HomeMy WebLinkAbout89-124 - Resolutions RESOLUTION NO. 89-124 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO CUCAMONGA, CALIFORNIA, CONDITIONALLY APPROVING TENTATIVE PARCEL MAP NUMBER 12779, LOCATED ON THE NORTH SIDE OF BANYAN STREET, EAST OF DEER CREEK CHANNEL - APN 201-191-24 WHEREAS, Tentative Parcel Map Number 12779, submitted by City of Rancho Cucamonga Redevelopment Agency, applicant, for the purpose of subdividing into 1 parcel , the real property situated in the City of Rancho Cucamonga, County of San Bernardino, State of California, identified as APN(s) 201-191-24, located on the north side of Banyan Street, east of Deer Creek Channel ; and WHEREAS, on September 27, 1989, the Planning Commission held a duly advertised public hearing for the above-described map. NOW, THEREFORE, THE RANCHO CUCAMONGA PLANNING COMMISSION RESOLVED AS FOLLOWS: SECTION 1: That the following findings have been made: 1. That the map is consistent with the General Plan. 2. That the improvement of the proposed subdivision is consistent with the General Plan. 3. That the site is physically suitable for the proposed development. 4. That the proposed subdivision and improvements will not cause substantial environmental damage, public health problems or have adverse affects on abutting property. SECTION 2: This Commission finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Commission hereby issues a Negative Declaration. SECTION 3: That Tentative Parcel Map No. 12779 is hereby approved subject to the attached Standard Conditions and the following Special Conditions: 1. The existing on-site desilting facility shall be relocated easterly of the project boundary. The size and location shall be determined by a final drainage study. 2. Flood protection facilities shall be provided to protect the project site from flows from the north to the satisfaction of City Engineer. Trees are prohibited within 5.0 feet of the outside diameter of any public storm drain pipe measured from the outer edge of a mature tree trunk. 4. A permit from the Metropolitan Water District is required for work within its right-of-way. 5. The developer shall provide necessary easements in favor of the San Bernardino County Flood Control District to provide access to the Deer Creek Channel and construct pavement within the easements to the satisfaction of the County Flood Control District. 6. The developer shall acquire the necessary dedication and construct the north one-half of Banyan Street from the Deer Creek Channel Bridge to and including the intersection of Milliken Avenue. The developer may request a reimbursement agreement to recover the costs of constructing the offsite improvements from future development of the properties located on the north side of Banyan Street. Offsite parkway improvements may be deferred until development of the adjacent property. APPROVED AND ADOPTED THIS 27TH DAY OF SEPTEMBER, 1989.
