HomeMy WebLinkAbout89-156 - Resolutions RESOLUTION NO. 89-156 A RESOLUTION OF THE RANCHO CUCAMONGA PLANNING COMMISSION APPROVING DEVELOPMENT REVIEW NO. 88-40, LOCATED AT 10955 ARROW ROUTE IN THE GENERAL INDUSTRIAL DISTRICT (SUBAREA 8) - APN: 209-142-33, AND MAKING FINDINGS IN SUPPORT THEREOF A. Recitals. (i) Garcia & Associates has filed an application for the approval of Development Review No. 88-40 as described in the title of this Resolution. Hereinafter in this Resolution, the subject Development Review request is referred to as "the application". ( ii) On the 13th day of December, 1989, the Planning Commission of the City of Rancho Cucamonga conducted a meeting on the application and concluded said meeting on that date. (iii) All legal prerequisites to the adoption of this Resolution have occurred. B. Resolution. NOW, THEREFORE, it is hereby found, determined and resolved by the Planning Commission of the City of Rancho Cucamonga as follows : 1. This Commission hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Resolution are true and correct. 2. Based upon substantial evidence presented to this Commission during the above-referenced meeting on December 13, 1989, including written and oral staff reports, this Commission hereby specifically finds as follows: (a) The application applies to property located at 10955 Arrow Route with a street frontage of 670 feet and lot depth of 710 feet and is presently improved with a 118,000 square foot warehouse building ; and (b) The property to the north of the subject site is a post office, the property to the south of that site consists of vacant land, the property to the east is vacant land, and the property to the west is General Industrial use. 3. Based upon the substantial evidence presented to this Commission during the above-referenced meeting and upon the specific findings of facts set forth in paragraphs 1 and 2 above, this Commission hereby finds and concludes as follows: PLANNING COMMISSION RESOLUTION NO. 89-156 RE: OR 88-40 - GARCIA & ASSOC. December 13, 1989 Page 2 (a) That the proposed project is consistent with the objectives of the General Plan; and (b) That the proposed use is in accord with the objective of the Development Code and the purposes of the district in which the site is located; and (c) That the proposed use is in compliance with each of the applicable provisions of the Development Code; and (d) That the proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. 4. This Commission hereby finds and certifies that the project has been reviewed and considered in compliance with the California Environmental Quality Act of 1970 and, further, this Commission hereby issues a Negative Declaration. 5. Based upon the findings and conclusions set forth in paragraphs 1 , 2, 3, and 4 above, this Commission hereby approves the application subject to each and every condition set forth below and in the attached Standard Conditions , attached hereto and incorporated herein by this reference. Planning Division: 1) Extend the building accent stripe across the 3 roll -up doors on the southeast corner of Building B. 2) Provide vertical scoring only, rather than a block pattern on all sandblasted panels. The specific detail for the scoring shall be reviewed and approved by the Planning Division during plan check. 3) Provide a blow-up of the employee eating area east of the existing building for staff review and approval . Note: Permanent concrete furniture is required for these eating areas; the final design of which oust be approved by staff. 4) A detailed landscape plan shall be submitted to staff showing those trees to be removed, relocated and preserved in place per the arborist 's report. December 13, 1989 Page 3 5) Tree Removal Permit No. 89-65 is hereby approved as follows: a) Trees Nos. 3 and 5 shall be preserved in place in accordance with Rancho Cucamonga Municipal Code Section 19.08.110 and in accordance with the recommendations of the arborist's report, including , but not limited to protective construction barriers and special grading techniques which shall be noted on the grading plans prior to issuance of permits. b) Trees Nos. 12, 14, 22, 25, 26, 29, 32, 42, 46-49, and 52-54 shall be preserved by transplanting elsewhere on the site, in accordance with the recommendations of the arborist's report, prior to occupancy. The applicant shall contract with a qualified arborist, approved by the City Planner, to assist the applicant 's engineer in preparing the grading plan and to supervise said transplanting. The trunks of transplanted trees shall be shown on the grading plan. c) The remaining trees shall be removed and replaced on a one-for-one basis with the largest nursery grown tree( s) available as determined by the City Planner, in accordance with Rancho Cucamonga Municipal Code Section 19.08.100, prior to occupancy. d) Replacement trees and transplanted trees shall be clearly identified in the detailed landscape plans. Engineering Division : 1) Off-site dedication for the construction of Vincent Avenue and for the extension of Arrow Route through the White Oak/Vincent intersection and transition shall be obtained prior to the issuance of building permits. 2) A lot line adjustment shall be recorded to incorporate the portion of APN: 209-142-06 between the existing east property line and the proposed Vincent Avenue alignment into APN: 209-142-33 prior to the issuance of building permits. PLANNING COMMISSION RESOLUTION NO. 89-156 RE: OR 88-40 - GARCIA & ASSOC. December 13, 1989 Page 4 3) Vincent Avenue shall be constructed full width from Arrow Route to the south project boundary. Off-site parkway improvements may be deferred until development of the adjacent properties. The developer may request a reimbursement agreement to recover the cost of constructing off-site improvements from future development. 4) Provide standard property-line-adjacent sidewalk on Vincent Avenue. 5) The existing overhead utilities (telecommunications and electrical ) on the project side of Arrow route shall be undergrounded along the entire project frontage extending to the first pole off-site (east and west) prior to public improvement acceptance or occupancy, whichever occurs first. The developer may request a reimbursement agreement to recover one-half the City-adopted cost for undergrounding from future development as it occurs on the opposite side of the street. 6) Street improvements on the south side of Arrow Route shall be constructed as follows: a) The westerly driveway shall be relocated near the west project boundary. The drive approach shall be a minimum of 35 feet wide and constructed to City Standard No. 306. An easement for shared access shall be provided in favor of the parcel to the west. b) All existing drive approaches on Arrow Route shall be removed and replaced with curbs and gutter, including the temporary driveway near the east project boundary for MDR 88-19. c) Improvements shall extend easterly through the ultimate BCR on the east side of the Arrow/Vincent (White Oak) intersection. Provide a transition to the existing pavement to the satisfaction of the City Engineer. The developer may request a reimbursement agreement to recover the cost of constructing improvements east of the Vincent Avenue centerline from future development. Off-site parkway improvements may be deferred until development of the adjacent property. The developer may request a reimbursement agreement to recover the cost of constructing off-site improvements from future development . 7) Landscaping within the "Limited Use Areas" for all project driveways and the intersection of Arrow/Vincent (White Oak) shall be approved by the City Traffic Engineer. 8) A deposit shall be posted with the City covering the estimated cost of apportioning the assessments under Assessment District 82-1 among the reconfigured parcels due to the lot line adjustment prior to the issuance of building permits. 6.
