A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO CUCAMONGA APPROVING TENTATIVE TRACT MAP NO. 13810,
LOCATED NORTH OF HILLSIDE ROAD BETWEEN HELLMAN AVENUE AND
BERYL STREET IN THE VERY LOW RESIDENTIAL DISTRICT (LESS
THAN 2 DWELLING UNITS PER ACRE) - APN: 1061-381-14
A. Recitals.
(i ) Vic Patel has filed an application for the approval of
Tentative Tract Map No. 13810 as described in the title of this Resolution.
Hereinafter in this Resolution, the subject Tentative Tract Map request is
referred to as "the application".
(ii ) On the 24th of August, 1988, the Planning Commission of the
City of Rancho Cucamonga conducted a duly noticed public hearing on the
application and concluded said hearing on that date.
(iii ) All legal prerequisites to the adoption of this Resolution
have occurred.
B. Resolution.
NOW, THEREFORE, it is hereby found, determined and resolved by the
Planning Commission of the City of Rancho Cucamonga as follows:
1. This Commission hereby specifically finds that all of the facts
set forth in the Recitals, Part A, of this Resolution are true and correct.
2. Based upon substantial evidence presented to this Commission
during the above-referenced public hearing on August 24, 1988, including
written and oral staff reports, together with public testimony, this
Commission hereby specifically finds as follows:
(a) The application applies to property located on the north
side of Hillside Road between Hellman Avenue and Beryl Street with a street
frontage of 320 feet along Hillside and 650 feet along the east tract boundary
and is presently vacant; and
(b) The property to the north of the subject site is
designated for flood control purposes and is developed with the Demens
Channel , the property to the south of that site consists of Single Family
Residential and vacant land, the property to the east is Single Family
Residential , and the property to the west is Single Family Residential .
3. Based upon the substantial evidence presented to this Commission
during the above-referenced public hearing and upon the specific findings of
facts set forth in paragraph 1 and 2 above, this Commission hereby finds and
concludes as follows:
(a) That tentative tract is consistent with the
General Plan, Development Code, and specific
plans; and

(b) The design or improvements of the tentative
tract is consistent with the General Plan,
Development Code, and specific plans; and
(c) The site is physically suitable for the type of
development proposed; and
(d) The design of the subdivision is not likely to
cause substantial environmental damage and
avoidable injury to humans and wildlife or
their habitat; and
(e) The tentative tract is not likely to cause
serious public health problems; and
(f) The design of the tentative tract will not
conflict with any easement acquired by the
public at large, now of record, for access
through or use of the property within the
proposed subdivision.
4. This Commission hereby finds and certifies that the project has
been reviewed and considered in compliance with the California Environmental
Quality Act of 1970 and, further, this Commission hereby issues a Negative
Declaration.
5. Based upon the findings and conclusions set forth in paragraph
1, 2 and 3 above, this Commission hereby approves the application subject to
each and every condition set forth below and in the attached Standard
Conditions attached hereto and incorporated herein by this reference.
Tentative Tract Map
1) An in-lieu fee as contribution to the future undergrounding of
the existing overhead utilities (telecommunications and
electrical ) on the opposite side of Hillside Road shall be paid
to the City prior to the issuance of building permits. The fee
shall be one-half the City adopted unit amount times the length
from the east project boundary to the west project boundary
(335± feet) .
2) Sidewalks are required on the west side of Court "A" only.
3) A decorative 6 foot high masonry wall shall be constructed,
within the city right-of-way for Court "A" , adjacent to the east
project boundary. The parkway abutting the wall shall be
heavily landscaped by the developer utilizing trees, shrubs and
groundcover, but no turf, and shall be annexed into a City
Landscape Maintenance District. The design of the wall and
landscaping shall be reviewed and approved by Design Review
Committee prior to issuance of building permits.

4) Existing drive approaches on Hillside Road within the project
frontage shall be removed and replaced with curb and gutter.
5) Court "A" shall be relocated westerly in order to protect the
existing driveway on Hillside Road which serves the existing
residence to the east, to the satisfaction of the City
Engineer. The resulting additional property between the curb
and easterly tract boundary shall be dedicated as street right-
of-way to be landscaped and annexed into the City landscape
maintenance district.
6) Storm drainage facility plans shall be prepared by a Registered
Civil Engineer and approved by the City Engineer and San
Bernardino County Flood Control District prior to issuance of an
encroachment permit. The cost of filling the channel and
installation of the underground pipe system shall be eligible
for credit against drainage fees and reimbursement from the City
Master Storm Drainage fund if it is designated as a Master Plan
Line by the City Council .
7) Within the storm drainage easement, trees shall be located a
minimum of 5 feet from the outside diameter of the pipe, or as
otherwise approved by the City Engineer.
8) The metal housing for the flow metering device shall be removed
and salvaged per instructions from the Flood Control District.
9) Off-site construction easements shall be obtained from
properties to the east of this site where cut or fill slopes
extend beyond the property Line. If this is not possible, the
project shall utilize retaining walls, as approved by the City
Engineer.
10) The existing storm drainage facilities shall be inspected by the
City prior to approval of the storm drain plans. Unnecessary
structures shall be removed and facilities which do not meet
City Standards shall be replaced.
11) Prior to recordation of the Final Map, the Developer shall
obtain written verification from the property owners to the east
as to their interest in obtaining access from Court "A." Drive
approaches and gates will be provided by the Developer for those
who choose to take access. Depending upon how many and which
properties choose to take access, a determination will be made
by the City Engineer as to how much, if any, of the parkway is
to be maintained by the City.
12) Provisions shall be made to accept drainage from all areas
currently draining to the existing earth channel including the
residential properties to the east.

Design Review
1) Trail fencing shall not be required along the outside of the
local feeder trails (north and west sides).
2) Driveway widths shall be reduced to approximately 16 feet at the
curb and shall widen gradually to the garage on lots 5 and 7.
3) The house on either lot 3 or 4 shall be reverse plotted.
4) Front yard setbacks shall be increased 5-10 feet on lots 1 and
4.
5) A decorative slumpstone wall shall be provided on Hillside Road.
6) 5:1 ramps shall be provided from Hillside Road to facilitate
access to the local feeder trail .
7) The trail shall tip to the perimeter property lines and shall
incorporate parallel "V" gutters (no curb), waterbars and/or
other anti-erosion devices as required.
8) Line of site drawings for lots 5, 6 and 7 shall be reviewed and
approved by the Design Review Committee prior to the issuance of
building permits.
6. The Secretary to this Commission shall certify to the adoption
of this Resolution.
