shall be
reviewed and approved by the Design Review Committee
prior to occupancy of any buildings.

(5) The tower elements shall not exceed the maximum
height limitation and the eastern tower element
shall be de-emphasized in order to maintain the
westernmost of the two as the center's main entrance
focus. Design Review Committee approval shall be
required prior to the issuance of building permits
of revised elevations.
(6) The arches and trellis feature shall be continued at
the eastern end of the main building and at the
satellite building.
(7) The rectangular window element shall be continued
onto the north elevations of the satellite building
(No. 3) and Building No. 1.
(8) Provide extensive landscaping at the intersection of
Foothill Boulevard and Ramona Avenue.
(9) Streetscape improvements, including landscaping and
street furniture, shall be provided in accordance
with the Foothill Boulevard Specific Plan.
(10) Provisions for the following design features in the
trash enclosure to the satisfaction of the City
Planner:
(a) Architecturally integrated into the design of
the shopping center.
(b) Separate pedestrian access that does not
require opening the main doors to include self-
closing pedestrian door.
(c) Large enough to accommodate two trash bins.
(d) Roll-up doors.
(e) Trash bins with counterweighted lids.
(f) Architecturally treated overhead shade trellis.
(g) Chain link screen on top to prevent trash from
blowing out of enclosure and designed to be
hidden from view.
(11) Graffiti shall be removed within 72 hours.

(12) The entire site shall be kept free of trash and
debris at all times, and in no event shall trash and
debris remain for more than twenty-four (24) hours.
(13) Trash collection shall occur between the hours of
9:00 A.M. and 10:00 P.M. only.
(14) Noise Levels - All commercial activities shall not
create any noise that would exceed an exterior noise
level of 60dBA during the hours of 10:00 P.M. to
7:00 A.M. and 65dBA during the hours of 7:00 A.M. to
10:00 P.M.
(15) Loading and Unloading - No person shall cause the
loading, unloading, closing, or other handling of
boxes, crates, containers, building materials,
garbage cans, or similar objects between the hours
of 10:00 P.M. and 7:00 A.M. unless otherwise
specified herein, in a manner which would cause a
noise disturbance to a residential area.
(16) The site shall be developed and maintained in
accordance with the approved Site Plan which
includes architectural elevations, exterior
materials and colors, landscaping, sign programs,
and grading on file with the Planning Division, the
conditions contained therein and Development Code
regulations.
Engineering Division:
(1) The portion of the frontage road within the project
shall be vacated prior to the issuance of building
permits. A request letter and appropriate fees will
be required to initiate the process.
(2) A lot line merger to consolidate the existing parcel
site into one parcel shall be completed prior to the
issuance of building permits.
(3) The portion of the existing alley adjacent to the
site shall be reconstructed as approved by the City
Engineer.
(4) Construct an access connection from the terminus of
the existing frontage road to Foothill Boulevard.
(5) Provide a system to convey drainage from the
easterly terminus of the existing frontage road to a
location acceptable to the City Engineer. The
system shall be located in a public right-of-way or
an easement provided to the City.

(6) Underground Utilities
(a) Foothill Boulevard - An in-lieu fee as
contribution to the future undergrounding of
the existing overhead utilities
(telecommunications) on the opposite side of
Foothill Boulevard shall be paid to the City
prior to the issuance of building permits. The
fee shall be one-half the City adopted unit
amount times the length from the center of
Ramona Avenue to the westerly terminus.
(b) Ramona Avenue - An in-lieu fee as contribution
to the future undergrounding of the existing
overhead utilities (electrical ) on the opposite
side of Ramona Avenue shall be paid to the City
prior to the issuance of building permits. The
fee shall be one-half the City adopted unit
amount times the length from the center of the
alley to the northerly terminus.
6. The Deputy Secretary to this Commission shall certify to the
adoption of this Resolution.
