A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO CUCAMONGA APPROVING TENTATIVE TRACT MAP NO. 14121,
LOCATED AT THE SOUTHWEST CORNER OF HIGHLAND AVENUE AND
MILLIKEN AVENUE IN THE LOW-MEDIUM RESIDENTIAL (4-8
DWELLING UNITS PER ACRE) DISTRICT OF THE VICTORIA AVENUE
PLANNED COMMUNITY - APN: 202-211-48.
A. Recitals.
(i) The William Lyon Company has filed an application for the
approval of Tentative Tract Map No. 14121 as described in the title of this
Resolution. Hereinafter in this Resolution, the subject Tentative Tract Map
request is referred to as "the application".
(ii ) On the 23rd of August 1989, the Planning Commission of the
City of Rancho Cucamonga conducted a duly noticed public hearing on the
application and concluded said hearing on that date.
(iii ) All legal prerequisites to the adoption of this Resolution
have occurred.
B. Resolution.
NOW, THEREFORE, it is hereby found, determined and resolved by the
Planning Commission of the City of Rancho Cucamonga as follows:
1. This Commission hereby specifically finds that all of the facts
set forth in the Recitals, Part A, of this Resolution are true and correct.
2. Based upon substantial evidence presented to this Commission
during the above-referenced public hearing on August 23, 1989, including
written and oral staff reports, together with public testimony, this
Commission hereby specifically finds as follows:
(a)The application applies to property located at the southwest
corner of Highland Avenue and Milliken Avenue with a street frontage of 820
feet and lot depth of 600 feet and is presently improved with streets and
curbs surround the site; and
(b)The property to the north of the subject site is single
family residential , the property to the south of that site consists of single
family residential , the property to the east is Village Commercial and the
property to the west is single family residential ; and
(c)The application contemplates the development of lots with a
minimum area of 5,000 square feet and an average of 6,866 square feet in
conformance with the Victoria Community Plan.
3. Based upon the substantial evidence presented to this Commission
during the above-referenced public hearing and upon the specific findings of
facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and
concludes as follows:

(a) That tentative tract is consistent with the General Plan,
Development Code, and specific plans; and
(b) The design or improvements of the tentative tract is
consistent with the General Plan, Development Code, and specific plans; and
(c) The site is physically suitable for the type of development
proposed; and
(d) The design of the subdivision is not likely to cause
substantial environmental damage and avoidable injury to humans and wildlife
or their habitat; and
(e) The tentative tract is not likely to cause serious public
health problems; and
(f) The design of the tentative tract will not conflict with
any easement acquired by the public at large, now of record, for access
through or use of the property within the proposed subdivision.
4. This Commission hereby finds and certifies that the project has
been reviewed and considered in compliance with the California Environmental
Quality Act of 1970 and, further, this Commission hereby issues a Negative
Declaration.
5. Based upon the findings and conclusions set forth in paragraphs
1, 2, 3, and 4 above, this Commission hereby approves the application subject
to each and every condition set forth below and in the attached Standard
Conditions, attached hereto and incorporated herein by this reference.
PLANNING DIVISION:
1. This map is being approved as a Tract Subdivision only. Any
future proposals for the development of five or more residential
units shall require Design Review and approval prior to the
issuance of building permits for any units.
2. Concurrent with any application for Design Review, the applicant
shall also submit an acoustical study detailing what mitigation
measures, if any, are required to achieve noise levels, both
exterior and interior, consistent with City Standards for lots
abutting Highland Avenue.
3. Landscape treatments at the end of side-on cul-de-sacs shall be
designed to provide an open view into the interior of the cul-
de-sac. Design treatment shall include the use of decorative
wrought iron fencing and sidewalk connections from the sidewalk
to the perimeter street, consistent with the treatment of other
side-on cul-de-sacs in the Victoria Planned Community.

4. A six foot high masonry wall shall be provided along Highland
Avenue consistent with the approved wall design for Highland
Avenue. This wall shall be staggered and offset to increase
visual interest and to ensure adequate area to landscape the
Highland Avenue streetscape with a windrow style of planting
consistent with the designated design standards of the Victoria
Planned Community. Landscape maintenance easements will be
required where the perimeter wall encroaches onto private lots
and are to be dedicated on the Final Map. Final plotting of all
walls and locations of all landscape easements are to be
determined prior to recordation of the Final Map.
5. The Milliken Avenue perimeter wall shall be constructed in
conformance with the requirements specified in the acoustical
study submitted with this application.
6. All retaining walls visible to the general public, i .e. on the
streetside of corner side yards and within the front yard, are
to be constructed of a decorative material to the satisfaction
of the City Planner.
7. To mitigate significant adverse noise impacts from the proposed
freeway, prior to the issuance of building permits an in-lieu
fee shall be required for the future installation of a sound
attenuation wall to the north of the site at the freeway
level . The amount of the deposit shall be to the satisfaction
of the City Planner, City Engineer, and CalTrans.
ENGINEERING DIVISION:
1. The following shall be constructed and operational prior to the
release of any occupancies:
a. Highland Avenue from Deer Creek Channel to the east
boundary of Tract 13440.
b. Milliken Avenue from Highland Avenue to Base Line Road.
c. The Milliken/Highland intersection traffic signal .
2. Parkway and median landscaping on Milliken Avenue shall conform
to the results of the City's Milliken Avenue beautification
study.
3. The boundary between homeowner and City maintenance along Kenyon
Way shall be delineated by a concrete mow strip or similar
device as approved by the City Engineer.
4. Lots "A" and "B" shall be landscaped to the satisfaction of the
City Planner and City Engineer.

6. The Secretary to this Commission shall certify to the adoption
of this Resolution.
