A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
RANCHO CUCAMONGA, CALIFORNIA, APPROVING CONDITIONAL USE
PERMIT NO. 89-24 FOR THE DEVELOPMENT OF A FIRE STATION
TOTALING 11,026 SQUARE FEET ON 3.15 ACRES OF LAND,
LOCATED ON THE NORTH SIDE OF BANYAN STREET, EAST OF THE
DEER CREEK CHANNEL IN THE PROPOSED LOW RESIDENTIAL
DISTRICT (2-4 DWELLING UNITS PER ACRE) , AND MAKING
FINDINGS IN SUPPORT THEREOF - APN: 201-191-21
A. Recitals .
(i) The Rancho Cucamonga Redevelopment Agency has filed an
application for the issuance of the Conditional Use Permit No. 89-24 as
described in the title of this Resolution. Hereinafter in this Resolution,
the subject Conditional Use Permit request is referred to as "the
application".
(ii) On the 27th of September, 1989, the Planning Commission of the
City of Rancho Cucamonga conducted a duly noticed public hearing on the
application and concluded said hearing on that date.
(iii ) All legal prerequisites to the adoption of this Resolution
have occurred.
B. Resolution.
NOW, THEREFORE, it is hereby found, determined and resolved by the
Planning Commission of the City of Rancho Cucamonga as follows:
1. This Commission hereby specifically finds that all of the facts
set forth in the Recitals, Part A, of this Resolution are true and correct.
2. Based upon substantial evidence presented to this Commission
during the above-referenced public hearing on September 27, 1989, including
written and oral staff reports, together with public testimony, this
Commission hereby specifically finds as follows:
(a) The application applies to property located on the north
side of Banyan Avenue, east of the Deer Creek Channel , with a street frontage
of 348 feet and a lot depth of 600 feet, and is presently vacant; and
(b) The property to the north and east of the subject site
is vacant, and the property to the south and west of that site contains single
family homes (under construction) .

3. Based upon the substantial evidence presented to this Commission
during the above-referenced public hearing and upon the specific findings of
facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and
concludes as follows:
(a) That the proposed use will be in accord with the General
Plan, the objectives of the Development Code, and the purposes of the district
in which the site is located.
(b) That the proposed use, together with the conditions
applicable thereto, will not be detrimental to the public health, safety, or
welfare, or materially injurious to properties or improvements in the
vicinity.
(c) That the proposed use will comply with each of the
applicable provisions of the Development Code.
4. This Commission hereby finds and certifies that the project
has been reviewed and considered in compliance with the California
Environmental Quality Act of 1970 and, further, this Commission hereby issues
a Negative Declaration.
5. Based upon the findings and conclusions set forth in
paragraphs 1, 2, 3, and 4 above, this Commission hereby approves the
application subject to each and every condition set forth below and in the
attached Standard Conditions , attached hereto and incorporated herein by this
reference.
Planning Division
(1 ) A decorative paving/banding treatment shall be provided
at both driveways to break up large expanses of paving,
subject to approval by the City Planner.
(2) A stucco and brick screen wall shall be provided to
screen the parking areas from public view.
(3) Trees planted around the perimeter of the project site
shall be spaced at a minimum of twenty (20) feet-on-
center. Trees at the east project boundary shall be
extended towards Banyan Street.
(4) Trees planted along the east project boundary shall be
moved away from the perimeter wall to prevent
landscaping from overhanging onto adjacent property.
(5) Seventeen (17) street trees shall be provided within the
Banyan parkway. In addition, the number of trees
provided within the landscape setback shall be increased
along Banyan, to the satisfaction of the City Planner.

(6) Landscape and irrigation plans addressing all proposed
landscaping and conditions of approval shall be
submitted for review and approval by the City Planner
prior to the issuance of building permits.
(7) The wall along the east boundary shall be stepped down
as it approaches Banyan Street. Sight lines shall be
plotted on the landscape plan to show at what points the
wall height needs to be recessed. Sight lines need to
be reviewed and approved by the City Engineer prior to
the issuance of building permits for the perimeter wall .
(8) No roof mounted equipment is proposed ; hence, all
equipment shall be ground mounted and shall be
adequately screened by landscaping and low decorative
walls. Any landscape screening shall be shown on the
landscape and irrigation plans to be reviewed and
approved by the City Planner prior to the issuance of
building permits.
(9) The applicant shall prepare a test panel of the exterior
paint color for approval by the Planning Division during
construction.
(10) The garage doors leading to the apparatus room shall be
painted to match the building exterior.
Engineering Division
Special Conditions :
(1) The existing on-site desilting facility shall be
relocated easterly of the project boundary. The size
and location shall be determined by a final drainage
study.
(2) Flood protection facilities shall be provided to protect
the project site from flow from the north , to the
satisfaction of City Engineer.
(3) Trees are prohibited within five (5) feet of the outside
diameter of any public storm drain pipe measured from
the outer edge of a mature tree trunk.
(4) A permit from the Metropolitan Water District is
required for work within its right-of-way.

(5) The developer shall provide necessary easements in favor
of the San Bernardino County Flood Control District to
provide access to the Deer Creek Channel and construct
pavement within the easements to the satisfaction of the
County Flood Control District.
(6) The developer shall acquire the necessary dedication and
construct the north one-half of Banyan Street from the
Deer Creek Channel Bridge to and including the
intersection of Milliken Avenue. The developer may
request a reimbursement agreement to recover the costs
of constructing the off-site improvements from future
development of the properties located on the north side
of Banyan Street. Off-site parkway improvements may be
deferred until development of the adjacent property.
6. The Secretary to this Commission shall certify to the adoption
of this Resolution.
