A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO CUCAMONGA MODIFYING A CONDITION OF APPROVAL FOR
PARCEL MAP 9897, LOCATED ON THE SOUTHEAST CORNER OF
CHURCH STREET AND TERRA VISTA PARKWAY IN THE TERRA VISTA
PLANNED COMMUNITY (APN 1077-421-06, 1077-091-17)
A. Recitals.
(i) On June 22, 1988, the Planning Commission adopted Resolution
No. 88-119, thereby approving, subject to specified conditions, Tentative
Parcel Map 9897, which creates 3 Parcels on 17.08 acres of land within the
Terra Vista Planned Community.
(ii ) On August 17, 1988, a request was filed by Lewis Homes
Management Corporation to modify the condition of approval requiring the
construction of a landscaped median on Terra Vista Parkway from Church Street
to Town Center Drive.
(iii ) On September 14, 1988, the Planning Commission of the City of
Rancho Cucamonga conducted a duly noticed public hearing on the application
and concluded said hearing on that date.
(iv) All legal prerequisites to the adoption of this Resolution
have occurred.
B. Resolution.
NOW, THEREFORE, it is hereby found, determined and resolved by the
Planning Commission of the City of Rancho Cucamonga as follows:
1. This Commission hereby specifically finds that all of the
facts set forth in the Recitals, Part A, of this Resolution are true and
correct.
2. Based upon substantial evidence presented to this Commission
during the above-referenced public hearing on September 14, 1988, including
written and oral staff reports, together with public testimony, this
Commission hereby specifically finds as follows:
(a) The request applies to the median island
within Terra Visa Parkway between Church
Street and Town Center Drive; and

(b) A median island within this portion of
roadway was not a requirement of the Planned
Community text; and
(c) A median island within this portion of
roadway is not practical due to roadway width
constraints.
3. Based upon the substantial evidence presented to this
Commission during the above-referenced public hearing and upon the specific
findings of facts set forth in paragraphs 1 and 2 above, this Commission
hereby finds and concludes as follows:
(a) That the proposed use is in accord with the
General Plan, the objectives of the Terra
Vista Planned Community, and the purposes of
the District in which the site is located;
and
(b) That the proposed use, together with the
conditions applicable thereto, will not be
detrimental to the public health, safety, or
welfare, or materially injurious to
properties or improvements in the vicinity;
and
(c) That the proposed use complies with each of
the applicable provisions of the Development
Code and the Terra Vista Planned Community.
4. This Commission hereby finds and certifies that the project
has been reviewed and considered in compliance with the California
Environmental Quality Act of 1970 and that a Negative Declaration was issued
on June 22, 1988.
5. Based upon the findings and conclusions set forth in
Paragraphs 1, 2 and 3 above, this Commission hereby modifies Resolution No.
88-119 by deleting "including a landscaped median" within Special Condition
2.b. , deleting the check mark under Median Island for the Terra Vista Parkway
portion of Standard Condition No. B.3., and replacing Special Condition 3 with
the followiong:
3. "A master plan for the landscaping of the
median within Church Street from Haven Avenue
to Rochester Avenue shall be completed and
approved by the City prior to submittal of
the improvement plans to the City for
review."

6. The Deputy Secretary to this Commission shall certify to the
adoption of this resolution.

I, Brad Buller, Deputy Secretary of the Planning Commission of the City of
Rancho Cucamonga, do hereby certify that the foregoing Resolution was duly and
regularly introduced, passed, and adopted by the Planning Commission of the
City of Rancho Cucamonga, at a regular meeting of the Planning Commission held
on the 14th day of September, 1988, by the following vote-to-wit:
