A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING COMMISSION
APPROVING DEVELOPMENT REVIEW NO. 88-04, LOCATED AT THE
SOUTHWEST CORNER OF ARROW HIGHWAY AND HAVEN AVENUE IN THE
INDUSTRIAL PARK DISTRICT, SUBAREA 6 OF THE INDUSTRIAL
SPECIFIC PLAN - APN: 209-142-17
A. Recitals.
(i ) Carney-Theodorou has filed an application for the approval of
Development Review No. 88-04 as described in the title of this Resolution.
Hereinafter in this Resolution, the subject Development Review request is
referred to as "the application".
(ii ) On the 11th of May, 1988, the Planning Commission of the City
of Rancho Cucamonga conducted a meeting on the application and concluded said
meeting on that date.
(iii ) All legal prerequisites to the adoption of this Resolution
have occurred.
B. Resolution.
NOW, THEREFORE, it is hereby found, determined and resolved by the
Planning Commission of the City of Rancho Cucamonga as follows:
1. This Commission hereby specifically finds that all of the facts
set forth in the Recitals, Part A, of this Resolution are true and correct.
2. Based upon substantial evidence presented to this Commission
during the above-referenced meeting on May 11, 1988, including written and
oral staff reports, this Commission hereby specifically finds as follows:
(a) The application applies to property located at the
southeast corner of Arrow Highway and Haven Avenue; and
(b) The property to the north of the subject site is an
existing retail center, the property to the south of that site consists of an
industrial project, the property to the east is vacant, and the property to
the west is vacant.
3. Based upon the substantial evidence presented to this Commission
during the above-referenced meeting and upon the specific findings of facts
set forth in paragraph 1 and 2 above, this Commission hereby finds and
concludes as follows:
(a) That the proposed project is consistent with
the objectives of the General Plan; and

(b) That the proposed use is in accord with the
objective of the Development Code and the
purposes of the district in which the site is
located; and
(c) That the proposed use is in compliance with
each of the applicable provisions of the
Development Code; and
(d) That the proposed use, together with the
conditions applicable thereto, will not be
detrimental to the public health, safety, or
welfare, or materially injurious to properties
or improvements in the vicinity.
(e) That the proposed project is in accord with the
goals and intent of the Haven Avenue Overlay
District.
4. This Commission hereby finds and certifies that the project has
been reviewed and considered in compliance with the California Environmental
Quality Act of 1970 and, further, this Commission hereby issues a Negative
Declaration.
5. Based upon the findings and conclusions set forth in paragraph
1, 2 and 3 above, this Commission hereby approves the application subject to
each and every condition set forth below and in the attached Standard
Conditions attached hereto and incorporated herein by this reference.
Planning Division
(1) The final design of the parking lot circulation, the
alignment of the main circulation spine and how it
interfaces with the "not-a-part" parcel shall be
subject to the City Planner and City Engineer review
and approval .
(2) The design of the plaza area and pedestrian
connection for this project along the south property
boundary shall integrate the existing half of the
plaza for the Haven Tech Center so as to achieve
completeness and continuity. Final design shall be
subject to City Planner review and approval .
(3) Textured paving shall be consistent and used at all
crosswalks and pedestrian walkways. Final approval
of materials shall be given by the Design Review
Committee prior to issuance of permits.

(4) The service entry drives at Buildings "E" and "F",
and "G" and "H" shall be narrowed and incorporate
additional landscape area as shown on Exhibit "B".
(5) Samples of all the proposed materials and colors for
the project shall be submitted to the Design Review
Committee for review and approval prior to the
issuance of any building permits.
(6) Mitigation shall be considered for wind at the
entries of the office buildings. Sliding doors
and/or vestibules shall be considered. Final
mitigation shall be reviewed and approved by the
City Planner prior to the issuance of building
permits.
(7) Enlarged details of all pedestrian spaces shall be
submitted for review and approval by the Design
Review Committee prior to the issuance of any
building permits.
(8) The landscape theme for the entire Master Planned
area shall consider wind mitigation.
(9) Terraced planter walls, mature trees, and/or other
measures shall be provided at the north side of
Building "B" and south side of Building "A".
(10) Phase I construction shall include the full plaza to
the east up to the easternmost north-south sidewalk
and edge treatment as proposed by the City Planner
shall be provided at the limits of work.
(11) Building setbacks for Buildings "A" and "B" shall be
determined at working drawings and shall be in
conformance with the Industrial Specific Plan
standard for buildings exceeding 35 feet in height.
Engineering Division
(1) The main drive aisle connecting the southerly
driveway on Haven Avenue to the Arrow Route driveway
shall be constructed with Phase I, including the
drive approach on Arrow Route. The drive aisle
design shall be approved by the City Engineer. The
median opening nearest to Arrow Route within the
drive aisle median will only be permitted if the
"not a part" parcel to the west absolutely needs it
due to grade constraints required for subterranean
parking. The opening shall not be constructed until
the building parcel has obtained either a
grading g permit.

(2) A contribution in aid of construction for the median
island within Haven Avenue shall be paid to the City
prior to the issuance of building permits. The
amount of the fee shall be the City adopted unit
amount for Phase II ($55.00) times the linear feet
of property fronting on Haven Avenue (±485 feet) per
Resolution No. 87-587.
(3) A drainage easement in favor of the "not a part"
parcel shall be provided.
(4) The developer shall pay the reimbursement fees per
City Council Resolution No. 85-328 executed by the
Daon Corporation for the construction of
improvements on Arrow Route prior to the issuance of
building permits.
(5) Utica Avenue shall be constructed full width (except
for off-site parkway improvements) from Arrow Route
to meet the existing improvements to the south with
Phase II.
(6) The Arrow Route improvements (except for parkway
improvements) shall be extended across the "not a
part" parcel to the west. Construct the portion
from Haven to and including the Arrow Route driveway
with Phase I. Construct the portion from the
driveway to Utica with Phase II.
(7) Haven Avenue shall be widened across the "not a
part" parcel to the north to provide a right turn
lane for eastbound traffic onto Arrow Route which
shall include modifying and upgrading the existing
traffic signal with Phase I.
(8) The developer may request reimbursement agreements
to recover the costs of constructing the
improvements fronting on the "not a part" parcel
upon its development and those east of the
centerline of Utica Avenue from the property owner
to the east upon its development.
(9) Utility Undergrounding
a. Arrow Route - The existing overhead utilities
(telecommunications and electrical ) on the
project side of Arrow Route shall be
undergrounded from the first pole on the west
side of Haven Avenue to the first pole on the
east side of Utica Avenue prior to public

improvement acceptance or occupancy for Phase
II, whichever occurs first. The developer may
request reimbursement agreements to recover
one-half the City adopted cost for
undergrounding from future development
(redevelopment) as it occurs on the opposite
side of the street and to recover the full cost
of undergrounding across the "not a part"
parcel to the west upon its development.
b. Haven Avenue - The existing overhead utilities
(communication for the 66 KV electrical ) on the
project side of Haven Avenue shall be
undergrounded from the first pole south of the
project's south boundary to the first pole on
the north side of Arrow Route prior to public
improvement acceptance of occupancy for Phase
I, whichever occurs first. The developer may
request a reimbursement agreement to recover
the full cost of undergrounding across the "not
a part" parcel to the north upon its
development.
c. If Haven Avenue street improvements precede
Arrow Route undergrounding, conduit shall be
placed across Haven Avenue.
d. Haven Avenue - An in-lieu fee as contribution
to the future undergrounding of the utilities
(telecommunications and electrical ) on the
opposite side of Haven Avenue shall be paid to
the City prior to the issuance of building
permits for Phase I. The fee shall be one-half
the difference between the undergrounding cost
of the utilities (telecommunications and
electrical ) on the opposite side of Haven
Avenue minus those (communication for 66 KV
electrical ) on the project side times the
length of the project frontage.
e. If the Arrow Route street improvements precede
the Haven Avenue undergrounding, conduit shall
be placed across Arrow Route.
6. The Deputy Secretary to this Commission shall certify to the
adoption of this Resolution.
