HomeMy WebLinkAbout89-104 - Resolutions RESOLUTION NO. 89-104 A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING COMMISSION APPROVING CONDITIONAL USE PERMIT NO. 88-46 FOR THE DEVELOPMENT OF A NEIGHBORHOOD SHOPPING CENTER CONSISTING OF THREE BUILDINGS TOTALING 28,200 SQUARE FEET ON 3.5 ACRES OF LAND AT THE SOUTHWEST CORNER OF BASE LINE ROAD AND HELLMAN AVENUE IN THE NEIGHBORHOOD COMMERCIAL DISTRICT, AND MAKING FINDINGS IN SUPPORT THEREOF. - APN: 208-202-13 & 14 A. Recitals. (i) James E. Carter has filed an application for the issuance of the Conditional Use Permit No. 88-46 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Conditional Use Permit request is referred to as "the application". (ii) On the 26th of July 1989, the Planning Commission of the City of Rancho Cucamonga conducted a duly noticed public hearing on the application and concluded said hearing on that date. (iii) All legal prerequisites to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined and resolved by the Planning Commission of the City of Rancho Cucamonga as follows: 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above-referenced public hearing on July 26, 1989, including written and oral staff reports, together with public testimony, this Commission hereby specifically finds as follows: (a) The application applies to property located at the southwest corner of Base Line Road and Hellman Avenue with a street frontage of 493.5 feet and lot depth of 295 feet and is presently vacant; and (b) The property to the north of the subject site is church and single family residential, Low Residential (2-4) dwelling units per acre) ; the property to the south of that site consists of multi-family apartments, Medium Residential (8-14 dwelling units per acre) ; the property to the east is service station and office building (Office/Professional ) ; and the property to the west is a park and library, Low Residential (2-4 dwelling units per acre) . 3. Based upon the substantial evidence presented to this Commission during the above-referenced public hearing and upon the specific findings of facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and concludes as follows: PLANNING COMMISSION RESOLUTION NO. 89-104 CUP 88-46 - JAMES CARTER DEVELOPMENT July 26, 1989 Page 2 (a) That the proposed use is in accord with the General Plan, the objectives of the Development Code, and the purposes of the district in which the site is located. (b) That the proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. (c) That the proposed use complies with each of the applicable provisions of the Development Code. 4. This Commission hereby finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Commission hereby issues a Negative Declaration. 5. Based upon the findings and conclusions set forth in paragraphs 1, 2, 3, and 4 above, this Commission hereby approves the application subject to each and every condition set forth below and in the attached Standard Conditions, attached hereto and incorporated herein by this reference. Planning Division: 1. Approval of CUP 88-46 shall be subject to approval of Minor Exception 88-20, permitting a 10 percent (2.5 foot) increase in the maximum height of a portion of the main building within 100 feet of a residential zone. 2. An additional cornice shall be placed below the built-up cornice on building "C" and shall continue around the entire building including all towers, with the exception of the area at the front of building "C" immediately adjacent to the wood trusses over the main building entrance. 3. Sample colors for the storefronts, tile, stucco, and stucco base shall be reviewed and approved on site prior to full finished application on the buildings. 4. The southeast corner of building "C" shall be revised in plan view to reflect the revised elevations. These revisions would also include the planter area and hardscape at the southeast corner of the building. 5. The enriched paving areas at the entrances to the project shall be located behind the property lines, within the project site, as directed by the City Engineering Division. Sidewalks shall align with the enriched paving areas at the driveways. PLANNING COMMISSION RESOLUTION NO. 89-104 CUP 88-46 - JAMES CARTER DEVELOPMENT July 26, 1989 Page 3 6. Grading plans shall be revised to clearly indicate the amount of fill soil to be placed around the Eucalyptus trees at the south edge of the site. All existing trees are subject to an arborist report describing preservation or replacement recommendations, as applicable. A Tree Removal Permit application shall be submitted to the Planning Division prior to the arborist's report and the arborist's report shall be approved prior to issuance of any permits. 7. The planting plan shall be revised to include trellises as shown on the south elevations of building "C" . 8. There shall be provision for security patrol of the shopping center at least three times per evening , seven days per week, between the hours of 10:00 p.m. and 6:00 a.m. , by a licensed private patrol operator. 9. There shall be provision for the following' design features in the trash enclosure to the satisfaction of the City Planner: a. Architecturally integrated into the design of the shopping center. b. Separate pedestrian access that does not require opening the main doors to include self-closing pedestrian door. c. Large enough to accommodate two trash bins. d. Roll -up doors. e. Trash bins with counterweighted lids. f. Architecturally treated overhead shade trellis. g. Chain link screen on top to prevent trash from blowing out of enclosure and designed to be hidden from view. 10. Trash collection shall occur between the hours of 9:00 a.m. and 10:00 p.m. only. 11. Graffiti shall be removed within 72 hours. 12. The entire site shall be kept free of trash and debris at all times, and in no event shall trash and debris remain for more than twenty-four (24) hours. 13. All operations and businesses shall be conducted to comply with the following standards, which shall be incorporated into the lease agreement of all tenants: PLANNING COMMISSION RESOLUTION NO. 89-104 CUP 88-46 - JAMES CARTER DEVELOPMENT July 26, 1989 Page 4 a. Noise Levels. All commercial activities shall not create any noise that would exceed an exterior noise level of 60dBA during the hours of 7:00 a.m. to 10:00 p.m. b. Loading and Unloading . No person shall cause the loading, unloading, opening, closing, or other handline of boxes, crates, containers, building materials, garbage cans, or similar objects between the hours of 10:00 p.m. and 7:00 a.m., unless otherwise specified herein, in a manner which would cause a noise disturbance to a residential area. 14. Hours of operation shall be restricted to 7:00 a.m. to 11:00 p.m. Engineering Division: 1. An in-lieu fee as contribution to the future undergrounding of the existing overhead utilities (telecommunication and electrical ) on the opposite side of Hellman Avenue and Base Line Road shall be paid to the City prior to the issuance of building permits. The fee shall be one-half the City adopted unit amount times the length of the project frontage as follows: a. Hellman Avenue - from the center of Base Line Road to the south project boundary. b. Base Line Road - from the center of Hellman Avenue to the west project boundary. 2. Access easements, ensuring access to Tract 12362 located south of the project site and to the City/County public facilities to the west, shall be submitted and approved by the City Engineer and the City Attorney and shall be recorded prior to issuance of building permits. 3. The developer shall remove the wall along Hellman Avenue as determined by the final drainage study and construct full parkway improvements including sidewalk adjacent to the property line. 4. The developer shall construct storm drain facilities to upgrade the existing Master Plan Storm Drain to the satisfaction of the City Engineer as follows: a. Provide easements and construct a storm drain pipe, including catch basins, on Base Line Road from the low point in Base Line Road at the northwest corner of the site to connect to the existing Master Plan Storm Drain in Hellman Avenue at a point to be determined by the final drainage study. Trees shall be placed a minimum distance of 5 feet from the outside diameter of the storm drain pipe or as otherwise determined by the City Engineer. This setback zone shall be delineated on the landscape plans to be submitted to the Planning Division. c. The developer shall be eligible for reimbursement of the cost of construction in accordance with City Ordinance No. 75. 5. Obtain a right of entry from the County of San Bernardino for the removal of the existing driveway, necessary grading, and landscaping within the County property. 6. The developer shall remove and replace any sections of sidewalk that have been defaced. 6. The Secretary to this Commission shall certify to the adoption of this Resolution.
