HomeMy WebLinkAbout88-193 - Resolutions RESOLUTION NO. 88-193 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA RECOMMENDING APPROVAL OF THE GENERAL PLAN AMENDMENT 88-03E, TO CHANGE THE LAND USE DESIGNATION FROM MEDIUM-HIGH RESIDENTIAL TO NEIGHBORHOOD COMMERCIAL FOR 12.9 ACRES OF LAND AT THE SOUTHEAST CORNER OF MILLIKEN AVENUE AND HIGHLAND AVENUE, AND FROM NEIGHBORHOOD COMMERCIAL TO MEDIUM RESIDENTIAL FOR 9.3 ACRES OF LAND AT THE SOUTHWEST CORNER OF MILLIKEN AVENUE AND HIGHLAND AVENUE, RANCHO CUCAMONGA, CALIFORNIA AND MAKING FINDINGS IN SUPPORT THEREOF A. Recitals. (i ) The William Lyon Company has filed an application for General Plan Amendment No. 88-03E as described in the title of this Resolution. Hereinafter in this Resolution, the subject General Plan Amendment is referred to as "the application". (ii ) On September 28, 1988, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application. B. Resolution. NOW, THEREFORE, it is hereby found, determined and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above-referenced public hearing on September 28, 1988, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows: (a) The application applies to approximately 12.9 and 9.3 acres of land, basically rectangular configurations, located at the southeast corner and southwest corner of Milliken and Highland Avenues; and is presently vacant. Said properties are currently designated as Neighborhood Commercial to the west and Medium-High Residential to the east; and (b) The property to the north of the subject site is designated Very Low (2 dwelling units per acre) and Low (2-4 dwelling units per acre) Residential ; however, bisected by the Foothill Freeway corridor which is vacant. The property to the west is designated Low Medium Residential (4-8 dwelling units per acre) and is developed with Single Family Homes. The property to the east is designated Medium Residential (8-14 dwelling units per acre) Community Facility and is vacant. The property to the south is designated Medium Residential (8-14 dwelling units per acre) and is vacant. PLANNING COMMISSION RESOLUTION NO. 88-193 GENERAL PLAN AMENDMENT 88-03E PAGE 2 (c) This amendment does not conflict with the Land Use Policies of the General Plan and will provide for development, within the district, in a manner consistent with the General Plan and with related development; and (d) This amendment promotes the goals and objectives of the Land Use Element; and (e) This amendment would not be materially injurious or detrimental to the adjacent properties and would not have a significant impact on the enviornment and/nor the surrounding properties and that a Negative Declaration be issued. 3. Based upon the evidence presented to this Commission during the above-referenced public hearing and upon the specific findings of facts set forth in paragraph 1 and 2 above, this Commission hereby finds and concludes as follows: (a) That the subject property is suitable for the uses permitted in the proposed district in terms of access, size, and compatibility with existing land use in the surrounding area; and (b) That the proposed amendment would not have significant impacts on the environment nor the surrounding properties; and (c) That the proposed amendment is in conformance with the General Plan. 4. This Commission hereby finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, recommends Certification of a Negative Declaration to the City Council . 5. Based upon the findings and conclusions set forth in paragraph 1, 2 and 3 above, this Commission hereby resolves that pursuant to Section 65850 to 65855 of the California Government Code, that the Planning Commission of the City of Rancho Cucamonga hereby approves on the 28th day of September 1988, General Plan Amendment No. 88-03E. 6. The Secretary to this Commission shall certify to the adoption of this Resolution.
