A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO CUCAMONGA, CALIFORNIA, APPROVING CONDITIONAL USE
PERMIT 88-41 FOR THE DEVELOPMENT OF A TRUCK RENTAL,
LEASING AND MAINTENANCE FACILITY WITH RETAIL SALES OF
MOVING SUPPLIES, CONSISTING OF 3 BUILDINGS TOTALING
27,428 SQUARE FEET ON 8.2 ACRES OF LAND IN THE GENERAL
INDUSTRIAL DISTRICT (SUBAREA 14), LOCATED AT THE
NORTHWEST CORNER OF 4TH STREET AND SANTA ANITA AVENUE,
AND MAKING FINDINGS IN SUPPORT THEREOF - APN: 229-331-06
& 07
A. Recitals.
(i ) Ryder Truck Rental Incorporated has filed an application for
the issuance of Conditional Use Permit 88-41 as described in the title of this
Resolution. Hereinafter in this Resolution, the subject Conditional Use
permit request is referred to as "the application".
(ii ) On the 28th day of June, 1989, the Planning Commission of the
City of Rancho Cucamonga conducted a duly noticed public hearing on the
application and concluded said hearing on that date.
(iii ) All legal prerequisites to the adoption of this Resolution
have occurred.
B. Resolution.
NOW, THEREFORE, it is hereby found, determined and resolved by the
Planning Commission of the City of Rancho Cucamonga as follows:
1. This Commission hereby specifically finds that all of the facts
set forth in the Recitals, Part A, of this Resolution are true and correct.
2. Based upon substantial evidence presented to this Commission
during the above-referenced public hearing on June 28, 1989, including written
and oral staff reports, together with public testimony, this Commission hereby
specifically finds as follows:
(a) The application applies to property located on the
northwest corner of 4th Street and Santa Anita Avenue with a street frontage
of 558.73 feet on 4th Street and a street frontage of 639.25 feet on Santa
Anita Avenue with the same corresponding lot depths and is currently
unimproved and vacant; and
(b) The property to the north of the subject site is vacant
within the General Industrial category of the Industrial Specific Plan, the
property to the south is vacant M2-Manufacturing within the City of Ontario,
the property to the east is improved with commercial office and industrial
buildings in the General Industrial area and the property to the west contains
a public utility corridor and railroad right-of-way within the General
Industrial area.

(c) The property is located partially within a Flood Zone "A";
therefore, is subject to potential flooding from overflow of Day Creek
Channel . "Break through" panels in the screen wall and minimal landscaping
within the flood zone mitigate flood hazards.
3. Based upon the substantial evidence presented to this Commission
during the above-referenced public hearing and upon the specific findings of
facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and
concludes as follows:
(a) That the proposed use is in accord with the General Plan,
the objectives of the Development Code, Industrial Specific Plan, and the
purposes of the district in which the site is located.
(b) That the proposed use, together with the conditions
applicable thereto, will not be detrimental to the public health, safety, or
welfare, or materially injurious to properties or improvements in the
vicinity.
(c) That the proposed use complies with each of the applicable
provisions of the Development Code and the Industrial Specific Plan.
4. This Commission hereby finds and certifies that the project has
been reviewed and considered in compliance with the California Environmental
Quality Act of 1970 and, further, this Commission hereby issues a Negative
Declaration.
5. Based upon the findings and conclusions set forth in paragraphs
1, 2, 3, and 4 above, this Commission hereby approves the application subject
to each and every condition set forth below and in the attached Standard
Conditions attached hereto and incorporated herein by this reference.
Planning Division
1) That the proposed buildings, site and
landscaping be constructed in conformance with
the plans as approved by the Planning
Commission for each of the development
components.
2) That the canopy for the gas island be
constructed with a stucco finish to match the
buildings.
3) That the screen wall along 4th Street, with
swing panel for release of storm water, shall
be designed to the satisfaction of the City
Engineer.
4) That an enriched paving treatment, approved by
the City Planner, be provided at the driveway
entrances on 4th Street and Santa Anita Avenue
to define pedestrian crossing.

5) That written agreement shall be provided to the
City, prior to the issuance of any permits,
defining Phase I and Phase II landscaping, the
timing of installation of said landscaping and
the method and amount of funding. The written
agreement shall be reviewed and approved by the
City Attorney, Engineering Division and
Planning Division prior to the issuance of any
building permits.
6) Tree maintenance criteria shall be developed
and submitted for review and approval by the
City Planner for the project to encourage the
natural growth characteristics of the selected
tree species.
7) If the operation of the facility causes adverse
effects upon adjacent businesses or operations,
the Conditional Use Permit shall be brought
before the Planning Commission for the
consideration and possible termination of the
use.
8) That an electronically operated gate be
installed at the south egress drive onto Santa
Anita Avenue and an "Exit Only" sign be
installed at said drive and that the design of
the gate be reviewed and approved by the City
Planner.
Engineering Division
1) Overhead Utilities
a) The existing overhead utilities
(telecommunications and electrical , except
for 66 K.V. electrical ) on the project side
of 4th Street shall be undergrounded from
the first pole on the east side of Santa
Anita Avenue to the first pole on the west
side of Day Creek Channel . The
undergrounding may be deferred until 90
days after the completion of the 4th Street
bridge over Day Creek Channel if a security
is posted and an agreement is executed to
the satisfaction of the City Engineer and
City Attorney. Reimbursement of one-half
the City adopted cost for undergrounding
from future development as it occurs on the
opposite side of the street is not feasible
because the property is located in the City
of Ontario.

b) An in-lieu fee as reimbursement for the
previously undergrounded overhead utilities
(electrical ) by the developer on the east
side of Santa Anita Avenue shall be paid to
the City prior to the issuance of building
permits. The fee shall be one-half the
City adopted unit amount times the length
of the project frontage.
2) A storm drain system, including catch basins,
shall be designed and constructed within Santa
Anita Avenue to connect the proposed storm
drain shown on the Day Creek Channel plans.
The size and length of the storm drain shall be
determined by the final drainage study. This
storm drain is to be included in the City
Master Plan Storm Drain System. Therefore, the
developer shall be eligible for reimbursement
of this cost.

3) A contribution in aide of the reconstruction
and overlay of 4th Street shall be paid to the
City prior to issuance of building permits.
4) The developer shall be responsible for the
reconstruction of the parking area along the
4th Street project frontage that may be
necessary due to the improvement of the Day
Creek Channel. An agreement and surety shall
be submitted to the City and approved by the
City Engineer and the City Attorney to
guarantee this reconstruction.
5) Flood protection measures shall be provided in
accordance with the accepted Preliminary Flood
Report and as substantiated by a Final Flood
Report as approved by the City Engineer.
6. The Secretary to this Commission shall certify to the adoption of
this Resolution.
